Yes. An Indian IT company can build, operate and support many U.S. software or IT-enabled-services projects entirely from India. The Reserve Bank of India’s 2025–26 survey, as reproduced by TrackRBI, reports US$221.4 billion in Indian software-services exports; US$203.0 billion (91.7%) was delivered off-site and US$202.7 billion (84.7%) through Mode 1 cross-border supply. Those figures show offshore delivery is the mainstream model, not an exception.
Keeping employees in India does not remove compliance work. The contract, GST and tax treatment, permanent-establishment exposure, data security, U.S. export controls and any employee travel must all be designed around the actual project.

It means the Indian company’s employees perform the productive work while physically in India. They may design software, write code, manage cloud infrastructure, provide help-desk services, analyse data, run quality processes, or support a U.S. customer through approved remote systems. The customer can be in the United States and the users, data or production environment can be there without the delivery staff relocating.
This is different from sending employees to a U.S. customer site to perform ordinary project labour. A remote engagement generally raises commercial, tax and technology questions; physical presence adds immigration and potentially payroll, employment and state-tax questions. Treat those as separate decisions even when the same project uses both models.

Why is offshore delivery commercially viable?
The RBI survey data is the clearest evidence that cross-border, off-site delivery is established at national scale. Of the US$221.4 billion in software-services exports reported for 2025–26, US$203.0 billion was off-site. Mode 1—services supplied across borders while the supplier remains in its home country—accounted for US$202.7 billion. TrackRBI reproduces these figures from the RBI survey; they are sector-level statistics, not a guarantee for any particular contract.
For an individual project, viability depends on requirements rather than nationality. A well-defined product backlog, overlap for critical meetings, reliable connectivity, customer-approved tools and a measured escalation path often matter more than a permanent U.S. office. Regulated workloads, export-controlled technology, on-site hardware, classified information or a customer’s contractual residency rules can still require a different arrangement.

Do Indian developers need a U.S. visa if they work from India?
Usually not, if they never enter the United States to perform the work. A person working from India is not carrying out employment on U.S. soil simply because the customer is American. The immigration analysis changes the moment that person travels to the United States.
The U.S. Department of State describes B-1 business activity as work such as commercial transactions, contract negotiations, consultations and conferences, and says that a B-1 visa is not appropriate for applicants who intend to obtain and engage in employment in the United States. Its fact sheet expressly distinguishes business activities from “the performance of skilled or unskilled labor.” Read the State Department’s B-1 guidance before booking a trip.
That means a developer can attend a planning meeting or negotiate a contract only if the trip fits the permitted visitor activity. It does not mean the same developer can enter on B-1 and spend three weeks coding, implementing a system or providing routine production support at the customer’s site. Installation, servicing or specialised training may have narrow visitor exceptions, but the precise facts and visa classification must be checked with qualified immigration counsel.
A practical travel rule
- No U.S. travel: focus on the service contract, tax, data and export-control analysis; no U.S. work-authorisation question is created merely by serving a U.S. customer remotely.
- Short business visit: document the meeting, negotiation, consultation or other permitted purpose and verify that the visitor classification matches it.
- Productive work in the United States: obtain a classification that authorises that activity. Never describe ordinary software labour as automatically covered by B-1.
How should the service contract be structured?
The contract should make the delivery location and responsibilities explicit. Identify the Indian legal entity as the supplier, state where personnel perform the services, define acceptance and support windows, and specify which party controls source code, credentials, cloud accounts and production changes. Add clauses for confidentiality, intellectual-property ownership, incident notification, subcontracting and customer audit rights.

Separate statements of work are useful when a project has offshore engineering, occasional meetings and a possible on-site phase. Each statement can identify deliverables, personnel location, travel approvals and the technical environment. A written travel-approval process prevents a sales or project manager from creating immigration risk by treating a customer-site visit as routine.
For customers in regulated industries, include a data schedule: categories of personal or confidential data, approved storage regions, permitted access countries, retention periods, encryption requirements and deletion evidence. The U.S.–India ICT Working Group has highlighted trustworthy cross-border data flows, privacy, cybersecurity and intellectual-property protection; those principles should appear as operational controls rather than broad promises.
Can the work qualify as an export of services under Indian GST?
It may. CBIC’s export-of-service framework lists five conditions: the supplier is in India, the recipient is outside India, the place of supply is outside India, payment is received in convertible foreign exchange, and the supplier and recipient are not merely establishments of the same person. CBIC’s sectoral FAQ sets out the conditions.
Apply each condition to the actual arrangement, not just the invoice address. Confirm who receives the service, where the place-of-supply rules put the service, how foreign-currency receipts are documented, and whether an Indian branch and a U.S. branch are legally the same person for the relevant rule. A related-party or group-company structure may require a different analysis from an independent U.S. customer.
Keep the purchase order, statement of work, invoices, bank realisation records, exchange-rate documentation and correspondence that establishes the recipient and service location. GST registration, return reporting and any zero-rated or refund procedure should be handled by the company’s Indian tax adviser; the export conditions are a starting framework, not a project-specific tax opinion.
Can offshore delivery still create U.S. tax or permanent-establishment exposure?
Yes. Employees staying in India does not automatically eliminate U.S. corporate-tax risk. Under the India–U.S. tax treaty and domestic law, the analysis can turn on the functions performed, authority to conclude contracts, use of premises, duration and continuity of the activity, and the relationship between the Indian company and any U.S. entity.

Risk increases where personnel habitually negotiate or conclude contracts for the enterprise, a U.S. office or customer site is effectively at the company’s disposal, a long-running team performs core revenue-generating functions in the United States, or an Indian parent directs a U.S. subsidiary’s operations without clear separation. A U.S. subsidiary can improve contracting and customer proximity while adding payroll, transfer-pricing, intercompany-service and state-tax obligations.
Before signing, map the people, entities, authority levels, locations and time spent in each country. Obtain advice on treaty permanent establishment, corporate income tax, withholding, transfer pricing, indirect taxes and, where applicable, state and local registrations. Do not market offshore delivery as “tax free” or “immune from U.S. tax.”
Does keeping the team in India avoid U.S. export-control obligations?
No. The U.S. Export Administration Regulations (EAR) can apply to U.S.-origin commodities, software and technology. BIS rules address exports, reexports, releases, access to controlled information and transfers to foreign persons. Providing source code, technical data, credentials or remote access to an Indian employee can therefore require classification and, in some cases, authorisation even when no one travels.
Start with an inventory of the technology: identify U.S.-origin components, encryption, controlled technical data, development kits, models and documentation. Determine the applicable classification, end-user and end-use restrictions, country controls and licence exceptions. Screen customers, subcontractors and other recipients where required. Ask the U.S. customer to identify restrictions attached to its software and data; do not assume the customer’s cloud tenancy makes the issue disappear.
Implement least-privilege access, strong identity management, multifactor authentication, customer-approved environments, logging, session review, data-location rules, vulnerability management and an incident-response plan. Record the export-control decision and the person who approved it. If the project cannot segregate controlled technology, redesign the team or obtain a formal legal determination before granting access.
Which delivery model should a company choose?
There are three practical models. The right choice depends on immigration burden, customer proximity, security and data restrictions, tax exposure, quality assurance, incident response and how much work genuinely requires physical presence.

| Model | Advantages | Trade-offs and controls |
|---|---|---|
| Offshore-only | Employees remain in India; the simplest travel posture and a single delivery location. | Requires dependable time-zone overlap, clear communication, secure remote access, customer governance and an escalation plan for outages. |
| India-based team with limited travel | Preserves offshore execution while allowing meetings, negotiations or narrowly permitted training. | Every trip needs a documented purpose, correct immigration classification, travel approval and records of what work was (and was not) performed in the United States. |
| U.S. entity or onshore team plus Indian capacity | Closer customer presence, local contracting and faster response for work that truly requires physical access. | Adds entity governance, payroll, transfer pricing, state-tax, permanent-establishment, data-segregation and immigration complexity. |
A hybrid model is not automatically safer. It is useful when customer meetings, hardware installation or regulated access genuinely need local staff; otherwise it can create two sets of compliance obligations without improving delivery.
How can an Indian IT company launch a compliant offshore project?
Complete these steps before granting production access or promising a customer-site visit.
- Classify the work. List deliverables, support hours, production responsibilities, data types, technology components and any hardware or physical-access requirement.
- Map entities and people. Identify the Indian supplier, any U.S. affiliate, subcontractors, managers with contracting authority and every country in which work may occur.
- Draft the service and data schedules. State the delivery location, acceptance criteria, IP ownership, confidentiality, approved systems, retention, incident deadlines and travel boundaries.
- Run the GST and tax review. Test the CBIC export conditions, payment evidence, place of supply, related-party status, withholding, transfer pricing and permanent-establishment exposure.
- Classify technology and users. Review U.S.-origin software and technical data, end users, end uses and any licence or screening requirement before access is provisioned.
- Build the security baseline. Use individual identities, multifactor authentication, least privilege, endpoint controls, logging, encrypted connections, segregated environments and tested restoration procedures.
- Set operating rules. Define overlap hours, on-call ownership, change approvals, code review, release gates, service levels and an escalation tree spanning India and the United States.
- Control travel. Require written approval describing the purpose, location, dates, customer activities and immigration classification. Reassess the plan whenever a meeting turns into implementation work.
- Retain evidence. Keep contracts, invoices, bank records, access logs, training, export-control decisions, screening results and travel records for the periods required by the relevant rules and contracts.
What can go wrong, and how should it be fixed?
“The customer is American, so every worker needs a U.S. visa.”
That confuses customer location with worker location. Staff who remain in India generally do not need a U.S. visa for the remote service, while staff who travel need an activity-specific immigration assessment. Fix the process by separating offshore work from every proposed trip.
“B-1 covers the whole implementation.”
B-1 is not a general employment authorisation. A customer-site coding, configuration or support assignment can exceed visitor activity even if the trip is short. Have immigration counsel review the actual itinerary and duties before tickets are issued.

Authority, premises, entity relationships and duration can matter more than where most engineers sit. Document who can sign contracts, where decisions are made and how affiliates are compensated, then obtain treaty and domestic-tax advice.
“The cloud provider handles export compliance.”
A cloud region does not classify the customer’s software or the people who can access it. Inventory U.S.-origin technology, restrict foreign-person access where required, and retain a written classification and authorisation decision.

“A generic security policy is enough.”
Customers often need evidence tied to their environment: named administrators, logs, data-location controls, incident deadlines and tested recovery. Convert the policy into a project-specific access matrix and audit package.
How should a customer decide whether a project can stay offshore?
Use a go/no-go review rather than a blanket “remote” label. An offshore-only decision is strongest when the deliverables are digital, all required systems permit access from India, the customer accepts the time-zone and support model, no physical installation is needed, and tax and export-control reviews are documented.
Escalate to a hybrid or onshore design when the project requires controlled technology that cannot be released to the proposed team, hands-on work with equipment, regulated data that must remain in a particular country, continuous U.S.-time-zone response, contract-signing authority in the United States, or a customer mandate for local personnel. If the reason is merely convenience, first test better scheduling, runbooks and incident coverage before creating a second legal footprint.
The core principle is simple: the work can cross the border even when the workers do not. Treat location, immigration, tax, security and technology access as separate control questions, document the answers, and revisit them whenever the scope or travel plan changes.
Frequently Asked Questions
Can a U.S. company pay an Indian IT vendor in U.S. dollars?
Yes, payment currency does not by itself prevent an Indian service export. The company must still document receipt in convertible foreign exchange, identify the overseas recipient and satisfy the other applicable GST and foreign-exchange requirements through its bank and tax records.
Does an Indian company need a U.S. subsidiary to serve U.S. customers remotely?
No. An Indian entity can contract directly with a U.S. customer when the commercial, tax and regulatory structure supports it. A U.S. subsidiary may help with local contracting or hiring, but it also introduces transfer-pricing, payroll, state-tax and permanent-establishment issues.
Quick wins for a faster PC:

Often, but only after the customer’s contract, data rules, security policy and export-control classification permit that access. Use named accounts, least privilege, multifactor authentication, logging and an approved data path; some controlled technology may require segregation or authorisation.
What records should a company keep for an offshore U.S. project?
Retain the signed contract and statements of work, invoices and bank-realisation evidence, GST and tax analysis, entity and authority maps, export-control classifications, access approvals, security logs, incident records and travel documentation. These records help demonstrate that the advertised offshore model matches what personnel actually did.
