Sometimes—but not under a blanket yes-or-no rule. Event contracts can be traded on CFTC-registered designated contract markets under the federal derivatives framework, and the Commodity Futures Trading Commission currently says federally regulated prediction markets can operate in all 50 states. States, however, are challenging that position, especially for sports contracts, and courts have issued conflicting preliminary rulings.
Whether a particular contract is lawful and available depends on its subject, the venue and its registration, your state, and the latest court or enforcement action. Sports, election, political, entertainment and other contracts that a state characterizes as wagering face the greatest uncertainty. This guide explains the framework as of October 30, 2026; it is general information, not legal advice.

What is an event contract?
An event contract is generally a yes-or-no derivative tied to whether a defined event occurs. Its market price is commonly displayed as the traders’ implied probability of that outcome. Depending on the venue, a trader may be able to sell or otherwise exit before the contract settles.
The legal label is important. Operators call these products event contracts, prediction-market contracts or swaps. States challenging sports products say that, whatever the label, the contracts function as wagers or sports betting. That classification determines whether federal derivatives law or state gaming law is treated as controlling. The CFTC’s consumer explanation of prediction markets and contract mechanics is available at cftc.gov/LearnandProtect/PredictionMarkets.

Why does federal law apply?
The Commodity Exchange Act (CEA) is the central federal statute. The CFTC says prediction markets have existed in the United States since 1988 and that it has regulated them since 2004. Congress amended the CEA through Dodd-Frank in 2010, including authority for the CFTC to prohibit certain event contracts.
A venue operating as a CFTC-registered designated contract market can generally list derivatives through the federal process. Registered exchanges may self-certify new products, subject to the CFTC’s review authority. The agency can prohibit a contract that is contrary to the public interest, including contracts involving gaming or activity unlawful under federal or state law. Those powers mean registration is significant, but it is not an automatic approval of every subject a venue might list.

The CFTC’s current consumer position is broad: “Market Access Consistency: Prediction markets are federally regulated and under federal law can operate in all 50 states.” The agency has also said it will defend its “exclusive regulatory authority” and, in 2026, filed lawsuits against states that sought to restrict CFTC-registered designated contract markets. Those statements describe the agency’s interpretation, not a final judicial answer for every category of contract. See the CFTC’s market-access guidance at cftc.gov/LearnandProtect/PredictionMarkets and its 2026 enforcement announcement at cftc.gov/PressRoom/PressReleases/9206-26.
Why is legality still unsettled?
The dispute is about federal preemption, the character of the product, and the reach of state gambling law. The federal position is that a contract traded on a registered designated contract market is a federally regulated derivative and that state gambling rules cannot interfere with that market structure. States respond that at least some contracts—particularly contracts on individual sports games—are wagers, so state gaming laws apply even when the platform is federally registered.
The Congressional Research Service describes the competing arguments and the continuing litigation in its report at everycrsreport.com/reports/IF13187.html. The CEA’s public-interest provisions make the analysis contract-specific: a product can be listed through an exchange process while still drawing a challenge over whether its subject is gaming, unlawful activity or otherwise contrary to the public interest.

What did the Ninth Circuit decide about sports contracts in Nevada?
On August 28, 2026, the U.S. Court of Appeals for the Ninth Circuit rejected Kalshi’s effort to keep an injunction blocking Nevada enforcement in place for sports-event contracts. The court said Kalshi had adopted an overly broad reading of the CEA and affirmed dissolution of the injunction as to those sports contracts. The opinion is available at cdn.ca9.uscourts.gov/datastore/opinions/2026/08/28/25-7516.pdf.
The ruling does not automatically decide every state’s law or every non-sports contract. It does make a blanket consumer statement such as “legal sports betting in all 50 states” unsafe. The opinion records that Kalshi advertised itself as “the first app for legal sports betting in all 50 states.” It also records that more than 90% of Kalshi’s trades in 2025, representing 95% of its revenue, were sports-related. Those figures describe the court’s record, not a nationwide legal rule.
What does the Utah case change?
According to an Associated Press report dated October 29, 2026, Utah filed felony charges against Kalshi and its founders and sought relief covering sports, elections, politics, culture and other outcomes. A federal judge rejected Kalshi’s request to block Utah enforcement, and the Tenth Circuit declined to halt enforcement while the appeal proceeds. The report is at apnews.com/article/42468686dad6981f58436befdedee03d.
Utah is significant because state authorities are testing criminal as well as civil theories. The action is still a dispute over jurisdiction and enforcement, not a final nationwide judgment that all event contracts are illegal. It does mean that access, operating risk and the consequences of trading can change quickly in a particular state.
Are sports, election and economic contracts treated the same way?
No. The subject of the contract is one of the most important practical distinctions, although none of the categories below carries an automatic nationwide answer.

| Contract subject | What the current record shows | Practical legal question |
|---|---|---|
| Sports | Most directly contested; Nevada litigation and Utah enforcement characterize offerings as sports betting or gaming. | Will a court treat the product as a federally preempted derivative or state-regulated wagering? |
| Elections and politics | Past CFTC leadership rejected some election contracts on gaming, unlawful-activity and public-interest grounds; a federal district court later allowed some election contracts to trade. | What are the exact contract terms, venue, regulator position and current court orders? |
| Financial, commercial and economic outcomes | These generally fit the federal derivatives rationale more naturally, but that is an inference, not a guarantee. | Does the contract satisfy the CEA and CFTC public-interest requirements? |
| Entertainment, culture, weather and other events | Availability and legality depend on the specific listing, exchange process and state posture. | Is the event being treated as a permissible derivative or as gaming under applicable law? |
The CRS discusses election-contract history and the statutory limits in its analysis of prediction-market jurisdiction. A non-sports label should not be treated as a safe harbor.
Is a CFTC-registered venue automatically legal in my state?
No. Registration is a critical fact, but it does not eliminate state litigation or guarantee that every contract is available to every resident. Confirm the actual U.S. entity providing access and the registration status of the exchange, then check your state’s current enforcement position and court orders.
Also distinguish a federally registered venue from an unregistered or offshore website. The latter may not provide the same disclosure, surveillance, customer-fund or complaint protections, and an offshore operator may be outside practical U.S. enforcement reach. The CFTC’s consumer guidance explains how to verify a venue and identify warning signs at cftc.gov/LearnandProtect/PredictionMarkets.
How can I check an event contract before trading?
Do these checks for the exact contract and your location; an app banner or a general claim about nationwide access is not enough.
- Identify the venue. Verify whether the operator and exchange are CFTC-registered and whether the U.S. entity you are dealing with is the one actually providing access.
- Read the contract specification. Confirm the outcome definition, settlement source, payout calculation, trading deadline, cancellation or adjustment rules, and which party decides whether the event occurred. A contract’s title can be less precise than its settlement language.
- Check state availability. Review the operator’s current state list, then look for recent state orders, lawsuits or enforcement notices. Do not rely solely on “all 50 states” marketing, particularly for sports products.
- Review costs and protections. Locate trading and withdrawal fees, account terms, customer-fund treatment, complaint channels, market-surveillance rules and the process for disputing a settlement.
- Use official software and links. The CFTC warns that counterfeit applications can appear in app stores. Obtain the app through the trading venue’s verified website and match the developer and domain before entering credentials.
- Use only risk capital. The CFTC advises caution around promises of large payoffs or pressure to trade more. Do not use money needed for rent, bills, taxes or emergency savings.
What legal and financial risks remain after those checks?
A contract can be available when you open an account and later be restricted, delisted or blocked in your state. A court order may affect the venue, a product category or enforcement against the state without resolving the merits nationwide. Read notices from the venue and preserve the exact contract rules that applied when you traded.
Market risk is separate from legal risk. A displayed price is a market-implied probability, not a promise of the final result. Thin liquidity can make an early exit difficult; settlement depends on the specified official source; and a correction to that source can change the result under the contract’s rules. Fees and spreads reduce returns even when the event is predicted correctly.

Expect uncertainty rather than an immediate nationwide answer. A state may seek a civil injunction, pursue criminal charges, or ask a court to classify the contracts as gambling. The operator may argue that the CEA preempts state action, while the CFTC may defend its exclusive authority. The effect can be limited to one state, one contract category or one stage of litigation.

Could Congress change the rules?
Yes. The CRS lists proposals that would restrict or prohibit contracts involving sports, elections, government activity, gaming, war, terrorism, assassination and other specified subjects. Those bills show that Congress is considering changes, but proposals are not current law. Track enacted legislation rather than treating a bill’s introduction as a ban. The CRS legislative overview is at everycrsreport.com/reports/IF13207.html.
What is the practical answer for a U.S. trader?
Some event contracts operate within a federal regulatory structure, but “legal in all 50 states” is not a reliable answer for every product. Economic contracts may fit the derivatives framework more comfortably; sports contracts currently carry the clearest state-law conflict; and election, political, entertainment and other contracts require a contract-by-contract review.

Before placing a trade, verify the registered venue, read the settlement terms, check your state’s latest position and court orders, and understand the financial protections and risks. Because the legal posture is changing, recheck those facts immediately before trading. For a substantial position or a business decision, speak with an attorney licensed in the relevant state.

Can I trade a prediction market while visiting another state?
Do not assume that travel changes the legal analysis. Access controls, residency terms, the location where a trade is entered and the current orders affecting the venue can all matter; review the platform’s location rules and obtain state-specific advice for a consequential trade.
What happens to an open contract if the market is delisted?
The answer is in that contract’s rules, which may provide for continued settlement, cancellation, a refund or an adjustment after a legal or regulatory event. Save the specification and any delisting notice, because the result can depend on the stated cutoff and settlement source.
Are offshore prediction-market websites safer because they are outside U.S. state law?
No. Offshore status can mean the operator is not registered with the CFTC and may not provide U.S.-style disclosures, customer-fund protections or an accessible complaint process. It can also make recovering funds or enforcing a judgment more difficult.
Does a market price prove that an event contract is legal?
No. Price reflects trading activity and an implied probability, not regulatory approval. A venue can offer a contract while its legality or state availability is being challenged, so check registration, contract terms and current court orders separately.
