GST invoice fraud is the use of an invoice for a taxable supply that never genuinely happened, usually to create, transfer or claim input tax credit (ITC). A document that looks like a tax invoice is not enough. Under section 16 of the Central Goods and Services Tax (CGST) Act, the buyer must meet the statutory conditions, including holding prescribed documentation and actually receiving the goods or services. Rule 36 also links the invoice to supplier reporting in GSTR-1 (or the invoice furnishing facility) and communication through the recipient’s GSTR-2B. If those conditions fail, the credit can be denied or reversed, with tax, interest, penalties and, in serious cases, criminal prosecution.
This guide explains how fake-invoice networks operate, how to test an invoice before claiming ITC, and what to do if a questionable invoice has already been reported.

What is a fake GST invoice?
A fake GST invoice is an invoice that does not represent a genuine taxable supply of goods or services. It may describe products never delivered, services never performed, or a transaction routed through entities that exist mainly on paper. The invoice can still carry a valid-looking GSTIN, tax rate and serial number; the fraud lies in the missing economic substance.
Fraudsters use these documents to pass ITC to another registered person. The recipient records a purchase and offsets output GST with credit that was never supported by a real input cost. In other cases, invoices are traded through several shell or dummy entities so a circular chain appears to show repeated buying and selling.

How bogus registrations enable the scheme
CBIC Instruction 03/2023 says non-genuine registrations are used to issue invoices without an underlying supply and pass fraudulent ITC to recipients. A fraudster may misuse another person’s PAN or Aadhaar, or submit forged electricity bills, property-tax receipts, rent agreements or other premises documents to obtain registration.
Identity theft is a recurring route into these networks. A Government of India release in January 2024 described syndicates collecting KYC documents from people promised jobs, commissions or loans, then using those documents to create fake or shell firms. The named person may not understand that a GST registration and invoices are being operated in their identity.

The mechanics vary, but most cases follow a recognizable sequence. The invoice is only one visible part; investigators look at whether the supply, money flow and business capacity line up.
1. Registration and access
The operator obtains a GST registration for a real, stolen or fabricated identity. The registered address may be a residential property, a vacant site or premises whose owner has no connection with the business. A registration can therefore exist in the GST system without a functioning supplier, warehouse, staff or service capability.

2. Invoices without supply
The entity issues tax invoices for goods or services that were never supplied. Sometimes the description is plausible but the quantity, delivery route or timing is impossible. Sometimes the invoice is for a service that leaves no completion evidence. The recipient books the purchase and treats the tax component as ITC.
3. Pass-through and circular chains
Networks may route invoices through multiple shell entities. A chain can be made to look commercial by adding mark-ups, changing descriptions or issuing matching debit notes. Circular invoicing sends documents around connected entities and back to an original participant. The legal test remains substance: did the stated supply occur, and did the recipient satisfy the conditions for credit?
4. Credit claim and cash impact
The recipient uses the reported invoice to reduce output-tax liability. If the recipient has not actually paid a legitimate input tax cost because no supply occurred, the reduction is artificial. A supplier’s reporting in GSTR-1 and appearance in GSTR-2B may show that data was uploaded, but it does not by itself prove delivery, performance or business use.
What conditions must be met before claiming GST input tax credit?
Section 16 makes ITC conditional rather than automatic. The purchase must be used in the course or furtherance of business, the recipient must possess a tax invoice or prescribed document, and the recipient must receive the goods or services. Rule 36 adds reporting controls: invoice or debit-note details must be furnished by the supplier in GSTR-1 (or the invoice furnishing facility) and communicated to the recipient in GSTR-2B.

| Control | What the buyer should be able to show | Why it matters |
|---|---|---|
| Business purpose | A purchase order, contract or internal explanation connecting the input to business activity | Personal, fictitious or unrelated purchases do not meet the business-use condition. |
| Prescribed document | A tax invoice or other document permitted by GST rules, with required particulars | A quotation, pro-forma invoice or informal bill is not a substitute for the prescribed document. |
| Actual receipt | Goods-received note, delivery challan, transport record, e-way bill where applicable, or service-completion evidence | Receipt is a separate condition from merely possessing an invoice. |
| Supplier reporting | The invoice furnished in the supplier’s GSTR-1 or invoice furnishing facility and communicated in GSTR-2B | Rule 36 ties documentary credit to the supplier’s reporting and recipient communication. |
| Commercial trail | Purchase order, inspection or acceptance record, payment entry and accounting trail | These records help establish that the transaction had economic substance. |
GSTR-2B reconciliation is therefore a gate, not a complete authenticity test. A buyer should retain evidence of movement or delivery, the work performed, payment and business use even when the invoice appears in the statement. Conversely, an invoice absent from GSTR-2B, later amended without explanation, or reported by a supplier with no credible operations presents a serious ITC risk.
How can a business check whether a GST invoice is genuine?
Use a layered check before booking the credit. No single screen, number or document establishes that a supply occurred.
- Validate the supplier identity. Check the GSTIN, legal name and registered address against the invoice. Confirm that the bank account used for payment identifies the same legal business or has a documented reason for a different account.
- Review invoice particulars. Check the invoice number and date, supplier and recipient details, description, quantity, taxable value, tax rate, tax amount and place of supply. Ask whether the rate and place of supply make sense for the actual transaction.
- Match the order to delivery. Tie the invoice to a purchase order or contract. For goods, compare quantities with delivery challans, goods-received notes, transport documents and e-way bills where applicable. For services, retain milestones, timesheets, reports, acceptance emails or other completion evidence.
- Check GSTR-1 and GSTR-2B. Confirm that the supplier furnished the invoice and that the details were communicated in the recipient’s GSTR-2B before claiming credit. Investigate an omission, a late upload or an unexplained amendment rather than assuming it will correct itself.
- Test the payment trail. Match the accounting entry and bank payment to the invoice. A payment proves money moved; it does not prove that goods arrived or services were performed, so it must be read with delivery and business-use evidence.
- Escalate unusual patterns. Apply extra review to unusually high-value or round-number invoices, back-to-back purchases and sales, rapid onward transfers, suppliers with no credible premises or staff, and transactions that appear circular.
Warning signs that deserve investigation
- The supplier’s registered address cannot support the stated business or nobody there recognizes the entity.
- Invoices describe large quantities but there is no warehouse, transport, inventory change or receiving record.
- The supplier repeatedly uploads invoices late, changes them after reconciliation or reports values that do not fit the purchase order.
- Several entities share contact details, bank accounts, directors, addresses or identical invoice formats without a commercial explanation.
- The buyer is pressed to book the invoice before delivery, inspection or GSTR-2B communication.
What happens if ITC is claimed on a bogus invoice?
The consequences depend on the facts, the amount, the person’s role and whether the conduct was deliberate, but the exposure is not limited to losing the credit.
| Exposure | How it can arise | Practical effect |
|---|---|---|
| Credit denial or reversal | The recipient cannot show a statutory condition, such as actual receipt, or the invoice is tied to a non-genuine supplier. | The disputed ITC is disallowed and recovered through the GST process. |
| Tax and interest | Improper ITC reduced the output-tax payment. | The resulting demand can include the tax shortfall and applicable interest. |
| Penalty under section 122 | Issuing an invoice without supply, or taking or using ITC without actual receipt. | The penalty is ₹10,000 or the tax evaded or ITC irregularly availed or passed on, whichever is higher. |
| Prosecution under section 132 | Issuing invoices without supply or availing ITC using such invoices, with the required statutory elements. | Where evaded tax or wrongly availed ITC exceeds ₹5 crore, imprisonment may extend to five years and a fine; lower statutory bands carry lower maximum terms. |
| Operational and reputational disruption | An investigation into the invoice chain or the recipient’s role. | Summons, record requests, account scrutiny, blocked credit, registration action and damaged commercial relationships are possible. |
CBIC Circular 171/03/2022 addressed cases in which registered persons issued tax invoices without actual supply so recipients could avail and use ITC fraudulently. That context matters: a recipient can face scrutiny even when it did not create the invoice if it claimed or used credit without satisfying the conditions.

What are the penalties for fake invoicing under GST?
Section 122 provides the principal monetary penalty described for these acts: ₹10,000 or the amount of tax evaded, ITC irregularly availed or ITC passed on, whichever is higher. The provision covers issuing invoices without supply and taking or using ITC without actual receipt.
Section 132 creates criminal offences for issuing invoices without supply and for availing ITC using such invoices. The maximum imprisonment depends on the statutory amount band. For evaded tax or wrongly availed ITC above ₹5 crore, the maximum term may be five years plus a fine. The exact charge and outcome depend on evidence, intent, amount and the individual’s role; a business should obtain qualified advice on any notice or summons.
How large is GST invoice fraud in India?
Published enforcement figures illustrate the scale of detected cases, not the total amount of fraud in the economy.
| Authority and period | Reported detection | Other reported action |
|---|---|---|
| CBIC central tax formations, financial year 2023–24 | ₹36,374 crore of fake ITC detected in 9,190 cases | 182 arrests and ₹3,413 crore voluntarily deposited |
| Government of India release, January 2024, covering the sustained drive against non-existent taxpayers since mid-May 2023 | 29,273 bogus firms and ₹44,015 crore of suspected ITC evasion | 121 arrests |
The two releases use different scopes and reporting periods, so their figures should not be added together or treated as a national estimate. They show why invoice verification must cover the supplier and the underlying transaction, not just the appearance of a GST number.

What should you do if a suspicious invoice has already been claimed?
Act promptly, preserve the complete record and avoid altering documents to make a transaction appear genuine. A qualified GST professional can assess whether credit should be reversed, whether tax and interest should be paid voluntarily, what disclosure is appropriate and how to respond to a notice.
- Place the invoice and related purchase on an internal hold; do not use further credit linked to the same supplier until reviewed.
- Preserve the original invoice, purchase order, contracts, delivery and service records, e-way bills, ledger entries, bank statements, emails and GSTR-1/GSTR-2B screenshots or downloads.
- Reconcile the supplier’s GSTIN, reported invoice details and tax amounts with your books, noting amendments, cancellations or unexplained differences.
- Document who approved the purchase, who received the goods or service and what business use occurred. Do not backdate or create replacement evidence.
- Obtain professional advice on reversal, voluntary payment, disclosure and replies to summons or notices. Cooperate with lawful requests while keeping a clear record of what was supplied.
How can companies prevent fake-invoice losses?
Prevention works best when tax review is built into procurement rather than left to a return-filing deadline. Configure the accounting or GST workflow to validate supplier GSTIN and legal name, reconcile GSTR-1 with GSTR-2B, and block payment or credit approval when key evidence is missing.

- Require evidence at each stage: no ITC approval without the order or contract, receipt record, invoice and payment trail.
- Use exception queues: route duplicate invoice numbers, unusual values, circular-looking movements and late or amended reports to a reviewer.
- Protect access: restrict who can edit supplier masters, tax codes and invoice dates; retain an audit trail of changes.
- Keep exportable records: preserve reconciliations, approval history and source documents so they can be produced if credit is questioned.
- Train staff on identity abuse: verify a supplier through independent contact and premises checks rather than relying only on documents supplied by an unknown intermediary.
These controls do not guarantee that every fraudulent supplier will be detected. They create contemporaneous evidence that the business tested identity, reporting, receipt and commercial purpose before claiming credit.
Frequently Asked Questions
Does a bank payment make a fake GST invoice valid?
No. Payment shows that funds moved, but it does not establish that goods were delivered or services performed. The payment record must be consistent with purchase orders, receipt or completion evidence, inventory or business use, and the GST reporting trail.
Can an employee be personally exposed for processing a bogus invoice?
Potential exposure depends on the employee’s knowledge, participation, authority and the evidence of the transaction. Employees should not approve unsupported credit, should preserve instructions and records, and should escalate concerns through the company’s tax, compliance or legal channel.
Are fake invoices always issued by companies that do not exist?
No. A registered entity can be real while the particular invoice is fictitious, inflated or unrelated to any supply. Fraud can also involve identity theft, shell firms and otherwise legitimate businesses used as links in a circular chain.
