Yes, you can ship a game made with Unreal Engine and AI-assisted tools, but “AI-assisted” is not a legal clearance. You must separately verify the Unreal Engine license, every Fab or other third-party asset license, the rights in AI inputs and outputs, and any copyright, trademark, privacy, publicity, or likeness issues. Keep a written rights register, preserve the terms in force when you release, disclose AI content where a platform or license requires it, and obtain specialist advice for high-risk material. This checklist is U.S.-centered and based on Epic’s current terms and U.S. Copyright Office guidance available in 2026; laws and contract terms can differ elsewhere.
Can I legally ship an AI-assisted game made in Unreal Engine?
Usually, yes, if the project complies with each applicable contract and the team has cleared third-party rights. Unreal Engine’s own code, Examples, and Starter Content are governed by the Unreal Engine End User License Agreement (EULA), while Fab and other marketplace items are separate Content with their own terms. AI use adds another layer: the person or company shipping the game must know what was supplied to an AI service, what that service permits, how much human creative control shaped the result, and whether any person, brand, recording, or copyrighted work appears in it.

Do not treat an engine license as a blanket license for everything imported into the project. A lawful release normally requires evidence for the engine, plugins, models, textures, animations, sounds, voices, fonts, logos, photographs, scans, text, and AI-generated or AI-modified material. The release platform may impose additional disclosure or content rules.
What does the Unreal Engine license cover, and when do royalties or seat fees apply?
Start by identifying which parts of the project are Epic Licensed Technology and which are Content. The EULA covers Unreal Engine code, Examples, and Starter Content. Fab or Marketplace downloads are not automatically covered by the same grant; their product pages and license agreements control the permitted use.

The $1 million threshold is not a general exemption from all obligations: it is the stated threshold for the 5% royalty calculation under the listed model, and the revenue must be directly attributable to the Unreal Engine product. Keep accounting records that show how you classified revenue and the date and terms on which you made that decision.
Read the EULA’s restrictions before sending project material to an AI service. Epic’s EULA states that Licensed Technology may not be used “as a training input to any Generative AI Program or as prompt-based input where the Generative AI Program trains on input data.” That language means a team should not upload engine source, restricted code, or other Licensed Technology to a system that trains on prompts or files unless the applicable terms clearly allow it. Check the service’s retention, training, enterprise-control, and deletion settings as well as Epic’s current EULA.

A purchase is evidence of a transaction, not proof that every use is allowed. Marketplace sellers must have legal rights to distribute each item. Customers generally receive a non-exclusive, worldwide, perpetual license under the Epic Content License Agreement, but the exact grant, exclusions, attribution rules, redistribution limits, and treatment of source files must be checked for the individual product and version.
Record the asset’s product page, seller, invoice, license text, version, permitted uses, and any restrictions. A license to include a compiled mesh, texture, sound, or animation in a game does not necessarily allow you to hand the source file to players, sell it as a standalone pack, put it in a competing asset library, or sublicense it to another developer. Marketplace rules also restrict certain third-party code licenses that would impose terms conflicting with the marketplace agreement, so inspect plugin dependencies instead of assuming that an open-source label resolves the issue.

“Perpetual” does not mean you can ignore later disputes or a seller’s lack of title. Keep the downloaded files and the terms that applied at purchase, and ask how the license operates if a listing is withdrawn, a dependency expires, or a rights holder challenges the seller. The answer may depend on the specific agreement; do not infer it from a product’s current store page.
Who owns copyright in AI-generated game art and code?
In the United States, copyright protects the human-authored expressive parts of a work. The U.S. Copyright Office’s Part 2 report states: “Copyright does not extend to purely AI-generated material, or material where there is insufficient human control over the expressive elements.” It also concludes that, based on generally available technology, “prompts do not alone provide sufficient control.” A detailed prompt can guide a result, but prompt wording by itself normally does not make the resulting pixels, music, text, or code human-authored expression.
Human contributions can still be protectable. Examples include selecting and arranging generated elements, making substantial edits, compositing several outputs, painting distinctive details, directing an original performance, writing original dialogue around generated suggestions, and designing the game’s overall presentation. Keep layered files, edit histories, version-control commits, shot lists, and notes that identify those contributions. A registration application should disclose AI-generated material and claim only the human-authored portions, including creative selection, coordination, arrangement, or modifications.
The Copyright Office received more than 10,000 public comments in its 2023 AI initiative, and its guidance may develop. That uncertainty is a reason to document authorship and avoid promising contributors that an unedited model output is exclusively owned. Contractually, you can allocate responsibilities and warranties, but a private contract cannot create copyright protection where the law does not provide it.

What other rights must be cleared besides copyright?
Copyright is only one layer of clearance. A model output can resemble protected material or identify a real person even when your team did not copy a file. Review each external element for the following rights.
- Trademark and trade dress: Remove or license recognizable names, logos, packaging, uniforms, and distinctive product designs. Consider confusion, endorsement, and dilution risks in the game, store listing, screenshots, and promotional video.
- Publicity and likeness: Obtain a written release for an identifiable person’s face, body, name, voice, mannerisms, or digital replica. Recreating a likeness independently does not automatically remove permission requirements.
- Privacy: Do not expose personal data, private photographs, recordings, locations, or biometric information in training material or shipped content without a lawful basis and appropriate consent.
- Music and sound: Clear the composition, sound recording, performer, and any sample separately. A “royalty-free” label may still impose attribution, usage, territory, or platform conditions.
- Fonts, scans, and photographs: Verify commercial use, modification, embedding, and redistribution rights; museum or public-domain status for an underlying object does not automatically clear a modern photograph or scan.
- Text and code: Identify the original author and dependency license. Check notice, source-distribution, patent, attribution, and copyleft obligations against the platforms and business model you intend to use.
Do I have to disclose AI assets?
Disclosure depends on the contract, store, jurisdiction, and materiality of the AI contribution. Epic’s Marketplace Distribution Agreement expressly requires a seller to apply the CreatedWithAI tag when a material portion of Marketplace Content was created using generative AI. If you submit such content, apply the tag and retain evidence of the disclosure. A game that merely uses a licensed marketplace item may not be the same party as the seller, so determine which disclosure duties attach to your submission and which attach to the original listing.

- Freeze the baseline. Record the exact Unreal Engine version, EULA version and date, project license model, revenue classification, legal entity, intended platforms, and target territories.
- Separate technology from Content. Label Epic Licensed Technology, Fab or Marketplace Content, internal work, open-source dependencies, and material supplied by contractors or clients.
- Capture marketplace evidence. Save each product page, seller identity, invoice, license agreement, version number, permitted commercial uses, attribution wording, source-file rules, redistribution limits, territory, term, and any AI tag.
- Audit code and plugins. List direct and transitive dependencies. Record each license and notice requirement, and reject a dependency whose obligations conflict with your intended binary, console, cloud, or source-distribution model.
- Clear external media. For every model, texture, animation, sound, voice, font, logo, photograph, scan, and text item, record the creator, source, grant, territory, term, modification permission, commercial-use permission, attribution, and sublicensing or redistribution rights.
- Document people and performances. Obtain written releases covering identifiable faces, names, voices, likenesses, performances, and publicity rights. Specify the game, trailers, patches, ports, advertising, and future platforms where appropriate.
- Document AI provenance. Keep the provider, account or plan, date, prompt, uploaded inputs, output, seed or settings when available, model version, edits, compositing steps, and the human-authored selection or arrangement. Confirm whether the provider trains on inputs or outputs and whether its terms grant commercial use.
- Apply required disclosures. Tag qualifying Marketplace submissions with
CreatedWithAI. For a U.S. registration, disclose AI material and claim only human-authored expression. Store screenshots or confirmations of each submission. - Check notices and credits. Preserve Epic copyright and trademark notices required by the EULA when the product has credits, and include third-party attribution notices exactly as their licenses require.
- Run a removal drill. Identify assets that could be withdrawn, revoked, expire, or become disputed. Keep a substitute asset, source files, build instructions, and a patch plan so a takedown does not strand the release.
How should I compare AI services and asset licenses?
Choose on documented rights, not on image quality alone. A short comparison matrix exposes gaps that a marketing page can hide.

What should I do if a rights holder objects after release?
Prepare a response before launch. Designate one person to receive notices, preserve the disputed file and its provenance, and pause advertising that repeats the allegedly infringing material. Compare the complaint with your license, releases, edit history, and credits; do not delete evidence or admit liability casually.
If the claim is credible or the license is uncertain, use the replacement plan: disable the affected asset where technically possible, substitute a cleared version, issue a patch, update store media and credits, and notify distributors if their agreement requires it. For a likeness, trademark, voice, or high-value copyright dispute, obtain advice from counsel in the relevant jurisdiction. A U.S.-centered checklist cannot resolve local moral rights, personality rights, consumer-protection rules, or platform-specific obligations.
Launch-day rights checklist
- Engine version and EULA archived.
- Royalty or seat-license classification supported by accounting records.
- Every Fab, Marketplace, open-source, contractor, and commissioned asset listed with its governing terms.
- AI prompts, inputs, outputs, edits, provider terms, and human contributions preserved.
- CreatedWithAI tagging completed wherever the Marketplace agreement requires it.
- U.S. registration materials prepared to disclose AI portions and claim only human authorship.
- Copyright, trademark, privacy, publicity, likeness, music, font, scan, and photograph clearances complete.
- Epic notices and all required third-party attributions present in credits or documentation.
- Store page, trailers, screenshots, and promotional posts reviewed separately from the game build.
- Removal, replacement, patch, and contact procedures tested.
Frequently Asked Questions
Can an AI-generated character be based on a real celebrity if I change the name?
Changing the name is not a reliable clearance. A recognizable face, voice, body, catchphrase, or mannerism can raise publicity, privacy, false-endorsement, or trademark issues even without using the celebrity’s exact name; obtain a release or redesign the character so the person is not identifiable.
Does a perpetual marketplace license let me redistribute the original asset files?
Usually not. A game-use license commonly permits embedding an asset in a compiled product while restricting resale, extraction, sublicensing, or distribution of the source files. Read the individual Content License Agreement and document the permitted form of distribution.
What evidence should a small studio keep if an asset seller disappears?
Keep the invoice, downloaded files, product-page capture, license text, seller information, version, hash, and the date of purchase in immutable storage. Also retain build records showing where the asset was used and a replacement plan in case the seller’s title or listing is later challenged.
Are AI disclosure rules identical in every country and store?
No. Marketplace labels, store questionnaires, consumer notices, and copyright-registration practices can differ by platform and jurisdiction. Treat the Epic tag and U.S. registration disclosure as separate obligations, then check the current rules for each territory and release channel.
