Yes. UK authorities can seize, freeze and seek forfeiture of cryptocurrency under Part 5 of the Proceeds of Crime Act 2002 (POCA), and the cryptoasset-specific civil route does not require a criminal conviction. A court must decide whether the assets are recoverable property or intended for unlawful use; seizure or a freeze is not itself a finding that the assets are criminal or that their owner is guilty.
The process depends partly on where the crypto is held. For assets in an unhosted wallet, officers may search for and seize items such as a recovery-seed note or hardware wallet, reconstruct access and transfer suspected assets to a law-enforcement-controlled wallet. For assets held by an exchange or custodian, an officer may seek a court order freezing the wallet administered by a qualifying UK-connected provider. Both routes lead to a court-based forfeiture process, with provisions for release, conversion, appeals and, in exceptional circumstances, compensation.

Does POCA require a criminal conviction before cryptocurrency can be taken?
No. POCA provides distinct routes: confiscation after conviction, and civil forfeiture or civil recovery that can proceed without one. They address different things and use different procedures, so civil forfeiture is not simply a quicker version of criminal confiscation.
Confiscation after conviction
After a criminal conviction, a court may make a confiscation order requiring a defendant to pay an amount reflecting the benefit obtained from criminal conduct, subject to the realisable assets available to meet the order. The order is for a sum of money: it does not necessarily declare that a particular bitcoin or token is itself criminal property. Crypto may, however, be among the assets used to satisfy the order.

The Crown Prosecution Service describes confiscation as a way to deprive offenders of criminal proceeds, deter further offending and reduce funds available to criminal enterprises. Quoting section 5A POCA, the CPS states that “the principal objective (of confiscation) is to deprive the defendant of the defendant’s benefit from criminal conduct, so far as within the defendant’s means”.
Civil forfeiture and civil recovery
These are non-conviction-based, property-focused powers. Home Office research distinguishes civil forfeiture in the Magistrates’ Court from civil recovery in the High Court: civil forfeiture can apply to specified categories including cryptoassets, while civil recovery can apply to assets more broadly. The process targets property rather than requiring a conviction of the person associated with it.

Under the cryptoasset civil-forfeiture scheme, the relevant property may also be property intended for use in unlawful conduct. The Home Office is explicit that “There is no provision for administrative forfeiture of cryptoassets”: a court-based process is central to this route.
What did the 2023 POCA reforms add for cryptocurrency?
Schedule 9 to the Economic Crime and Corporate Transparency Act 2023 added four cryptoasset-specific chapters to Part 5 POCA. The Home Office says the scheme was modelled on existing cash, listed-asset and bank-account forfeiture regimes.
| POCA chapter | What it covers |
|---|---|
| Chapter 3C | Searching for, seizing and detaining cryptoassets and related items, especially in unhosted-wallet cases. |
| Chapter 3D | Crypto wallet freezing orders for assets held by a qualifying UK-connected cryptoasset service provider. |
| Chapter 3E | Applications to forfeit detained or frozen cryptoassets. |
| Chapter 3F | Conversion of detained or frozen cryptoassets into money before a forfeiture hearing, principally to address volatility. |
The statutory definition of “cryptoasset” is broad: it covers cryptographically secured digital representations of value or contractual rights that use distributed-ledger technology. The Home Office circular says the definition can encompass non-fungible tokens (NFTs), stablecoins and privacy coins. A “cryptoasset-related item” is property that is, contains, or gives access to information likely to help seize recoverable cryptoassets or assets intended for unlawful conduct.
A crypto wallet may be software, hardware, a physical item, or a combination used to store the private key that permits access. That means officers may be concerned not only with tokens themselves, but also with devices or records that can help them reach the assets.

How can officers seize cryptocurrency in an unhosted wallet?
For an unhosted wallet, the seizure process can involve gaining lawful access to relevant premises or a person, locating items that help access the wallet, obtaining information from them, reconstructing the wallet and then transferring the crypto. The Home Office identifies five stages:
- Search.
- Seize and detain cryptoasset-related items.
- Obtain information from those items.
- Reconstruct the cryptoasset wallet.
- Seize and detain the cryptoassets.
Search and seizure of wallet-related items
Officers need lawful authority to be on the premises and reasonable grounds to suspect that an item likely to assist in seizing cryptoassets is present. The provisions can cover premises, vehicles and people. Prior judicial authority is generally required unless the statutory urgent route applies.
Items may include a paper notebook containing recovery seeds, an electronic hardware wallet, or a phone, tablet, laptop or desktop computer with relevant information or an application controlling a software wallet. Whether a particular item qualifies depends on the statutory test and the circumstances; the fact that a device contains a wallet app does not by itself establish that its assets are recoverable.
Accessing information and reconstructing the wallet
For specified purposes, an officer may require accessible electronic information to be produced in visible and legible form. The purposes include deciding whether an item is a cryptoasset-related item or enabling seizure of cryptoassets. The Home Office circular says this power does not authorise requiring information protected by legal professional privilege. Failure to comply may amount to an obstruction offence, depending on the officer and the enactment that applies.
After obtaining relevant information, an officer may use it to open or reconstruct the wallet in a wallet controlled by law enforcement. The Home Office distinguishes that reconstruction from the subsequent transfer of the cryptoassets: the transfer is the seizure step. Its circular says officers can take steps to recreate wallets and transfer assets into a law-enforcement-controlled wallet.
The officer may seize the cryptoassets where there are reasonable grounds to suspect they are proceeds of unlawful conduct or intended for use in such conduct. Those grounds support the seizure stage; a court later decides whether the statutory basis for forfeiture is established.

How does a freeze work when crypto is held on an exchange?
Where an exchange or custodian holds the assets, officers may seek a crypto wallet freezing order rather than reconstructing an unhosted wallet. The order is directed at a wallet administered by a qualifying UK-connected cryptoasset service provider, where there are reasonable grounds to suspect the wallet contains recoverable property or property intended for unlawful conduct.
The Home Office circular describes possible UK connections including a provider with a UK registered or head office whose day-to-day affairs are conducted from the UK; a provider whose terms submit disputes to UK courts; or a provider holding relevant customer data in the UK. A provider keeps custody of frozen assets while the order operates.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsA freezing order generally prohibits withdrawals, payments or other use of the wallet unless the court allows an exclusion. Potential exclusions include reasonable living expenses, carrying on a business, trade or occupation, and legal expenses. An order can be made without notice where giving notice could prejudice later forfeiture steps.
How long can authorities hold seized or frozen cryptocurrency?
The initial detention periods for cryptoassets and related items are short—generally 48 hours unless detention has been authorised in advance. A judicial authority can extend detention in periods of up to six months. The ordinary maximum is two years from the first order, with an extension to three years possible where an outstanding overseas evidence request, often described as mutual legal assistance, is connected with the assets or related items.
A crypto wallet freezing order can also operate for up to two years and may be extended to three years in the specified overseas-evidence situation. These are statutory maximums, not automatic holding periods: continued detention must remain justified under the applicable suspicion and procedural requirements.
What happens at a cryptoasset forfeiture hearing?
A judicial authority may order forfeiture of some or all of the detained or frozen cryptoassets if satisfied they are recoverable property or intended for use in unlawful conduct. Where a service provider holds the assets, it must transfer forfeited crypto to a wallet nominated by an enforcement officer. The new cryptoasset civil-forfeiture powers have no minimum value threshold.

Joint ownership, victims and true owners
Joint or associated property can make the outcome more complicated. If parties cannot agree on their respective interests, the question can go to the High Court or, in Scotland, the Court of Session. In appropriate cases, a court may sever or extinguish an interest and order payment to the affected holder; it must consider whether that would be just and equitable.
The scheme also provides for true-owner and victim claims. Someone deprived of crypto through unlawful conduct, such as theft, may apply for release in the circumstances set out in the legislation. Other true-owner applications face additional conditions, including restrictions intended to avoid making the court resolve an unnecessary ownership dispute. A person who believes seized assets were stolen from them should raise that claim through the applicable process and provide supporting evidence; the existence of a claim does not by itself guarantee release.
Can seized crypto be converted, returned or destroyed?
Yes. Before a forfeiture application is decided, cryptoassets can be converted into sterling. The court must consider whether the assets are likely to suffer a significant loss in value while awaiting release or forfeiture, including during any appeal period. Conversion proceeds are held in an interest-bearing account pending the outcome. The Home Office circular says either the agency bringing the case or the cryptoasset holder may apply for conversion.
If forfeiture is ordered, enforcement officers must take steps to realise the assets once appeal rights are exhausted. Destruction is permitted if realisation is not reasonably practicable or would be contrary to the public interest, particularly where circulating the assets could facilitate further criminal conduct.

If the court does not make a forfeiture order, compensation may be available in exceptional circumstances for loss caused by seizure, detention or a wallet freeze. That is not an automatic payment for every unsuccessful case. The circular states that an appeal against a forfeiture decision must be lodged within 30 days of the court’s order. If an appeal succeeds and assets are released, accrued interest must also be returned in the circumstances set out in the scheme.

The Home Office identifies constables, HMRC officers, Serious Fraud Office officers and qualifying accredited financial investigators as enforcement officers for the relevant powers. National Crime Agency officers can use them when designated with the powers of a constable.

Jurisdiction matters. Home Office Circular 005/2024 is expressly addressed to officers exercising Part 5 powers in England and Wales. The 2024 explanatory memorandum describes the related code framework for England and Wales, Scotland and Northern Ireland, but that does not establish that every procedure is identical across all UK jurisdictions. The Home Office says its circular is intended to promote consistency, not to provide a comprehensive statement of the law; authoritative interpretation belongs to the courts. This article is legal information, not legal advice.
How can civil asset recovery relate to a criminal investigation?
Authorities may consider asset recovery and financial investigation early, using criminal and civil powers as appropriate. The Section 2A guidance says non-conviction-based powers may be pursued whether or not a criminal investigation or prosecution exists and regardless of its stage, subject to statutory restrictions.

There is an important coordination limit: a civil recovery order cannot be sought for property already taken into account when calculating the amount of a confiscation order. That is one reason the route for particular assets may need to be assessed early rather than treated as a separate afterthought. The existence of a parallel criminal case does not turn the civil process into a conviction-based confiscation order.
What do the latest official recovery figures show?
The Home Office reported that £284.5 million of assets were recovered from confiscation, forfeiture and civil recovery orders in the financial year ending 31 March 2025. It reported this as a 15% increase on the previous year and a 31% increase on the financial year ending March 2020. These are all-asset figures, not a cryptocurrency-only total, and should not be read as a measure of crypto seized or forfeited.
Frequently Asked Questions
Can a holder ask the court to convert frozen cryptocurrency before the hearing?
Yes. The Home Office circular says an application to convert may be made by either the agency bringing the case or the cryptoasset holder. The court considers the risk of significant loss in value while the assets await release or forfeiture.
Does POCA make owning cryptocurrency unlawful in the UK?
The powers described here do not make cryptocurrency ownership itself unlawful. They concern specific property suspected of being proceeds of unlawful conduct or intended for unlawful use, subject to the statutory process and court decision.
Does a freeze mean the court has already decided the assets are criminal property?
No. A freezing order can be sought on reasonable grounds to suspect that the wallet contains relevant property, before the forfeiture hearing. The later court decision determines whether the statutory test for forfeiture is met.
