Someone Copied My Game With AI—Which Rights Can Protect It?

Maybe—but not just because another game feels familiar. Under the U.S. legal framework discussed here, the key question is what was taken: original expressive material, a brand that identifies the game’s source, or valuable confidential information acquired or used improperly. Copyright, trademark, and trade-secret law address different kinds of harm, and similar mechanics, genre, or broad themes alone do not establish a claim. AI use does not automatically make a new game unlawful—or give its creator permission to copy someone else’s protected material.

What should I compare first if someone copied my game with AI?

Separate the similarities into categories before deciding what kind of legal issue you may have. Put the games side by side and identify the particular material that appears to have been repeated, rather than treating overall resemblance as proof of infringement.

For copyright, look for concrete expressive elements: artwork, rulebook or dialogue text, audiovisual material, or software. The U.S. Copyright Office’s Games guidance gives expressive rulebook text and gameboard artwork as examples of material that may be registrable, and its registration portal includes video games among audiovisual works and computer programs. That does not mean every element of a game is protected as one undivided whole.

Separately, compare the titles, logos, and other source-identifying branding as consumers encounter them. For a trade-secret concern, identify a specific confidential item—such as source code or unreleased design material—and ask how the other party could have obtained it. Similarity can be a reason to investigate, but it does not by itself answer any of those questions.

What does each kind of protection cover?

Copyright, trademark, and trade-secret law protect different interests. A fact pattern can raise more than one issue, but each route has its own requirements; none is a general right to stop a competitor from making a similar game.

Protection What it can cover What similarity alone does not establish Practical protection step Potential response
Copyright Original expression fixed in a tangible form, including qualifying artwork, text, audiovisual material, and software. Ownership of a game idea, genre, or method of play. Document authorship; consider registering copyrightable components and accurately identify AI-generated material. Assess whether protected expression was copied; consider a compliant notice for qualifying online material and seek legal advice about suit.
Trademark Words, symbols, or designs used to identify the source of goods or services, such as a game name or logo used as a brand. That similar gameplay means consumers are likely to be confused about source, affiliation, sponsorship, or approval. Document actual brand use; consider a search and federal registration where appropriate. Assess likely confusion and, where relevant, whether claimed trade dress is nonfunctional.
Trade secret Information with independent value from being secret and protected by reasonable secrecy measures; programs and codes may qualify. That a competitor independently developed something similar or lawfully reverse-engineered it. Restrict access and document confidentiality measures before disclosure. Identify the specific secret, the protections used, and the alleged improper acquisition, disclosure, or use.

The distinctions in the table reflect U.S. Copyright Office guidance and the relevant federal statutes. They are a screening framework, not a finding that a particular game infringes or that a particular piece of information qualifies as a trade secret.

Can I copyright game mechanics or a game idea?

No. Copyright does not give an owner control over a game idea, system, or method of play simply because the owner developed it first. The Copyright Office states: “The idea for a game is not protected by copyright.”

That limit does not make every element surrounding a mechanic free to copy. A particular explanation of rules, original illustration, animation, music, or code may contain protectable expression even when the underlying rules or method of play do not. The relevant comparison is between specific protected expression and the material used by the later game—not simply between the games’ goals, genres, or play loops.

Section 106 of the U.S. Copyright Act describes rights that include reproduction, preparation of derivative works, and distribution, subject to statutory limitations. A claim therefore needs more than evidence that two games share a concept: it needs a rights holder, material within the relevant protection, and facts supporting the allegation that protected expression was taken. The 2024 U.S. Code edition is the statutory edition referenced here; anyone acting on a live dispute should confirm current law with qualified counsel.

Does AI use change a copyright claim?

No. AI is not a shortcut around another creator’s copyright, and using an AI system does not automatically make a new game either lawful or unlawful. The question about possible copying remains whether the new game reproduces protected expression, not whether a person or a model produced it.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is a separate question: what copyright, if any, can the AI-assisted developer claim in their own work? The Copyright Office’s human-authorship guidance says that a human creator’s expressive contribution can be protected, while prompting alone does not establish copyright in expression determined by the machine. The Office’s January 29, 2025 announcement quoted Register of Copyrights and Director Shira Perlmutter saying, “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” That statement concerns human creativity; it is not a declaration that every AI output receives copyright.

For registration, the Office instructs applicants to identify human contributions and disclose more-than-de-minimis AI-generated content. A creator should not present machine-determined expression as their own human authorship. At the same time, authorship rules for the new game do not decide whether its creator had permission to reproduce expression belonging to someone else. Those are distinct questions.

Can I trademark my game name or logo?

Potentially, if the name or logo is being used to identify the source of goods or services and the facts support trademark rights. The central issue in a dispute is whether consumers are likely to be confused about origin, affiliation, sponsorship, or approval—not merely whether two strings of text look alike.

The USPTO explains that trademark rights can arise through use. Federal registration is not a prerequisite to any rights, but unregistered rights are limited; federal registration offers broader protection. For that reason, compare how the names and logos are actually presented and used in commerce, including the surrounding branding, rather than comparing names in isolation.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Trade dress—the overall look or presentation claimed as a source identifier—can raise a separate issue. For unregistered trade dress, nonfunctionality matters. A visual feature that serves a functional purpose should not be treated as a brand right merely because it is distinctive-looking. A fact-specific assessment is needed before alleging that a rival’s presentation creates actionable confusion.

Is my game’s source code or unreleased design a trade secret?

It may be, but confidentiality and value matter. Under the federal trade-secret definition, the information must derive independent economic value from not being generally known or readily ascertainable, and its owner must take reasonable measures to keep it secret. The statute lists programs and codes among the potential forms of protected information.

Public gameplay that a competitor can observe is not, by that fact alone, a trade secret. Nor does a similar shipped feature prove that confidential information was misappropriated. Identify the particular information at issue, who could access it, what permission and confidentiality controls applied, and what evidence points to improper acquisition, disclosure, or use.

Reasonable safeguards depend on the circumstances. Access restrictions and documented confidentiality practices are relevant; for physical materials such as printed designs or storage media, a locking document safe can be one part of controlling access. A safe, lock, or confidentiality label by itself does not establish that every legal requirement is satisfied.

Independent development and lawful reverse engineering are not, by themselves, trade-secret misappropriation. The issue is not simply whether a rival reached a similar result, but whether the information qualified for protection and whether it was obtained or used through conduct the law treats as improper.

What should I do before making a claim?

Preserve specific evidence and match it to the legal theory. Avoid public accusations based only on a shared mechanic or a general sense that another game resembles yours.

  1. Preserve dated versions. Keep the relevant source files, artwork, text, builds, public release dates, and records showing when the disputed material appeared. Preserve the specific comparison material rather than relying on memory or screenshots without context. This is practical evidence-preservation guidance, not a guarantee that particular records will meet a legal standard.
  2. Identify ownership and authorship. Determine who created or controls the material at issue, and distinguish human-created expression from AI-generated content. Gather agreements or other records relevant to ownership rather than assuming that the studio, individual developer, or AI tool automatically owns every contribution.
  3. Classify the alleged taking. For copyright, point to particular expressive material. For trademark, document the names or designs as used in commerce and the facts relevant to likely confusion. For trade secrets, specify the information, its value from secrecy, the steps used to keep it secret, and the suspected route of access or use.
  4. Check registration and filing status. Copyright generally begins when qualifying work is created and fixed, but registration is generally required before suing over a U.S. work. Trademark rights can arise through use, while federal registration offers broader protection. These are different systems; registration or a filing in one does not establish a claim under another.
  5. Choose a response that fits the claim. For qualifying online copyright material, a notice under section 512(c)(3) has statutory content requirements. Do not treat a platform notice as a substitute for evaluating ownership, the specific material, or available legal remedies. Trade-secret civil relief and trademark claims are separate routes, not interchangeable versions of a generic AI complaint.
  6. Get legal advice before escalating. The scope of a right, the evidence of copying or confusion, and the facts around access can change the answer. Consult a qualified U.S. intellectual-property attorney before threatening litigation or asserting that confidential information was misappropriated.

What does U.S. law establish—and what remains case-specific?

This article addresses U.S. federal law and U.S. agency guidance. It does not establish rules for every country where a game may be released. Copyright, trademark, and trade-secret questions in other jurisdictions require separate analysis.

The Copyright Office announced Part 2 of its AI report on January 29, 2025. Its AI initiative page described a pre-publication Part 3 on generative-AI training dated May 9, 2025, with a final version still to come in the material referenced here. That policy work is not a ruling that a particular game was copied or that a specific developer owns particular AI output.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Office reported reviewing more than 10,000 responsive comments in connection with its AI initiative. That number is a comment count, not a count or rate of AI-cloned games. It provides no basis for estimating how common game cloning is or for resolving an individual dispute.

The practical conclusion is narrower and more useful: AI does not erase existing rights, but resemblance alone does not prove they were violated. A credible assessment starts with the material allegedly taken and applies the distinct legal test for expression, source identification, or confidential information.

Frequently Asked Questions

Do I need to register my game before I release it?

Copyright generally arises when qualifying work is created and fixed, so registration is not what initially creates copyright. Registration has a separate procedural role for a U.S. work, and the timing and status of a specific filing are worth confirming before a dispute escalates.

Can a game title be protected by copyright?

A title by itself is not protected as copyrightable game expression. If it functions as a source identifier in commerce, trademark law is the more relevant framework; the facts of actual use matter.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does an AI copyright report decide whether a game was cloned?

No. The Copyright Office’s AI policy work addresses broader copyright questions and is not a case-specific infringement finding. Whether a particular game copied protected material depends on the works and evidence involved.
