For most U.S. readers, downloading an SNES ROM from an unauthorized website carries copyright risk. A ROM is a digital copy of videogame software, and copyright owners generally control reproduction and distribution. The game’s age, the number of sites offering it, or your ownership of the original cartridge does not by itself authorize an internet download.
There are narrower questions around making an archival copy, fair use, technological-protection measures, and institutional preservation. Each depends on specific facts. This guide explains the federal framework current as of October 30, 2026; it is general information, not legal advice, and another country or a particular game’s license may produce a different result.

Usually not when the file comes from a source that lacks the copyright owner’s authorization. The U.S. Copyright Office explains that uploading or downloading copyrighted works without permission can infringe the exclusive rights of reproduction and distribution. A ROM does not become legally neutral because it is an old file or because the original cartridge is no longer sold.
A lawful download can exist when the rights holder authorizes it, the title is genuinely public domain, or a specific legal exception applies. Those facts must be established for the particular game and source; a site’s availability is not proof of authorization.

What legal questions determine whether a ROM download is lawful?
Five facts usually control the analysis. Looking at them separately prevents common assumptions from turning a narrow exception into a blanket permission.
| Question | Why it matters |
|---|---|
| Who authorized the copy? | An official release, written permission, or a demonstrable public-domain status is materially different from an unknown upload. |
| What is the purpose? | Personal play, archival preservation, scholarship, and commercial distribution can raise different issues, but purpose alone does not erase the owner’s rights. |
| Who is making it? | An ordinary consumer is not treated the same way as an eligible library, archive, or museum operating under the preservation rules. |
| How was the file obtained? | A lawfully acquired copy held by an institution is different from a third-party server offering a downloadable image. |
| Was access protection bypassed? | Copyright exceptions and the DMCA’s anti-circumvention rules are separate questions. |
What rights does copyright give a game owner?
Title 17 gives a copyright owner exclusive rights to reproduce a protected work and distribute copies, subject to statutory limitations. Video games combine expressive audiovisual content with computer software, both of which can be protected. Creating or distributing a ROM therefore implicates rights even when the cartridge was released decades ago.

Copyright eventually expires, but age alone does not establish that a specific SNES title is public domain. Rights may also have moved between companies, been licensed by territory, or remained subject to a particular agreement. Unless clear information shows otherwise, treat a commercial game as protected.
Does owning the original cartridge make a ROM download legal?
No. Owning a cartridge may be relevant to a separate question about making a copy, but it does not give an unrelated website authority to distribute its ROM. The source’s authorization and your ownership are distinct facts.
Section 117 of the Copyright Act describes a conditional archival-copy privilege for the owner of a copy of a computer program. An archival copy must be made for archival purposes, and it must be destroyed or transferred with the original when the original is transferred. The rule is not a general license to obtain a download from someone else’s server.

A National Telecommunications and Information Administration report specifically cautioned that the archival-copy exception does not apply to contemporary personal-computer, videogame-console, or online-gaming environments, and that a website offering backup copies to the public falls outside the exception. That guidance means cartridge ownership should not be treated as a universal defense to downloading a ROM from a public ROM site.
Can I make a backup ROM from my own SNES cartridge?
That is a narrower and more fact-specific question than downloading a file. A person who lawfully owns a program copy may look to Section 117’s conditions, but the federal guidance cited here does not create a broad consumer safe harbor for videogame-console ROMs.
Any claim would need to account for the purpose of the copy, whether it is truly archival, what happens to the copy if the cartridge is transferred, and whether another rule is implicated by the copying method. A backup made for personal convenience is not automatically the same as an archival copy recognized by statute. Publicly uploading the resulting image is a separate reproduction and distribution issue.
Does fair use make downloading an SNES ROM legal?
Fair use is not an automatic permission to download a ROM. The Library of Congress describes fair use as a case-by-case analysis of four factors: the purpose and character of the use, the nature of the copyrighted work, the amount used, and the effect on the potential market. Only a court can make the final determination.
Because a ROM is normally a complete copy of software and game content, the amount and market factors can be significant, but no single factor decides every dispute. A noncommercial purpose may be relevant without being conclusive. Do not describe a download as lawful merely because it is for private use, education, research, or because the game is unavailable at retail.

How does the DMCA anti-circumvention rule affect ROMs?
Section 1201 generally prohibits circumventing a technological measure that effectively controls access to a copyrighted work. The statute also creates a triennial process through which the Librarian of Congress can adopt limited, temporary exemptions for defined classes of noninfringing uses.
Keep two questions separate:
- Access control: Did the method bypass an effective technological protection measure, and does a current Section 1201 exemption cover that act?
- Copy and distribution: Was the game reproduced or distributed without the copyright owner’s authorization?
An exemption to the anti-circumvention prohibition does not, by itself, authorize public distribution of the resulting ROM. A person can therefore face a separate copyright question even when an exemption addresses the act of bypassing access controls.
What does the video-game preservation exemption actually cover?
The current preservation rule is narrow and institution-focused. It covers eligible libraries, archives, and museums working with lawfully acquired complete games under specified conditions. The activity must be without direct or indirect commercial advantage, and the game generally must no longer be reasonably available commercially or require restoration after an owner has stopped providing an authentication server.
Who can use it?
The rule is aimed at qualifying libraries, archives, and museums, not every individual who wants a ROM. An institution must keep the preservation activity within the rule’s conditions and document its lawful acquisition and purpose.
What access is permitted?
The preserved game and necessary console computer programs may be used for the covered preservation activity, but the rule restricts distribution or availability outside the institution’s physical premises. That limitation is fundamentally different from placing a ROM on a public website for remote downloads.

What is the timing of the current rule?
The Copyright Office identifies October 28, 2024 as the final-rule date for the ninth triennial Section 1201 proceeding. As of October 30, 2026, the tenth proceeding for the 2027 cycle has begun. The Copyright Office describes streamlined renewal of existing exemptions and says renewed exemptions are intended to remain in force from October 2027 through October 2030. Anyone updating a preservation policy after the 2027 cycle should verify the final rule rather than relying on an older summary.
Why a preservation rationale does not legalize a ROM site
Preservation law is built around eligible institutions, lawful acquisition, noncommercial purposes, defined preservation needs, and controlled access. A public ROM site may lack one or more of those elements, and its assertion that files are backups or preserved games does not establish authorization.
The NTIA’s published warning is direct: a website or other source offering unauthorized copies of works other than computer programs as backup copies violates the law. Even where software-specific rules are argued, a public distribution service cannot simply assume the institutional preservation conditions.

The Copyright Office’s current digital-files guidance states that unauthorized uploading or downloading can infringe reproduction and distribution rights. It describes statutory damages of up to $30,000 per infringed work, rising to up to $150,000 per work when willful infringement is proven, and notes that attorney’s fees may also be available.
Those figures are statutory maximums, not an automatic bill or a prediction of what any particular downloader would owe. Liability, available remedies, and the amount awarded depend on the facts and the court. The figures also concern infringement analysis generally; they do not mean every ROM download produces the maximum penalty.

How can I evaluate a ROM source before downloading?
Use a rights-first checklist rather than the site’s age, popularity, or claim that a file is a backup.
- Look for affirmative authorization: Is the download offered by the rights holder or an expressly licensed distributor?
- Check the game’s status: Is there reliable evidence that this exact title is public domain, rather than merely old or commercially unavailable?
- Separate ownership from source authority: Your cartridge does not prove that the uploader has permission.
- Identify the purpose and access: Private local use is not the same as public hosting, remote access, or redistribution.
- Check the technology involved: Determine whether obtaining the file requires bypassing an access control and whether a current Section 1201 exemption actually applies.
- For institutions, document the record: Keep evidence of lawful acquisition, eligibility, noncommercial purpose, preservation need, and physical-premises access controls.
What is the safest legal approach for a specific SNES game?
Prefer an authorized release or service when one exists. If none exists, do not infer permission from scarcity, cartridge ownership, or a ROM site’s wording. Check the title’s rights history, license terms, current authorized availability, and the law of the relevant jurisdiction before making a definitive decision.
For a preservation project, involve the responsible institution’s counsel or rights specialist and map each action to the current Section 1201 rule. For a personal copy, recognize that the federal guidance leaves the consumer videogame-ROM question narrower and less certain than many online claims suggest.
What changes outside U.S. federal law?
This explanation addresses U.S. federal law as of October 30, 2026. State law, foreign law, a game’s license, the identity of the rights holder, public-domain status, and later court decisions or rulemaking can change the result. A conclusion that may be supportable for one title, country, or institution should not be generalized to every SNES ROM.
Frequently Asked Questions
Does a game being out of print make its ROM legal to download?
No. Commercial unavailability can be relevant to an institution’s preservation eligibility, but it does not itself place the game in the public domain or authorize a public download. You still need evidence of authorization, public-domain status, or a specific applicable exception.
Are ROM sites allowed to call files “backup copies”?
That label does not create a legal exception. NTIA guidance specifically warns that a website offering unauthorized backup copies to the public falls outside the archival-copy rule.

No. The Copyright Office’s figures are maximum statutory amounts per infringed work. Whether a claimant can recover damages, whether infringement was willful, and the amount awarded depend on litigation and the facts.
What should a museum record when preserving an SNES game?
It should be able to show lawful acquisition of a complete game, eligibility as a qualifying institution, a noncommercial preservation purpose, the reason the title qualifies, and controls preventing distribution or access outside the institution’s physical premises.
