Neither open-source nor closed AI models are automatically easier to audit for safety. A release with downloadable weights can let independent reviewers run experiments, reproduce tests and inspect behavior at scale, but weights alone do not disclose training data, development decisions or the quality of safety evaluations. A closed provider can support serious audits through documentation, logs and controlled external testing, yet outside reviewers must work within the access that provider grants. The right answer depends on what you need to establish: observed behavior, reproducibility, training claims, security, or governance compliance. Treat “open” and “closed” as descriptions of access to particular components, not as safety ratings.
What do “open-source” and “closed” mean for an AI safety audit?
“Open-source AI” has no single, universally accepted definition. The OECD’s August 2025 primer and the US National Telecommunications and Information Administration (NTIA) describe openness across separate components: model weights, source code, training and fine-tuning data, documentation, access conditions and license terms. A model can be open on one dimension and restricted on another.
As an Amazon Associate I earn from qualifying purchases.
Model weights are the numerical parameters produced by training and fine-tuning. They allow a party to run a model, but they are not a copy of the training corpus, the training software, the evaluation process or the organization’s safety decisions. Calling a weight release “open” therefore says much less about auditability than many readers assume.
Three practical release patterns
- Weights with little context: Anyone who receives the files can run local tests, but information about data sources, training methods, red-team results and known limitations may be sparse.
- Weights plus evidence: The publisher also supplies code or implementation details, data documentation, evaluation methods, model cards, limitations and licensing that permit the intended research. This gives auditors more evidence to cross-check.
- Closed service with controlled access: The model runs behind an API or hosted interface. The provider may publish documentation, retain logs, answer auditor questions or permit an independent evaluator to test a controlled instance.
These are access conditions, not a ranking from safe to unsafe. A well-documented closed service may expose more usable safety evidence than an undocumented weight dump, while a genuinely open release can enable scrutiny that a provider-controlled interface cannot.

Which audit question are you trying to answer?
Auditability is not one test. Before comparing releases, write down the claim you want to verify and the evidence that would support it.
“How does the model behave?”
Behavioral auditing examines outputs under normal, adversarial and edge-case prompts. An evaluator needs access to the model or to a testing interface, documented limits, a stable version and a reproducible test setup. Downloadable weights can support unlimited local experiments and parallel community testing. A closed provider can also permit robust testing, but it controls rate limits, model routing, filters, logging and the version that responds.
“Can another party reproduce the result?”
Reproduction requires more than a model name. Testers need the exact checkpoint or service version, tokenizer and configuration, prompts, sampling settings, evaluation data, scoring code and a record of any safety filters. Weight access helps when the files are complete and the license allows the experiment; it does not guarantee that the original training run or a provider’s hosted behavior can be recreated.
“Are the training and development claims credible?”
Auditing development requires evidence about architecture, data sources, filtering, human feedback, fine-tuning, evaluation design, incidents and change control. Weights cannot reveal which copyrighted or personal data were used, how unsafe examples were handled or whether a reported benchmark was selected after testing. Documentation such as a model card can disclose intended uses, capabilities, limitations and evaluation results, but its usefulness depends on specificity and supporting records.
“Is the system secure?”
Security review covers the model artifact, serving stack, update process, access controls, secrets, supply-chain integrity and abuse monitoring. An auditor may need to inspect code and deployment configuration, not just model outputs. Open files can make vulnerability research easier, while a provider may have better visibility into production telemetry; either arrangement can fail if evidence is withheld or poorly maintained.
“Is the provider meeting governance or legal duties?”
Governance audits examine who is accountable, what risk controls exist, how incidents are handled and whether required records are available. The answer depends on jurisdiction and model category. An openness label cannot substitute for the specific documents an authority, customer or affected person is entitled to inspect.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteDoes access to model weights make a model more transparent?
It can make direct experimentation easier, but it does not by itself make the model transparent. The OECD and NTIA component-based approaches separate weights from code, data information and documentation for precisely this reason.

| Evidence or capability | What weight access can provide | What it does not establish |
|---|---|---|
| Local execution | Run prompts without a provider’s API limits, routing changes or availability constraints. | That local behavior matches a hosted product with additional system prompts, filters or tools. |
| Reproducible experiments | Repeat tests on a fixed checkpoint and publish the same artifact to other evaluators. | That the training run, data pipeline or reported safety process can be reproduced. |
| Mechanistic or security analysis | Inspect parameters, probe internals and test modified versions under controlled conditions. | That the weights contain no hidden behavior, memorized personal data or exploitable vulnerability. |
| Community scrutiny | Allow more researchers to test the artifact, subject to license and resources. | That reviewers are independent, findings are representative or safety mitigations are effective. |
A weight release is therefore best understood as an opportunity for inspection. To turn that opportunity into an audit, pair it with provenance, evaluation records, documentation and a way to verify that the artifact has not changed.
Can a closed AI model be audited for safety?
Yes. Closed access limits what outsiders can inspect, but it does not make auditing impossible. Providers can grant independent evaluators controlled access to a model, share technical documentation, provide red-team environments, expose safety-relevant logs or commission external assessments. The UK government’s 2023 paper on safety processes discusses independent external model evaluations and red teaming, including the possibility of broader community involvement for open models.
What a controlled audit can include
- A dedicated endpoint or sandbox tied to a named model version.
- Pre-agreed prompts, abuse scenarios and success criteria, with enough request volume to detect low-frequency failures.
- Documentation of system prompts, refusal layers, tool permissions, retrieval sources and post-processing that affect outputs.
- Access to relevant logs, incident records and mitigation changes under confidentiality controls.
- A process for reporting vulnerabilities and verifying fixes without exposing sensitive weights or user data.
The trade-off is dependence on the provider. Auditors may be unable to inspect hidden routing, reproduce a result after an update, test unrestricted variants or publish all evidence. A closed audit is credible only when the scope, independence, data access and change-notification rules are explicit.

Use the same evidence questions for both categories. The following framework avoids treating a binary label as an audit score.
| Comparison axis | Questions for an open release | Questions for a closed service |
|---|---|---|
| Weights and access | Is the exact checkpoint downloadable? Can evaluators run it, modify it and share test results under the license? | Can an independent evaluator access the exact production model, with stable versioning and sufficient request volume? |
| Training and evaluation information | Are architecture, data sources, filtering, fine-tuning and evaluation methods documented, or are only weights provided? | Will the provider disclose methods, limitations, benchmark construction and relevant safety-test results? |
| Documentation quality | Does a model card state intended uses, limitations, known risks, testing conditions and change history? | Are those details available to customers and auditors, including system prompts, tools and post-processing that shape behavior? |
| Independent evaluation | Can unaffiliated researchers test the artifact without permission, and can they publish findings? | Which external evaluators have access, what restrictions apply, and can they report negative results? |
| Reproducibility and license | Are files complete, checksummed and legally usable for the proposed research? Are dependencies and inference instructions supplied? | Can a second auditor repeat the test later, or does access, pricing, rate limiting or a silent update prevent replication? |
| Governance evidence | Is there a responsible organization, contact, incident process and record of releases? | Can the provider demonstrate accountability, risk management, incident response and retention of audit evidence? |
Score each cell with evidence rather than assigning one “openness” number. If a field is unavailable, record it as unknown; do not infer safety from the absence of a disclosed problem.
What does a rigorous safety audit require in practice?
A practical audit can be organized as a sequence that works for either release model.
- Define the claim and scope. State whether you are testing harmful-content refusal, privacy leakage, robustness, cybersecurity behavior, fairness, reliability or compliance. Specify the deployment context, user population, languages, tools and model version.
- Map the evidence needed. For behavioral claims, collect an executable model or adequate interface, test data and configuration. For development claims, request architecture, data and training documentation, evaluation protocols and limitation reports. For governance claims, identify policies, accountability, incident records and required legal documents.
- Verify provenance. Record the checkpoint hash or API model identifier, release date, license, tokenizer, system instructions and dependencies. Note whether a hosted service can silently route requests to a newer model or apply a separate moderation layer.
- Design independent tests. Combine ordinary use cases, known failure modes, adversarial prompts, distribution shifts and regression tests. Pre-register scoring rules where possible so that favorable cases are not selected after results are known.
- Run and preserve the experiment. Save prompts, outputs, timestamps, random seeds, sampling parameters, tool calls, errors and model responses. For a closed service, document rate limits, account permissions and any provider intervention.
- Check the provider’s claims against results. Compare published limitations and benchmark conditions with your observations. Investigate discrepancies rather than averaging them away; a high aggregate score can conceal a severe failure in a critical use case.
- Assess residual risk and controls. Decide whether safeguards, monitoring, human review, access restrictions or deployment changes reduce the identified risk to an acceptable level. An audit report should state what was not tested.
- Plan repeatability. Set a re-test trigger for model updates, new tools, changed policies, incidents or shifts in the user population. Keep artifacts and test scripts so another qualified party can repeat the work.
What do transparency scores actually tell you?
Transparency indices measure the disclosures or openness dimensions defined by their authors. They are not direct measurements of safety, audit quality or the absence of harmful behavior.

The 2024 comparison
The Stanford Institute for Human-Centered Artificial Intelligence’s 2024 report, summarizing the 2023 Foundation Model Transparency Index, reported an average score of 51.3% for open models and 30.9% for closed models in that comparison. Those figures describe the index’s criteria and sample. They do not prove that open models are safer, that every component of an open release is inspectable or that a higher-scoring provider has stronger controls in your deployment.
The 2026 sample
Stanford’s AI Index Report 2026, reporting the Artificial Analysis Openness Index sample, said most models scored between 2 and 16 out of 100. It also treated training-methodology transparency and data transparency as separate dimensions. More than 90% of notable industry models in the report’s 2025 population were released without training code. That statistic concerns code availability, not whether those models underwent safety evaluation.
Because the reports use different indices, years and model samples, their figures should not be combined into a trend line. Use a score to understand what a particular index measured, then inspect the underlying evidence for the model you are considering.
What does the EU AI Act require from general-purpose AI providers?
The European Union’s general-purpose AI (GPAI) regime illustrates why legal auditability is conditional. The framework requires covered providers to maintain technical documentation for authorities and downstream providers, adopt a copyright policy and publish a public summary of training content. These are EU obligations for covered models and providers, not a worldwide definition of openness.

Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Article 53 documentation exemptions can apply to qualifying free and open-source releases, but the exemption is conditional. The European Commission’s materials state that it does not apply to GPAI models classified as having systemic risk. A model’s license or downloadable weights therefore do not, by themselves, determine its legal duties. Check the model category, provider role, deployment date and applicable EU guidance before relying on an exemption.
What are the main failure modes in open-model audits?
Open access removes some barriers but introduces its own traps.
Confusing a public file with complete openness
A downloadable checkpoint may omit training data information, source code, evaluation scripts, safety incident history or a permissive license. Record each missing component instead of labeling the release simply “open.”

Testing a different system from the one users receive
Local weights may not include the hosted service’s system prompt, retrieval layer, moderation model, tool permissions or quantization. Results from local inference can therefore overstate or understate production risk.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What are the main failure modes in closed-model audits?
Provider-controlled access creates different weaknesses.
Scope negotiated too narrowly
A provider may allow only a small prompt set, short sessions or preselected scenarios. Such access can miss rare failures, long-context behavior, tool misuse and interactions between safeguards.
Silent model or policy changes
An API can change weights, routing, system prompts or filters without changing its public name. Require version identifiers, release notes and advance notice where the audit’s conclusions depend on a stable target.
Evidence that cannot be independently checked
Aggregated benchmark scores or a summary of red-team findings are difficult to evaluate without test cases, sampling rules and failure counts. Ask for enough methodological detail to determine what the result means, even when sensitive material must remain confidential.
Best Value
Confidentiality blocking accountability
Non-disclosure agreements can protect proprietary information, but they should not prevent auditors from reporting material risks to regulators, affected customers or the public when necessary. Define escalation paths before testing begins.

How can an organization choose an auditable model?
Use an evidence-based procurement or deployment review rather than an open-versus-closed shortcut.
- Write the use-case risk statement: identify who could be harmed, how often the system acts, whether outputs affect rights or safety and what human oversight exists.
- Set minimum access requirements: decide whether you need local execution, source inspection, production logs, independent red teaming, data provenance or contractual audit rights.
- Request a documentation package: include model and version identifiers, intended uses, limitations, evaluation methods, known incidents, update policy, license or service terms and contact details for reporting issues.
- Test before deployment: run representative and adversarial cases, measure false refusals as well as harmful completions and test every tool or retrieval source that will be enabled.
- Verify operational controls: check logging, access management, retention, rollback, human review, rate limits and incident response. These controls often determine real-world safety more than the release label.
- Contract for change and disclosure: require notice of material model updates, cooperation with independent audits and a process for urgent vulnerability reporting.
- Record uncertainty: state which claims were verified, which rely on provider assertions and which remain unknown. Do not convert missing evidence into a clean bill of health.
What framework can structure the risk work?
NIST’s AI Risk Management Framework 1.0, published in 2023, offers a voluntary structure for organizations that design, develop, deploy or use AI systems. Its Govern, Map, Measure and Manage functions can organize responsibilities, context analysis, testing and risk treatment for either open or closed models. It is not an open-versus-closed scoring system, and NIST has reported a revision process, so organizations should check the current version and sector-specific obligations.
What is the practical verdict?
Open releases are potentially easier to scrutinize when they provide usable weights, documentation, reproducible tooling and licenses that permit independent work. Closed services can still be auditable when they offer stable versions, meaningful documentation, controlled external evaluation and access to the records needed for the claim under review. Neither format reveals every fact an auditor may need.
The defensible conclusion is conditional: identify the audit objective, list the required evidence, verify who can inspect it, and test whether another qualified party could reproduce the result. Treat openness as an enabler of scrutiny, not a safety guarantee; treat closed access as a constraint on outside inspection, not proof that no serious audit exists.

Frequently Asked Questions
Can you audit an AI model without downloading its weights?
Yes. Black-box testing can measure outputs, refusal behavior, robustness and tool use through an API or other interface. The audit should document the interface limits and distinguish findings about observed behavior from claims about hidden training data, internal mechanisms or unexposed safeguards.
What should an auditor do when a provider will not share training data?
Ask for a traceable description of data sources, collection dates, filtering, licensing and retention, plus evidence that privacy and copyright controls were applied. If the provider cannot disclose sensitive records, use a qualified independent assessor or regulator with appropriate confidentiality protections and mark any unverified provenance claims as a residual risk.
How often should a safety audit be repeated after deployment?
Repeat testing after any material change to weights, system prompts, tools, retrieval sources, moderation layers or user population, and after a serious incident. For continuously updated services, agree on a monitoring and regression schedule rather than treating one assessment as permanent.
Are openness scores from different transparency indexes comparable?
Not reliably. Each index defines its own criteria, weighting, model sample and publication year, and some measure documentation while others emphasize access to components. Compare the underlying dimensions and evidence, not the headline numbers across indexes.
