The Office of the Comptroller of the Currency (OCC) is encouraging community banks to consider participating in the payment-stablecoin market, including applying to become permitted issuers under the GENIUS Act. That is an invitation to evaluate a regulated business opportunity—not evidence that community banks are already issuing tokens, or that the OCC is currently accepting applications.

As of October 26, 2026, the OCC said its application and waiver intake had not opened. The agency is waiting for final Office of Management and Budget approval of the information collection tied to its forms. Its final rule was published October 23, 2026, and takes effect January 18, 2027.

What is the OCC asking community banks to do?

The OCC is asking community banks to consider entering the stablecoin payments market directly or through a subsidiary. CoinDesk reported on October 26, 2026 that the agency wants smaller banks to help shape payment infrastructure and compete with larger banks and crypto companies.

The invitation does not authorize a bank to launch a token immediately. A bank would still need to meet the GENIUS Act’s licensing and supervisory requirements, establish the necessary controls, and obtain permission through the applicable OCC process.

Can a community bank issue its own stablecoin?

Potentially, yes, but only as a permitted payment-stablecoin issuer under the federal framework and after the required application process. The GENIUS Act, signed July 18, 2025, establishes requirements for permitted and foreign payment-stablecoin issuers; the OCC’s rule implements that framework for issuers within its jurisdiction.

In the Federal Register, a stablecoin is described as a digital asset: a digital representation of value recorded on a cryptographically secured distributed ledger, such as a blockchain. A bank considering issuance would therefore be taking on a regulated token-issuance business, not simply adding a new payment button to its existing online-banking system.

Issuing a token

An issuer would be responsible for the stablecoin program and its compliance obligations. The available materials do not establish a universal launch cost, revenue model, required technology vendor, or likely adoption rate. Those economics would depend on the bank’s plan, scope and supervisory requirements.

Holding reserve deposits

A community bank could instead hold deposits that serve as reserves backing another issuer’s stablecoin. This is a reserve-bank relationship, not issuance of the token itself. The bank would need to assess counterparty, liquidity, operational, legal and compliance risks associated with the arrangement.

Using stablecoins for payments

A bank could use stablecoins or distributed-ledger technology to facilitate payments, or partner with a separate issuer or technology provider. In that model, the bank supplies a payment or infrastructure service around another party’s token rather than becoming the issuer.

What is the difference between the three entry routes?

Option What the bank does Regulatory question Primary burden
Direct or subsidiary issuance Creates and operates its own payment stablecoin Can it qualify and remain compliant as a permitted issuer under the GENIUS Act and OCC rule? Issuer governance, reserves, technology, consumer protection, compliance and ongoing supervision
Reserve-bank relationship Holds deposits backing another issuer’s token Can it safely provide the account and manage the issuer relationship? Counterparty, liquidity, operational, legal and financial-crime controls
Payment use or technology partnership Uses stablecoins or ledger technology to move money or provide services Does the activity fit the bank’s authority, risk profile and applicable law? Third-party, cybersecurity, settlement, operational and customer-treatment controls

OCC Bulletin 2025-2 treats these as separate supervised activities and expressly applies its guidance to community banks. A bank should not describe a reserve account or payment integration as equivalent to issuing a stablecoin.

When do the GENIUS Act rules take effect?

The OCC’s final rule was published in the Federal Register on October 23, 2026, and becomes effective January 18, 2027. The GENIUS Act itself became law on July 18, 2025. These dates establish the federal framework and the effective date of the OCC rule; they do not mean every bank can begin issuing on January 18 without approval.

What happens to existing issuers?

CoinDesk reported that an existing issuer that submits a substantially complete application by the rule’s effective date may request a temporary waiver to continue operating while the OCC reviews the application. The OCC has said it generally expects to grant waivers where appropriate, but a waiver is not automatic or guaranteed.

Can banks apply now?

Not according to the OCC implementation page available at the October 26, 2026 reporting timestamp. The OCC said it was not yet accepting applications or waiver requests. Intake will begin after the Office of Management and Budget gives final approval to the information collection associated with the forms, and the OCC said it will announce when submissions open.

Because this status can change, bank leaders should check the OCC’s current implementation and application notices before relying on the date. A bank should not treat the OCC’s public encouragement as evidence that a portal is open.

What would a community bank need to do before entering?

  1. Define the activity. Decide whether the plan is issuance, reserve deposits for another issuer, payment use, or a technology partnership. Each route has a different regulatory pathway and risk profile.
  2. Fit the plan to the bank’s strategy. OCC Bulletin 2025-2 says new crypto-asset activities should align with the bank’s overall plans and strategy and be conducted safely, soundly, fairly and in compliance with applicable law.
  3. Build governance and controls. Map responsibilities for board oversight, compliance, financial crime controls, technology, cybersecurity, liquidity, third-party management, customer disclosures and incident response before seeking approval.
  4. Prepare the application materials. The OCC’s forms and information-collection requirements will determine what an issuer must submit. Until intake opens and the final forms are available, no complete public checklist can be stated.
  5. Engage supervisors early. Discuss the proposed activity with the bank’s OCC supervisory team and document how risks will be measured, controlled and reported.

What risk standard will the OCC apply?

Regulatory permission does not reduce a bank’s ordinary safety-and-soundness duties. The OCC’s March 2025 release quoted Acting Comptroller Rodney E. Hood: “The OCC expects banks to have the same strong risk management controls in place to support novel bank activities as they do for traditional ones.” That statement is supervisory context for the newer invitation, not a new quote issued with the October 2026 report.

In practice, management should test whether the proposed activity can withstand technology outages, cyber incidents, liquidity stress, failed or delayed settlement, inaccurate reserve information, vendor disruption and customer complaints. Fair treatment and compliance obligations continue to apply when the payment rail is based on a distributed ledger.

What is not known yet?

  • No verified source establishes how many community banks will apply or launch a token.
  • The reviewed materials do not provide a universal cost, return, adoption forecast or measured effect on deposits or lending.
  • No approved stablecoin provider or required technology partner has been identified.
  • The OCC’s application-opening date remained pending final OMB approval at the stated reporting time.

Frequently Asked Questions

Does the OCC invitation mean community banks can issue stablecoins without a new license?

No. A bank would need to qualify under the GENIUS Act framework and complete the applicable OCC approval process. The invitation signals that participation is being considered, not that existing bank powers automatically cover issuance.

Are stablecoin reserve deposits insured like other bank deposits?

The materials covered here do not establish a special insurance treatment for reserves. A bank must analyze the legal structure, account ownership, deposit coverage and disclosures for each arrangement rather than assume that a token reserve has the same treatment as every ordinary customer deposit.

Will every stablecoin activity require an OCC application?

Not necessarily. Issuing a payment stablecoin is distinct from holding reserve deposits for another issuer or using a token in payments. The required supervisory pathway depends on the activity, the bank’s charter and the applicable law.

What should a bank do while the OCC application process is closed?

It can define the proposed activity, perform a risk and strategy assessment, build governance and controls, and discuss the plan with its supervisors. It should not represent that an application or waiver has been filed until the OCC announces that intake is open.
