Neither Microsoft Copilot nor ChatGPT can be called the more accurate legal researcher on the available evidence. No controlled, independent head-to-head study establishes a winner. Both can produce persuasive but false case names, quotations, citations or legal rules, so a lawyer must retrieve and check every authority in an official source before relying on it. The practical choice turns on the exact product (consumer or work version), account settings, data-retention terms, source traceability, jurisdiction and professional rules—not on the brand name alone.
Use either assistant for bounded tasks such as generating search terms, organizing issues or summarizing non-confidential text when your policy permits. Do not treat an answer as legal authority, and do not paste client material until your firm, client, court and privacy obligations have been checked.

Is Copilot or ChatGPT better for legal research?
There is no evidence here that establishes a universal accuracy winner. “Copilot” includes a consumer service and Microsoft 365 versions with organizational grounding, while ChatGPT behavior changes with the plan, sign-in state and workspace policy. A defensible comparison therefore asks which configuration can handle your data and verification workflow, not which logo appears on the screen.
For a lawyer, the decisive test is whether an output leads to a retrievable primary source and survives an independent check for jurisdiction, date, subsequent treatment and exact wording. Microsoft itself says that commercial Copilot responses are not guaranteed to be completely factual, and its consumer terms warn that sources may be unreliable or inaccurate. Microsoft Support likewise describes work-account Copilot Chat as potentially inaccurate, incorrect or out of date and treats its references as a starting point. Microsoft’s privacy and security documentation, consumer Copilot terms and Copilot Chat FAQ describe those limits.
#1 Best Overall
Legal Aid NSW gives the same warning in legal terms: a generative system may invent cases, statutes, quotations or principles, or apply law from the wrong jurisdiction. Its guidance says the user remains responsible for checking every fact, reference and explanation filed or relied on. Legal Aid NSW’s guidance is a useful practical baseline even outside New South Wales.
What do “Copilot” and “ChatGPT” mean in this comparison?
The products have materially different data paths. Identify the edition before comparing an answer or a privacy promise.
| Configuration | What it can use | Important qualification |
|---|---|---|
| Consumer Copilot | Conversation context and any material you provide through the consumer service | Microsoft’s consumer terms say sources can be unreliable, irrelevant or inaccurate and an answer can sound convincing while being wrong. Consumer terms do not establish the commercial Microsoft 365 commitments. |
| Commercial Microsoft Copilot | With permission, organizational documents, email, chats and meetings through Microsoft Graph | Microsoft says prompts, responses and Graph data are not used to train foundation language models. The statement applies to the described commercial service, not every Copilot product, and assumes tenant permissions are correctly configured. |
| Personal ChatGPT Free, Plus or Pro | Conversation content under the personal account’s controls | OpenAI’s current Data Controls page says model-improvement sharing is enabled by default, but the user can turn off “Improve the model for everyone.” Plan and sign-in state affect the controls. |
| Managed ChatGPT workspace | Workspace-controlled conversations and files, subject to the organization’s policy | Do not infer personal-account behavior. An administrator’s retention, access and model settings control the workspace. |
OpenAI documents the personal controls, Temporary Chats and plan dependence at Data controls in ChatGPT. Microsoft’s commercial statements are at Data, Privacy, and Security for Microsoft Copilot. Read the terms for the account actually used, rather than relying on a general claim that “Copilot” or “ChatGPT” is private.
Which assistant is more accurate with cases, statutes and citations?
Neither can be presumed more accurate. A fluent paragraph is not evidence that a case exists, that a quotation is genuine or that a rule remains good law.
Why legal hallucinations are dangerous
A model can combine fragments from real authorities, invent a plausible citation or give a correct rule from another country. Errors are particularly hard to spot when the output includes a realistic case name, reporter reference, pinpoint paragraph or quotation. A citation displayed by either assistant is a lead to investigate; it is not proof that the source exists, supports the proposition or applies in your court.
What an accuracy check must establish
- Identity: retrieve the actual judgment, statute, regulation or rule from an official court, legislature or authenticated database.
- Proposition: read the cited passage in context and confirm that it says what the answer claims.
- Jurisdiction: check the court, territory, governing law and procedural posture.
- Currency: search for appeals, overruling, amendments, later treatment and commencement dates.
- Quotation: compare every word and pinpoint reference; never file an unverified quotation.
- Scope: distinguish a holding from dicta, a general explanation from advice, and a fact pattern from a binding rule.
No percentage accuracy score, hallucination rate or controlled Copilot-versus-ChatGPT benchmark is established by the cited sources. Publishing one would create false precision.

How do Microsoft’s and OpenAI’s privacy controls differ?
The difference is configuration-specific: commercial Microsoft Copilot describes a no-training commitment for prompts, responses and Graph data, while personal ChatGPT gives users a model-improvement opt-out and a separate Temporary Chat mode.
Commercial Microsoft Copilot
Microsoft says prompts, responses and Microsoft Graph data in its commercial Copilot are not used to train foundation language models. Copilot can ground an answer in an organization’s documents, email, chats and meetings, but it surfaces that content according to the user’s existing permissions. Microsoft also says interaction data is stored in alignment with Microsoft 365 contractual commitments. These statements do not mean zero retention, universal coverage of every Copilot experience or a correctly configured tenant. A permission error could expose material to someone who already has excessive access, so administrators must review sharing and identity settings.
Personal ChatGPT
For Free, Plus and Pro personal workspaces, OpenAI says sharing data for model improvement is enabled by default. Turning off Improve the model for everyone prevents new conversations after the change from being used to train OpenAI models, although those conversations may remain in chat history. Temporary Chats are not used to improve models, do not appear in history and may be retained for up to 30 days for safety. The available controls depend on sign-in status, plan and workspace settings; confirm the current setting before each sensitive workflow.
Why retention and training are separate questions
“Not used for training” does not mean “never stored” or “accessible to nobody.” Ask separately where content is retained, for how long, who can administer or retrieve it, whether support personnel can access it, and how deletion requests work. The Office of the Australian Information Commissioner’s guidance treats accuracy, security, transparency and privacy risk as separate governance issues.
Can you put confidential client information into Copilot or ChatGPT?
Do not submit confidential or identifying client information until the applicable contract, firm policy, client instruction, account configuration and professional rules expressly permit it. Public guidance does not establish that either service is suitable for every confidential matter.
- Classify the material. Mark privileged, personal, health, financial, trade-secret and export-controlled data before choosing a tool.
- Check the governing duty. Review the retainer, nondisclosure terms, court order, firm data policy and applicable professional-conduct rules.
- Confirm the exact account. Record whether you are in consumer Copilot, commercial Microsoft 365 Copilot, personal ChatGPT or a managed workspace.
- Review settings and contracts. Check model-improvement, history, retention, administrator access, regional processing and deletion controls; obtain the provider’s current terms rather than relying on a marketing summary.
- Minimize the prompt. Remove names, file numbers, addresses and unnecessary facts. Use a fictional or public fact pattern where possible.
- Document approval. Keep a record of the tool, account, purpose, data class, settings and reviewer for an auditable matter file.
Microsoft’s professional guide advises lawyers to review provider data-protection commitments before entering confidential information. Legal Aid NSW gives a stronger public warning not to enter private, identifying or sensitive information into an AI tool. Those are risk controls, not a blanket authorization.

What is a safe legal-research workflow with either assistant?
Use the assistant for preliminary support, then move the legal work into authoritative sources and human review.
1. Define a bounded research question
State the jurisdiction, court, relevant date, procedural posture and the exact issue. “Find the law” is too broad; “List official authorities discussing whether a court may extend this deadline in [jurisdiction] after [date]” is testable.

Request alternative terminology, statutory sections to investigate, likely databases and factual distinctions. Ask the system to label uncertainty and to return links only when it can identify a source. Do not ask it to invent a citation to fill a gap.
3. Retrieve primary sources yourself
Open the judgment, legislation, regulation or official practice direction. Save the authoritative URL, version or PDF and access date. Secondary summaries can orient you but cannot replace the controlling text.
4. Verify every generated proposition
Use a source ledger with columns for proposition, authority, pinpoint, jurisdiction, current status and reviewer. Mark an item “unverified” until the source supports the precise sentence you intend to use.
5. Strip unsupported language
Delete invented quotations, broad claims drawn from narrow facts and statements that omit an exception or later amendment. If the source is silent, say that it is silent.
6. Keep a human lawyer accountable
Review, edit and quality-assure the final analysis. Microsoft’s lawyer guide summarizes the principle as: “Generative AI should be used as a copilot, not an autopilot.” The guide identifies confidentiality, accuracy, data privacy and intellectual property as considerations and says human oversight is essential. It is vendor guidance, not a regulator’s rule, but it captures the required workflow.
What court and professional rules can restrict AI use?
Rules vary by jurisdiction and can change, so check the current practice direction for the court in which you are appearing. Legal Aid NSW provides concrete examples that should not be generalized worldwide.
New South Wales courts
For Local, District and Supreme Court of NSW matters, Legal Aid NSW says generative AI must not be used to write or reword affidavits, witness statements, statutory declarations, character references and similar evidence or opinion documents. Some submissions or reports may be prepared with AI only when the required statement confirming that citations and authorities are real, accurate and relevant is included. Users remain responsible for anything filed or relied upon. See Using generative AI in the legal system for the current wording.
Federal Circuit and Family Court of Australia
The same guidance describes a requirement for closed AI that protects confidential and sensitive information in that court. “Closed” is a technical and contractual condition, not a label you can assume from a familiar brand; verify the court’s current requirements and your organization’s implementation.

Do not transplant the NSW examples into another court. Check local rules on disclosure, affidavits, submissions, expert evidence, privilege, confidentiality and records management before using generated text.

Best Value
| Situation | More relevant capability | Non-negotiable safeguard |
|---|---|---|
| Brainstorming terms for a public legal issue | Either assistant; compare the usefulness of suggested terminology | Verify all resulting authorities independently. |
| Summarizing a public judgment | Either, provided the judgment is supplied or linked from an authoritative source | Check the summary against the full opinion and preserve the original. |
| Searching internal Microsoft 365 material | Commercial Copilot’s permission-scoped Graph grounding may be operationally convenient | Audit tenant permissions and confirm the commercial service and contractual terms. |
| Personal account with sensitive text | Neither without a documented policy decision | Minimize or anonymize data; review model-improvement, history and retention settings. |
| Drafting a filing or evidence | Neither as an autonomous drafter | Follow the court’s practice direction and require lawyer review and source checks. |
Convenience is not authority. A tool that can see more internal material may increase both relevance and the consequences of a permissions or confidentiality mistake.
How should a firm decide between Copilot and ChatGPT?
Use a written decision matrix rather than a brand-level preference.
- License and identity: Is the account consumer, personal, commercial or administrator-managed?
- Data path: What is sent, stored, used for improvement, accessible to administrators and deleted on request?
- Grounding: Can the system point to a retrievable source, and are internal permissions correctly enforced?
- Jurisdiction: Can researchers constrain the task to the relevant court, law and date?
- Professional fit: Does client consent, privilege, a court rule or a firm policy prohibit the use?
- Auditability: Can the firm preserve prompts, outputs, sources, reviewer identity and final edits where its records policy requires?
- Failure response: Is there a process to notify a supervisor, client or court if an inaccurate or confidential output is discovered?
If the organization cannot answer these questions, use the assistant only with public, non-sensitive material or do not use it for the matter. The absence of a measured accuracy winner makes governance and verification the meaningful differentiators.
What are the main limitations to explain to a client or supervisor?
- Generated text can be fluent, incomplete, stale or factually wrong.
- A citation can be fabricated or can support a different proposition than the one stated.
- Training and retrieval do not guarantee current law, correct jurisdiction or good-law status.
- Privacy protections differ by account, plan, workspace, settings, contract and tenant configuration.
- Removing model-improvement use does not automatically remove chat history or other retention.
- Professional and court duties remain with the lawyer and filing party, not the software.
Explain those limits before a client assumes that an AI-generated memo is checked legal advice. The responsible description is an assisted research process with documented human verification.
Frequently Asked Questions
Can an AI assistant check whether a cited case is real?
It can help you search for a case name or quotation, but its confirmation is not conclusive. Open the judgment in an official court or legislation database, compare the passage and check later treatment before citing it.
Does turning off ChatGPT model improvement delete earlier conversations?
No. OpenAI says new conversations after opting out are not used to improve models, but they may remain in chat history. Temporary Chats have different history and safety-retention behavior, so review the current control description for the account you are using.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesWhat should a law firm record when it uses generative AI?
Record the account and workspace, data classification, relevant settings and policy approval, the research question, source links, reviewer and material edits. The record should make it possible to reconstruct what was generated and how each legal proposition was verified.
Can a lawyer use AI to summarize a confidential judgment?
Only after checking confidentiality, privilege, client instructions, court rules and the provider’s contract for the exact account. A public judgment may be suitable for a lower-risk workflow, while a confidential or identifying record requires an explicit, documented authorization.
