There is no single U.S. “medical device cybersecurity regulation.” Three different authorities address different risks: FDA law governs manufacturers submitting qualifying connected “cyber devices”; the HIPAA Security Rule governs covered entities and business associates protecting electronic protected health information (ePHI); and NIST publishes voluntary frameworks and implementation resources. An organization may need to follow FDA requirements, HIPAA safeguards, and NIST practices at the same time, but none substitutes for the others. FDA’s current premarket guidance is the February 2026 final edition. Section 524B of the Federal Food, Drug, and Cosmetic Act creates statutory submission duties for qualifying cyber devices, while HIPAA requires a documented, ongoing security program for ePHI. NIST can provide the practical structure for carrying out that work.
What are the medical device cybersecurity regulations?
Medical-device cybersecurity obligations depend on what is being regulated. FDA focuses on the device and its manufacturer, particularly when a connected device is submitted for marketing authorization. HIPAA focuses on organizations and vendors that create, receive, maintain, or transmit ePHI. NIST focuses on how an organization can organize cybersecurity risk management; its publications are not statutes or regulations.

These regimes can overlap in a hospital or health system. For example, a manufacturer may need FDA submission documentation for a connected infusion pump, while a hospital operating that pump must address access, integrity, availability, and incident risks under HIPAA if the environment handles ePHI. The legal duties arise from different sources and attach to different parties.
How do FDA, HIPAA, and NIST differ?
| Source | Regulated subject | Legal force | Lifecycle stage | Typical evidence or action | Responsible organization |
|---|---|---|---|---|---|
| FD&C Act section 524B | Qualifying cyber devices and their premarket sponsors | Statutory requirement | Covered premarket submissions, with postmarket duties | Vulnerability-management plan, cybersecure lifecycle processes, updates and patches, and a software bill of materials (SBOM) | Device sponsor or manufacturer |
| FDA February 2026 premarket guidance | Devices with cybersecurity risk and cyber devices | Agency recommendations; not the statute itself | Design, labeling, premarket documentation, and lifecycle planning | Recommended design, labeling, testing, monitoring, disclosure, patching, and submission documentation | Industry submitting devices and FDA reviewers |
| HIPAA Security Rule | ePHI handled by covered entities and business associates | Federal regulation | Ongoing safeguards and risk management | Administrative, physical, and technical safeguards supported by risk analysis and documentation | Covered entity or business associate |
| NIST SP 800-66 Rev. 2 and Cybersecurity Framework | An organization’s cybersecurity and risk-management program | Voluntary implementation guidance and framework resources | Continuous governance, risk assessment, and improvement | Control mappings, procedures, profiles, and implementation examples | Organization choosing to use the resources |
The practical mistake to avoid is treating the three as competing certifications. FDA authorization does not prove HIPAA compliance, HIPAA compliance does not authorize a device, and adopting NIST does not eliminate either legal obligation.

What does FDA section 524B require?
Section 524B was added by section 3305 of the Consolidated Appropriations Act, 2023, signed December 29, 2022, and became effective March 29, 2023. FDA says it applies to new qualifying premarket submissions made on or after that date. A previously authorized device can become subject to the requirements when a later modification requires premarket review.
Which devices are “cyber devices”?
FDA describes three criteria. The device must include software that the sponsor validates, installs, or authorizes as a device or in a device; it must be capable of connecting to the internet; and it must have technological characteristics that the sponsor validates, installs, or authorizes and that could be vulnerable to cybersecurity threats. All three elements matter; an internet connection alone is not the complete statutory test.

FDA identifies 510(k), Premarket Approval (PMA), Product Development Protocol (PDP), De Novo, and Humanitarian Device Exemption (HDE) pathways, along with specified supplements, when the submission concerns a qualifying cyber device. Sponsors should determine whether a planned supplement or change requires premarket review rather than assuming the original authorization settles the question.
What three duties must a sponsor address?
- Postmarket vulnerability plan. The submission must include a plan to monitor, identify, and address postmarket vulnerabilities and exploits within a reasonable time. It must include coordinated vulnerability disclosure, so researchers and other reporters have a defined way to communicate security findings.
- Cybersecure processes and updates. The sponsor must document processes and procedures that provide reasonable assurance that the device and related systems are cybersecure. The sponsor must make postmarket updates and patches available.
- Software bill of materials. The submission must include an SBOM covering commercial, open-source, and off-the-shelf software components.
These are statutory submission duties. The submission must provide information showing that the device meets section 524B(b), rather than merely asserting that the product is secure.

What does the FDA’s February 2026 guidance add?
FDA’s final document, Cybersecurity in Medical Devices: Quality Management System Considerations and Content of Premarket Submissions, was issued in February 2026 and supersedes the June 27, 2025 version. FDA describes it as recommendations about device design, labeling, and documentation that the agency recommends in premarket submissions for devices with cybersecurity risk.
Guidance is not the same as a statutory command. The FD&C Act supplies the binding section 524B duties; the guidance explains the evidence, processes, and lifecycle thinking FDA recommends sponsors use to demonstrate that those duties and broader quality-system expectations are addressed.
What lifecycle practices should manufacturers document?
- How the organization monitors vulnerabilities after release and triages their effect on device safety and effectiveness.
- How researchers, customers, and other reporters can disclose vulnerabilities through a coordinated process.
- How the manufacturer decides whether an update, patch, compensating control, or other mitigation is needed.
- How updates are developed, tested, distributed, and communicated to customers.
- How cybersecurity design decisions, assumptions, residual risks, labeling, and submission evidence are maintained through the device lifecycle.
FDA’s postmarket guidance emphasizes that a customer notice by itself may be inadequate. A response should include a practical strategy that reduces the risk of patient harm to an acceptable and controlled level.
Does HIPAA apply to medical devices?
HIPAA applies to covered entities and business associates that create, receive, use, or maintain ePHI, not to every device simply because it is used in healthcare. The Security Rule establishes national standards for protecting ePHI’s confidentiality, integrity, and availability through appropriate administrative, physical, and technical safeguards. It appears in 45 CFR Part 160 and Subparts A and C of Part 164.

A hospital, health plan, healthcare clearinghouse, or qualifying vendor may therefore have HIPAA duties involving a device when the device or its surrounding systems handle ePHI. A manufacturer that only sells hardware is not automatically a HIPAA-regulated business associate; its status depends on whether it performs functions involving ePHI for a covered entity or another business associate.
What safeguards does the Security Rule require?
The rule is scalable and technology neutral. An organization chooses reasonable and appropriate safeguards after considering its size, complexity, capabilities, infrastructure, costs, and the probability and criticality of risks. HIPAA does not mandate one product, one cloud architecture, or one universal security stack.
Recommended Free Tools
- Administrative safeguards: governance, assigned security responsibility, workforce procedures, contingency planning, and documented risk processes.
- Physical safeguards: controls for facilities, workstations, devices, and media that can expose ePHI.
- Technical safeguards: access control, audit-related capabilities, integrity protections, authentication, and transmission security suited to the organization’s risk.
The safeguards must protect all ePHI in the organization’s environment, including information moving through connected clinical equipment, interfaces, storage, and support services.
What is the difference between HIPAA risk analysis and risk management?
Risk analysis is the assessment; risk management is the action taken in response. HHS defines risk analysis as assessing threats and vulnerabilities that could affect ePHI confidentiality, integrity, and availability, including their likelihood and impact. Risk management is the actual implementation of security measures to sufficiently reduce the organization’s risk and meet the general security standards.

What should a risk analysis cover?
- Identify where ePHI is created, received, maintained, or transmitted, including device interfaces and connected systems.
- Identify reasonably anticipated threats and vulnerabilities affecting confidentiality, integrity, or availability.
- Assess the likelihood and potential impact of each relevant risk.
- Document the analysis, assumptions, systems examined, and conclusions.
HHS does not prescribe one risk-analysis methodology or one frequency that fits every organization. The analysis is ongoing: significant technology, workflow, threat, facility, or organizational changes can require an update, and the organization should retain documentation showing why its timing and scope were reasonable.
What does risk management do with the findings?
Risk management selects and implements safeguards, assigns responsibility, sets priorities, and tracks whether residual risk is acceptable. It can include access changes, segmentation, workforce procedures, vendor controls, backup and recovery measures, monitoring, or other protections. The resulting measures should be tied to the documented risks rather than copied from a generic checklist.
Is NIST mandatory for healthcare?
NIST is not a federal medical-device regulation and is not automatically mandatory for every private healthcare organization. NIST SP 800-66 Rev. 2, Implementing the HIPAA Security Rule: A Cybersecurity Resource Guide, was published in February 2024 and superseded Rev. 1 from 2008. It is practical guidance for regulated entities of different sizes.
NIST’s Cybersecurity and Privacy Reference Tool maps HIPAA Security Rule standards and implementation specifications to NIST Cybersecurity Framework subcategories and controls in SP 800-53 Rev. 5. Such mappings help a team translate a legal requirement into policies, technical controls, evidence, and accountable owners. They do not turn a NIST publication into a regulation or an FDA approval checklist.

How can an organization use NIST without overclaiming compliance?
- Use the HIPAA Security Rule and the organization’s own risk analysis to define obligations and priorities.
- Use SP 800-66 to find implementation ideas and terminology for those obligations.
- Map selected safeguards to NIST CSF outcomes or SP 800-53 controls when that improves governance, procurement, auditing, or communication.
- Document why controls were selected, how they operate, and what evidence demonstrates operation.
- Continue to evaluate compliance against HIPAA and any applicable state, contractual, or sector requirements; do not use a NIST profile as a legal safe harbor.
How should a manufacturer, hospital, or vendor combine the three?
A practical program starts by assigning each requirement to the party and lifecycle stage it actually governs.
- Classify the role and object. Determine whether the work concerns a device sponsor, a covered entity, a business associate, or an organization voluntarily structuring its security program.
- Screen for FDA section 524B. For a device submission, evaluate the three cyber-device criteria and the covered pathway. If applicable, prepare the vulnerability plan, lifecycle process documentation, postmarket patch commitment, and SBOM.
- Map ePHI flows. For a healthcare organization or vendor, identify every system, interface, device, and service that creates, receives, maintains, or transmits ePHI.
- Perform and document HIPAA risk analysis. Evaluate threats, vulnerabilities, likelihood, and impact across the environment, then record the scope and reasoning.
- Implement and monitor safeguards. Use administrative, physical, and technical measures selected for the documented risks. Include incident response, recovery, vulnerability handling, and supplier oversight where relevant.
- Use NIST as an organizing layer. Apply SP 800-66 and NIST mappings to assign owners, define measurable outcomes, and make evidence easier to review without presenting NIST as the source of the legal duty.
- Reassess after change. A device modification, new interface, software component, threat, merger, facility, or workflow can alter FDA submission needs or HIPAA risk and should trigger the appropriate review.
What common mistakes create compliance problems?
- Calling FDA guidance a law. Describe recommendations as recommendations and identify section 524B when discussing statutory duties.
- Assuming every connected device is covered by section 524B. Apply all three statutory cyber-device criteria and confirm whether the submission pathway is covered.
- Treating HIPAA as a product certification. HIPAA evaluates an organization’s safeguards for ePHI; it does not grant market authorization to a device.
- Doing a one-time risk analysis. HHS describes analysis as documented and ongoing, with timing driven by organizational circumstances and change.
- Using a NIST checklist as a substitute for legal analysis. NIST can structure implementation, but the Security Rule and FD&C Act remain the controlling authorities.
- Issuing a vulnerability notice without a mitigation path. FDA’s postmarket perspective ties communication to reducing patient-harm risk, not merely announcing a defect.
- Ignoring software components outside proprietary code. Section 524B’s SBOM duty includes commercial, open-source, and off-the-shelf components.
Is the proposed 2025 HIPAA cybersecurity update final?
No conclusion that it is final should be drawn from the proposal alone. HHS’s current Security Rule materials describe the rule in effect and list a separate proposed rule, titled HIPAA Security Rule to Strengthen the Cybersecurity of Electronic Protected Health Information, dated January 6, 2025. Unless HHS confirms a final rule, organizations should describe that item as a proposal and continue applying the existing Security Rule.
Frequently Asked Questions
Can a medical-device manufacturer be subject to HIPAA automatically?
No. HIPAA status depends on the manufacturer’s functions and access to ePHI. A manufacturer may become a business associate when it performs services involving ePHI for a covered entity, but selling a device alone does not automatically create that relationship.
Is an SBOM required for every FDA medical-device submission?
Section 524B’s SBOM duty applies when the submission concerns a qualifying cyber device and falls within a covered premarket pathway or supplement. The required inventory includes commercial, open-source, and off-the-shelf components; a non-cyber-device submission is not covered by that specific statutory duty.
Does using NIST provide a HIPAA safe harbor?
No. NIST resources can help an organization select, map, and document safeguards, but they do not replace the HIPAA Security Rule or determine whether the organization’s risk decisions are reasonable. Compliance still depends on the organization’s ePHI environment and documented risk management.
What happens when a device was authorized before section 524B took effect?
The original authorization is not the only relevant event. FDA explains that a later device change requiring premarket review can bring the device within section 524B requirements, so sponsors should assess the regulatory pathway for the change.
