India’s AI Governance Guidelines, unveiled by the Ministry of Electronics and Information Technology (MeitY) on 5 November 2025 under the IndiaAI Mission, are government guidance rather than a single AI statute. They set seven principles, expectations for developers and deployers, and a phased plan for oversight. In practice, an organisation using AI in India must already comply with applicable data-protection, information-technology, copyright, consumer-protection and sectoral rules, while putting documented controls around risk, human oversight, transparency, security and complaints.
For users, the promise is practical: understandable information about AI decisions, safeguards against foreseeable harm and a clear route to report problems. Some proposed institutions and implementing rules are still evolving, so organisations should check the latest MeitY notifications and sector-regulator directions before treating any recommendation as a settled legal obligation.

The guidelines are a cross-sector, technology-neutral governance framework. They combine seven guiding principles (sutras), recommendations grouped into six governance pillars, short-, medium- and long-term actions, and practical advice for industry, developers and regulators. They are designed to work with existing Indian law instead of replacing it with one omnibus AI act.
The seven sutras
| Sutra | What it means in practice |
|---|---|
| Trust is the Foundation | Build confidence through reliable performance, security, privacy and accountable decisions. |
| People First | Design systems around human welfare, dignity, accessibility and meaningful human control. |
| Innovation over Restraint | Use proportionate safeguards that manage genuine risks without blocking beneficial experimentation. |
| Fairness & Equity | Detect and reduce discriminatory outcomes, including impacts on vulnerable groups. |
| Accountability | Assign responsibility across the AI value chain and keep evidence that controls work. |
| Understandable by Design | Explain what a system does, how an output affects a person and what outcomes are reasonably likely. |
| Safety, Resilience & Sustainability | Prepare for failures, attacks, abnormal behaviour and environmental or operational strain. |
MeitY Secretary S. Krishnan described the approach as using existing legislation wherever possible and keeping human centricity at its centre. Principal Scientific Adviser Prof. Ajay Kumar Sood summarised the spirit of the framework as: “Do No Harm.”

Is AI regulated in India today?
Yes, but through a layered legal system rather than one comprehensive AI law. The guidelines tell organisations to identify every rule that applies to their use case and be able to demonstrate compliance when an agency or sectoral regulator asks.
| Area | How it can affect an AI deployment | Current position in the guidelines |
|---|---|---|
| Privacy and personal data | Lawful collection, purpose limitation, security and individual-data rights. | Comply with the Digital Personal Data Protection Act 2023 and applicable rules; implementation material is evolving. |
| Information technology | Platform due diligence, cybersecurity, online harms and intermediary responsibilities. | Use the Information Technology Act and IT Rules, including later amendments or guidance when in force. |
| Copyright | Training, storing, transforming or publishing protected works may create rights and licensing questions. | Assess copyright exposure for data, models, prompts, outputs and downstream distribution. |
| Consumer protection | Misleading claims, unsafe products, unfair practices and deficient services can trigger liability. | Keep marketing and automated decisions accurate, reviewable and consistent with consumer law. |
| Sectoral regulation | Finance, health, telecoms, education, employment and other fields have specialised duties. | Follow the relevant regulator’s directions in addition to cross-sector expectations. |
| Protection of vulnerable groups | Children, women and other protected or vulnerable people may face heightened risks. | Apply safeguards required by applicable statutes and proportionate controls recommended by the guidelines. |
MeitY’s policy index lists the Digital Personal Data Protection Rules 2025 and 2026 draft IT-rule amendments, including work concerning synthetically generated information. Draft or proposed material should not be treated as binding until formally notified.

What must a business do before deploying AI?
A deployment should pass a documented governance process before it reaches customers, employees or the public. The following sequence turns the voluntary recommendations into an operational control plan.
- Define the use and affected people. Record the purpose, data sources, users, decisions influenced by the system and foreseeable effects on customers, workers and bystanders. Note whether children or other vulnerable groups are involved.
- Map the legal and contractual duties. Identify applicable privacy, IT, copyright, consumer and sectoral requirements. Check vendor terms, data-location commitments, intellectual-property licences and any regulator-specific approval or reporting rule.
- Classify risk proportionately. Use an India-specific risk-classification approach as the guidance develops. Escalate systems that determine access to essential services, affect safety, process sensitive information or can cause significant financial, physical or reputational harm.
- Assign accountability across the value chain. Name owners for the model, data, product, security, compliance and incident response. Contracts with suppliers should state who monitors performance, handles complaints, preserves logs and notifies the other party about failures.
- Test fairness, security and performance. Evaluate representative Indian conditions, language and demographic groups. Add privacy-enhancing technologies, automated bias detection, adversarial and cybersecurity testing, anomaly detection and early-warning thresholds where appropriate.
- Build human oversight. Specify when a trained person must review, override or stop an output. Give reviewers enough context, authority and time; a nominal click-through approval is not meaningful oversight for a high-impact decision.
- Make the system understandable. Tell people that AI is being used when that information matters, explain the role of the output, describe likely consequences and provide a way to challenge an error, to the extent technically feasible.
- Prepare records and transparency reporting. Keep versioned model and data documentation, test results, decisions, incidents, overrides and corrective actions. Produce transparency reports that assess risks of harm in the Indian context when the deployment’s scale or sensitivity warrants it.
- Operate a grievance channel. Publish a clear contact route, acknowledge complaints, set reasonable resolution times and preserve an escalation path to a responsible human team or regulator.
- Plan for retirement and unlearning. Define how data, model versions and access credentials are withdrawn. Where feasible, use machine-unlearning methods to remove data that must no longer influence a system and document what was done.
How should high-impact or sensitive AI systems be governed?
High-impact systems need controls beyond ordinary product quality checks. The guidelines recommend a proportionate risk assessment, named accountability, human oversight, incident records and readiness for questions from regulators or customers.

Risk assessment that reflects Indian use
Assess severity and likelihood, not just technical accuracy. Consider language coverage, local social and economic conditions, connectivity constraints, accessibility, power asymmetries and whether an affected person can realistically obtain a human review. Reassess after a model update, a new data source, a change in purpose or a material incident.
Incident management
Define what counts as an AI incident, such as unsafe advice, discriminatory denial, privacy leakage, security compromise, fabricated evidence or an uncontrolled model action. Log the time, model version, input context, affected users, containment steps, root cause and corrective action. The proposed national, federated AI-incident reporting mechanism is intended to make lessons shareable while allowing sectoral regulators to retain responsibility.

Audits and benchmarks
Algorithmic auditing and automated bias detection are encouraged, alongside common benchmarks for provenance, cybersecurity and fairness. An audit should state its scope, limitations, test population, metrics, unresolved failures and the person accountable for remediation; a pass result is not a guarantee that every future output is safe.
What information and remedies should users receive?
The people-first and understandable-by-design principles point to four user-facing expectations: notice, meaning, protection and recourse.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
- Notice: Users should be told when an AI system materially participates in a service or decision, where that information is technically feasible and relevant.
- Meaning: Explain what the output represents, what it does not prove and how it may affect the person.
- Protection: Use safeguards for privacy, security, resilience, anomaly detection and early warning; apply stronger controls where children or vulnerable people are involved.
- Recourse: Provide a visible way to report AI-related harm, obtain a timely response and request human attention or correction when appropriate.
These expectations do not promise that every model can reveal its internal reasoning or that every complaint will end in a reversal. Explanations should be meaningful and technically feasible, and organisations still have to follow the specific remedies and appeal rights in the law governing the service.
Which institutions are expected to oversee AI?
The background framework proposes a coordinated architecture rather than a single super-regulator.
| Proposed or existing actor | Role |
|---|---|
| AI Governance Group (AIGG) | Strategic coordination across government and policy priorities. |
| Technology & Policy Expert Committee (TPEC) | Specialist advice on technical, legal and policy questions. |
| AI Safety Institute (AISI) | Testing, evaluations and safety research. |
| Sectoral regulators | Apply field-specific rules, approvals, supervision and enforcement. |
| Regulatory sandboxes | Allow controlled trials with defined safeguards and monitoring. |
Because these bodies and mechanisms are recommendations or proposals in the current guidance, their mandates, powers and reporting channels may change. A business should therefore monitor MeitY notices and the regulator for its sector instead of assuming that a proposed institution is already accepting filings.
How do India’s AI and data initiatives fit together?
AI governance is being developed alongside national compute and data infrastructure. The IndiaAI Mission reports a public-private plan for more than 38,000 graphics processing units, as well as datasets, indigenous-model development, skills and safe-and-trusted-AI initiatives. 38,000+ GPUs — Office of the Principal Scientific Adviser, Government of India, 2026. This is a planned capacity figure, not a count of machines available to every company or a measure of model safety.

The National Data Governance portal records Committee of Secretaries approval on 15 May 2026 and constitution of the National Data Governance Council on 22 May 2026. Its four pillars are policies, standards, platforms and governance. Organisations should expect data-access, provenance, interoperability and stewardship expectations to evolve as those pillars are implemented.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What is the likely implementation timeline?
The action plan is divided into short-, medium- and long-term work rather than a single compliance deadline.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →- Short term: clarify guidance, promote voluntary principles and standards, strengthen awareness, and begin practical safety, privacy and fairness measures.
- Medium term: develop risk classification, benchmarks, sandboxes, incident-reporting arrangements and stronger institutional coordination.
- Long term: evaluate targeted legal or regulatory changes, expand testing and assurance capacity, and deepen international cooperation.
The sequence means a company should start governance now, even when a later rule may refine the details. Waiting for an omnibus statute can leave an organisation exposed under laws that already apply.
What should a practical compliance file contain?
A concise evidence pack makes it easier to answer a regulator, customer or affected person.
Best Value
| File or record | Minimum useful contents |
|---|---|
| System register | Purpose, owner, supplier, model/version, users, data categories and deployment locations. |
| Impact assessment | Benefits, foreseeable harms, affected groups, severity, likelihood and mitigation decisions. |
| Data and rights record | Source, permissions, retention, copyright basis, security controls and deletion or unlearning process. |
| Evaluation pack | Accuracy, fairness, robustness, security, accessibility and local-language test results with limitations. |
| Human-control plan | Review triggers, reviewer competence, override authority, suspension procedure and escalation contacts. |
| Incident and complaint log | Reports, acknowledgements, resolution times, root causes, notifications and corrective actions. |
| Transparency material | User notice, explanation of outputs, known limitations, appeal route and any public reporting. |
What remains uncertain about the guidelines?
The document does not establish a nationwide statistic for AI-harm frequency, a standard compliance cost or a user-adoption rate. It also does not create a universal penalty schedule. Consequences will depend on the underlying law, contract, sector regulator and facts of a particular incident.
Institutions such as the AIGG, TPEC and AISI, a national incident-reporting mechanism, and several rule changes are described as proposed or evolving. Treating recommendations as mandatory can create unnecessary cost; treating them as optional forever can leave gaps in safety and evidence. The defensible approach is to implement proportionate controls now, record the reasoning, and update the file when MeitY or a sectoral regulator issues a binding direction.

Are India’s AI governance guidelines legally binding on their own?
No. They are government guidance and recommendations, not a standalone statute with a universal penalty schedule. Binding duties come from the laws and regulator directions that apply to the particular data, service, sector and harm.
Do small businesses or startups get an automatic exemption?
The guidance does not describe a blanket small-business exemption. Smaller teams can scale documentation and testing to risk, but they still need to identify applicable law, assign an accountable owner and provide a workable complaint route.
What evidence should I keep if an AI system harms me?
Save the notice shown to you, the relevant output, dates, account or transaction details, correspondence and any financial or physical impact. Ask the provider for a human review and a case number, then use the sectoral or statutory complaint channel if the response is inadequate.
Which regulator should a company contact about an AI deployment?
Start with the regulator responsible for the service—such as the authority supervising a financial, health, telecom or education activity—and monitor MeitY for cross-sector notices. The proposed national bodies are not a substitute for an existing sector regulator unless their final mandates say otherwise.
