Verify every material legal claim against the original authority before relying on AI-generated legal research. Confirm that each case, statute, rule, or regulation exists; read its authoritative text; check that it supports the exact proposition and quotation; then verify jurisdiction, later treatment, and current status. A plausible citation is not proof, and another AI tool is not an independent final check. For court documents, the responsible human must review and correct the work.
What does it mean to verify AI-generated legal research?
Verification means testing each important statement in an AI answer against the controlling primary source, not merely checking that a citation looks plausible or that a search result repeats the same summary. A case name and reporter citation may point to a real decision while still failing to support the proposition for which the AI used it.

The National Center for State Courts puts the discipline succinctly: “Never trust, always verify.” That does not mean every sentence in an AI answer carries equal risk. It means you must identify which statements matter, then establish what the underlying authority actually says and whether it governs the question at hand.

How do I verify an AI-generated case citation or legal answer?
Use a repeatable workflow that preserves the original answer, separates its claims, and connects each material claim to exact source text. Do not approve an answer merely because its citations exist.
1. Preserve the answer as received
Save the prompt, date, AI tool or model name if known, full response, citations, and quoted language. Keep this version unchanged before making corrections. That record lets a reviewer see what the system produced, what was checked, and what was later amended.

Separate statements about legal rules, case facts, procedural history, dates, and quotations. Mark the propositions that could affect a filing, a dispositive motion, a criminal matter, a rights-affecting decision, or a novel issue. A paragraph that sounds like one explanation may actually contain several independent claims, each needing its own source check.
For example, an answer might claim that a particular court decided a case, that the case adopted a rule, and that the rule controls a current dispute. Those are distinct questions: the decision must exist, its holding must support the rule, and its jurisdiction and subsequent history must make it relevant now.
3. Establish that every cited source exists
Search the exact case name and citation in an official court repository, a trusted case-law database, or a law-library database. For statutes and rules, use the legislature’s, regulator’s, or court’s official source. Check the actual source record rather than relying on an AI answer or a search-result snippet to confirm it.

If you cannot locate the cited authority, treat that citation as unverified and do not rely on it. A citation that appears convincing may still be fabricated or materially wrong. Finding a matching case record is only the first checkpoint, not a finding that the AI’s description is accurate.

4. Read enough of the authoritative text
Read the opinion or enactment itself, not only a headnote, abstract, excerpt, or secondary summary. For an opinion, understand the issue presented, procedural posture, relevant facts, holding, reasoning, and any dissent or concurrence that bears on the point. For a statute or rule, examine the operative text and the context needed to understand its scope.
This step catches errors that a citation search cannot: a real case may address a different issue, resolve a narrower question, or contain language the AI has taken out of context. The University of Alberta Libraries cautions that “AI-generated text is not a substitute for reading the primary sources (case law and legislation) on your topic.”
5. Match each claim to a pinpoint
For every material proposition, note the exact page, paragraph, or statutory or rule section that supports it. Record the proposition, the pinpoint, and why the cited text supports that proposition. If the source does not support the claim as written, narrow or correct the claim rather than stretching the source to fit.
Check quotations word for word against the primary text. Confirm that the words are attributed to the right speaker or court, that any omitted text does not change their meaning, and that the pinpoint leads to the quoted passage. A correct quotation can still mislead if it comes from a dissent, a party’s argument, or a passage that does not state the holding.

6. Confirm jurisdiction and precedential weight
Identify which court or lawmaking body issued the authority and which jurisdiction’s law applies to the question. Determine whether a case is binding or persuasive for the relevant court, and whether the AI has blended authorities from a different jurisdiction. A case can be genuine and accurately quoted yet still have little or no controlling force in the matter at hand.
Compare authorities on court level, jurisdiction, procedural posture, factual fit, and the distinction between holding and dicta. Also look for material differences between the cited facts and the problem being analyzed. The AI’s choice of a case does not itself establish that the case is the best or controlling authority.
7. Check current status and later treatment
Use ordinary citator or noting-up practice to find later decisions and identify overruling or negative treatment. For legislation and rules, check amendments and the version in force on the date that matters. Do not assume that a source remains current just because the AI supplies a recent-looking citation or quotes a familiar rule.
The relevant date can matter: a legal question may turn on what text governed when an event occurred, while a filing may also require checking the law currently in force. Make clear which version or period your analysis addresses, and verify it against an official source or the appropriate legal-research tools.
8. Look for missing authorities
Once the cited material is checked, compare the answer with human-authored legal research—such as a treatise, legal-research guide, court commentary, or other relevant analysis—to identify leading or binding authorities the AI omitted. This is a completeness check, not a substitute for verifying the primary sources that the answer did cite.

An answer can contain no fabricated citations and still be incomplete. Missing legislation, a controlling case, or an important later decision may change the analysis. For consequential work, assess both whether the cited material supports the stated proposition and whether important authority has been left out.
9. Record review and corrections
Document who performed the verification, when it was done, which sources were checked, what was corrected, and any unresolved limits. Preserve proposition-to-pinpoint notes alongside the saved AI answer so a responsible reviewer can trace the reasoning rather than relying on an unexplained “verified” label.
The Courts Service of Ireland states: “All court users are responsible for the content of their Court Documents notwithstanding the use of any GenAI Tool.” The Supreme Court of Victoria similarly warns that “it is not sufficient verification to ask an AI tool to confirm that the materials exist or contain the content that GenAI says they do.” Human review is substantive: the person approving the work must be able to explain how its legal claims were checked.
What should I compare when authorities conflict or appear similar?
Do not resolve competing authorities by counting citations or choosing the one that sounds most like the AI’s answer. Compare their legal force, context, and fit with the question, and check what law was in effect for the relevant period.
- Jurisdiction and weight: Which jurisdiction governs, and is each authority binding or persuasive there?
- Court and posture: Which court issued the decision, and what procedural question did it decide?
- Text and timing: What statutory or rule language applied on the relevant date, and has it since changed?
- Facts and fit: Which facts are material, and do meaningful distinctions limit the authority’s reach?
- Holding or dicta: What did the court actually decide, as opposed to discussing in passing?
- Later history: Has a later decision overruled, limited, or otherwise negatively treated the authority?
- Completeness and quotations: Are leading authorities or legislation missing, and does each quotation and pinpoint support the claimed use?
These comparisons help expose a common failure mode: an AI may produce a collection of individually real authorities but blur differences in court level, jurisdiction, posture, or legal status. Assess each source in the role it can actually play, rather than treating a list of citations as a coherent legal analysis.
How much scrutiny does AI-assisted legal work need?
Scrutiny should rise with the consequences of an error. Court filings, dispositive motions, criminal matters, decisions affecting rights, and novel issues call for the greatest care. Lower-risk background explanations still need source checks whenever they state a legal proposition; the lower stakes affect the level of review, not whether verification matters.
The University of Washington Gallagher Law Library reports an estimate that up to 40% of citations in AI-generated content may be hallucinated. The guide’s page is updated annually, and the figure is a contextual estimate—not a universal rate for every model, database, jurisdiction, or task. It should not be used to predict the reliability of a particular answer. Its practical lesson is to check citations independently rather than infer accuracy from a plausible-looking response.

What changes by jurisdiction before you file?
The verification principles are broadly useful, but procedural duties are not uniform across the United States, Canada, Ireland, Australia, or other jurisdictions. Court-document requirements, disclosure rules, confidentiality obligations, and databases accessible to you can differ. Before filing, check the controlling court’s current local rules and practice directions, and follow the requirements that apply to the specific court and document.
Do not treat guidance or a quotation from one jurisdiction as a universal rule for another. Confirm the source, date, and jurisdiction of any direction you rely on, and check whether it applies to the court user, filing, or kind of AI use at issue. Where the applicable rule or duty is unclear, resolve that question through the governing court materials and responsible legal review rather than by asking an AI system to decide it.
