A video game beer is officially licensed only when the game’s intellectual-property owner gives the brewer written permission to use its names, logos, artwork and other protected assets, normally with contractual quality-control rights. In the United States, that private licence is separate from federal alcohol approval. The Alcohol and Tobacco Tax and Trade Bureau (TTB) may approve a label for interstate sale through a Certificate of Label Approval (COLA), but a COLA does not prove that a publisher authorised the game branding.
That distinction matters for the three Grand Theft Auto-themed labels reported in the TTB database in September and October 2026. They have reported label approvals, yet neither Rockstar Games nor Tripping Animals Brewing has publicly announced a licence. By contrast, Carlsberg’s 2015 Fallout Beer in the United Kingdom and Jones Soda’s 2026 Vault-Tec Beverage Ration are documented collaborations.

What does “officially licensed” mean for a game beer?
An official product has a documented intellectual-property agreement between the game owner (the licensor) and the brewery or beverage company (the licensee). The agreement defines which marks may be used, on which products, in which territories and for how long. It normally also gives the licensor the right to approve artwork, packaging and other consumer-facing details.
A beer licence is usually limited to a product category. Permission to use a game title on beer does not automatically cover apparel, toys, a film or a new game. A licence can also be exclusive to one brewer, non-exclusive, limited to the United States or limited to a particular release window.

Trademark and copyright are different permissions
Video-game attorney Zachary Strebeck separates the rights this way: “Pokemon the word mark and the Pikachu logo? Those are trademarks. The character art, game code, and music? That’s copyright. You often need licenses for both, and one doesn’t cover the other.”
Applied to a can, a trademark licence covers the game title, logos, slogans, fictional beverage names such as Pißwasser or Nuka-Cola, and trade dress that signals an authorised source. A copyright licence is generally needed for character illustrations, key art, distinctive label artwork and other copied game assets. A campaign using a real performer, voice or music may require additional publicity or music rights.

Trademark owners must exercise reasonable control over licensed goods. If an owner lets another company use a mark without monitoring quality, a court can find a “naked licence” and treat the mark as abandoned. Strebeck cites Eva’s Bridal v. Halanick Enterprises, FreecycleSunnyvale v. The Freecycle Network and Blue Mountain v. Bliss Nutraceuticals as examples of this doctrine.
For beer, quality control can include a style guide, approval of the can illustration, review of the recipe presentation and a right to reject packaging that could confuse buyers about who made or sponsored the drink. A small trademark notice is useful, but an approval process and a named licensor are stronger evidence.
Does TTB label approval mean the beer is official?
No. A TTB COLA is a regulatory approval for a particular alcohol label, not a trademark licence. TTB checks whether the label is truthful, not misleading and complete under federal alcohol rules. It does not decide who owns a game brand or whether a publisher signed a merchandising agreement.
TTB’s Label Approval Basics explains that a COLA is required for malt beverages introduced into interstate commerce. The domestic bottler files it before bottling; an importer files before removing an imported product from Customs custody. Malt beverages sold only within the state where they are made generally do not need a COLA or certificate of exemption. The application uses COLAs Online and TTB Form 5100.31. There is no application fee, and TTB says approval often takes less than a week.
Formula approval may be required before the COLA when the beverage uses added flavours, colours, artificial sweeteners or other regulated ingredients. A COLA also does not finish state registration, advertising review, formula compliance or distribution permissions.

“A COLA does not grant trademark ownership and does not establish that the approved brand may be used without infringing another party’s rights.” — Cohn Legal, 28 August 2026.
What a COLA actually proves
- A specific label design was approved for the product and permit holder shown in the certificate.
- The label met applicable federal malt-beverage requirements when reviewed.
- The product may be eligible for interstate introduction, subject to other federal and state obligations.
What it does not prove
- That the game publisher owns or licensed the name.
- That the brewer owns a registration for the mark.
- That the beer has shipped, is on shelves or will launch on a particular date.
- That the label complies with every state’s registration and alcohol rules.
TTB may approve a brand name that resembles or even matches a competitor’s name because trademark ownership is outside the bureau’s label review. Approved, expired, surrendered and revoked certificates can be searched in the Public COLA Registry; rejected applications and formulas are not public.
What must appear on a US game-themed beer label?
Game artwork cannot replace mandatory alcohol information. Current guides applying 27 CFR Part 7 and Part 16 place the following items on a typical US malt-beverage label:
| Label element | What readers should look for | Rule |
|---|---|---|
| Brand name | The name under which the beer is sold; it must not mislead about identity, age or origin. | 27 CFR 7.64 |
| Class or type | Beer, ale, lager, stout, porter, malt beverage or another recognised designation. | 27 CFR Part 7, Subpart I |
| Brewer or importer | Name and address, with wording such as “Brewed by” or “Brewed and bottled by.” | 27 CFR 7.66, 7.68 |
| Net contents | US measure such as 12 fl oz; metric units may be added but not substituted. | 27 CFR 7.70 |
| Alcohol content | Federally optional for most beers, but required in specified cases and sometimes by states. | 27 CFR 7.65 |
| Conditional disclosures | For example, Yellow No. 5, sulfites at 10 ppm or more, aspartame/PKU language, or cochineal/carmine. | 27 CFR 7.63(b) |
| Government Warning | The statutory warning, reproduced exactly. | 27 CFR 16.21, 16.22 |
| Country of origin | Required for imported beer. | 27 CFR 7.69 |
The mandatory text must be readily legible on a contrasting background. Type is generally at least 2 mm on containers larger than half a pint and 1 mm on smaller containers. On common 12 oz and 16 oz packages, the Government Warning must be at least 2 mm high and use no more than 25 characters per inch.
The warning must read:
GOVERNMENT WARNING: (1) According to the Surgeon General, women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. (2) Consumption of alcoholic beverages impairs your ability to drive a car or operate machinery, and may cause health problems.
When a beer states its alcohol content, TTB’s tolerance is 0.3 percentage points in either direction. A label showing 6.0% may therefore test between 5.7% and 6.3%. TTB-facing labels generally use “ALC/VOL” rather than the abbreviation “ABV.”

How do trademark law and in-game references differ?
A fictional beer shown inside a game is not the same legal use as a beer sold in the real world. The Rogers v. Grimaldi test, used in many expressive-work cases, can protect a mark used artistically inside a game unless the use has no artistic relevance or explicitly misleads consumers about sponsorship.
The Ninth Circuit applied that reasoning in E.S.S. Entertainment 2000 v. Rock Star Videos, involving a strip-club mark depicted in Grand Theft Auto: San Andreas. The court said artistic relevance need only be “above zero” and found that a reasonable consumer would not assume the real club produced the game.
That protection is much weaker when a brewery puts the mark on the front of a competing product and sells it as beer. Strebeck identifies packaging, store pages, titles, downloadable content names and merchandise as trademark use that can be judged under ordinary likelihood-of-confusion principles. The Supreme Court’s Jack Daniel’s Properties v. VIP Products decision reinforces the risk when a mark functions as a source identifier on a consumer product rather than merely as commentary.
In practical terms, “the name exists in the game” is evidence of fictional world-building, not permission to bottle it.
Which game-themed drinks have documented licences?
Carlsberg Fallout Beer (United Kingdom, 2015)
Digital Trends reported that Bethesda and Carlsberg produced a limited Fallout Beer for the UK launch of Fallout 4. It was sold as cases of 12 bottles, advertised for £30 on Amazon UK, with shipping scheduled for 5 November 2015. The product was described as a light-coloured pilsner lager with zesty hop character and floral aroma. Its Vault-Tec-inspired presentation and the named Bethesda–Carlsberg collaboration make it a documented licensed alcoholic tie-in, but it was a UK release rather than a US national product.

The Licensing Letter reported Jones Soda’s 2026 return of the Vault-Tec Official Beverage Ration through its licensing collaboration with Bethesda Softworks. The run contains 12 flavours, including new Nuka-Orange, Nuka-Victory and Nuka-Cherry variants, and ships through national club-retail partners. It is soda, not beer, but it demonstrates the same licensing path: the publisher is identified, the product calls itself “Official,” and the beverage company uses approved Fallout branding.

Tripping Animals GTA-themed labels (United States, 2026)
Reports from GTAVice.net and TweakTown found three TTB-approved labels filed by Tripping Animals Brewing in Doral, Florida:
| Brand shown | Reported TTB approval | Reported details |
|---|---|---|
| Pißwasser | 29 September 2026 | Existing GTA fictional beer brand. |
| No Mames Vice City | 9 October 2026 | Reported as a 6% lager with GTA VI artwork and Vice City imagery. |
| Patriot | 15 October 2026 | Reported label slogan “Never Refuse a Patriot” and 4.2% alcohol by volume. |
These approvals show that someone prepared labels for bottling, but they do not establish a Rockstar or Take-Two licence. As of 29 October 2026, neither Rockstar Games nor Tripping Animals Brewing had publicly announced a collaboration. The products had no confirmed retail price, ship date, distribution map or launch-day status. TweakTown’s summary is the safe interpretation: TTB approval clears the artwork and wording for the packaging; it does not by itself establish authorised retail sale.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →How can you check whether a can is authentic?
Use several independent signals. No single badge or database entry proves official status.
- Find a publisher or brewery announcement. Look for a named collaboration, a press release or “used under licence from” language. “Official” should identify the licensor, not merely appear as decorative copy.
- Check the owner of the marks. Search the USPTO trademark database for the game title and fictional beverage name. Beer is generally International Class 32; wine and distilled spirits are generally Class 33. Older game registrations in Classes 9 and 41 still matter because a famous software mark can create confusion on related goods.
- Search the TTB registry. Match the brand, label image and bottler. A certificate under a different brewery does not authenticate the can in your hand.
- Inspect the legal copy. Confirm the brewer or importer, net contents, class/type and exact Government Warning. Missing or paraphrased mandatory text is a compliance warning.
- Check geography and channel. A UK limited run, a Florida taproom product and a nationwide US club-retail soda are different markets. A nearby real-world analogue—such as Doral for fictional Vice City—is not proof of authorisation.
- Separate announcement from availability. A COLA has no release date or price. Shelf timing depends on production, state registrations and distribution.
Can a brewery sell game-branded beer without the publisher’s permission?
It can apply for a COLA, and TTB can approve the label, without deciding whether the brewery has cleared the game owner’s rights. That does not make the product lawful. The publisher may demand that sales stop, bring trademark claims, and pursue copyright claims if the brewery copied protected artwork.
Trademark filings help an owner police this space. Bethesda’s Nuka-Cola filings covered games and merchandising, and a later “Nuka Dark” application listed liquor, bourbon, spirits, wine, beer, ale, lager and other alcoholic beverages. Those filings do not themselves prove that every later Nuka-branded drink is licensed; they show how an owner reserves categories before or alongside a beverage deal.

Entertainment licences commonly use royalties. Strebeck describes 5–15% of net receipts as a typical game or entertainment trademark range and 2–15% for consumer products, with exclusivity and high-profile deals often priced higher. These are practitioner benchmarks, not TTB fees or a published rate for any particular beer.

What changes could affect future labels?
TTB’s January 2025 Notice 237 proposals would add an Alcohol Facts panel with serving size, servings per container, alcohol by volume, calories, carbohydrates, fat and protein, plus major-allergen labelling. The comment period closed in August 2025, but the proposal was not final as of this research. A proposed five-year compliance period would apply only if TTB adopts a final rule.
Until then, collectors should apply the current Part 7 and Part 16 checklist, verify state requirements separately and treat a COLA as a regulatory document—not a certificate of fandom or publisher approval.
Licensed product versus lookalike: a quick comparison
| Question | Licensed product | Lookalike or unconfirmed product |
|---|---|---|
| IP grant | Written trademark and, where needed, copyright permission. | No public permission or only an unverified claim. |
| Quality control | Publisher reviews art and packaging under the agreement. | No evidence of licensor review. |
| Federal label gate | May have a matching COLA for the exact SKU. | May also have a COLA; that alone proves nothing about IP rights. |
| Credits | Named publisher, “used under licence” or official-partner wording. | Fan art, vague references or a disclaimer only. |
| Geography | Clearly stated territory and sales channel. | Unclear route to market or speculative launch claims. |
Frequently Asked Questions
Can a beer sold only in one US state skip a COLA?
Generally, a malt beverage sold only inside the state where it is made does not need a federal COLA or certificate of exemption. State alcohol authorities still regulate the label, production and sale, and an interstate shipment would trigger the federal requirement.
Do video game beer licences have to be exclusive?
No. A publisher can grant non-exclusive rights to several brewers or limit exclusivity to one territory, time period or product category. The contract controls whether another licensed beer can appear at the same time.
Can a TTB certificate be revoked after a beer launches?
Yes. Approved certificates generally do not expire, but TTB can revoke them or the holder can surrender them. A registry entry should therefore be checked for its current status, not treated as permanent approval.
What does the number on a TTB COLA identify?
The registry identifier encodes the year and Julian day received, the filing method and a daily sequence. For example, a prefix such as 26295 indicates the 295th day of 2026; it is an application identifier, not a trademark registration number or release date.
