Look for a clear, prominent disclosure that identifies a commercial relationship: “Ad,” “Sponsored,” or an explanation that the creator received money, a free product, a discount, or another benefit. Check the recommendation itself—not only a profile bio or video description—and inspect on-screen text and audio in videos. An AI-generated face or voice does not prove sponsorship; the key question is whether a marketer has an unexpected connection to the person or organization behind the recommendation. A platform’s paid-partnership badge can help, but the Federal Trade Commission (FTC) says it may not be sufficient by itself.

The FTC’s U.S. Endorsement Guides apply to advertising messages from human and virtual influencers. If a post lacks a disclosure, treat that as a reason to investigate, not proof that sponsorship exists or that a hidden deal is unlawful.

What makes an AI recommendation sponsored?

Under the FTC’s endorsement framework, an endorsement is an advertising message consumers are likely to believe reflects someone other than the sponsoring advertiser. Sponsorship depends on the commercial relationship and the context of the recommendation, not on whether the presenter is a human, an avatar, or a synthetic voice.

A material connection is any relationship that could affect how viewers evaluate the recommendation and that they would not reasonably expect. Common examples include:

Connection What to look for Why it matters
Payment A fee, commission, bonus, or other compensation The recommendation is part of a commercial arrangement.
Free or discounted product The creator received the item, access, or a price reduction The benefit can influence the recommendation even without a required post.
Perks and invitations Travel, event access, services, gifts, or special treatment Viewers may not expect the benefit when judging the endorsement.
Personal or family relationship A close connection to an owner, employee, or marketer Personal ties can affect credibility and are not obvious to the audience.
Employment or ownership The endorser works for, owns, or represents the company The commercial interest is direct, even if the post sounds independent.

The creator’s belief that the recommendation is honest does not remove the need to disclose a material connection. Conversely, enthusiastic praise without evidence of a connection does not establish sponsorship.

AI content is not the same as paid content

AI generation describes how a recommendation was produced. Sponsorship describes who has a commercial relationship with the recommendation. A fan can make an unpaid AI-generated review, while a company can pay for an avatar to promote its product. The facts about payment, benefits, ownership, and control are what determine the disclosure question.

How can you check a post step by step?

  1. Start with the recommendation itself. Read the opening caption, text beside the post, and any text over the image. In a video, watch and listen rather than relying on the description. Look for plain terms such as “Ad” or “Sponsored,” and identify the brand or benefit when it is stated.
  2. Check placement and prominence. A disclosure should be easy to notice without expanding a caption, opening a menu, or searching through comments. Tiny, low-contrast, rapidly disappearing text can be inadequate even when the right word appears somewhere.
  3. Review every format in which the endorsement appears. A campaign may have a feed post, story, short video, livestream, and repost. A disclosure in one format does not automatically cover the others.
  4. Look for the nature of the connection. Search the post and linked materials for statements that the product was gifted, supplied for free, discounted, or provided in exchange for coverage. Consider employment, ownership, family, and personal ties as well as cash.
  5. Treat platform labels as supporting evidence. A paid-content or partnership badge can confirm that a platform field was used, but it does not replace a clear disclosure in the endorsement itself.
  6. Separate facts from inference. Record what is explicit (“Sponsored by…”, “gifted by…”) and keep unexplained patterns—repeated praise, referral links, or unusual access—as indicators rather than proof of a secret contract.
  7. Check the claim separately. A disclosure tells you about the relationship. It does not prove that performance, safety, pricing, or other product claims are accurate.

What disclosure should you expect in each format?

Images, captions, and stories

The disclosure should appear where viewers see the recommendation, normally near the beginning of the caption or in readable text over the image. It should remain visible long enough to be read and contrast with the background. A label buried after a long block of hashtags, or one that requires tapping “more,” may not be prominent enough for a typical viewer.

Short-form and long-form video

For video, the disclosure belongs in the video itself. Use on-screen text and, when appropriate, spoken audio so viewers who do not read the caption can understand the relationship. A description-only disclosure can be missed when a clip is watched in a feed, embedded elsewhere, or shared without its description.

Livestreams

Repeat the disclosure periodically. A statement made only at the opening will not reach people who join later, and viewers may enter after the first notice has disappeared. Repetition is especially important when the stream lasts long enough for the audience to turn over.

AI-generated voice, avatar, or virtual influencer

Apply the same placement and clarity principles. If an avatar delivers a paid recommendation, the commercial relationship should be disclosed in the post, video, or stream. The FTC’s June 2023 revised-Guide announcement specifically clarified that endorsement coverage includes virtual influencers and social-media tags; it did not create a special AI-only disclosure phrase.

Which words make a disclosure clear?

Plain language is easier to understand than insider shorthand. “Ad” and “Sponsored” are generally clearer than a label that leaves viewers guessing about the relationship.

Wording or signal How to read it What may still be missing
“Ad” or “Sponsored” A direct indication of advertising The brand or type of benefit may need to be identified.
“Paid partnership with [brand]” Names a commercial relationship and the marketer Check that it appears in every format carrying the endorsement.
“Gifted by [brand]” or “received this product for free” Explains a non-cash benefit Confirm the wording is visible where the recommendation appears.
“Ambassador,” “partner,” or “collab” alone May suggest a relationship but is open to interpretation It may not tell an ordinary viewer whether money or products were involved.
“Thanks [brand]” Could be ordinary courtesy or a benefit disclosure It does not clearly explain the commercial connection by itself.

The FTC’s practical guidance favors disclosures that are clear, conspicuous, and close to the endorsement. Naming the brand or explaining the perk helps viewers understand what they are being told.

Can you rely on a platform’s paid-content tool?

Use a platform’s built-in label as an additional signal, not as a guarantee. The FTC has warned that a platform’s disclosure tool might not be an adequate disclosure in every context. The influencer and the brand remain responsible for making the relationship clear to the audience.

Check how the label appears on the device and format you are using. If it is hidden behind an icon, truncated, absent from a repost, or separated from the recommendation, look for a plain-language disclosure in the caption or content itself. A badge can be helpful evidence that a disclosure was attempted, but adequacy depends on what viewers actually see and understand.

What if there is no sponsorship label?

Do not jump from “no visible label” to “this is secretly sponsored.” A creator may have no connection to the marketer, the disclosure may be in another part of the content, or a repost may have removed it. The FTC emphasizes that whether a disclosure is sufficient depends on the facts and on how the audience is likely to understand the message.

Instead, document the observable clues:

  • Repeated recommendations that use identical talking points or unusual certainty.
  • A referral or discount code, shopping link, or instruction to buy through a particular channel.
  • Statements about receiving a product, trip, access, or other benefit.
  • Employment, ownership, family, or personal ties that are publicly disclosed elsewhere.
  • A platform partnership badge that appears without an explanatory caption.

Describe these as indicators unless you have direct evidence of a commercial agreement. If you contact the creator or brand, ask a specific question—whether the product was paid for, gifted, discounted, or provided under another arrangement—rather than asserting misconduct.

Does a sponsorship disclosure prove the product claims?

No. Disclosure and truthfulness are separate checks. A sponsored endorsement should not describe an experience the endorser did not have, and an advertiser should have evidence for claims that require substantiation. An AI avatar cannot honestly claim to have tested a device, used a service, or experienced a result unless the statement is based on a real, supportable experience.

When evaluating the recommendation, ask two independent questions: “What is the commercial relationship?” and “What evidence supports the product claim?” A clear “Ad” label answers only the first.

Are AI influencers held to a different disclosure standard?

There is no separate FTC shortcut for AI. The 2023 revised Endorsement Guides announcement clarified that virtual influencers fall within the scope of endorsements, along with social-media tags. The same expectations—clarity, prominence, proximity, and format-specific presentation—apply when an avatar or synthetic voice is used to deliver the message.

The AI system’s operator may be more important than the on-screen character. Identify who controls the account, who supplied the script or product, and who benefits from sales. A fictional persona can still carry a marketer’s message, and a real creator can use AI tools without having a sponsorship.

Where does U.S. guidance apply?

This explanation follows U.S. FTC guidance. The Endorsement Guides themselves do not have the force of law; they describe how Section 5 of the FTC Act may apply to endorsement marketing. The FTC evaluates individual facts and how the intended audience is likely to understand the message.

U.S. law can apply to posts made outside the United States when effects on U.S. consumers are reasonably foreseeable. Other countries may impose additional or different requirements. For example, the UK’s ASA/CAP influencer advertising guidance dated October 23, 2026 is a jurisdiction-specific reference, not a replacement for the U.S. analysis. If a campaign targets several countries, check the rules for each audience and platform.

What is a fast, reliable review checklist?

  • Relationship: Is there payment, a gift, discount, perk, employment, ownership, or personal connection?
  • Words: Does the post use an ordinary viewer-friendly term such as “Ad,” “Sponsored,” or a clear explanation of the benefit?
  • Placement: Can you see or hear the disclosure next to the recommendation without searching?
  • Format: Is it present in the image, video, story, livestream, and repost—not only in a profile or description?
  • Specificity: Does it identify the brand or explain what was received?
  • Evidence: Are you distinguishing an explicit disclosure from clues that merely suggest a relationship?
  • Claims: Are product statements supported independently of the sponsorship disclosure?

Examples of how to interpret common scenarios

An avatar says, “This headset changed my workflow,” with no label

The lack of a visible disclosure is a warning sign to investigate, not proof of payment. Check the account owner, links, codes, and any statement about receiving the headset. Also ask whether the avatar is presented as having personal experience that it cannot actually have.

A creator says “Sponsored by Brand X” in the first seconds of a review

That is an explicit disclosure of a commercial relationship. Continue evaluating whether the statement is visible and audible in the version you watched and whether the factual product claims have evidence.

A livestream opens with “partnered with Brand X,” then runs for two hours

The opening statement may not reach viewers who join later. Look for periodic reminders or a persistent on-screen disclosure so the relationship remains clear throughout the stream.

A post carries a partnership badge but no words

The badge is a clue that a platform field was used. Check how prominent it is and whether an ordinary viewer would understand the commercial relationship; the FTC does not treat the tool as automatically sufficient.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What should you remember?

Judge the relationship, not the realism of the influencer. A clear, nearby disclosure that names the advertising relationship or benefit is the strongest evidence of sponsorship. AI generation alone is not evidence, and an undisclosed-looking post alone is not proof; separate what the content shows from what you infer.

Frequently Asked Questions

Does an AI avatar have to disclose that it is fictional or computer-generated?

FTC endorsement guidance addresses commercial relationships, not a universal label for every synthetic character. An avatar may need a separate transparency notice under a platform’s rules or another law, but that is distinct from disclosing payment, gifts, or other benefits tied to a recommendation.

Can a disclosure in the comments count?

A comment can be missed, especially when comments are collapsed, filtered, or loaded after the recommendation. Because the FTC stresses proximity and prominence, a disclosure placed only in comments is harder to understand than one in the caption, video, or on-screen text.

What should a brand do when an influencer forgets the disclosure?

The brand should promptly correct or remove the content, add a clear disclosure in every affected format, and review its approval and monitoring process. Responsibility is not eliminated because the creator published the post or because a platform offered an optional label.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a creator disclose a free product even when the brand did not ask for a post?

Yes. Receiving a free or discounted product can be a material connection regardless of whether the marketer required coverage or dictated the opinion. The relevant issue is whether viewers would reasonably expect that benefit when judging the recommendation.
