To tell whether an AI company is telling the truth, turn each marketing statement into a narrow, testable claim and check whether the evidence measures that claim in the way you will actually use the system. A credible file identifies the exact product or model, version, configuration, date, users, data, test conditions, evaluator, results, uncertainty, limitations, and follow-up controls. A policy, benchmark badge, framework logo, or polished case study may show intent or one test result; none automatically proves that an AI system is accurate, safe, private, fair, or suitable for your deployment.

The practical standard is traceability: you should be able to move from a sentence in a sales deck to a defined test, inspect how it was run, see what failed, identify who reviewed it, and verify that the production system still matches the evaluated version.

What counts as evidence for an AI claim?

Evidence is information that can be tied to a specific claim, system, measurement method, and decision. The stronger the evidence, the fewer assumptions you must make between what a company says and what your users will experience.

Evidence level What it can establish What it cannot establish by itself
Claim or commitment The company’s stated intention or promise. That the system performs as promised in any particular setting.
Process document such as a policy, model card, system card, or transparency report The documented process, scope, owners, assumptions, and exclusions. That controls work in production or that results generalize to your users.
Observed test result A measured result for a named version under stated conditions. Performance outside those conditions, on a different version, or with different data and workflows.
Independent evaluation Additional scrutiny from an assessor outside the developer, if the assessor had meaningful access and disclosed its methods and conflicts. Complete assurance when the review excluded relevant tools, data, safeguards, or production behavior.
Operating evidence such as monitoring, incidents, corrective actions, rollback tests, and change logs Whether controls continued to work after deployment and how the company responds when they do not. Proof that future changes will have no new failure modes.

NIST’s AI Risk Management Framework (AI RMF) emphasizes rigorous testing, documented metrics and test sets, uncertainty measures, benchmark comparisons, formal reporting, and independent review. NTIA’s evaluation guidance likewise asks whether a system’s processes, controls, and performance are actually as claimed. Treat these as requirements for a reviewable evidence trail, not as a guarantee that every system meeting them is good for your use case.

How do I turn a broad AI promise into a testable claim?

Start by copying the company’s wording exactly, then narrow it until a reviewer could say what result would prove or disprove it. Do not silently remove qualifiers such as “for this model,” “in our test,” “with monitored access,” or “for selected customers.”

Rewrite universal language

“Our AI is safe” is not a testable proposition. A usable version might be: “Version 4.2 blocks at least 99% of the abuse scenarios in our defined test set, with human approval required before external actions, during monitored access in the European Union.” The rewritten claim tells you what to measure and exposes questions about the test set, threshold, geography, human review, and monitoring.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Separate several claims hiding in one sentence

A statement such as “enterprise-grade, accurate, secure, and compliant” contains multiple propositions. Accuracy, security, privacy, availability, fairness, and legal compliance require different evidence and may involve different teams and evaluators. Ask for a separate claim-and-evidence record for each material property.

Record exclusions

A company may have evidence for a chat interface but not for an agent that calls tools, retrieves customer records, or sends messages automatically. A result for a base model may not apply after fine-tuning, retrieval, a new system prompt, a safety filter, or a change in the data pipeline. Exclusions belong beside the claim, not in a footnote several pages away.

What context must be frozen before comparing evidence?

Write down the deployment context before you accept a result. NTIA frames substantiation around fitness for the intended, likely, or actual deployment, so a result detached from context is not enough.

  • System identity: product and model name, release or version, API or interface, system prompt or policy configuration, tools, retrieval components, and safety controls.
  • Time and place: test date, region, language, hosting arrangement, and applicable operating environment.
  • Users and uses: intended users, foreseeable misuse, accessibility needs, and whether a human reviews outputs before action.
  • Inputs: data sources, data quality, sensitive fields, customer-provided content, and any training or fine-tuning data relevant to the claim.
  • Consequences: what happens when the system is wrong, including financial, health, employment, legal, security, or reputational effects.
  • Production differences: latency fallbacks, model routing, updates, plugins, agent actions, logging, and rate limits that were absent from the test.

If any of these variables can change the risk or result, include them in the evidence request and in the contract or change-control process.

What proof should an AI startup or vendor show for each type of claim?

Match the requested proof to the property being advertised. A generic “benchmark report” is not a substitute for evidence designed around the specific risk.

Accuracy and capability

  • Define the task, acceptable error, and intended user decision.
  • Identify the test-set source, date, sampling method, exclusions, contamination checks, and whether examples resemble your data.
  • Report the metric, denominator, baseline, confidence or uncertainty, and separate results for important subgroups or task types.
  • Show representative failures, not only average scores, and explain how abstentions, retries, human edits, and rejected outputs were counted.
  • State whether the result came from a fixed model, a routed collection of models, or a changing production service.

Safety and security

  • Provide a threat model covering misuse, abuse, prompt injection, data exfiltration, unauthorized actions, and relevant supply-chain or infrastructure threats.
  • Describe safeguards, attack coverage, test prompts or scenarios, bypass rates, severity definitions, and residual risks.
  • Explain whether red-teamers had access to the same tools, permissions, data, and interfaces as real attackers.
  • Show retest results after mitigations and identify the person or group authorized to block a release.

Fairness

  • Define the affected population and the subgroup categories used in testing.
  • Report sample sizes, error rates, thresholds, missing-data treatment, and confidence intervals where appropriate.
  • Explain whether the tested groups match your geography, language, user base, and decision context.
  • Disclose groups that were not measured and risks that the chosen fairness metric cannot detect.

Privacy and data use

  • Request a data-flow diagram covering collection, prompts, logs, storage, retention, deletion, access, training use, and subprocessors.
  • Ask how customer data is isolated, whether staff or contractors can view it, and how deletion requests are propagated to caches, backups, and derived datasets.
  • Separate contractual promises from technical controls and from verified deletion or access tests.

Compliance

Identify the jurisdiction, legal role of each party, specific rule or standard, audit scope, and date. A voluntary framework, self-attestation, or logo can document an approach, but it is not automatically a legal certification or evidence that your particular deployment meets a regulator’s requirements.

Are AI benchmarks reliable?

Benchmarks are useful when the test set, metric, denominator, scoring procedure, uncertainty, and limitations are documented and the benchmark resembles the decision you need to make. A high score can be irrelevant when the system will see different languages, longer documents, adversarial inputs, private data, or tool calls.

Check what the score actually measures

Ask whether the benchmark tests the capability named in the claim or a convenient proxy. A coding score may not measure reliability in your repository; a toxicity score may not measure abuse prevention in your product; a factuality set may not measure citation accuracy with your retrieval system.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check denominator and selection effects

“95% accurate” is incomplete without the number and type of cases, class balance, abstentions, retries, and human corrections. A vendor can obtain a flattering result by excluding difficult examples, selecting only successful workflows, or counting multiple attempts as one answer.

Check repeatability and uncertainty

NIST says test sets, metrics, and evaluation-tool details should be documented so measurement can be repeated. Request the test materials or a reviewable equivalent, scoring code where feasible, randomization details, confidence intervals or other uncertainty estimates, and a record of changes since the result was produced.

Check for contamination and drift

Public benchmark items may have appeared in training data or prompt examples. Ask how contamination was considered and whether the score is stable across time. Production traffic, new model routing, altered prompts, and changing retrieval sources can create drift even when the benchmark score is unchanged.

How can I judge whether an “independent” evaluation is genuinely independent?

Independence is about incentives, access, and transparent methods, not merely an outside logo. NIST notes that independent review can reduce internal bias and conflicts, but the value depends on what the reviewer could inspect.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Identity and expertise: name the assessor, relevant qualifications, and the people who performed and approved the work.
  • Funding and conflicts: disclose who paid, commercial relationships, prior work, and any limits on publishing adverse findings.
  • Access: specify whether the assessor inspected the model, prompts, safeguards, data, logs, production configuration, and incident records—or only a demonstration environment.
  • Scope: list products, versions, regions, user groups, tools, attack classes, and dates included and excluded.
  • Methods and findings: provide procedures, sample sizes, severity definitions, failures, uncertainty, remediation status, and unresolved issues.
  • Follow-up: state whether the evaluator retested fixes and whether the company can change the system without notifying customers.

An external review that cannot see the component responsible for a risk may still be useful, but its conclusion must be limited to the inspected scope.

What operating evidence shows that controls work after launch?

Deployment records reveal whether a company converts findings into action. Look for a named decision owner, release thresholds, monitoring signals, incident routes, correction deadlines, and a trigger for reassessment.

Monitoring and incident records

Request aggregate monitoring results, alert definitions, severity levels, response targets, and examples of how alerts changed behavior. Incident summaries should explain impact, detection, containment, user notification, root cause, and corrective action without exposing unnecessary personal data.

Change control

Compare the evaluation date with later model, tool, policy, prompt, data, and infrastructure changes. A result can become stale after a material update. Ask for versioned release notes, approval records, rollback tests, and a notice period for changes that affect risk or performance.

Mitigation and retest evidence

A red-team announcement is not proof that a vulnerability was fixed. Require the original finding, the mitigation, the retest conditions, the remaining bypasses, and the owner responsible for monitoring recurrence.

What are the biggest red flags in AI evidence?

  • Universal language with no product, version, date, population, or deployment boundary.
  • Benchmark scores without test conditions, denominator, failure examples, uncertainty, or limitations.
  • Red-team publicity that omits scope, findings, access, or evidence that controls changed.
  • “Independent” reviews with no funding, conflict, methodology, access, or limitation statement.
  • A model-only evaluation when production adds retrieval, tools, agents, customer data, automated actions, or fallback models.
  • Policies, framework logos, or badges presented as proof of effectiveness or legal certification.
  • Incident claims without severity definitions, response targets, disclosure rules, or correction records.
  • Results that predate a material model, safeguard, tool, data, or deployment change.
  • Claims that rely on averages while withholding subgroup results, tail failures, abstentions, retries, or human intervention.
  • Refusal to provide a written claim, scope statement, or change-notification commitment.

How should a buyer compare two AI companies?

Use the same claim definitions and evidence questions for every supplier. A side-by-side scorecard prevents a polished presentation from outranking a less glamorous but more complete record.

Comparison axis Questions to ask Stronger evidence looks like
Claim scope What exactly is promised, for which version and users, and what is excluded? Plain-language boundaries tied to a dated configuration.
Test validity Does the test represent your data, workflow, threats, and consequences? Deployment-like scenarios, documented sampling, and failure analysis.
Data provenance Where did test and training data come from, and what quality checks were applied? Traceable sources, licensing or permission details, and known gaps.
Evaluator independence Who funded and performed the review, and what could they inspect? Conflict statement, meaningful access, methods, and limitations.
Reproducibility Can another qualified party repeat the measurement? Test materials, scoring rules, tool versions, uncertainty, and a change log.
Governance authority Who can delay a launch, require mitigation, or stop a feature? Named accountable owners and documented release gates.
Operational history What incidents occurred and how were they detected and corrected? Severity definitions, monitoring, response records, and retests.
Residual risk What remains unknown or unsafe after controls? Specific gaps, affected users, compensating controls, and review dates.

Do not collapse these axes into a single “trust score.” A vendor may have excellent capability results but weak privacy controls, or strong governance documents but little evidence that safeguards work under attack.

What should I ask an AI vendor before signing?

Send a written request and require answers that identify the system you will actually receive. Use this checklist in a procurement review:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. State each material claim in writing, including qualifiers and exclusions.
  2. Identify the product, model, release, configuration, interface, tools, regions, and evaluation date.
  3. Provide the test plan, benchmark or scenario provenance, raw or reviewable results, denominator, uncertainty, and failure examples.
  4. Explain data collection, quality, licensing or permissions, retention, deletion, training use, access, and subprocessors.
  5. Describe human oversight, approval points, escalation, and what happens when the system abstains or fails.
  6. Provide threat models, safeguards, attack coverage, incident history, monitoring, and mitigation-retest records.
  7. Name evaluators, funders, conflicts, expertise, access, methods, scope, and limitations.
  8. Show version history, release approvals, rollback tests, and notice procedures for material changes.
  9. Define contractual audit, evidence-access, incident-notification, data-deletion, and cooperation rights.
  10. Set a reassessment trigger for a model, prompt, tool, data, policy, region, or user-population change.

If a supplier cannot disclose sensitive details, ask for a controlled review by an independent assessor, a redacted report with verifiable scope, or contractual rights that let you validate the missing controls. “Confidential” should narrow the disclosure method, not erase the claim’s test conditions or limitations.

What does a defensible conclusion look like?

End your review with a bounded statement rather than “trusted” or “untrusted.” A useful form is:

For [product/version], assessed on [date] in [conditions], the evidence supports [narrow claim]. It does not establish [excluded claim]. Remaining uncertainty is [specific gap]. Before [use or decision], require [control, test, contract term, or monitoring].

This wording keeps the conclusion attached to the evidence. It also gives procurement, engineering, security, legal, and business owners a concrete action instead of a vague confidence label.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Why evidence must be revisited

AI systems are moving targets. A new model, system prompt, retrieval index, tool permission, safety filter, data source, routing rule, or user population can invalidate an earlier result without changing the product’s name. Treat the evidence file as a living release record: preserve the tested configuration, monitor production, log incidents and fixes, and rerun material evaluations when the system or its context changes.

The central test is simple: can you show, for the exact deployment under consideration, how the claim was measured, who checked it, what failed, and what happens next? If not, the statement remains a promise rather than demonstrated performance.

Frequently Asked Questions

Can a vendor refuse to share raw evaluation data and still be credible?

Yes, but it should offer a verifiable alternative, such as a controlled review by an independent assessor, reproducible scoring materials under confidentiality, or a redacted report that preserves scope, methods, failures, and uncertainty. If no qualified party can inspect the relevant evidence, treat the claim as unverified for a high-consequence decision.

How often should an AI system be reevaluated?

There is no universal calendar interval. Reevaluate whenever a change could alter behavior or risk—such as a model replacement, prompt or policy change, new tool permission, retrieval-data update, routing change, or materially different user population—and use ongoing monitoring to detect problems between formal reviews.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What is the difference between a model card and an audit report?

A model card is usually the developer’s description of intended use, limitations, data, and testing. An audit report is an assessment of defined criteria by a reviewer who should disclose methods, evidence access, conflicts, findings, and scope; either document can be incomplete, so read what each actually examined.

Does an AI safety certification guarantee my deployment is safe?

No. A certification applies only to the standard, scope, dates, configuration, and organization covered by it. Your prompts, data, integrations, permissions, human workflow, and legal context can introduce risks outside that assessment, so map the certification’s boundaries to your own deployment and test the gaps.
