Protect borrower data in AI mortgage software by treating the tool as part of your lender’s information environment—not as a separate, automatically safe service. Before enabling it, map the data it handles and the people and vendors who can access it; assess security, retention, and reuse; limit access to a justified need; and verify that staff can review its outputs and explain credit decisions. In the United States, the rules that apply depend on the institution, activity, data, transaction, and state law.

What should a lender do before enabling AI mortgage software?

Start with the specific use case, then trace the information through every system and organization involved. A document summarizer, an underwriting-support model, and a borrower-facing assistant may handle different information and create different risks. “We use AI” is not a useful data map: record which fields and files enter the feature, what it produces, and where both the inputs and outputs go.

Make an inventory before a pilot—not after the feature is connected to live loan files. Include information supplied directly by borrowers, information staff enter into prompts, documents the system scans, generated outputs, logs, and information derived from any of those sources. The Federal Trade Commission’s Safeguards Rule guidance emphasizes knowing where information is collected, stored, and transmitted. NIST’s Generative AI Profile recommends inventorying third parties with access to organizational content.

Map the full data path

For each category of information, record the application or system that collects it, each place it is stored, each transmission, who can access it, and how it is ultimately disposed of. Include the lender’s own systems and the vendor’s environment, along with any subcontractor or other service provider that receives or can reach the information. A diagram is useful, but a maintained inventory is the important part: it should be specific enough to support a security review, an incident investigation, or a borrower-data request.

Do not stop at the uploaded document. A prompt can disclose borrower details even if the system does not ingest the original file; a generated summary can reproduce sensitive content; and logs or derived information may be retained separately from the main application. Ask internal teams and the vendor to identify those flows rather than assuming they match the visible user interface.

Ask what the feature actually needs

For each use, identify the minimum borrower information necessary to produce a useful result. Ask whether particular fields or documents can be omitted, masked, or excluded from the feature. If the answer is that the model works better with more data, ask what that means for this use case and whether the added information is justified. An available input is not automatically a necessary input.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Document the intended purpose and the people who approve it. A feature introduced to organize documents should not silently become a tool for a different decision or a new kind of data analysis. Changes in purpose, configuration, model, or data flow should trigger review before they reach production.

What should you ask an AI mortgage software vendor about data use?

Get clear answers in writing about how the service handles borrower information, including information in prompts, files, outputs, logs, and backups. A product description or a promise that data is “secure” does not explain who can access it, whether it is reused, how long it remains, or what happens when the service changes or ends.

Clarify training, improvement, and reuse

Ask whether borrower information is used only to deliver the contracted service or also to train or improve a general-purpose model or other services. Identify the settings and contract terms that govern that use, including whether a setting can be changed by an administrator or overridden by a vendor update. Do not infer that data will be excluded from training just because a vendor describes the product as enterprise software, or infer that it will be used for training just because the product uses a general model.

Distinguish the vendor’s stated policy from the technical configuration in your institution’s account. Record who can verify the configuration and how the institution will learn about a change. If the vendor cannot explain the data-use boundary in terms that match the lender’s intended use, pause deployment until the uncertainty is resolved.

Identify subprocessors and locations

Request the names or categories of subprocessors that can receive or access borrower information, the purposes for which they do so, and the locations from which they handle it. Establish how the vendor assesses and monitors those providers and how the lender will be notified if the chain changes. A contract with the primary vendor does not, by itself, tell the lender who else may handle the information.

Set retention, deletion, and incident terms

Ask how long the vendor retains each relevant data type, including prompts, uploads, outputs, logs, and backups. Confirm how deletion works, whether the lender can request return or deletion when the relationship ends, and what evidence the vendor can provide. Ask how promptly the vendor will notify the lender of a suspected incident, who the lender can contact at any time, and what information will be made available to support investigation and response.

Also ask whether the institution can obtain access logs and evidence of control testing relevant to its risk review. Answers to these questions are practical diligence, not a claim that every question is separately mandated by law. The lender should match its review to its activities, applicable rules, regulator, contracts, and risk.

Which security controls should a lender review?

Evaluate the controls against the sensitivity of the information and the consequences of unauthorized access, alteration, loss, or disclosure. For institutions covered by the FTC Safeguards Rule, FTC guidance describes a written information security program that includes risk assessment, access controls, encryption, monitoring and testing, incident response, and service-provider oversight. Coverage depends on FTC jurisdiction and the rule’s definitions; institutions should check their own obligations and regulator requirements.

The FTC summarizes the rule as requiring covered financial institutions to “develop, implement, and maintain an information security program with administrative, technical, and physical safeguards designed to protect customer information.” That is a program-level obligation, not a certification that a vendor’s product is safe or that a single control is sufficient.

Review access, encryption, and monitoring

  • Access: Confirm that employees, contractors, vendor staff, administrators, and support personnel receive only the access needed for their roles. Ask how access is approved, reviewed, changed, and removed.
  • Encryption: Review how borrower information is protected in transit and at rest, and ask how encryption keys are managed. The existence of encryption does not answer who can decrypt or access the information.
  • Logs: Determine whether logs show relevant access and changes, how long the logs are kept, and whether the lender can review them during an investigation.
  • Testing and monitoring: Ask what testing and monitoring the vendor performs, how findings are addressed, and what evidence the lender can review. Evaluate the evidence in context rather than treating a vendor statement as a substitute for risk assessment.

Review change management and incident readiness

Agree how changes to the model, configuration, integrations, or data flows are communicated and evaluated. A product can change after initial approval, so identify who at the lender must assess a material change and what records they will retain. Ensure the vendor’s incident contacts and escalation process fit the lender’s own response plan, including the preservation of evidence needed to determine which information was affected.

Name an internal owner for the use case and a separate or appropriately qualified security reviewer. The business owner should understand why the feature is being used and what its outputs can influence; the security review should address data flows, vendor access, and safeguards. Compliance and legal teams should assess the rules that apply to the institution and activity rather than relying on a product label.

How do privacy rules apply when borrower data is processed by AI?

AI processing does not make privacy obligations disappear, and a feature’s technical ability to process information does not establish that the lender may collect, disclose, reuse, or retain it for every purpose. CFPB identifies non-bank mortgage lenders, brokers, loan servicers, and related businesses among entities that may be subject to Regulation P. Applicability depends on the entity and its activities.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Regulation P addresses privacy notices and limits on disclosure of information to nonaffiliated third parties, as well as redisclosure and reuse. CFPB’s text of Regulation B also says its general rules on information requests do not limit or displace federal or state privacy, privileged-information, credit-reporting, or similar restrictions. Map the proposed data use to the requirements that apply to your institution; do not treat a vendor’s ability to accept a file as permission to repurpose it.

State privacy, security, fair-lending, mortgage licensing, and contractual requirements may add obligations. The federal sources discussed here do not provide a complete survey of those requirements, so a lender operating across states should assess the relevant jurisdictions and its specific role in each transaction.

How can a lender keep AI-assisted credit decisions explainable?

Keep a reliable connection between a credit decision and the factors actually considered or scored. CFPB Circular 2022-03 says that ECOA and Regulation B require specific, accurate principal reasons for adverse action even when a creditor uses complex algorithms. A model’s opacity does not excuse an inadequate explanation.

Before production use, test whether the lender can produce accurate, case-specific reasons for adverse action and retain the records needed to review them. The notice must reflect factors actually considered or scored—not a plausible-sounding explanation generated after the decision. Include the feature in decision-governance and fair-lending review when it can influence a credit decision.

A vendor’s explanation feature is not proof that the lender’s notices are accurate. Validate its reasons against the actual data, model behavior, and decision process in the institution’s use case. If the institution cannot establish that the reasons are specific and tied to the factors considered, it should not rely on a vendor assurance as a substitute for a workable review process.

What does a real mortgage vendor incident show?

The FTC’s account of a case involving mortgage analytics firm Ascension Data & Analytics illustrates why the supply chain belongs in the lender’s data review. According to the FTC, a vendor hired by Ascension to scan mortgage documents using text-recognition technology stored document contents in plain text on a cloud server without protections such as a password. The FTC said those records included names, birth dates, Social Security numbers, and other personal information, and that the server was accessed dozens of times.

The FTC described the matter as allegations and finalized a settlement requiring stronger safeguards and vendor oversight. This case is an example of downstream vendor risk, not evidence that AI itself caused the incident or that all AI vendors handle information this way. Its practical lesson is to examine the controls and access of every provider that handles mortgage documents, including providers behind a primary technology vendor.

How should you compare AI mortgage software on borrower-data protection?

Use consistent questions across providers, and distinguish documented evidence from a feature claim or sales assurance. The following comparison axes synthesize CFPB adverse-action guidance, FTC safeguards guidance, and NIST supply-chain planning; they are an evaluation framework, not a certification or provider ranking.

Evaluation area Questions to ask
Data use and retention What information enters the system, how is it used, and when is it deleted or returned?
Access and security What access controls, encryption, logging, testing, and incident processes are documented?
Supply chain Which subprocessors have access, and how are they assessed and monitored?
Decision explainability Can the lender produce specific, accurate adverse-action reasons tied to actual factors?
Change management How are model, configuration, and data-flow changes communicated, evaluated, and recorded?
Evidence and oversight What logs, assessments, and contractual commitments can the institution review?

Score providers against the same use case and risk tolerance rather than selecting on a general claim such as “AI-ready” or “bank-grade.” If a provider cannot answer a material question, record the unresolved issue and decide whether the feature can be configured to avoid the exposure, whether additional contractual or technical controls are needed, or whether the use should not proceed.

What is a practical approval process for a new AI feature?

A repeatable approval process helps prevent a limited pilot from quietly expanding into a higher-risk production use. Keep a record of the intended purpose, information involved, vendor chain, controls reviewed, decision impact, and the people who approved the use.

  1. Define the use: Describe the task the feature will perform, the users, the workflow, and whether the output can influence eligibility, pricing, or another credit decision.
  2. Inventory the information: List inputs, documents, prompts, outputs, logs, and derived information, then map collection, storage, transmission, access, retention, and disposal.
  3. Review data use and vendors: Obtain written answers about training or improvement use, subprocessors, locations, deletion, incident notice, and available evidence.
  4. Assess applicable obligations: Have the appropriate legal, privacy, compliance, and security owners determine which federal, state, regulatory, and contractual requirements apply to the institution’s role.
  5. Test decision consequences: If the output can affect a credit decision, verify that the institution can identify factors actually considered and produce accurate adverse-action reasons.
  6. Approve with conditions: Record limitations, access approvals, monitoring expectations, change triggers, and the owner responsible for revisiting the approval.
  7. Reassess when the use changes: Reopen the review if the model, configuration, data, vendor chain, purpose, or decision role changes materially.

This process is a practical governance approach, not a universal legal checklist. The right control set depends on the institution’s risk and obligations. A lender should not assume that a successful pilot settles the questions for broader deployment, where more users, information, or decisions may be involved.

What should a lender do if the vendor cannot answer a key question?

Treat an unanswered material question as a risk to resolve, not as evidence that no risk exists. First determine whether the feature can be used with less information, a narrower configuration, or without influencing a credit decision. Then establish whether additional contractual terms, technical safeguards, or evidence are needed before proceeding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If the institution cannot identify where sensitive information goes, who can access it, how it is reused or retained, or how a consequential output can be reviewed, do not treat the feature as approved for that use. Escalate the uncertainty to the internal owner and relevant security, compliance, privacy, or legal reviewers. Record the decision and its conditions so that a later change does not bypass the original review.

This article reflects U.S. federal-source guidance reviewed on October 25, 2026, and is practical information rather than legal advice. CFPB’s Regulation B page reported 2026 amendments and said an updated version would be published soon; verify the current regulation and applicable state requirements before relying on it.

Frequently Asked Questions

Does using an AI mortgage tool require a separate privacy notice?

There is no universal answer established by the federal materials discussed here. Notice and disclosure obligations depend on the institution, the information, the recipient, and the applicable rules, so have counsel assess the specific deployment rather than assuming AI use always does—or never does—require a notice change.

Can a mortgage lender upload borrower documents to a general AI chatbot?

A tool’s public availability does not establish that it is appropriate for nonpublic loan files. Before any upload, the lender would need to understand the service’s data use, access, retention, subcontractors, safeguards, and applicable restrictions; absent that review, use a workflow that does not expose borrower information.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Who is responsible if an AI vendor exposes borrower information?

Responsibility depends on the parties’ roles, applicable law, and contracts, so it cannot be assigned categorically from the fact that a vendor was involved. The FTC’s Safeguards Rule guidance specifically includes service-provider oversight for covered institutions, making vendor selection and ongoing oversight part of the lender’s security governance.

Does the lender have to tell borrowers that AI was used?

The federal guidance summarized here does not establish a blanket disclosure rule for every AI-assisted mortgage workflow. The answer may depend on the use, the decision involved, the institution’s obligations, and state law; assess the precise feature and borrower communication rather than relying on a general yes-or-no rule.
