Copyright can protect the original expression of your game—such as source code, artwork, music, writing, and audiovisual files—but not the broad premise, genre, mechanic, or method of play. Protecting an unreleased concept therefore requires two tracks: document the human-authored expression for copyright purposes, and use practical secrecy controls before sending confidential material to an AI coding tool. The U.S. Copyright Office’s 2025 guidance says AI assistance does not automatically eliminate copyright, while prompts alone are not enough to establish human authorship. Tool policies also differ by plan and feature. GitHub’s 2026 Copilot policy change illustrates why you must check the exact account terms, retention, training settings, and context-sharing behavior immediately before use.
Can I copyright a game idea?
No. In the United States, copyright protects original expression fixed in a tangible form, not an abstract game idea. The U.S. Copyright Office states, “Copyright does not protect ideas, concepts, systems, or methods of doing something,” and its games guidance says, “The idea for a game is not protected by copyright.”
As an Amazon Associate I earn from qualifying purchases.
That distinction matters for an indie team using AI assistance. A pitch describing a time-loop detective game, a rule that combines cards with real-time movement, or a general progression system can remain outside copyright protection even when the concept is commercially valuable. Another developer could independently use a similar premise or mechanic without copying your protected expression.
Copyright may still cover the particular way you express that premise. Your original pitch prose, dialogue, lore, character illustrations, user-interface artwork, music, sound recordings, cinematic presentation, and qualifying source code can each contain protectable expression when created by a human and fixed in a tangible medium. Protection for those elements does not give you exclusive control over the underlying idea.

What copyright does not lock up
- A genre, theme, setting, premise, title, or high-level plot idea.
- Rules, procedures, systems, algorithms, methods of play, or functional game mechanics as abstract concepts.
- The general look or feel of a genre when no particular expressive work is copied.
What may be protected
- Original text in a design document, script, dialogue file, or lore bible.
- Original computer-program expression in source code, subject to the limits on ideas, logic, algorithms, systems, and methods embodied in that code.
- Original illustrations, models, textures, animations, interface art, music, sound effects, and audiovisual sequences.
- A creative selection or arrangement of otherwise unprotectable game elements, to the extent the arrangement contains sufficient original expression.
These are U.S.-framed principles. Copyright rules and registration practices can differ in other countries, so a cross-border release or team should obtain advice for the relevant jurisdictions.
Which game assets should I document first?
Start with a dated inventory that separates the idea from the files that express it. This gives you evidence of authorship, clarifies ownership among collaborators, and shows which materials must remain confidential.

| Material | U.S. copyright treatment | Practical record to keep |
|---|---|---|
| Premise, genre, mechanic, or method of play | Not protected as an idea or method by copyright. | Dated concept notes and confidentiality controls; do not describe copyright as making the concept exclusive. |
| Pitch text, dialogue, lore, and scripts | Potentially protected when original and fixed. | Original drafts, revision history, authors, and dated exports. |
| Source code | Copyright may cover original program expression, not the underlying logic, algorithm, system, or concept. | Version-control commits, authorship notes, generated-code review records, and access logs. |
| Art, animation, music, and audiovisual work | Potentially protected as original pictorial, audiovisual, musical, or related works. | Layered source files, project files, stems, model files, renders, and dated approvals. |
| AI-assisted output | Depends on sufficient human-authored expressive elements; assistance alone does not decide the result. | Prompts, candidate outputs, human edits, rejected alternatives, selections, arrangements, and integration commits. |
| Unreleased production information | May qualify for trade-secret treatment only while secrecy, value, and reasonable protection measures are maintained. | Classification labels, access lists, confidentiality terms, and disclosure approvals. |
Use source control for code and a comparable versioned system for art, audio, and documents. Preserve the original human files rather than keeping only a final build. A clear timeline showing who created, selected, edited, or combined each component is more useful than an undated folder full of exports.
Does AI assistance eliminate copyright in my game?
No. The U.S. Copyright Office’s January 29, 2025 announcement says generative-AI output can be protected where a human author has determined sufficient expressive elements. The question is the nature and extent of the human contribution, not whether an AI tool appeared somewhere in the workflow.
What usually counts as meaningful human contribution?
- Writing original code or substantially revising generated code.
- Choosing among multiple outputs and making creative decisions about composition, pacing, dialogue, visual design, or arrangement.
- Editing, combining, retouching, or integrating machine-generated material into a larger human-created work.
- Designing expressive elements that the tool merely helps implement.
The Office’s summary says merely providing prompts is not enough by itself. A detailed prompt can communicate an idea or desired result, but it does not automatically establish that the user authored the expressive details in the output. Keep records showing what you changed and why.
How should a small team maintain an authorship record?
- Create a project log with the date, contributor, asset or code path, and tool used.
- Save the relevant prompt and the unedited output when retaining that output is lawful and practical.
- Record the human decisions: what was selected, discarded, rewritten, redrawn, arranged, or merged.
- Commit the edited result with a meaningful message, such as “reworked enemy-state logic and rewrote dialogue branches.”
- Keep source layers, editable files, and intermediate versions so the final contribution can be explained later.
- Before a registration or dispute, review the current Copyright Office guidance because its AI analysis is developing.
Do not claim that every AI-generated image, line of code, or sound is automatically unprotectable. The result can contain protectable human-authored elements, but the scope may be narrower than the scope of a wholly human-created work.

Can someone steal my game concept if I use an AI coding assistant?
Copyright is not a complete answer for a confidential concept. If unreleased information has economic value because it is secret and you take reasonable measures to keep it secret, it may be a candidate for trade-secret protection. That protection depends on actual secrecy practices; it is not a blanket monopoly over a game idea.
What should remain confidential?
- Unreleased mechanics, level plans, narrative twists, characters, and production schedules.
- Private source code, build scripts, keys, credentials, telemetry, and backend architecture.
- Unpublished art, models, audio stems, design documents, and investor or publisher materials.
- Roadmaps, pricing plans, launch dates, and information received under another party’s confidentiality obligation.
What are reasonable secrecy measures?
- Give access only to people and services that need it.
- Use separate repositories or folders for public samples and confidential project material.
- Apply least-privilege permissions and multi-factor authentication.
- Use written confidentiality and intellectual-property agreements with employees and contractors where appropriate.
- Mark sensitive files and document who approved each external disclosure.
- Remove secrets from logs, issue trackers, crash reports, and copied prompts.
An NDA can impose contractual duties on a recipient, but it does not turn an abstract premise into copyrighted property or guarantee that a court will find trade-secret status. Its usefulness depends on the wording, the parties, the jurisdiction, and whether you actually treated the information as confidential.
How should I classify material before sending it to an AI tool?
Use a simple disclosure classification before every request. The safest default is to send only the minimum context needed to solve the problem and to keep the game’s distinctive commercial information out of the prompt.
Public or disposable
Examples include a generic programming question, a small self-contained test, or code you have already released under terms that permit disclosure. Even here, remove credentials and third-party material you are not authorized to share.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsInternal but non-critical
This may include boilerplate systems or a simplified reproduction. Replace project names, proprietary identifiers, narrative text, and unique mechanics with neutral placeholders. Confirm that the tool’s terms permit the intended use before uploading anything.
Confidential and commercially central
This includes unreleased mechanics, complete private files, distinctive art, source that reveals the product, credentials, and data covered by another agreement. Keep it out of hosted prompts and connected context unless you have verified contractual and technical controls that are adequate for the risk.

Restricted or legally sensitive
Never paste passwords, private keys, personal data, licensed assets with sharing restrictions, or a partner’s confidential information into a coding assistant. Route an unavoidable use through your security or legal review process.
What should I check in an AI coding tool’s terms?
Do not infer privacy from a “private repository” label or from the fact that an assistant runs inside your editor. Check the current terms and settings for the exact account, feature, model, and access method you will use.

- Identify the data path. Determine whether the request sends the prompt, selected files, open-editor buffers, repository history, diagnostics, telemetry, or retrieved documentation.
- Check retention. Find out whether inputs, outputs, snippets, and context are stored, for how long, and whether deletion controls exist.
- Check training and product-improvement use. Look for the default setting, the opt-out mechanism, and whether the rule differs for personal and organization accounts.
- Check feature differences. IDE extensions, web chat, command-line tools, code review features, and third-party model choices may have separate handling.
- Check organizational terms. Read the customer agreement, data-processing terms, subprocessors, and administrator controls that apply to a team account.
- Check context controls. Verify whether you can exclude files, disable repository indexing, restrict directory access, or turn off automatic context collection.
- Recheck after changes. Revisit the policy before a plan renewal, model switch, major feature update, or new integration.
Save a dated copy or internal note of the terms and settings you relied on. A policy that is acceptable for generic scaffolding may be inappropriate for a complete unreleased project.
What does GitHub Copilot’s 2026 policy change show?
GitHub Copilot is a dated example of why plan-specific checking matters; it is not a universal description of coding assistants. GitHub announced on March 25, 2026 that a change would take effect April 24, 2026.
| Copilot plan group | Policy described by GitHub for the April 24, 2026 change | What a developer should verify |
|---|---|---|
| Free, Pro, and Pro+ individual users | GitHub says interaction data—including inputs, outputs, code snippets, and associated context—may be used to train and improve models unless the user opts out. | Whether the opt-out is enabled in personal settings, what features generate interaction data, and whether a later terms change alters the setting. |
| Business and Enterprise users | GitHub says customer data for these plans is not used to train AI models and that the April 24 change does not affect them. | The organization’s agreement, administrator settings, retention, subprocessors, and the behavior of each enabled feature. |
GitHub’s documentation also says individual subscribers can opt out in personal settings and that Business and Enterprise customer data is not used to train AI models. These statements apply to the documented plans and dates. They do not establish how another vendor, a third-party model, a different Copilot feature, or a future policy will handle data.
Before using Copilot on a sensitive project, open the current policy and account settings, confirm the plan tier, inspect what context the extension sends, and document the result. If you cannot establish that the handling is suitable, do not provide the confidential material.

What is a safer AI-assisted coding workflow?
A safer workflow reduces both the amount of information disclosed and the chance that generated material is accepted without review.
- Prepare a sanitized reproduction. Copy the smallest failing function or create a toy project. Replace names, story text, unique constants, endpoints, and proprietary data.
- Strip secrets. Remove API keys, tokens, passwords, private certificates, signing material, and internal URLs. Rotate a credential immediately if it was exposed.
- Disable unnecessary context. Turn off automatic repository-wide indexing or exclude directories containing design documents, assets, credentials, and unreleased code.
- Ask a narrow question. Request an explanation, test idea, or generic pattern rather than uploading the whole architecture.
- Review every output. Check correctness, security, license compatibility, performance, and whether the output reproduces material from an unknown source.
- Rewrite and integrate deliberately. Make the human design decisions, edit the code, and record the changes in version control.
- Run normal engineering checks. Use tests, static analysis, dependency review, and manual code review; an assistant’s confidence is not evidence of correctness.
- Record the disclosure. Note the tool, plan, feature, date, data class, settings, and files shared.
When a local or restricted workflow is preferable
If the information is central to the game’s value, the risk may justify a workflow that does not transmit the material to a hosted service. The appropriate choice depends on your technical ability, security requirements, model behavior, and contractual terms; no particular product or paid tier is universally required.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if confidential code or assets were already sent?
Treat an accidental disclosure as an incident, not as proof that the game is lost. The next steps depend on what was sent, to which account, under which terms, and whether the data was retained or used for training.
- Stop further transmission and preserve the relevant prompt, output, timestamp, account, feature, and settings.
- Identify the exact files, snippets, credentials, personal data, and third-party material included.
- Revoke or rotate exposed credentials and invalidate affected tokens.
- Use the service’s deletion, privacy, or administrator controls where available, and record the request and response.
- Read the applicable retention and training terms to understand what the provider says about the data.
- Notify collaborators, clients, publishers, or other parties if an agreement requires notice.
- Ask qualified counsel whether contractual, trade-secret, privacy, copyright, or security actions are appropriate.
- Update the workflow, repository exclusions, permissions, and staff guidance so the same path cannot recur.
Do not promise that deleting a chat retroactively erases every copy, backup, log, or model-training use. Only the provider’s current terms and a confirmed response can establish what happened.

Copyright analysis cannot substitute for clear agreements. A small team should decide in writing who owns contributions, what license applies to pre-existing tools and assets, who may use AI services, and who is responsible for reviewing outputs.
- Define whether a contractor assigns rights or grants a license, and when that transfer occurs.
- List pre-existing code, art, libraries, music, and tools that remain owned by their original contributors.
- Require disclosure of third-party and AI-assisted material when it enters the project.
- Set confidentiality duties, permitted tools, repository access, return or deletion obligations, and incident-notification procedures.
- Specify review standards for licenses, attribution, security, and unsuitable generated content.
- Keep contributor identities and signed agreements with the project’s authorship records.
These contracts can allocate rights and duties among the parties, but they cannot make an unprotectable game idea copyrightable. They also cannot override a third party’s terms if your team lacks the right to share that third party’s confidential material.
Best Value
Should I register the game with the U.S. Copyright Office?
Registration is a separate decision from protecting a concept. Copyright protection generally arises when original authorship is fixed; publication is not a prerequisite. Registration can provide procedural advantages in enforcement, but it does not convert an abstract premise, title, or method of play into protected expression.
For an AI-assisted submission, describe the human-authored portions accurately and follow the Office’s current application requirements. Your project log should make it possible to identify which code, text, art, music, or audiovisual elements were created, selected, edited, or arranged by people.
What mistakes most often expose an indie game?
- Assuming “private repository” means private prompts. Repository storage and assistant transmission are different data paths.
- Pasting the whole project for convenience. Large context increases disclosure without guaranteeing a better answer.
- Leaving automatic context enabled. An extension may include open files or repository material you did not intend to send.
- Relying on prompts as proof of authorship. The Copyright Office says prompts alone are insufficient.
- Calling every generated result unprotectable. Human selection, editing, arrangement, and integration can matter.
- Using an NDA as a substitute for security. Contract language cannot repair unrestricted access or careless disclosure.
- Ignoring plan changes. A setting or policy that was acceptable last year may not remain so.
- Failing to preserve drafts. Without history, it is harder to show human contribution, ownership, or the source of a disputed asset.
How do I choose a disclosure level for each task?
Match the workflow to the sensitivity of the material, not to the convenience of the tool.
| Task | Recommended input | Stop and reassess when |
|---|---|---|
| Learn a language or API | A generic example with invented names and data. | The answer requires proprietary architecture or credentials. |
| Debug a small function | A minimized, sanitized reproduction and error message. | The reproduction reveals a unique mechanic, secret, or private endpoint. |
| Refactor a subsystem | A redacted interface and representative code, after checking terms and context controls. | The assistant would need repository-wide access or unreleased design files. |
| Generate narrative, art, or audio direction | Generic prompts or material you are authorized to disclose. | The request includes confidential plot twists, characters, commissioned work, or partner material. |
| Handle production credentials or release infrastructure | No credentials or private keys; use controlled internal procedures. | Any tool requests secrets, unrestricted logs, or access to a production environment. |
The governing principle is simple: disclose less, document more, and verify the exact terms before each material change. Copyright protects the expression you create; secrecy controls protect information only while you actually keep it secret; and an AI assistant’s plan label never replaces reading its current data practices.
Frequently Asked Questions
Does a private Git repository stop an AI assistant from seeing my code?
Not necessarily. An editor extension or chat feature may transmit open files, selected snippets, repository context, diagnostics, or history to the service even when the repository itself is access-restricted. Check the feature’s context and retention settings separately from repository permissions.
Can an NDA protect a game mechanic from being copied?
An NDA can create contractual confidentiality duties for the people or organizations that sign it. It does not make a mechanic copyrightable, bind unrelated third parties, or guarantee trade-secret protection if you failed to use reasonable secrecy measures.
What evidence should I keep for AI-assisted art or code?
Keep dated source files, version-control history, prompts, candidate outputs, rejected alternatives, and notes describing human edits, selections, arrangement, and integration. Preserve contributor identities and agreements so the human contribution can be explained without relying on memory.
Do copyright rules for AI-assisted games apply outside the United States?
Not automatically. The guidance discussed here comes from U.S. sources, and other countries may apply different authorship, registration, moral-rights, or database rules. A team releasing internationally should obtain advice for the countries that matter to its project.
