Keep a human reviewer accountable for decisions that need judgment, and preserve a record that lets the lender reconstruct how each case was handled. That record should connect the information available at the time, the model and policy in effect, the system’s output, the reviewer’s actions, the final decision, and—where relevant—the reasons given to the applicant. The exact fields and review process depend on the use: credit-decision explanations, covered automated valuation models (AVMs), and Fannie Mae’s seller/servicer expectations apply in different circumstances.

What does an accountable AI mortgage workflow need to record?

A useful audit trail is a reconstruction of the decision path, not just a stored score or a note that someone clicked “approve.” A later reviewer should be able to tell what information the system received, what it returned, how the lender’s policy treated that result, what a person did, and what action the lender ultimately took.

The field list below is an implementation recommendation inferred from the cited legal and investor materials; it is not a verbatim regulatory checklist. The rules and guidance discussed here do not prescribe this exact schema.

  • Use and authority: workflow stage, purpose, affected loan population, decision authority, and whether the model advises, routes, or makes a recommendation used by a decision-maker.
  • Inputs and provenance: material values as they stood when the decision was made, their sources, and relevant timestamps. Retain what is needed to explain the decision, while limiting unnecessary sensitive data and protecting records under applicable privacy and security controls.
  • System context: model or vendor, version, configuration, and the policy or thresholds active at that time. Preserve exception, uncertainty, or other relevant flags along with the output.
  • Human action: reviewer identity and role, time, information presented, action taken, rationale, correction requests, escalation, and any override. Keep the model’s output distinct from the person’s decision.
  • Outcome and communication: final action and, when an adverse-action notice is required, the reasons communicated to the applicant and their connection to the factors actually considered or scored.
  • Change history: effective dates, approvals, testing evidence, and remediation associated with model, vendor, configuration, threshold, or policy changes. Make it possible to identify which version applied to a given decision.

A final score without its inputs, version, policy context, and handling history is difficult to interpret later. Conversely, collecting every available data point “just in case” can create privacy and security risks without improving the decision record. Define the record around what is material to reconstructing the workflow and demonstrating that controls operated.

Which rules apply to which mortgage AI uses?

There is no single rule that applies in the same way to every mortgage AI tool. ECOA and Regulation B govern adverse-action explanations for credit decisions; the federal AVM rule covers specified valuation uses; and Fannie Mae’s AI/ML letter applies to covered seller/servicers and their relevant loans.

Framework When it matters Central expectation
ECOA, Regulation B, and CFPB circulars Credit decisions resulting in adverse action Give specific, accurate principal reasons tied to factors actually considered or scored, regardless of the technology used.
Federal AVM rule Specified AVM uses by mortgage originators and secondary market issuers in covered credit decisions or securitization determinations involving a consumer’s principal-dwelling collateral Maintain controls addressing confidence, data integrity, conflicts, random sample testing and review, and nondiscrimination.
Fannie Mae Lender Letter LL-2026-04 AI/ML used by covered seller/servicers in origination or servicing of loans sold to or guaranteed by Fannie Mae, or serviced for it Establish AI/ML policies and risk management, communicate with staff, review policies at least annually, oversee vendors, and provide specified information upon request.

These frameworks are not interchangeable. For example, the AVM rule does not prescribe a universal human-review recipe for every mortgage AI tool, and Fannie Mae’s letter should not be treated as a requirement for every lender. Identify the use and the organization’s role first, then determine which obligations apply.

How should a lender handle adverse-action reasons?

When a credit decision results in adverse action, the reasons communicated must be specific and accurate descriptions of the principal factors actually considered or scored. A black-box model does not excuse a creditor from that responsibility.

CFPB Circular 2022-03, issued May 26, 2022, says ECOA and Regulation B apply regardless of the technology used. It states that a creditor cannot rely on an algorithm that prevents it from identifying and giving the specific reasons for adverse action. CFPB Director Rohit Chopra put the point plainly: “Companies are not absolved of their legal responsibilities when they let a black-box model make lending decisions.”

Regulation B § 1002.9 requires a statement of the specific principal reason or reasons. A statement that points only to internal standards or says an applicant failed to achieve a qualifying score is insufficient. Reasons must relate to and accurately describe factors actually considered or scored; a lender should not infer a reason after the fact simply because it sounds plausible.

CFPB Circular 2023-03, issued September 19, 2023, cautions against using a sample checklist whose selections fail to identify the actual principal reasons. A notice-generation process therefore needs a validated path from the decision record to the reason codes and plain-language explanations. The reviewer should be able to confirm that the selected reasons fit the case rather than merely accept a default list.

Build the reason mapping into the decision process

  1. Capture factors at decision time. Preserve which factors the model or decision process actually considered or scored, together with the relevant output and policy context.
  2. Map only supported factors to reason codes. Maintain a clear relationship between the recorded factor and the reason text used in the notice. Do not select a generic explanation simply because it is available.
  3. Check the case-specific explanation. Before notice delivery, validate that the reasons describe the actual principal factors for that application. Route unclear or unsupported mappings for resolution rather than inventing a reason.
  4. Retain the communication record. Keep the final action and the reasons actually communicated connected to the decision record, so a later examination can compare the explanation with the underlying factors.

This is a practical control design, not a prescribed technical format. The essential point from the CFPB materials and Regulation B is that the reason must match what actually drove the adverse action.

When does the federal AVM rule apply?

The rule applies to specified automated valuation model uses in covered mortgage credit decisions and certain securitization determinations about a consumer’s principal-dwelling collateral. It does not sweep in every use of AI or every property valuation workflow.

The six federal agencies’ final rule was published in the Federal Register on August 7, 2024, and became effective October 1, 2025. Its scope concerns AVMs used by mortgage originators and secondary market issuers when determining collateral value in connection with covered credit decisions or securitization determinations. The rule excludes some uses from the relevant scope, including monitoring mortgage quality or performance, reviewing valuations that have already been completed, and developing an appraisal by a certified or licensed appraiser.

For covered uses, institutions must maintain policies, practices, procedures, and control systems designed to:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Ensure a high level of confidence in estimates produced by AVMs.
  • Protect against the manipulation of data.
  • Seek to avoid conflicts of interest.
  • Require random sample testing and reviews.
  • Comply with applicable nondiscrimination laws.

These are control objectives, not a single mandated reviewer sequence. A lender can use human review as part of its control design, but should not assume that a person’s approval alone satisfies all five objectives. The record should show how the institution’s controls address the covered AVM use and how testing or review findings are handled.

What does Fannie Mae expect from covered seller/servicers?

Fannie Mae Lender Letter LL-2026-04 addresses seller/servicer AI/ML use in the origination or servicing of loans sold to or guaranteed by Fannie Mae, or serviced for it. The letter was published April 8, 2026; Fannie Mae’s official page says it was updated October 21, 2026.

  • [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by

The letter calls for transparent policies and procedures, trustworthy and ethical AI/ML, understanding of relevant legal and regulatory requirements, risk management that reflects the organization’s risk tolerance, a responsible owner, security and resiliency controls, and governance of vendors and subcontractors. It also calls for staff communication and at least annual policy review.

When requested, covered seller/servicers must promptly disclose the types of AI/ML used, their purpose and manner of use, safeguards, and other requested information. A current inventory is therefore useful: it helps an organization describe the systems in use and explain how they are governed. The letter’s expectations are specific to its covered seller/servicers; they should not be generalized to all lenders.

How can a lender build human review into the workflow?

Human review should be a control with defined authority and evidence of work, not a ceremonial approval step. The reviewer needs enough relevant case information and model context to assess the issue, plus a clear route to pause, correct, override, or escalate.

1. Inventory each AI/ML use

Record where the tool operates, what it is intended to do, which loan population it affects, its material inputs, the model or vendor, the decision authority, and the policy and rule scope. Distinguish an AVM valuation use from other credit-decision support, and distinguish a model that advises a person from a process that routes or produces a decision. This inventory supports risk management and, for covered Fannie Mae seller/servicers, the ability to respond to disclosure requests.

2. Define escalation triggers and authority

Set triggers for cases that should receive a trained human’s attention. Practical examples include incomplete or conflicting information, unusual cases, low confidence, policy exceptions, and other cases outside the tool’s intended operating conditions. These triggers are recommended control design, not a universal regulatory list.

Specify what the reviewer may do: pause the workflow, seek a correction, request further information, override a recommendation, or escalate to someone with greater authority. A meaningful review assesses relevant evidence and the model’s role; recording an acknowledgment of a score is not equivalent to recording the person’s reasoning.

3. Present the evidence needed to review

Show the reviewer the material information and its source, the model output, relevant flags, and the policy context for the case. Keep enough context to understand why the case was routed for review and what the system contributed. Avoid a screen that displays only a score if the reviewer is expected to evaluate the basis for action.

4. Capture the reviewer’s independent action

Log who reviewed the case, their role, when the review occurred, what information they saw, what they decided, and why. Record corrections requested, escalations, and overrides. Separate the model’s recommendation from the reviewer’s final action so the record shows who exercised decision authority.

5. Close the loop with testing and governance

Review patterns in errors, exceptions, overrides, and other outcomes to identify where controls may need attention. For covered AVM uses, this sits alongside the rule’s required random sample testing and reviews and its other control objectives. For covered Fannie Mae seller/servicers, connect findings to ongoing risk management, vendor oversight, and the required annual policy review.

Document remediation and changes. When a model, vendor, threshold, or policy changes, preserve effective dates, approvals, and testing evidence so the organization can identify which version applied to a particular decision. That change history is a recommended way to make the workflow reconstructable, not a specific field list prescribed in the cited materials.

How should a lender compare workflow or governance tools?

Evaluate whether a system can produce a reconstructable case record and support the controls relevant to the lender’s use. A feature list alone cannot establish that a lender’s process complies with law or investor expectations; assess the configured workflow, record quality, access controls, and governance responsibilities.

  • Can it preserve input provenance and model or vendor version lineage?
  • Can it connect adverse-action reason codes to factors actually used and retain the explanation communicated?
  • Can it record reviewer identity, authority, rationale, timestamps, escalations, and override reasons separately from model output?
  • For covered AVM uses, can it support random sample review and testing and preserve evidence of findings and remediation?
  • Can it document policies, approvals, model changes, vendor or subcontractor oversight, and review history?
  • Can it export a complete case record for an audit or examination?
  • Can it enforce role-based access, retention, and security controls appropriate to lender data?

Ask for a sample exported case record and trace one hypothetical decision from inputs to final action. Check whether the export identifies the version and policy in effect, shows the reviewer’s distinct contribution, and preserves the reasons actually communicated where applicable. These are selection criteria derived from the governance needs described above, not endorsements of particular products.

What common audit-trail failures should teams prevent?

Several recordkeeping shortcuts make it harder to show how a decision was reached or whether a control worked. Treat them as design risks and test for them during workflow reviews.

  • Saving only the final score: Without the input snapshot, system version, and policy context, the score cannot reliably reconstruct the case.
  • Blurring model and human authority: If the record labels a model recommendation as the final decision, it obscures who acted and what review occurred.
  • Using a standard reason list without case validation: A convenient checklist can produce vague or inaccurate adverse-action reasons when it does not fit the actual principal factors.
  • Recording an override without rationale: The action alone does not explain why the reviewer departed from the model output or whether the case was handled under policy.
  • Leaving version changes untraceable: Without effective dates and decision-to-version linkage, a lender may not know which configuration or threshold applied to a past case.
  • Treating a human sign-off as the entire control: Review does not replace the distinct control objectives applicable to covered AVMs or the accurate-reason requirements for adverse action.

Build periodic case sampling into governance so the organization tests the record itself, not just whether a workflow field was completed. The sources establish relevant duties and governance expectations; they do not establish that any particular lender or vendor has implemented them effectively.

Frequently Asked Questions

Does Regulation B specify how long an AI mortgage audit trail must be kept?

The provisions and guidance discussed here do not establish a single retention period for the recommended AI decision-record fields. A lender should determine applicable record-retention obligations for its situation rather than treating this implementation list as a retention rule.

Does a human approval make an AI mortgage decision compliant?

No. Human review is one possible control, not a substitute for accurate adverse-action reasons or the control objectives that apply to covered AVM uses. The reviewer’s role and actual work should be clear in the record.

Can an AI model’s score be used as the adverse-action reason?

A score-only explanation is not enough when it fails to identify the specific principal factors actually considered or scored. Regulation B § 1002.9 rejects a statement that merely says an applicant failed to achieve a qualifying score.

Do Fannie Mae’s AI/ML expectations apply to every mortgage lender?

LL-2026-04 addresses covered Fannie Mae seller/servicers and AI/ML used in specified origination or servicing activities. It should not be read as a universal rule for every lender or every mortgage workflow.
