Autonomous weapons should be governed by a layered set of safeguards: ban systems that cannot be reliably understood or that autonomously target people; tightly limit every other system’s targets, location, duration and scale; preserve informed human judgment and the ability to stop an engagement; and require legal review, realistic testing, records and accountability. International humanitarian law (IHL) already applies, but the International Committee of the Red Cross (ICRC) says new binding rules are needed to make the limits clear. The issue is not whether a weapon uses automation at all; it is whether, after activation, it selects and engages targets without further human intervention.
What counts as an autonomous weapon?
An autonomous weapon system is one that, once activated, can select and engage targets without further human intervention, according to the ICRC. The defining feature is autonomy in the critical targeting functions: choosing what to attack and applying force. A system that flies, navigates or performs another support function autonomously is not necessarily an autonomous weapon under this definition.

That distinction matters because “military AI,” “armed drone” and “autonomous weapon” are not interchangeable labels. An armed drone may be remotely piloted, with a person selecting and authorizing each target. A weapon may also use artificial intelligence for navigation or data processing while a human remains responsible for target selection and engagement. Conversely, a comparatively simple rule-based weapon can fall within the definition if it selects and engages targets without further human input.
So the governance question should be asked about a weapon’s function and operating conditions, not its marketing label or whether it uses advanced AI. A reviewer needs to know what the system can target, what causes it to apply force, how it behaves when conditions change, and what humans can do after activation.

Should autonomous weapons be banned?
Not every autonomous function is necessarily unlawful, but some systems should be prohibited outright and all others should face strict limits. The ICRC’s proposed approach draws a line between systems that cannot be used consistently with IHL and systems that might be used lawfully only within a narrow, controlled operating envelope.
Two categories merit prohibition:
- Systems whose functioning or effects cannot be sufficiently understood, predicted or explained. This includes systems that may behave differently in comparable circumstances, particularly opaque or adaptive systems whose effects cannot be reliably anticipated. If a weapon’s likely effects cannot be assessed, commanders cannot confidently determine whether its use will comply with the rules governing attacks.
- Systems designed or used to apply force directly against human beings. A machine should not make the decision to select a person as a target and apply force. The concern is not only technical error: delegating that decision removes the human judgment and moral restraint required for decisions about life and death.
The rationale is not that every weapon with an autonomous feature is automatically unlawful. Rather, unpredictability can make a weapon indiscriminate by nature, while direct autonomous targeting of people crosses a distinct ethical and legal boundary. For systems outside these prohibited categories, restrictions should still be strong enough to make their effects foreseeable and their use controllable.
What does meaningful human control mean?
Meaningful control is more than a person pressing an activation button or remaining nominally “in the loop.” People responsible for the weapon must understand its relevant capabilities and limits, make informed decisions about whether and how to use it, and retain a practical opportunity to intervene or terminate an engagement.
Before authorizing a mission, commanders and operators need to understand at least:
- the system’s target-selection logic and the types of targets it is designed to engage;
- the conditions and environment in which it can operate as approved;
- known failure modes, limitations and uncertainty in its identification or sensing;
- the mission’s geographic, time and scale boundaries; and
- what alerts or other information will be available while it operates, and how to suspend or end an engagement.
A human who lacks this information cannot make an informed decision merely by authorizing activation. Nor is control meaningful if the system moves from target detection to applying force faster than an operator can understand the situation and intervene. The ICRC’s 2026 legal briefing stresses that “it is not the weapon system that must comply with IHL, but the humans using it.” In practice, the weapon’s design and the way it is deployed must leave those humans able to discharge that responsibility.
The U.S. Department of Defense’s Directive 3000.09 offers one national implementation example: it requires covered systems to allow commanders and operators to exercise appropriate levels of human judgment over the use of force. The Congressional Research Service’s summary also describes requirements concerning training, procedures, doctrine and interfaces that trained operators can readily understand. That framework is an example of national policy, not a substitute for internationally agreed rules.

How should systems that are not banned be restricted?
Every permissible system should have a bounded operating envelope: precise limits on what it may target, where and when it may operate, how many engagements it may conduct, and what it must do when conditions depart from assumptions. These limits reduce the range of possible outcomes that commanders must anticipate and assess under IHL.
| Safeguard | What the rule should require | Why it matters |
|---|---|---|
| Target type | Where possible, limit use to objects that are military objectives by nature; define the authorized target class precisely. | A narrow target class is easier to assess than an open-ended category based on changing behavior or ambiguous characteristics. |
| Geographic scope | Set a bounded operating area and prevent or prohibit operation outside it. | A weapon authorized for one area should not carry that authority into an unapproved location or a different civilian context. |
| Duration | Use a short, reviewable activation period rather than open-ended operation. | Conditions, intelligence and civilian presence can change; time limits prompt renewed human assessment. |
| Scale | Cap the number of systems, targets or engagements that may proceed without renewed human authorization. | Limits prevent a single authorization from expanding into a much larger sequence of attacks than the decision-maker considered. |
| Situation | Prohibit use where civilians or civilian objects are present if the system cannot reliably account for changing circumstances. | A weapon’s suitability depends on its surroundings, not just its technical performance in isolation. |
| Supervision and stopping | Require effective supervision, timely intervention and reliable means to deactivate, neutralize or destroy the system. | Oversight must be actionable, not merely a monitoring screen or a theoretical override. |
These are linked constraints, not a menu from which a commander can select just one. A narrowly defined target type does not make a weapon safe for indefinite operation across a large area. A short mission does not cure an inability to distinguish a permitted target from civilians. The limits must work together to keep the weapon’s possible effects foreseeable and its use within the authorized conditions.
How should testing and legal review work?
A state should review a weapon’s legality before deployment and test it under realistic conditions before authorizing operational use. Review should consider the weapon as used in a particular configuration and mission, including its target profile, operating area, duration, scale, human supervision and failure responses—not just its performance in a controlled demonstration.
Realistic evaluation should cover the full intended operating envelope and foreseeable adverse conditions. Relevant scenarios include degraded communications, changing environmental conditions, civilian presence, sensor failure, adversarial inputs and loss of operator connectivity. These cases matter because they can undermine identification, supervision or the assumptions under which the weapon was approved.

Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →The U.S. framework summarized by the Congressional Research Service provides a concrete national baseline: covered systems must demonstrate appropriate performance, capability, reliability, effectiveness and suitability under realistic conditions. It also calls for retesting when changes—such as machine-learning-related changes—alter a system’s operating state or could affect safety features. A system that has been modified may not behave like the version previously reviewed, so approval should not silently carry over when a change affects its safety or operational characteristics.
Review should produce documented limits that operators can follow: approved targets, operating conditions, mission boundaries, required supervision, failure responses and any restrictions on use near civilians. Systems with significant autonomy should receive senior-level approval, as contemplated by the U.S. model. Legal review and technical testing answer different questions: testing can establish how a system performs under examined conditions, while legal review determines whether its use and effects can comply with applicable law. Neither replaces the other.

What makes an override or shutdown safeguard effective?
An override is meaningful only if it can stop an unsafe or unlawful engagement in time. The intervention channel must be available throughout the authorized operating period, reliable in the conditions where the system is expected to work, and fast enough for an operator to act before force is applied or further engagements occur.
Approval should also specify fail-safe behavior. If communications are lost, sensors fail, identification confidence falls below an approved threshold, or environmental conditions leave the tested range, the system should not simply continue on the assumption that the original authorization remains safe. It should respond as the approved design and mission rules require, which may include suspending target engagement and requiring human review. The precise response will depend on the system and its mission; the essential requirement is that it be defined, tested and compatible with the limits of the authorization.
Supervision is not meaningful if operators receive information too late, cannot tell what the weapon is doing, or have no effective way to suspend it. For that reason, the interface, communications link, alerts and deactivation mechanism are part of the safety case—not optional accessories to an otherwise autonomous system.
How can humans remain accountable?
Rules should identify the people and organizations responsible for authorizing, deploying, supervising and reviewing a system. A weapon’s autonomy cannot be treated as a replacement for human responsibility. If unlawful harm occurs, investigators need enough information to determine what was authorized, how the system behaved and what people knew or did.
Records should preserve, as appropriate, the authorization and mission parameters, system version, target profile, relevant alerts, operator interventions or overrides, and engagement outcomes. Those records help establish whether a system operated within its approved envelope, whether operators had a practical chance to intervene, and whether the mission or system needs to be suspended or reviewed.
Accountability is especially difficult when the weapon’s process is opaque or its actions are hard to reconstruct. The ICRC identifies this as a specific challenge: autonomous processes can make it harder to determine responsibility when unlawful harm occurs. Documentation, auditability and investigation procedures therefore need to be designed in from the start. They cannot restore responsibility if decisions are left untraceable after deployment.

Are autonomous weapons legal under international law?
International humanitarian law already applies to the use of autonomous weapons; autonomy does not create a legal vacuum. The relevant question is whether a particular weapon, in its design and intended use, can comply with IHL and whether the circumstances of a particular attack satisfy the applicable rules, including distinction, proportionality and precautions in attack.
That does not mean all autonomous weapons are necessarily unlawful, or that a system’s legality can be answered by its label alone. The ICRC’s position is that existing law needs new, legally binding rules to clarify which systems cannot comply and how other systems must be restricted. National policies and voluntary principles can shape practice, but they do not provide the same common, enforceable red lines as an international instrument.
On August 25, 2026, UN Secretary-General António Guterres and ICRC President Mirjana Spoljaric called for negotiations on a legally binding instrument with clear prohibitions and restrictions. They described autonomous targeting of humans by machines as a moral red line. As of November 5, 2026, the Seventh Review Conference of the Convention on Certain Conventional Weapons (CCW), scheduled for November 16–20, is a forthcoming diplomatic decision point—not a conference that has already produced a treaty. The appeal identifies that meeting as the clearest available path to begin negotiations.
Any international rules should be technology-neutral enough to cover future systems, while specific enough to prohibit unpredictable systems and direct autonomous targeting of humans and to impose strict limits on other systems. Without that combination, rules risk either becoming obsolete as technology changes or remaining too vague to guide decisions.

What do current uses show—and what do they not show?
Autonomous weapons are already used in bounded contexts against military objectives by nature, such as missiles, radars and warships, often where civilians are absent or excluded and under human supervision. That limited fact does not establish that autonomy generally protects civilians better, or that a system suitable in one context is suitable in another.
The more defensible conclusion is narrower: some autonomous functions may be operationally useful in tightly constrained environments, but widening the target set, geographic area, operating time or degree of autonomy can increase unpredictability, escalation risk and difficulty complying with distinction, proportionality and precautions. A governance rule should therefore assess the complete mission envelope, rather than treating a successful use in a bounded context as evidence for broader permission.

How should readers compare safeguard proposals?
A useful comparison asks whether a proposal creates enforceable boundaries or relies mainly on general promises of care. The ICRC’s proposed prohibitions and restrictions and the U.S. weapons-review framework overlap in their concern for human responsibility and control, but they are different kinds of measures: one advocates international prohibitions and limits, while the other describes a national review and implementation framework.
- Does it prohibit unacceptable systems? Look for a clear ban on systems that cannot be sufficiently understood or predicted and those that directly target people, rather than risk-management language alone.
- What targets are covered? A rule should distinguish objects that are military objectives by nature from ambiguous objects or behavior-based categories, and explain how that distinction is enforced.
- Can the system’s functioning and effects be predicted and explained? A proposal that does not address opacity, adaptation and uncertainty leaves a central legal and safety question unanswered.
- Is the operating envelope bounded? Check whether the rules constrain geography, duration, scale, environmental conditions and civilian presence, and require renewed authorization when necessary.
- Can a human make an informed decision and stop the system? Assess the quality and timing of information, the operator’s training and authority, and whether intervention works under mission conditions.
- Are review and accountability mandatory? Look for legal review, realistic testing, retesting after significant changes, records, investigation and appropriate senior approval.
A proposal that says only “keep a human involved” is incomplete unless it defines what the human must know, what authority the person has, when intervention remains possible and who is responsible if the system exceeds its limits.
Frequently Asked Questions
Does a remotely piloted armed drone count as an autonomous weapon?
Not automatically. If a human selects the target and authorizes the use of force, remote flight alone does not meet the ICRC definition; the decisive question is whether the weapon selects and engages targets after activation without further human intervention.
What does “human in the loop” mean for a weapon?
The phrase is used inconsistently, so it is not a safeguard by itself. Ask whether a person has enough information and time to make a real decision, and whether the person can prevent or stop the use of force in practice.
Can an autonomous weapon make a proportionality decision?
The legal responsibility for applying IHL remains with the humans using the weapon, not the system. A technical capability to process information does not transfer that responsibility or by itself establish that a particular attack is lawful.
What happens at the CCW Review Conference in November 2026?
The Seventh Review Conference is scheduled for November 16–20, 2026, and has been identified as an opportunity to begin negotiations on a legally binding instrument. As of November 5, 2026, it is still forthcoming; no outcome should be assumed.
