For U.S. federal tax purposes, cryptocurrency paid to an employee for services is wages—not a way around payroll taxes. Convert the payment to its fair market value in U.S. dollars when the employee receives it, include that value in payroll, apply the federal income-tax withholding, FICA, and FUTA rules that apply, deposit and report taxes under the current IRS procedures, and report wages on Form W-2. The key operational discipline is to preserve evidence of both the dollar valuation and the receipt time. State and local wage-payment and tax requirements must be checked separately.
What are the federal payroll-tax rules for cryptocurrency wages?
The payment medium does not change an employee’s wage status. IRS FAQ 61 says that remuneration for employee services is generally wages regardless of the medium used; the fair market value (FMV) of digital assets paid as wages is subject to federal income-tax withholding, Social Security and Medicare taxes under FICA, and federal unemployment tax under FUTA, and is reportable on Form W-2. The IRS added this digital-asset guidance on December 15, 2025. See the IRS digital-asset FAQ.

“Generally, the medium in which remuneration for services is paid is immaterial to the determination of whether the remuneration constitutes wages for employment tax purposes.” — Internal Revenue Service, FAQ 61
That is the federal framework, not a determination that every state permits wages to be paid in cryptocurrency or that every payment arrangement complies with state wage-payment laws. IRS Publication 15 addresses federal employment taxes and directs employers to the relevant state or local tax departments for those jurisdictions’ requirements. Publication 15 (2026), Circular E is the current federal employer guide for the 2026 tax year.

How do I handle payroll taxes when employees are paid in cryptocurrency?
Use a documented sequence: classify the worker, value each wage payment when received, process the dollar amount through ordinary payroll, meet federal deposit and return deadlines, and report the wages on Form W-2. The employer should be able to reconstruct the payment and its valuation from retained records. A written procedure helps payroll, accounting, treasury, and human-resources staff use the same receipt-time and valuation rules for every pay period.
- Confirm the worker is an employee. Apply the ordinary worker-classification analysis; calling compensation crypto does not determine status. Employee remuneration belongs in payroll and is generally reported on Form W-2. An independent contractor follows a different tax and reporting path, described below. Resolve classification before creating a payment instruction or selecting a tax form.
- Define the payment event. Identify which asset is being transferred, the quantity, the wallet or exchange involved, and the event that constitutes receipt. For an on-chain transfer, the relevant receipt point is when the transaction is recorded on the distributed ledger. For an exchange-facilitated transaction, retain the exchange’s recorded receipt information.
- Record the asset and receipt details. For each payment, capture the digital asset, quantity, date and time received, transaction identifier or exchange reference, and the U.S.-dollar FMV used for payroll. Keep the valuation source and supporting evidence with the payroll record rather than relying on a later account statement.
- Include the dollar value in payroll. Treat the FMV at receipt as wage compensation and calculate applicable federal income-tax withholding, employee and employer FICA, and FUTA under the rules that apply to that employee and employer. The payroll record should show how the asset amount became a dollar wage amount.
- Deposit and report on schedule. Use the current-year Publication 15 procedures for federal tax deposits and employment-tax returns. Do not rely on a prior-year calendar or assumptions about deposit frequency when determining current obligations. Deposits can be due on a schedule that is separate from the date a return is filed.
- Prepare Form W-2 using the payroll amounts. Report employee wages using the U.S.-dollar value included in payroll, following the current W-2 and W-3 instructions. Keep the year-end form consistent with the wage and tax amounts used during the year.
- Retain records and check other jurisdictions. Keep the valuation evidence and transaction timestamps with employment-tax records. Separately review applicable state and local rules for wage payment and taxes, including the jurisdiction where the employee performs services and any jurisdiction whose rules apply to the payment.
How should I value cryptocurrency paid as wages?
Measure the service compensation in U.S. dollars at FMV when the employee receives it. The IRS digital-asset FAQ explains that for an on-chain transfer, receipt occurs when the transaction is recorded on the distributed ledger; for an exchange-facilitated transaction, the exchange-recorded dollar value is relevant. For a peer-to-peer transfer, use FMV at the time it is recorded on the ledger and retain evidence that the selected value accurately represents FMV. The IRS FAQ on digital-asset transactions describes these valuation points.
Think of valuation as a payroll input, not as an estimate made at the end of the month. The asset name, units, dollar price, timestamp, and transaction reference should travel together through approval, payroll calculation, deposit support, and year-end reporting. If an employee receives several transfers in one pay period, value and document each receipt according to the applicable transaction facts before determining the period’s total wage amount.
Exchange-facilitated payment
Retain the exchange’s transaction record and the dollar value recorded for the receipt. Make sure the record can be matched to the relevant employee, payment, and payroll period. If your payroll valuation differs from the exchange record, preserve the basis for the value you used. A record that shows only the number of tokens, without the exchange’s dollar value or a separate FMV support file, may not explain the wage amount entered in payroll.
Peer-to-peer, on-chain payment
Use the time the transfer is recorded on the ledger as the receipt point and determine the asset’s FMV in dollars at that time. Preserve the transaction identifier or equivalent transaction detail and the evidence for the dollar value selected. The IRS FAQ places responsibility on the taxpayer to establish that a chosen value accurately represents FMV when relying on a value other than an explorer’s displayed value. Keep enough detail to show which asset, network, and ledger event were used, especially where an address receives multiple transfers.
Why a timestamp matters
A later price, a payroll-period average, or the amount the employee eventually receives after moving the asset is not a substitute for documenting FMV when the wage payment is received. Use a consistent, supportable process that ties the valuation to the actual receipt time; preserve the source and time with each payment record. Price volatility makes a short time difference material, but the central rule is the receipt-time valuation rather than a particular level of volatility.
What if the transfer is delayed or pending?
Separate an attempted transfer from a completed receipt. For an on-chain payment, the FAQ identifies ledger recording as the receipt event. Keep the transaction status and recording time so payroll does not treat an unsigned, rejected, or still-pending instruction as a completed wage receipt. If the payment is exchange-facilitated, retain the exchange’s confirmation and recorded value. When the facts are unusual, document the event chronology and apply the current IRS guidance to those facts.

Which payroll taxes apply, and how do I calculate them?
Include the dollar value of the cryptocurrency wages in the employee’s payroll calculation and apply the federal taxes relevant to the employer and employee: federal income-tax withholding, employee and employer FICA, and FUTA. Digital-asset compensation is not exempt merely because it is noncash. IRS Publication 15 gives the employer procedures, while the IRS employment-tax overview explains the general employer duties. IRS: Understanding employment taxes.
The exact calculation depends on current-year rules and the employee’s and employer’s circumstances. Use the current Publication 15 and applicable instructions rather than relying on a static rate, wage-base limit, or threshold from an older article. No single tax figure applies to every employee and payroll situation. The employee’s existing wages, the employer’s payroll facts, and applicable exceptions can affect the calculation, so a token price by itself is not a complete payroll answer.
Show the FMV wage amount as part of the same payroll calculation used for other remuneration. The process should separately identify the employee share and employer share of FICA and the employer’s FUTA obligation, while preserving the inputs used for federal income-tax withholding. This makes it possible to reconcile the asset transfer, taxable wage amount, tax deposit, employment-tax return, and W-2.

Publication 15 generally treats noncash, in-kind wages as subject to income-tax withholding, Social Security, Medicare, and FUTA based on FMV when provided, while describing exceptions for household work, agricultural labor, and services outside the employer’s trade or business. The digital-asset FAQ separately addresses digital assets paid as employee wages. Do not assume a general noncash-wage exception automatically removes a cryptocurrency payment from the digital-asset wage rule; review the applicable IRS guidance and the facts of the employment arrangement.
What operational controls prevent common payroll errors?
Crypto payroll adds a transaction record to the ordinary payroll record. Use a control sequence that can be followed by someone who did not initiate the transfer:
- Authorize the payment terms. Identify the employee, asset, quantity or payment formula, pay date, and applicable payroll period in the employment or compensation records.
- Capture the completed transaction. Save the exchange confirmation or ledger transaction detail, including the date and time that establishes receipt.
- Document FMV independently. Save the dollar value, valuation source, and any evidence needed to show that a peer-to-peer value accurately represents FMV.
- Reconcile to payroll. Match the asset quantity and FMV to the wage amount, withholding calculation, FICA amounts, FUTA calculation, and deposit support.
- Review exceptions. Escalate missing timestamps, contradictory exchange records, pending transfers, or unexplained differences between the recorded dollar value and the payroll value.
- Archive the file. Keep transaction evidence with the employment-tax records, not solely in a trading or wallet account that may be difficult to retrieve later.
These controls do not replace the employer’s payroll system or tax adviser. They create an audit trail showing why a particular dollar amount was treated as wages in a particular period.
What if the employee is paid only in cryptocurrency?
The wage value still has to be included in payroll and the applicable federal withholding, FICA, and FUTA obligations still have to be handled. The employer should plan the payment arrangement and payroll process so it can calculate and meet tax obligations using the current IRS deposit and reporting procedures; paying wages in a digital asset does not itself satisfy those separate obligations.

Before launching an all-crypto arrangement, map the transfer event to the payroll calendar, determine how the dollar wage amount will be entered, and confirm who will prepare deposits and returns. The process must account for taxes even when the employee receives no separate cash wage. Publication 15 governs the applicable federal deposit and return procedures; consult it for the employer’s deposit frequency and due dates and obtain professional advice on implementing the arrangement.
Publication 15 also warns that withheld income, Social Security, and Medicare taxes are trust-fund taxes: failure to withhold, deposit, or pay them may result in the trust fund recovery penalty. Employers should not wait until a tax return is filed to address deposits that are due earlier under the applicable schedule. A policy that says “the employee received crypto” is not a substitute for completing the tax calculation, deposit, and return steps.
How do I report cryptocurrency wages on Form W-2?
Report the employee’s applicable wages using the U.S.-dollar amount included in payroll, following the current General Instructions for Forms W-2 and W-3. The 2026 instructions specifically state that FMV of virtual currency paid as wages is subject to withholding, FICA, and FUTA and must be reported on Form W-2. The IRS terminology in newer digital-asset guidance is “digital assets”; the W-2 instructions use “virtual currency.” Read the 2026 W-2 and W-3 instructions.
Form W-2 reporting is for employee remuneration. Do not report an employee as a contractor just because compensation was transferred in cryptocurrency. For filing and form information, see the IRS About Form W-2 page.

Use the same wage and withholding records that supported the periodic payroll calculations. A year-end conversion using a different price or date can create a mismatch with deposits and returns. Reconcile the total FMV of recorded employee receipts to the wage amount reported for the year and retain the reconciliation with the W-2 workpapers.
How is payment to an independent contractor different?
Do not put a contractor’s payment through employee wage withholding merely because the payment is made in cryptocurrency. IRS FAQ 60 states that the FMV of digital assets received by an independent contractor for services generally constitutes self-employment income and is subject to self-employment tax. That is distinct from the employee wage treatment in FAQ 61. The worker’s actual status controls the applicable path; the payment medium does not make an employee a contractor. The IRS FAQ covers both employee and contractor digital-asset payments.
Document the classification analysis and keep it separate from the valuation analysis. Both an employee and a contractor may need an FMV at receipt, but the withholding, employment-tax, and information-reporting consequences differ. If facts change—such as a change in control, duties, or working relationship—revisit classification rather than assuming the original label continues to control.

What records should an employer keep?
Keep the normal employment-tax records and enough digital-asset detail to substantiate the wage value entered in payroll. The IRS’s 2026 Publication 15 specifies that employment-tax records must be retained for at least four years and includes the FMV of in-kind wages among the records to keep. See Publication 15’s recordkeeping guidance.

These records connect the asset transfer to the wage amount, tax calculation, deposit, and year-end reporting. Retain them for at least the period specified in the current guide and longer where another applicable rule or a particular record situation requires it. Access controls and reliable backups matter because a wallet or exchange interface may not preserve historical details in a payroll-ready format.
Employee, contractor, exchange, or peer-to-peer: what changes?
| Question | Employee | Independent contractor |
|---|---|---|
| Core income treatment | Digital-asset FMV for services is wages. | FMV at receipt generally constitutes self-employment income. |
| Federal payroll path | Apply applicable income-tax withholding, FICA, and FUTA; report on Form W-2. | Do not apply employee wage withholding solely because payment is in crypto; use the contractor reporting path that fits the facts. |
| Classification test | Employee status is determined by the working relationship, not the asset used. | Contractor status is determined by the working relationship, not the asset used. |
For either category, the payment record should identify the asset, quantity, receipt time, and dollar FMV. The difference is what the employer does with that value after classification.
| Payment route | Receipt and valuation evidence |
|---|---|
| Exchange-facilitated | Use and retain the exchange-recorded dollar value and transaction record, matched to the employee and payroll period. |
| Peer-to-peer or other on-chain transfer | Use the ledger-recording time as the receipt point and retain the transaction detail and evidence that the selected FMV accurately represents market value. |
What federal guidance does not settle
The cited IRS guidance establishes federal tax treatment; it does not establish whether a particular state or locality allows an employer to satisfy wage-payment requirements with cryptocurrency, or what additional state and local taxes or disclosures apply. Check the labor and tax authorities for every jurisdiction where the employee works and is paid, and review any applicable employment agreement and wage-payment rules before implementing the arrangement.
Publication 15 is a federal employer guide. It does not provide a universal answer for state minimum-wage calculations, payday rules, permissible deductions, notice requirements, or local withholding. Those questions require a separate jurisdiction-by-jurisdiction review. Keep a written record of which authorities and rules were checked and the conclusion reached for each employee location.
Likewise, the IRS sources explain the tax treatment and employer procedures but do not endorse a particular cryptocurrency, exchange, wallet, payroll vendor, or valuation product. The employer remains responsible for using a defensible FMV and meeting its filing, deposit, and recordkeeping duties. A vendor’s transaction export can support the file, but it does not transfer the employer’s legal responsibility for accurate payroll reporting.
Frequently Asked Questions
Does the IRS require employers to use a specific cryptocurrency exchange or price website?
No specific exchange, wallet, or valuation product is endorsed in the cited IRS guidance. For a peer-to-peer receipt, the FAQ says the taxpayer must be able to establish that the selected dollar value accurately represents fair market value. Keep the evidence and explain the method used.
Best Value
Should a cryptocurrency wage payment be treated as a contractor payment if no cash changes hands?
No. The form of payment does not determine worker status. The IRS distinguishes employee wages from contractor service income, so classification must be resolved before choosing payroll and reporting treatment.
Where can I check whether cryptocurrency wages are allowed under my state’s rules?
Publication 15 addresses federal taxes and directs employers to state or local tax departments for local requirements. The federal guidance cited here does not determine whether a particular jurisdiction permits crypto wage payments.

For an on-chain transaction, the IRS digital-asset FAQ identifies receipt when the transaction is recorded on the distributed ledger. Record that time, the transaction details, and the FMV used for payroll.
Can I use the price at the end of the payroll period?
The wage is measured at FMV when received, not by a later payroll-period average or a later sale price. Use the applicable receipt time and preserve the valuation source and supporting evidence.
What if the employee receives several crypto transfers in one pay period?
Record each asset, quantity, receipt time, transaction detail, and dollar FMV. Include the applicable values in the payroll calculation and retain a reconciliation showing how the transfers became the period’s wage amount.
Are crypto wages subject to Social Security, Medicare, and FUTA?
The IRS treats FMV of digital assets paid as employee wages as subject to federal income-tax withholding, FICA, and FUTA, with the applicable current-year rules and exceptions determined from the employer and employee facts.

Does paying only cryptocurrency remove the employer’s deposit obligation?
No. The wage value still enters payroll, and applicable withholding, FICA, FUTA, deposits, returns, and W-2 reporting still must be handled under current IRS procedures. Publication 15 warns that withheld income, Social Security, and Medicare taxes are trust-fund taxes.
The Bottom Line
For federal purposes, cryptocurrency paid for employee services is wages. Value each receipt in U.S. dollars at the time it is received, document the transaction and FMV, run the amount through ordinary withholding, FICA, and FUTA procedures, make deposits and file returns under the current Publication 15 schedule, report the wages on Form W-2, and retain the records for at least four years. Resolve worker classification first and verify state and local wage-payment and tax rules separately.
