Evaluate an AI vendor by testing whether its specific system can support your specific decision at an acceptable level of accuracy, fairness, security, explainability and operational resilience—not by accepting a benchmark slide or a general certification. Start by defining the decision, affected people, alternatives to AI, measurable success thresholds and stop conditions. Then require comparable evidence from every vendor, run a controlled evaluation with representative and difficult cases, examine the supplier and dependency chain, and contract for monitoring, change notification and exit. The result should be a conditional, documented approval with an accountable owner and a practical fallback.

What makes an AI business decision “high stakes”?

A decision is high stakes when an error can materially affect a person’s rights, safety, livelihood, access to essential services, finances or legal position, or can expose the organization to serious operational, regulatory or reputational harm. Examples include credit or insurance decisions, hiring and employment actions, medical triage, fraud intervention, safety monitoring, benefits eligibility, legal-risk assessment and automated actions that can move money or disable an account.

The label depends on context, not on the model’s marketing category. A generative system that drafts internal meeting notes may be low risk; the same system used to recommend disciplinary action is not. Record the consequences of false positives, false negatives, delay, unequal error rates and an unavailable service before asking a vendor to demonstrate its product.

How do I define the decision before speaking to vendors?

Write a use-case brief that describes the decision and the complete workflow, including what happens when the system is uncertain or unavailable. This prevents a polished demo from quietly changing the problem you actually need to solve.

Describe the people and process

  • Decision or task: State the action the system will advise on or take, such as ranking applications, flagging transactions or routing cases.
  • Users: Identify operators, reviewers, administrators and anyone who can override an output.
  • Affected people: Identify customers, employees, applicants, patients, citizens or other groups who may bear the consequences.
  • Data: List inputs, sources, fields, retention periods, sensitive attributes and any data supplied by third parties.
  • Workflow authority: Specify whether the system only recommends, requires human approval, or acts automatically.
  • Alternatives: Document whether a rules-based, manual or lower-risk process could meet the need.

Set acceptance and stop conditions

Define measurable thresholds before procurement. They can include minimum task accuracy, maximum false-negative and false-positive rates, response time, uptime, review time and disparity limits between relevant groups. State which failures are unacceptable even if the average score is high. A safety-critical or rights-affecting error may be a blocking condition rather than a defect to be balanced against price.

Also define prohibited uses, geographic or population boundaries, required human review, escalation rules and conditions that stop the purchase. The UK government’s AI procurement guidance recommends an impact assessment covering user needs, impacts, data quality, unintended consequences and whole-of-life costs, with named risk owners and go/no-go points.

What should I ask an AI vendor before buying?

Send every supplier the same evidence request and require each answer to identify scope, dates, product version and test conditions. A general corporate policy is not evidence that the proposed configuration is suitable for your deployment.

Evidence area Questions to require in writing Why it matters
Product identity What exact service, model, version, configuration, region and sub-processors are proposed? Which components are optional or changeable? “The platform” may contain several models and APIs with different behavior and contracts.
Intended use and limits What uses, languages, populations and environments are supported? What uses are excluded? What failure modes are known? A vendor’s stated boundary is a useful control against scope drift.
Performance How were accuracy, robustness and latency measured; on what data; against which baseline; and under what operating conditions? Results are meaningful only when they resemble your workflow.
Fairness Which groups were evaluated, what metrics were used, how were trade-offs handled, and who independently reviewed the analysis? Average performance can hide materially different error rates.
Data use What data is sent, retained, used for training or shared? Where is it processed? What deletion, export and access controls apply? Data rights and residency can determine whether deployment is permissible.
Security and privacy What controls, independent assessments, vulnerability processes, incident notices and recovery arrangements cover this service? A corporate security statement may not cover the product or its subprocessors.
Interpretability and audit Can users inspect inputs, outputs, confidence or reasons? What logs, timestamps, versions and audit exports are available? Reviewers need to challenge decisions and reconstruct events.
Change management What changes can occur without notice? How are model updates tested, documented and communicated? Can customers delay or reject a material change? Behavior can change while the product name and contract remain the same.
Service and exit What service levels, support hours, portability, knowledge transfer, termination assistance and deletion certificates are offered? A system that cannot be paused or replaced creates operational and negotiating risk.

Ask for the underlying methodology and limitations, not just a score. Canada’s federal guidance recommends standardized criteria and vendor documentation of development, testing and limitations. For generative AI, the National Institute of Standards and Technology (NIST) Generative AI Profile, released July 26, 2024, advises updating due diligence for privacy, security, intellectual-property and third-party risks.

How do I compare vendors fairly?

Compare vendors on the same use case, data conditions, review process and acceptance criteria. A vendor that reports a higher score on a different dataset or task has not demonstrated superiority for your decision.

Build a representative test set

  1. Sample normal cases from the proposed workflow, removing unnecessary personal information and documenting any sampling limits.
  2. Add boundary cases, missing fields, ambiguous language, rare events, adversarial inputs and cases where the correct action is “do not decide.”
  3. Define the reference answer or expert judgment and the permitted range of disagreement before running a vendor evaluation.
  4. Freeze the test set, prompts, configuration, human-review instructions and scoring code for each comparison round.
  5. Record the model and version used, date, region, latency, failures, abstentions and any manual intervention.

Measure the workflow, not only the model

Report task-level outcomes such as precision, recall, calibration, rejection or abstention rates, time to resolution and the rate at which reviewers overturn outputs. For generative systems, examine factuality, instruction following, harmful content, data leakage and citation quality where relevant. Averages should be accompanied by distributions and concrete failure examples.

Test the human process as part of the system. Can a reviewer understand the output, find the evidence, override it and escalate an uncertain case? Measure whether time pressure, interface design or automation bias causes reviewers to accept poor recommendations. The Information Commissioner’s Office (ICO) recommends setting accuracy thresholds in advance, conducting bias due diligence and independently evaluating trade-offs.

Test relevant groups and conditions

Choose fairness measures that fit the decision and legal context; no single metric resolves every trade-off. Compare error rates, abstentions, calibration and service quality for groups that may be affected, including language, accessibility and intersectional groups where the data supports analysis. Investigate differences rather than hiding them in an overall score. Document which trade-offs were accepted, who approved them and what mitigation is required.

Separate evidence types in the scorecard: vendor-reported results, independent assessments, published studies and observations from your own controlled test. Do not present a supplier’s claim as your own validation.

How should I assess data, privacy, intellectual property and security?

Trace data through the whole dependency chain: your application, the vendor’s service, embedded models, hosting provider, APIs, model libraries and subprocessors. NIST’s 2026 ICT Supplier Due Diligence Quick-Start Guide (SP 1326, published July 8, 2026) highlights ownership and control, component provenance, resilience, foundational cyber practices and deeper supply-chain tiers.

Data and rights checklist

  • Identify the legal and contractual basis for every input and output, including training, evaluation, abuse monitoring and support access.
  • Confirm processing locations, cross-border transfers, retention defaults, deletion timing, backups and administrator access.
  • Establish whether prompts, uploaded files, feedback and generated outputs are used to improve a shared model or isolated to your tenant.
  • Verify rights to use training and reference material, and allocate responsibility for third-party claims involving generated content.
  • Require controls for redaction, field-level minimization, tenant isolation, encryption, key management and export.

Security and resilience questions

  • How are accounts, service identities, privileged access, secrets and administrative actions protected and logged?
  • How does the supplier test for prompt injection, data exfiltration, model abuse, malicious files and supply-chain compromise?
  • What is the incident-notification deadline, what evidence will be shared, and who coordinates customer and regulator communications?
  • What recovery point and recovery time objectives apply to this service, and how often are they exercised?
  • Which external services are essential, and what happens if a model, API, region or data source is unavailable?

Ask for evidence specific to the proposed service and deployment. An enterprise-wide certificate or policy can support due diligence, but it does not answer whether your data is retained, whether a particular subprocessor is involved or whether recovery works at your required scale.

What governance and human controls must be in place?

A high-stakes deployment needs an accountable operating model, not just a technically capable model. Assign a named risk owner with authority to pause the system, define who approves changes, and document the path for complaints, appeals and corrections.

Require reviewable outputs

Choose an explanation appropriate to the decision: input evidence, retrieved records, decision factors, confidence or uncertainty, or a clear statement that the system cannot determine an answer. Do not promise a simple causal explanation when the model cannot provide one. Log the input version, output, model version, policy or prompt configuration, reviewer action and final decision, subject to privacy and retention limits.

Design escalation and fallback

  • Set thresholds that route uncertain, novel or high-impact cases to a trained person.
  • Give reviewers enough context and authority to override an output without penalty for disagreement.
  • Provide a manual or rules-based fallback for outages, degraded quality, suspected drift and security incidents.
  • Train users on intended use, prohibited use, common failure modes, privacy handling and incident reporting.
  • Offer affected people a correction or appeal route where the decision warrants it.

Explainability, auditability and training should be tested in exercises, not merely promised in documentation. The UK procurement guidance emphasizes audit access, monitoring, training and avoiding lock-in.

Which standards and government guidance are useful?

Frameworks can organize questions and evidence, but none automatically certifies that a vendor’s product is fit for your use case or legally compliant in your jurisdiction.

Resource Date and role How to use it
NIST AI Risk Management Framework 1.0 Released January 26, 2023; voluntary process framework Structure activities for governing, mapping, measuring and managing trustworthiness across the lifecycle.
NIST Generative AI Profile (NIST AI 600-1) Released July 26, 2024 Extend acquisition and risk controls for generative-model privacy, security, intellectual-property and third-party issues.
ISO/IEC 42001:2023 First edition published December 2023 Assess whether an organization has an AI management system and continual-improvement process; do not treat the standard alone as product validation.
NIST SP 1326 Final supplier due-diligence quick-start guide published July 8, 2026 Examine ownership, provenance, resilience, cyber practices and supply-chain tiers.
UK AI Risk Management Toolkit Published September 8, 2026 Use its procurement-oriented risk and lifecycle prompts when operating in, selling to or benchmarking against UK practice.

ISO/IEC 42001 describes requirements for establishing and continually improving an AI management system. Its existence can be useful organizational evidence, but it does not prove that a particular model reaches your accuracy, fairness or safety threshold. The NIST AI RMF is likewise a process aid, not a supplier certification.

How do I score vendors and make a conditional decision?

Use a written scorecard that records evidence and uncertainty separately. Avoid a single opaque total that allows a severe safety or rights risk to be traded away for a low subscription price.

Decision axis Evidence to record Typical blocking questions
Outcome fit Your test results, failure modes, human-review results and acceptance threshold Does the system meet the minimum threshold on difficult and representative cases?
Data and rights Processing terms, provenance, retention, deletion, training use and IP allocation Can you lawfully use the data and remove it when required?
Risk and control Privacy, security, fairness, interpretability, audit and escalation evidence Can you detect, challenge and correct a harmful output?
Operational resilience Availability history or commitments, recovery tests, incident process, dependencies and fallback Can the business operate safely during an outage or supplier incident?
Change and exit Version notices, re-testing rights, portability, switching effort and termination support Can you suspend, replace or exit without losing essential records or control?
Whole-life cost Integration, data preparation, evaluation, monitoring, training, support and migration estimates What will ownership cost beyond the recurring subscription?

For every criterion, note the source and date, applicability to your configuration, remaining uncertainty, accountable owner, mitigation and status: approved, contract condition, pilot-only or blocked. A “pilot” should still have boundaries, data controls, success criteria and a stop date.

What should the contract require?

Translate the evaluation into obligations that survive deployment. The ICO recommends accuracy key performance indicators or service-level agreements and a reasonable timeline for re-evaluation.

  • Defined service: Name the model, version or change category, region, interfaces, dependencies and supported use.
  • Performance commitments: State measurable accuracy or quality indicators, measurement method, reporting cadence and remedies when thresholds are missed.
  • Change notification: Require advance notice of material model, data, subprocessor, safety-policy or interface changes, with time to test or reject a change.
  • Data restrictions: Specify permitted uses, retention, deletion, export, access, training restrictions and assistance with data-subject requests.
  • Audit and cooperation: Secure access to logs and evidence, incident cooperation, independent-assessment results and regulator support, subject to appropriate confidentiality.
  • Security and incidents: Define controls, notification windows, remediation duties, recovery commitments and customer communication.
  • Knowledge transfer and exit: Require usable exports, documentation, migration assistance, deletion confirmation and continued access to records needed for appeals or audits.

Have legal, privacy, security, procurement, domain and affected-user representatives review the terms. Contract language cannot compensate for an unmeasured use case, but it can preserve your ability to detect and respond when conditions change.

How do I monitor the system after launch?

Approval is the beginning of lifecycle management. Set a review calendar and event-based triggers before production use.

Monitor outcomes and operations

  • Track accuracy, false-positive and false-negative rates, abstentions, overrides, complaints, appeals and subgroup differences.
  • Track latency, availability, queue time, cost, security events, data-quality changes and fallback activation.
  • Sample outputs for qualitative review, including cases that passed automated checks.
  • Compare live input distributions with the evaluation set to detect drift and new populations.

Define reassessment triggers

Re-evaluate after a material model or prompt change, new data source, changed population or use, significant incident, sustained metric deterioration, regulatory change, subprocessor change or a shift in business impact. Record who can pause the service and what evidence is needed to resume it. Retain enough versioned logs to reconstruct decisions and demonstrate that monitoring occurred.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What are the most common evaluation mistakes?

  • Choosing from a demo: Demos use curated inputs and rarely expose abstentions, edge cases or reviewer workload.
  • Using a generic benchmark: A public score may measure a different language, population, task or model version.
  • Accepting a certificate as proof: Management-system or security evidence does not establish your product’s outcome fit.
  • Ignoring the dependency chain: An API, foundation model, cloud region or subprocessor can change your risk profile.
  • Leaving thresholds until after purchase: Without pre-set criteria, teams tend to rationalize weak results.
  • Automating the exception path: Rare and ambiguous cases often need more human attention, not less.
  • Neglecting exit: Data formats, proprietary workflows and undocumented prompts can make replacement expensive.
  • Measuring only launch performance: Model behavior, inputs and operating conditions change over time.

The remedy is consistent evidence, controlled testing, explicit ownership and contractual as well as technical controls. If a supplier cannot provide enough information to judge a blocking criterion, record that uncertainty rather than converting it into an assumption.

What does a defensible go/no-go decision look like?

Approve only a defined deployment, not an unlimited license to use “AI.” The decision record should identify the use, population, model and configuration, evidence reviewed, test results, residual risks, mitigations, owner, monitoring plan, contract conditions, review date and exit plan. State what is not approved.

Go when the system meets the pre-set outcome and fairness thresholds, data and security conditions are satisfied, human controls are workable, dependencies are understood and the organization can monitor and exit. Pause or reject when a blocking error is unresolved, evidence is not applicable, affected people cannot obtain meaningful review, or the supplier cannot support safe change and recovery. A smaller, bounded deployment with a manual fallback is often more defensible than broad automation.

Frequently Asked Questions

Should I require an ISO/IEC 42001 certificate from every AI vendor?

Not necessarily. ISO/IEC 42001 evidence can show that a supplier operates an AI management system, but it does not prove that its particular product meets your task, fairness or safety thresholds. Treat it as one governance input alongside deployment-specific testing and contractual controls.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What can I do if a vendor will not disclose its model or training data?

Ask for the minimum evidence needed to evaluate your risk: model and version identity, data-use and retention terms, test methodology, limitations, subprocessors, change controls and audit artifacts. If proprietary information prevents independent verification of a blocking criterion, classify the uncertainty explicitly and consider a restricted pilot or rejection rather than assuming the claim is true.

How often should an approved AI system be re-evaluated?

Set a scheduled review interval appropriate to the impact and add event-based reviews for model updates, data or population changes, incidents, drift, new subprocessors or changed use. The review should repeat the relevant performance, fairness, security and human-workflow checks, not merely confirm that the vendor name is unchanged.

Can a small organization perform this evaluation without a dedicated AI team?

Yes, if it assigns clear ownership and brings in the needed expertise for the decision. A compact review group can include the process owner, domain expert, privacy or legal reviewer, security lead and someone representing affected users; external assessment may be appropriate when the consequences or technical complexity exceed internal capability.
