Evaluate an opaque AI product by separating every vendor claim from evidence that applies to the exact product, version, deployment and intended use. A polished policy, benchmark slide or framework badge is not proof that the system is accurate, safe or lawful for your situation. Map the system boundary, request structured disclosures, test what matters under your conditions, record what remains unknown and make approval conditional on controls. If a supplier will not disclose material information, narrow the claim, require compensating safeguards or decline the purchase; silence is not a positive result.
What does a trustworthy evaluation of an AI product involve?
A sound evaluation is a documented decision process, not a hunt for a single trust score. It connects a proposed use to evidence about performance, safety, privacy, security, fairness, explainability, accountability and change management. The burden of proof should increase with the potential harm and irreversibility of an error: a drafting assistant needs less evidence than a system that ranks applicants, approves credit, recommends treatment or acts without review.

Start by writing down the decision you are making, the people affected, the failure modes you cannot accept and the human who remains accountable. Then verify that each material statement is about the same model or system version, configuration, data flows and date you will actually use.
How do I define the decision and harm boundary?
Write a short use-case statement before speaking with a supplier. Include the task, users, affected people, jurisdictions, operating environment and whether an output informs, recommends, approves, denies or executes an action. This prevents a vendor from using evidence for a low-risk demonstration to support a much broader claim.

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
Specify unacceptable outcomes
- List safety, financial, legal, discrimination, privacy and service-continuity harms that would be unacceptable.
- Set required accuracy, reliability, response time and availability for the actual task, not a generic benchmark.
- Describe escalation: who reviews an uncertain output, who can override it and how an affected person can challenge a decision.
- Identify whether an error can be reversed. Irreversible decisions, such as termination of a benefit, require stronger controls than a disposable draft.
Set evidence proportional to impact
For a low-impact internal assistant, you may be able to begin with access controls, logging, human review and a limited pilot. A system influencing employment, housing, insurance, education, health or public services needs documented subgroup performance, red-team results, privacy analysis, auditability and a clear redress route before deployment. Legal duties vary by jurisdiction and use case, so treat this boundary as a governance input rather than legal advice.
What exactly should I include in the AI system boundary?
Do not evaluate only the named model. Record every component that can change an output or create a failure: the base or fine-tuned model, prompts, retrieval index and source documents, moderation and safety filters, ranking logic, tools and agents, data stores, cloud region, external APIs, subprocessors, identity system, monitoring and update channel.
Windows Errors? Fix Them Before They Spread

Random freezes, missing sound and display glitches usually trace back to one bad driver. Find and replace yours safely.Free scan · under a minuteAsk which components are operated by the supplier, which are supplied by another company and which can change without your approval. A generic model card may omit retrieval, human review, tool use or policy layers added in the commercial product. A failure in any dependency can interrupt service, leak data or alter risk even when the underlying model is unchanged.
Record the deployment configuration
- Legal supplier and product or edition name.
- Model and system version, release date and update channel.
- Hosting arrangement, deployment region and data-residency commitments.
- External APIs, retrieval sources, subprocessors and support access.
- Customer-content handling, tenant separation, retention and deletion paths.
- Components that can be changed, retrained, deprecated or replaced without customer approval.
NIST governance guidance treats procurement, cybersecurity, computational infrastructure, data, deployment mechanics and system failure as connected responsibilities. Your inventory should therefore show not just what the product does, but where it runs and who can alter it.
How do I separate vendor claims from evidence?
Create a claim-to-evidence register before assigning a score. The register makes unsupported marketing language visible and gives procurement, security, legal, engineering and business owners a shared record.
| Register field | What to record |
|---|---|
| Vendor claim | The precise statement, such as a reliability, privacy or security promise. |
| Evidence | A dated test report, contract term, technical document, audit result or independently verified observation. |
| Scope match | Exact product, model or system version, configuration, task, population, region and operating conditions. |
| Owner and date | Who supplied or checked the evidence and when it was last validated. |
| Independent verification | Whether a party outside the vendor reproduced, reviewed or audited the result. |
| Limitation | Known exclusions, sample limits, failure cases, confidence intervals or conditions that were not tested. |
| Residual uncertainty | What you still cannot establish from the available material. |
| Decision impact | The control, pilot restriction, contract term or rejection decision caused by the uncertainty. |
Use “not stated” when the supplier provides no answer. The AI TrustMark supplier-evaluation guide, updated 19 September 2026, puts the principle plainly: “Marketing claims alone are not verified evidence.” A policy can describe intent; it does not demonstrate that the deployed system meets the policy.

What should I ask an AI vendor before buying?
Send a structured request and require answers tied to the version and deployment you will purchase. A useful disclosure pack covers the following areas.
Purpose, limits and known failures
- What are the documented intended and out-of-scope uses?
- Which failure modes have been observed, and under what conditions?
- What operating limits, confidence indicators or abstention behavior exist?
- Which decisions must remain with a trained human?
Models, data and evaluation
- Provide a model card or system card for the exact commercial version, not only a generic foundation-model card.
- Describe training and evaluation data: provenance, licensing, collection method, representativeness, languages, time period and exclusions.
- Provide task-specific results by relevant population, language, environment and operating condition.
- Identify test sets, metrics, validation methods, red-team or adversarial testing, sample sizes and test dates.
- Explain whether results were produced by the vendor, a customer, an auditor or another independent party.
Privacy and data flows
- What data is collected, where is it processed and how long is it retained?
- Who can access prompts, outputs, logs and support copies?
- Are customer inputs used to train or improve models, and can that use be disabled?
- How are deletion requests, backups, tenant isolation and subprocessors handled?
- What data leaves your chosen region or crosses a jurisdictional boundary?
Security and resilience
- Describe identity and access controls, encryption, key management, network isolation and privileged support access.
- How are vulnerabilities, supply-chain risks, prompt injection and data exfiltration investigated?
- What logging is available to you, for how long, and can logs support an incident investigation?
- What are the outage, recovery, backup and service-level commitments?
- How and when will the supplier notify you of a breach or material security event?
Human oversight, fairness and redress
- Show the workflow for review, override, escalation and safe shutdown.
- Provide subgroup or intersectional performance where protected or vulnerable groups may be affected.
- Explain how harmful bias is measured, mitigated and re-tested after changes.
- Identify user training, support, complaint handling and a route for affected people to challenge an output.
Change, audit and exit terms
- What model, dependency, policy or retrieval changes require notice or approval?
- Can you pin a version, test a new version in a sandbox, roll back and preserve logs?
- Will the supplier permit an independent audit and provide test reports, logs and quality criteria?
- What audit rights, indemnity scope, service levels, portability and deletion commitments apply when you leave?
The NIST procurement workbook asks suppliers whether they permit independent third-party audits and whether they can provide documentation such as test reports, logs and quality criteria. A refusal is therefore a procurement fact to record, not an awkward detail to omit.
How should I read model cards, system cards and datasheets?
These artifacts are useful only when their scope matches your deployment. A model card typically describes a model’s purpose, intended and off-label uses, performance, evaluation data and limitations. A datasheet focuses on a dataset’s motivation, composition, collection and recommended uses. A system card addresses the complete system and deployment context, including layers that a model card leaves out.
Check identity and currency
- Does the document name the model or system version used in your contract?
- Is there a publication or test date, and does it predate a material update?
- Are the test population, language, environment, prompts, tools and metrics described?
- Are limitations and failed cases reported, or only headline results?
A generic card for a foundation model cannot by itself establish how a vendor’s retrieval, prompt templates, moderation, ranking, human-review or tool-use layers perform. Missing version, date, population or limitation information is an evidence gap. It does not prove the supplier failed to perform the work, but it prevents you from verifying the claim from the supplied material.
How can I compare two AI products when benchmark claims are not comparable?
Compare products on explicit, use-case-specific axes rather than placing unmatched benchmark numbers in one league table. Results are comparable only when model version, test data, metrics, validation method, configuration and test date are sufficiently aligned.
| Axis | Questions to answer |
|---|---|
| Purpose and fit | Is your intended use inside the documented scope, and are prohibited uses clear? |
| Validity and reliability | Are task-specific results repeatable under your data, workflow and operating conditions? |
| Safety and robustness | What happens with unusual, adversarial, incomplete or degraded inputs? |
| Fairness | Are relevant groups measured, and are harmful disparities mitigated? |
| Explainability | Can operators and affected people understand, question and correct an output? |
| Privacy and data governance | What is collected, retained, shared or used for training, and how is it deleted? |
| Security and resilience | How are access, isolation, vulnerabilities, incidents and outages handled? |
| Accountability | Are owners, logs, audit rights and redress routes defined? |
| Change control | Are model, dependency and policy changes disclosed, tested and reversible? |
| Operational fit | Can staff use, monitor, override and safely exit the system? |
Weight the axes according to the harm boundary. For a customer-support drafting tool, privacy and operational recovery may dominate. For a ranking system affecting access to services, subgroup validity, explainability, appeal and human override should carry much greater weight than a small difference on a general benchmark.

Run a customer-controlled evaluation
- Freeze a representative, lawfully usable test set that reflects your languages, edge cases and workload.
- Define metrics before seeing results, including error severity, abstention, latency, subgroup outcomes and reviewer override rates.
- Document prompts, retrieval sources, tools, model version, temperature or equivalent settings and dates.
- Have an independent team or qualified reviewer inspect a sample of outputs and failure cases.
- Repeat the test after a material update and compare both performance and failure patterns.
NIST’s Measure guidance emphasizes documenting pre- and post-deployment performance, external inputs, test sets, metrics and risks that are not measured. That record is more useful than a vendor’s uncontextualized “state of the art” claim.
What should I do when a vendor refuses to disclose how its AI works?
Treat the refusal as a decision input. Record the exact question, the supplier’s stated reason, the risk created and whether a narrower claim or alternative evidence is available. Commercial confidentiality can justify withholding source code or sensitive weights; it does not automatically justify withholding version identity, test scope, data handling, incident procedures or change terms needed to manage your risk.

Try proportionate alternatives
- Request a confidential review under a nondisclosure agreement.
- Ask for an independent assurance report, redacted test summary or auditor attestation.
- Use a customer-controlled evaluation environment with restricted data.
- Replace a broad promise with a narrower contractual commitment tied to a measurable task.
- Require notice, testing and rollback rights for material model or dependency changes.
If material uncertainty remains, compensate with a limited pilot, human review, access restrictions, logging, rate limits, data minimization and a defined stop trigger. Do not award a high score because the vendor has a polished policy or framework logo. If the remaining uncertainty could cause unacceptable harm and cannot be controlled, defer or reject the purchase.
How do I evaluate privacy, security and data governance in practice?
Trace one piece of sensitive input from entry to deletion. Identify every copy in prompts, retrieval indexes, caches, logs, backups, support systems and subprocessors. Confirm the legal and technical basis for processing, the retention period, deletion propagation and who can retrieve historical content.
For security, ask to see the architecture and the operating process rather than relying on a certification badge. Verify least-privilege access, administrative separation, encryption, vulnerability disclosure, incident response, forensic logging and recovery objectives. Test whether an ordinary user can trigger tool calls, retrieve another tenant’s data or place secrets into a prompt that is later exposed through output or logs.
Require a change record for alterations to models, filters, retrieval sources, hosting regions and subprocessors. A silent change can alter both accuracy and data risk, so version pinning, notification, regression testing and rollback are operational controls, not optional paperwork.

How do I test fairness, explainability and human oversight?
Define the groups and intersections that matter in your use case before requesting metrics. Compare error types, false positives, false negatives, abstentions, wait times and override rates, not only an aggregate accuracy figure. Ask whether the sample represents real users and whether performance changes across language, disability, geography, age or other relevant conditions.
Explainability should be matched to the decision. Operators need enough information to detect an error and intervene; affected people need a comprehensible reason and a way to challenge it. A confidence score without a calibrated meaning, or a generated rationale that is not causally connected to the output, is not sufficient explanation.
Document who reviews outputs, what training they receive, how often they override the system and what happens when the system is unavailable. Human-in-the-loop is meaningful only when the reviewer has time, authority, information and a practical way to disagree.
What should a safe pilot and approval decision look like?
Use a staged pilot with production-like data only when lawful and necessary. Start with a small user group, non-binding outputs, strict access controls and manual review. Define success and stop criteria before launch.

Pilot checklist
- Named accountable owner and escalation contacts.
- Approved data sources and retention settings.
- Baseline performance and representative test set.
- Logging of inputs, outputs, model version, overrides and incidents.
- Review queue for high-risk or low-confidence cases.
- Monitoring for drift, subgroup harm, complaints and security events.
- Rollback procedure tested by the operations team.
Approve only the documented use, version and configuration. Put unresolved items in the decision record with an owner and due date. Approval can be conditional on contractual audit rights, data-use restrictions, notification periods, service levels, indemnity, portability and a right to suspend processing.
How does evaluation continue after launch?
Transparency is a lifecycle obligation. NIST’s accountable-and-transparent characteristic spans design decisions, training data, model training, intended uses, deployment decisions and the people who made those decisions. The UK procurement guidance likewise emphasizes explainability, testing under varied conditions, defined performance, security, logging, auditability and ongoing monitoring.
Best Value
Maintain a post-launch register of performance, drift, incidents, overrides, user complaints, subgroup outcomes, external data or API changes and unresolved risks. Re-test after material updates, new retrieval sources, policy changes or a shift in user population. Notify decision-makers when a metric crosses a stop threshold, and preserve the evidence needed to investigate what happened.
The NIST AI Risk Management Framework, released 26 January 2023, is voluntary and intended to help organizations incorporate trustworthiness into the design, development, use and evaluation of AI products, services and systems. It is a structure for making and documenting decisions, not a universal vendor ranking or a guarantee of safety.
What counts as enough evidence to proceed?
There is no universal pass mark for AI products. Evidence is sufficient only for a defined use, population, configuration and period, with controls that address the remaining uncertainty. A defensible decision record can say: the claim was tested under these conditions; these limitations remain; these people are accountable; these controls reduce the residual risk; and this event will trigger suspension or re-evaluation.
When a supplier cannot establish a material claim, choose among four honest responses: narrow the claim, obtain stronger evidence, add technical or contractual controls, or do not proceed. That discipline protects the organization from turning an absence of information into an assumption of quality.
Frequently Asked Questions
Can a model card prove that an AI product is safe?
No. A model card describes a model’s scope and reported limitations, but it may not cover retrieval, prompts, moderation, tools, human review or the commercial deployment. Check that its version, test conditions and date match the complete system you will operate.
What evidence should a small company request if it lacks an AI safety team?
Ask for a concise system description, versioned evaluation summary, data-flow and retention diagram, security controls, incident process, change-notice terms and an independent assurance report where available. Use a limited pilot with manual review and keep a written register of unanswered questions rather than relying on a vendor score.
How often should an AI system be re-evaluated?
Re-evaluate after any material model, dependency, policy, retrieval-source or hosting change, and whenever the user population or task changes. Continuous monitoring should track incidents, drift, overrides, complaints and subgroup outcomes so that a scheduled review is not your only warning.
Is refusing to reveal source code automatically a deal-breaker?
Not necessarily. Protecting proprietary code can be reasonable if the supplier provides verifiable evidence about behavior, data handling, security, limits, audit access and change control. It becomes a blocker when the withheld information prevents you from testing or controlling a risk that matters to the proposed use.
