How to Disclose AI Use Clearly in Products and Communications

Clear AI disclosure tells people what they are encountering, when they need to know it, and what the system actually did. In practice, that means a plain notice before or at a chatbot’s first exchange, a visible or audible label on synthetic or manipulated media, and a specific disclosure for AI-generated public-interest text when no meaningful human editorial control occurred. Hidden metadata, a generic footer, or a link to a policy page is not a substitute for a notice people can perceive and understand.

Use the stricter applicable rule when several regimes overlap. The European Union’s AI Act Article 50 transparency duties apply from 2 August 2026, while US advertising disclosures remain subject to the Federal Trade Commission’s clear-and-conspicuous standard. The workflow below helps product, marketing, editorial, legal, and accessibility teams implement those requirements consistently.

What does clear AI disclosure mean?

A clear disclosure is a timely, noticeable statement that identifies the AI involvement relevant to the person’s decision or experience. It should answer three questions without forcing the audience to investigate: Am I interacting with AI or seeing synthetic content? What role did AI play? What should I understand about authenticity or human review?

Clarity is not achieved by using the word “AI” somewhere. The notice must be distinguishable from surrounding content, accessible to the intended audience, and placed where the interaction or claim occurs. A person should not need special software, a metadata viewer, a second click, or a long legal document to discover the fact.

  • Specific: Say “You’re chatting with an AI assistant” or “AI-generated image,” rather than “technology may be used.”
  • Timely: Give the notice at the first interaction or exposure when that is the applicable trigger.
  • Perceivable: Use visible text, audible language, or both, depending on how people encounter the content.
  • Accurate: Describe whether AI generated, transformed, recommended, or merely helped format the material.
  • Accessible: Make the notice usable with screen readers, captions, sufficient contrast, keyboard navigation, and other relevant accommodations.

A disclosure can be short and still be effective. Brevity is useful only when it does not hide the material fact or create a misleading impression.

Who has to disclose AI use, and when?

Responsibility depends on the role your organization plays and the type of AI use. The same company may be a provider for one system, a deployer for another, and an advertiser or publisher for a campaign. Map each touchpoint instead of assigning disclosure to one department.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Situation Primary actor What people should receive Timing or trigger
Direct, two-way interaction with an AI system Provider of the interactive system A plain statement that the person is interacting with AI At the start of the first interaction, unless the AI nature is genuinely obvious in context
AI-generated or manipulated image, video, audio, or text output Provider must support machine-readable marking; the deployer or publisher must make required user-facing disclosures A visible or audible indication that the content is artificially generated or manipulated, plus machine-readable marking where applicable When the audience first encounters the media or output
Deepfake published or displayed by a deployer Deployer A perceivable label, such as visible text or an audible statement On or alongside the deepfake, not only in file metadata
AI-generated or manipulated text about a matter of public interest Deployer or publisher with editorial responsibility Disclosure of AI generation or manipulation when the human-review exception does not apply With the published text or at the point where readers encounter it
Advertising, sponsored content, or product claims Advertiser and other parties responsible for the communication A disclosure that prevents a reasonable audience from being misled about the claim, speaker, relationship, or AI involvement Close to the claim, in the same format and at the same time people consume it

The European Commission describes four cumulative conditions for the direct-interaction duty: the system qualifies as AI, is designed for genuine two-way exchange, communicates directly with a person, and interacts with a natural person. A static search box or automated background process may require a different analysis, but do not assume an interface is exempt merely because it looks conventional.

How should a chatbot, agent, or avatar disclose that it is AI?

Put a plain notice in the interaction surface before, or no later than, the first exchange. Keep it visible while the conversation starts, and ensure assistive technologies announce it. A logo, synthetic voice, animated avatar, or futuristic design does not by itself make the AI nature genuinely obvious to an ordinary user.

Use a direct opening notice

Examples include:

  • “You’re chatting with an AI assistant.”
  • “This support agent is powered by AI. Ask for a human representative at any time.”
  • “AI is generating responses in this conversation; verify important information before relying on it.”

Choose the wording that matches the system’s role. If the model only routes requests, say that. If it drafts answers that a human approves, explain the human checkpoint rather than implying the human wrote every sentence.

Place the notice where the exchange begins

Display the statement above the message composer, in the first system message, or in an opening screen that must be seen before a person submits a request. Do not place it only in a privacy policy, a help-center article, a tooltip that disappears, or a footer below the conversation. If the user can start speaking before the notice is announced, the design is too late.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Handle human handoffs explicitly

When a person takes over, announce the change: “A human support specialist has joined this conversation.” When the human leaves and AI resumes, say so again. Keep a transcript marker or other accessible signal so a person reviewing the conversation later can tell which messages came from which source.

Support language and disability access

Translate the notice for every language supported by the product. Expose it to screen readers in the correct reading order, provide captions or an equivalent visual statement for voice interfaces, and do not rely on color or an icon alone. Test at common zoom levels, on mobile screens, and with keyboard-only navigation.

How should images, video, audio, and synthetic voices be labeled?

Use a human-facing label at the point of exposure and preserve machine-readable marking or provenance supplied by the generation system. The two signals serve different purposes: people need an understandable cue, while platforms and tools need a detectable technical signal.

Images

Place “AI-generated image” or “Image created with generative AI” in the caption, on the image itself when it may be separated from its caption, or in an adjacent clearly associated label. If the image depicts a real person, event, or place in a materially altered way, identify the manipulation rather than using a vague “edited” tag.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Video

Show the label in the player or immediately beside the video. Keep it on screen long enough to read; a disclosure that flashes for a fraction of a second is not clear and conspicuous. For short-form video, repeat the label if viewers may enter partway through, and include it in captions or an equivalent text track.

Audio and voices

Say “This voice was generated with AI” at the beginning or provide a persistent, readable label in the player. If the content is distributed as an audio-only file, include the disclosure in the spoken track and in the episode or file description. Make sure the spoken notice is intelligible at ordinary playback speeds.

Deepfakes

A deepfake requires a perceivable deployer disclosure. Metadata hidden inside the file cannot be the only notice because viewers may encounter a re-encoded copy, a screen recording, or a platform that strips metadata. Put the label where viewers encounter the manipulated face, body, voice, or event.

Keep provenance intact

Do not remove machine-readable markers when cropping, transcoding, exporting, or moving assets between systems. Record which tool created the file, what transformations were applied afterward, and whether the destination platform preserves the marker. A technical mark supports detection; it does not replace the visible or audible explanation.

When must public-interest text disclose AI involvement?

AI-generated or manipulated text published to inform the public about a matter of public interest should carry a disclosure when it has not received the human review or editorial control relevant to the Article 50 exception and a person or organization holds editorial responsibility.

“Public interest” can include reporting, public safety information, election-related information, health notices, civic guidance, and other material intended to shape public understanding. Do not decide based only on the channel; a newsletter, app notification, social post, or webpage can all reach a public audience.

Describe the actual AI role

If AI generated substantive claims, say that. Do not label a fully generated article as “AI-assisted editing.” Conversely, if a journalist or subject-matter expert wrote and verified the text while AI corrected spelling or suggested headlines, describe the limited role accurately.

Document the human-review exception

Record who reviewed the material, what they checked, whether they had authority to change or reject it, and who holds editorial responsibility. A nominal approval click is not the same as meaningful editorial control. Retain the version reviewed and the final published version so the organization can explain any material changes.

Use a reader-facing statement

Examples include “This briefing was generated with AI and has not received human editorial review” or “AI drafted this article; an editor verified the claims and approved the final copy.” Put the statement near the headline or opening, not only in an about page.

How do advertising and product communications apply the clear-and-conspicuous standard?

For advertising and marketing, the Federal Trade Commission’s guidance applies the same consumer-protection principles online as in other media. A disclosure is effective when people notice it, understand it, and receive it before the claim or impression causes a misleading takeaway.

Put the notice next to the claim

If an AI-generated spokesperson makes a product claim, place the AI disclosure beside the claim or in the spoken script. A notice in a comment thread, collapsed description, distant policy page, or vague hyperlink is easy to miss. Do not make the overall presentation imply that a real customer, doctor, employee, or celebrity made a statement when that person did not.

Match the medium

  • Static display: Use readable type, strong contrast, and a position adjacent to the claim.
  • Video: Show the disclosure and say it aloud when either channel is necessary for comprehension; leave it visible long enough to read.
  • Audio: Include a spoken disclosure at a natural point before the relevant claim.
  • Interactive product pages: Repeat the notice when a user opens a generated recommendation, review, image, or comparison, rather than assuming they saw a general site banner.

Do not contradict the disclosure

A tiny “AI-generated” label cannot cure a presentation that otherwise strongly suggests an authentic human endorsement or an unaltered event. Review the whole impression, including the voice, setting, testimonials, animation, and surrounding copy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Is machine-readable marking enough?

No. Machine-readable marking helps services detect artificially generated or manipulated content, but it is not a human-facing disclosure. For a covered deepfake or other synthetic media presented by a deployer, people must be able to perceive the notice without special tools or extra actions.

Signal Who uses it What it accomplishes What it cannot do alone
Visible text label People viewing a page, post, image, or video Explains the content’s AI status immediately Guarantee that a re-uploaded copy retains provenance
Audible disclosure People consuming audio or voice content Works when no visual channel is available Help a person who cannot hear the track unless a text equivalent exists
Machine-readable metadata or watermark Platforms, search tools, moderation systems, and forensic services Enables automated detection or provenance checks Satisfy a user-facing disclosure duty by itself
Policy-page explanation People seeking additional detail Provides full methodology, ownership, and retention information Replace the notice at first interaction or exposure

Implement both layers when applicable, and monitor whether downstream platforms strip or ignore technical markers.

How can a team build an AI-disclosure workflow?

Treat disclosure as a repeatable release control rather than a copywriting task performed at the end. The following sequence works for product launches, campaigns, editorial publishing, and changes to an existing model.

  1. Inventory AI touchpoints. List chat interfaces, agents, recommendation surfaces, generated media, synthetic voices, editorial tools, advertising assets, customer-service scripts, and internal systems that can reach an external audience.
  2. Classify each touchpoint. Mark it as direct interaction, generated content, manipulated content, public-interest text, advertising communication, biometric or emotion-recognition exposure, or internal-only assistance. Flag mixed cases instead of forcing one label.
  3. Assign the legal and operational role. Record whether your organization is acting as provider, deployer, advertiser, publisher, or more than one. Identify any vendor whose technical marking or documentation you depend on.
  4. Assess the authenticity risk. Ask whether a reasonable person could mistake the output, speaker, image, voice, or event for human or authentic. Consider the audience’s age, expertise, language, context, and likely viewing path.
  5. Select the exact wording. State what AI did, what a human did, and any limitation that changes how the audience should interpret the material. Avoid euphemisms such as “smart enhancement” when the material was generated.
  6. Set placement and timing. Choose the first-interaction notice, media label, spoken disclosure, caption, or claim-adjacent statement. Specify duration, persistence, contrast, size, and whether it must repeat for late arrivals.
  7. Preserve technical provenance. Keep machine-readable marks and generation records through export and publication. Note when a platform cannot retain them and add compensating human-facing labels.
  8. Record review and ownership. Capture the system version, AI role, content type, intended audience, reviewer, editorial owner, approval date, exception rationale, and planned recheck date.
  9. Test with representative users. Test comprehension, not merely visibility. Include screen readers, captions, keyboard navigation, mobile layouts, low-vision settings, and the languages in which the product is offered.
  10. Monitor changes. Recheck the design when laws, regulator guidance, platform rules, model behavior, or generation tools change. A label that was accurate for a text assistant may become misleading after the system begins producing images or taking actions.

What wording and placement should teams use?

Use the shortest statement that communicates the material fact, then add detail where it changes a person’s decision. The examples below are starting points, not universal safe harbors.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Use case Recommended first-line notice Useful second line when needed
Chatbot “You’re chatting with an AI assistant.” “A human specialist can take over; ask for one at any time.”
AI customer-service draft reviewed by staff “AI drafted this reply; a support specialist reviewed it.” “Ask us to clarify or correct anything that affects your account.”
Generated image “AI-generated image.” “People, places, or events may be synthetic or materially altered.”
Manipulated video “This video contains AI-generated or manipulated footage.” Identify the altered person, scene, or segment if that matters to interpretation.
Synthetic voice “This voice was generated with AI.” “It does not represent a live statement from the named person.”
Public-interest article without qualifying human review “This text was generated or materially manipulated with AI and has not received human editorial review.” State who is responsible for publication and where readers can report an error.
AI-assisted advertising claim “The spokesperson and demonstration are AI-generated.” Separately disclose sponsorship, qualifications, or material limitations required for the claim.

Do not combine unrelated facts into an unreadable paragraph. Put the essential AI disclosure first, then link or point to fuller methodology if the audience needs it.

What accessibility and user-testing checks prevent disclosure failures?

A notice can be technically present yet functionally invisible. Test the complete journey from entry point to consumption, including people who arrive through a shared link or begin a video midway.

  • Confirm screen readers announce the notice before the first interactive control.
  • Provide synchronized captions or a text equivalent for spoken disclosures.
  • Check contrast, text size, reflow, zoom, and dark-mode behavior.
  • Make labels persistent or repeat them when content can be encountered out of order.
  • Ensure keyboard users can reach and understand the notice without opening a hover-only element.
  • Test translation quality; do not leave the disclosure in a language the user did not choose.
  • Ask participants to describe what they think the AI did. If they infer a stronger human role or greater authenticity than intended, rewrite the notice.

Keep screenshots, scripts, accessibility test results, and version dates with the release record. These artifacts show how the communication was designed, not just what the final copy said.

What are the most common disclosure mistakes?

Using one generic footer everywhere

“AI used” at the bottom of a site does not tell a chatbot user, video viewer, or reader of a public-interest article what happened in that specific experience. Use a context-specific notice at the relevant interaction or exposure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on metadata alone

Metadata may be stripped, unavailable to ordinary viewers, or unreadable without special software. Preserve it, but add visible or audible language where a person needs to know.

Hiding the statement in legal text

Dense terms, long license agreements, and vague hyperlinks are poor locations for a material fact. Put the plain-language disclosure in the main user flow and offer detailed policy information separately.

Labeling the tool instead of the output

Saying “made using an AI platform” may not tell people that a real-looking photograph, voice, or quote was synthesized. Identify the output’s status and any material alteration.

Calling generation “editing”

That wording understates AI’s role when it created claims, dialogue, imagery, or a person’s voice. Match the label to the substantive work performed.

Failing to update after a product change

A disclosure written for a text-only assistant can become inaccurate when the system gains voice, image, recommendation, or autonomous-action features. Reclassify the touchpoint at each material release.

What dates and jurisdictions should teams plan around?

Article 50 transparency obligations under the European Union AI Act apply from 2 August 2026. The European Commission describes a limited later date of 2 December 2026 for marking and detection obligations for certain AI systems placed on the market before 2 August 2026. That later date does not remove the need for user-facing interaction or deployer disclosures that already apply.

The direct-interaction rule is framed around informing people at the latest at first interaction, and the Commission says the information must be provided clearly, distinguishably, and accessibly. If your service is available in the EU, design for those requirements now rather than treating the later marking date as a general grace period.

In the United States, FTC guidance is principles-based rather than a single AI-labeling statute. The same consumer-protection laws that apply to commercial activity in other media apply online. A disclosure that is technically present but hard to notice, contradicted by the overall impression, or separated from the claim can still fail the clear-and-conspicuous standard.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Interactive Advertising Bureau’s AI Transparency & Disclosure Framework V2, published 18 August 2026, offers a risk- and materiality-based decision aid for advertising and marketing. Use it to structure industry practice, but treat applicable law and regulator guidance as controlling.

How should organizations govern disclosures over time?

Assign one accountable owner for each disclosure, even when several teams contribute. Product should own interface timing; editorial should own public-interest text and human review; marketing should own claim-adjacent notices; engineering should own technical marking and retention; accessibility specialists should verify perceivability; and legal or compliance should resolve jurisdictional questions.

Maintain a register with these fields:

  • System and version
  • Provider, deployer, publisher, and advertiser roles
  • AI function and content types
  • Audience, geography, languages, and channels
  • Authenticity or deception risk
  • Required visible, audible, and machine-readable signals
  • Exact approved wording and placement
  • Human-review and editorial-responsibility status
  • Approval owner, launch date, and next review date
  • Known platform limitations, exceptions, and remediation steps

Review the register whenever a model, interface, campaign, distribution platform, or applicable rule changes. A living record prevents teams from assuming that a provider’s technical mark or an old site-wide notice covers a new user experience.

What is the practical standard for launch approval?

Before release, a reviewer should be able to answer “yes” to all of the following:

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The audience is told about AI at the first relevant interaction or exposure.
  • The wording accurately describes generation, manipulation, assistance, and human review.
  • The notice is visible or audible in the medium people actually use.
  • Machine-readable marking is preserved where the system supports it.
  • The design works for screen readers, captions, keyboard users, mobile layouts, and supported languages.
  • The disclosure sits next to the claim or content it qualifies and is not contradicted by the overall presentation.
  • Ownership, review status, exceptions, and dates are recorded.
  • The team has a plan to recheck the notice after model, platform, or legal changes.

This standard turns disclosure from a vague promise into an observable product and communications control: people receive the material fact when it can affect how they interpret the interaction, content, or claim.

Frequently Asked Questions

Does every use of AI inside a company need to be disclosed publicly?

No. Internal assistance that never reaches an external audience may not require a user-facing notice under the situations described here. Keep an internal record anyway, and reassess if AI-generated material is later published, used in a customer decision, or incorporated into a public claim.

Can I disclose AI use with an icon instead of words?

An icon alone is risky because people may not recognize its meaning and assistive technologies may not announce it. Pair any icon with plain text or spoken language, and provide an accessible explanation in the same interaction or media player.

What should a company do when a platform removes its AI metadata?

Keep the original marked asset and document the platform limitation. Add or retain a prominent visible or audible label on the published version, and ask the platform whether it supports an alternative provenance or disclosure field.

Free tools Windows power users keep installed

How often should AI disclosure language be reviewed?

Review it at every material model, interface, content-format, distribution, or legal change, and at the date recorded in your disclosure register. A scheduled review alone is not enough if the system’s capabilities change between review dates.

Who should approve a disclosure for a public-interest article?

The person or organization with editorial responsibility should approve the wording and document the actual human review performed. Legal or compliance can advise on the applicable rule, but approval should remain with the team accountable for the published information.
