Creating an AI version of yourself is a rights-and-contract project, not merely a software exercise. You need to define what the replica contains—voice, face, likeness, movement, name, biography, performance data or a trained model—then obtain informed written consent for each intended use. A workable license states the media, audience, territory, language, term, compensation, approvals, disclosure, security, sublicensing, takedown, deletion and postmortem rules. Copyright in a recording or photograph is separate from rights in your identity, and state law, union agreements and estate rules can change the result. Have independent entertainment or intellectual-property counsel review the governing law and final agreement before any recording, model training or publication.
What is an AI version of yourself?
An AI version can be a synthetic voice, a talking avatar, a digital double, a chatbot written in your style, a motion-capture character, or a model trained on your recordings and images. Those components create different legal interests. A voice session may involve performer and labor rights; a photograph or recording has a copyright owner; your name, face and recognizable persona may be protected by publicity, privacy or unfair-competition laws; and the software model may be owned by the developer or licensee.

Do not treat the phrase “AI clone” as a single asset in a contract. List every input, transformation and output. A license that permits a company to capture your voice is not automatically permission to train a reusable model, generate new sentences, place the voice in advertising or give the model to another company.
How do I make an AI clone of myself legally?
Use a staged process. Each stage creates a separate approval record so that consent to build the system cannot be mistaken for consent to publish every future output.

- [Deep Bass with Clear Vocals] High-performance drivers produce punchy bass while keeping vocals clean and detailed for everyday listening.
- Define the replica. Write down whether the project includes voice, visual likeness, face, body movement, name, biography, catchphrases, performance capture, recordings, photographs, biometric measurements, training data, model weights and generated outputs. State whether an existing performance may be materially altered.
- Map ownership and permissions. Identify who owns each recording, photograph, script, musical work, costume design, scan and dataset. Obtain permission from photographers, studios, writers, musicians or other rightsholders where your materials contain their work. Your personal consent cannot transfer a copyright you do not own.
- Describe every proposed use. Specify the product or character, medium, campaign, audience, language, territory, distribution channel and duration. Name whether the output is entertainment, education, customer support, advertising, political communication, news-style content or another category.
- Separate creation from deployment. Sign one approval for capture and model training and another for generating or publishing outputs. Require a fresh written approval for a new client, campaign, product category, language, territory or materially different performance.
- Choose a license scope. Decide whether the grant is narrow and nonexclusive, or broad and exclusive. Set a definite term and territory unless counsel confirms why a longer grant is necessary and enforceable.
- Set compensation and controls. Negotiate an upfront fee, minimum payments, royalties, residuals, reuse fees, accounting and audit rights. Reserve approval or veto rights for sensitive contexts and require disclosure that a performance is synthetic when appropriate.
- Protect source material. Require encryption, access limits, retention periods, breach notice, deletion and return of recordings, scans, biometric data and model weights. Define whether a vendor may use the material to train another model.
- Plan the end of the relationship. State what happens when the term expires, a party terminates, a breach occurs, you become incapacitated or you die. Include takedown deadlines, disabling of generation, deletion certification and any continuing estate rights.
- Obtain independent advice. Counsel should check publicity, privacy, labor, advertising, data-protection and inheritance rules in every relevant jurisdiction before signature.
What rights and assets should the agreement identify?
A schedule attached to the contract should describe the assets in plain language. The following table helps prevent a broad label such as “likeness” from hiding an unexpected use.
| Asset or right | Questions the contract should answer |
|---|---|
| Voice and speech patterns | May the licensee synthesize new words, accents, languages or emotional states? Are source recordings retained after training? |
| Face and visual likeness | May the face be placed on another body, age-shifted, stylized or combined with a fictional character? Are scans and facial embeddings deleted? |
| Body movement and performance | Can motion capture be edited, looped or transferred to another character? Is material alteration allowed? |
| Name, biography and catchphrases | May the system answer questions as if it were you, state opinions, or create new biographical claims? |
| Recordings, photographs and scripts | Who owns the underlying copyright, and what reproduction, adaptation or distribution rights are granted? |
| Training data and model | Who may use the data, model weights, embeddings and fine-tuned versions? Can they be transferred to a vendor or used for another model? |
| Generated outputs | Who may publish, edit, license or monetize each output, and what approval and attribution rules apply? |
Copyright in a fixed work does not automatically give the copyright owner the right to impersonate the person depicted or heard. Conversely, your identity rights do not automatically give you copyright ownership of a photograph or sound recording made by someone else. The agreement should license both sets of interests where necessary.

What should an AI voice or digital-likeness contract include?
1. A precise grant of rights
Use a numbered grant that names the asset, permitted technologies and permitted outputs. State whether the license is exclusive, nonexclusive, transferable or sublicensable. Avoid relying on a generic grant of “all rights in all media” without a schedule explaining the actual project.
2. Specific intended uses
List the product, character, campaign, audience, language, territory, channels and term for each use. Include examples of allowed and prohibited prompts or scenarios. California Assembly Bill 2602 and New York General Obligations Law section 5-302 both make reasonably specific intended uses important in covered contracts; a vague clause can create enforceability problems.
3. Separate approvals for training and publication
State that capture, model training, internal testing, generation and public release are separate permissions. A company should not be able to argue that permission to build a model also authorized a later endorsement, a new client campaign or a substantially different performance.
4. Compensation and accounting
Specify the signing or session fee, minimum guaranteed payments, royalties, residuals, reuse fees and payment dates. Define the revenue base, permitted deductions, currency and tax treatment. Give you periodic statements and a practical audit right, including a remedy if an underpayment exceeds an agreed threshold. If the license is a buyout, identify exactly which future payments are being exchanged for the buyout and which uses still trigger a fee.

5. Approval, veto and disclosure rights
Reserve approval for political endorsements, sexual or violent material, medical claims, news-style presentations, financial or safety claims, and any use reasonably likely to damage your reputation. Set a review period and a deemed-approval rule only if you are comfortable with it. Require an on-screen, audio or metadata disclosure that the performance is synthetic when the audience could otherwise be misled.
6. Downstream use and vendors
Name the model host, production vendors and advertising partners, or require your written consent before adding them. Prohibit sublicensing, assignment, model transfer or geographic expansion unless the contract expressly allows it. Every approved vendor should receive the same confidentiality, security, deletion and use restrictions.
7. Data security and deletion
Define encryption in transit and at rest, role-based access, logging, breach notification and a maximum retention period. State whether backups, caches, embeddings and model weights must be deleted, and require written certification. If a vendor cannot technically remove your contribution from a shared model, the contract should prohibit that architecture or provide a different remedy before training begins.
8. Term, territory and exclusivity
Give the license a start date, end date and renewal process. Identify countries and language markets rather than assuming worldwide rights. If the grant is exclusive, define the field of exclusivity and list activities you may continue, such as personal appearances, your own channels or unrelated products.
9. Takedown, suspension and remedies
Provide an emergency contact and a deadline for disabling a disputed output. Permit immediate suspension for an unauthorized use, security incident or reputationally harmful release. Specify injunction or takedown rights, cure periods, indemnities, liability caps and the process for preserving evidence.
10. Incapacity and death
Name the person authorized to act if you cannot give instructions. State whether consent survives death, for how long, at what compensation, and who may approve new uses. Require estate approval where the governing law demands it, and explain how royalties, audits and takedowns continue after death.

Should I choose a narrow license or a broad buyout?
A narrow, nonexclusive license preserves control and future bargaining power but requires the licensee to return for additional uses. A broad exclusive buyout can command more money and simplify production, but it transfers control for a longer period and can restrict your own work. Compare the options before signing rather than treating “buyout” as a single standard product.
| Contract point | Narrow, nonexclusive license | Broad, exclusive buyout |
|---|---|---|
| Permitted uses | Named products, campaigns and output categories only. | May cover many products and output categories; the schedule must still be specific enough to be enforceable. |
| Term and territory | Usually a defined period and selected countries or language markets. | May be long or worldwide; negotiate renewal, sunset and reversion dates. |
| Compensation | Fee plus reuse payments, royalties or residuals as new uses arise. | Larger upfront payment, but fewer later payments; list exceptions and accounting duties. |
| Approval rights | Practical to require approval for each campaign or sensitive output. | Must expressly preserve vetoes; exclusivity does not automatically remove them. |
| Sublicensing and vendors | Consent can be required for each downstream party. | Licensee may seek broad transfer rights; limit them to named, bound vendors. |
| Data and model control | Deletion and disabling are easier to enforce at expiry. | Require a detailed model inventory, transfer restrictions and deletion certification. |
| Postmortem rights | Short, defined survival period can be negotiated. | Estate consent, term and compensation must be explicit; a perpetual grant has major consequences. |
| Remedies and governing law | Set rapid takedown and injunction procedures for each use. | Address forum, indemnity and liability limits carefully because more uses create more exposure. |
What do U.S. laws and union rules change?
Federal digital-replica policy
The U.S. Copyright Office released Part 1 of its artificial-intelligence report on July 31, 2024 and recommended that Congress create a federal law protecting everyone from knowing distribution of unauthorized digital replicas. That recommendation is not itself a federal license or a substitute for a state-law analysis. The same office published Part 2, concerning copyrightability of generative-AI outputs, on January 29, 2025; copyrightability of an output remains a separate question from permission to use your identity.
The Tool Desk
Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →California AB 2602
California AB 2602 addresses new digital-replica performances fixed on or after January 1, 2025. A covered provision can be unenforceable when it lacks a reasonably specific description of intended uses and the individual was not represented by qualifying legal counsel or a labor union. If a California performance falls within the statute, arrange qualifying representation before signing and attach a detailed use schedule.
California AB 1836
California AB 1836 requires estate consent for covered commercial digital replicas of deceased performers. A company planning to continue or create a replica after death should identify the authorized estate representative, obtain the required consent and state compensation and approval procedures in the original agreement.
New York General Obligations Law section 5-302
New York’s statute addresses contracts for creation and use of digital replicas and likewise requires attention to reasonably specific intended uses. A New York-connected deal should be reviewed for the statute’s scope, choice-of-law language and any limits on assignment or future uses.
Union-covered work
SAG-AFTRA describes its AI guardrails as “clear consent, fair compensation, control over performances.” The Congressional Research Service reports that the 2023 SAG-AFTRA studio agreement requires “clear and conspicuous” consent and a “reasonably specific description” of intended use, and discusses postmortem consent. Union minimum compensation, representation and grievance procedures can apply in addition to the private contract. Confirm whether the project, employer and performer are covered before waiving any rights.

FTC impersonation rule
The Federal Trade Commission impersonation rule cited here targets impersonation of governments, businesses and their officials or agents in interstate commerce and became effective April 1, 2024. It does not answer every question about a personal digital replica, but an AI persona used in a commercial or institutional setting should be reviewed for deceptive claims, disclosures and authorization.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What is different outside the United States?
Rights depend on the person, licensee, performance, audience and contract connections to each country. In the United Kingdom, comparative guidance says there is no general personal image right; copyright protects the fixed work, such as a sound recording or photograph, rather than the person’s voice or appearance as such. A UK-facing agreement therefore needs careful copyright licensing and may rely on passing-off, confidentiality, data-protection, contract or other applicable doctrines instead of assuming a U.S.-style publicity right. Obtain local advice before collecting or exporting biometric or voice data.
Who owns an AI avatar or its outputs?
There is no single answer. You may own a copyright in original human-authored scripts, recordings or photographs, while a studio, photographer, employer or platform owns another component. The developer may own software and model infrastructure. A generated output may have limited or uncertain copyright protection depending on the amount of human authorship and the applicable law; the Copyright Office’s January 29, 2025 Part 2 report addresses that issue. None of those ownership questions automatically grants permission to use your name, face or voice.
Your contract should therefore allocate ownership and licenses separately: source materials, training data, model weights, prompts, generated files, edits, metadata and publicity rights. Include a warranty describing what each party actually owns and an indemnity process for third-party claims. If the company insists that it owns the model, preserve your approval, takedown, audit and deletion rights even after delivery.

How should compensation be structured?
Match payment to the value and risk of each use. A one-time session fee may compensate capture but not years of advertising. A recurring royalty can reflect usage but requires reliable reporting. A minimum guarantee protects you when the licensee underuses the replica, while reuse fees trigger when a campaign, territory, language or client changes.
- Session or capture fee: pays for recording, scanning, rehearsal and performance time.
- Model-creation fee: covers training, testing and technical development, with a separate approval for deployment.
- Per-use or campaign fee: applies each time an output appears in a defined product or campaign.
- Royalty or residual: calculated from a clearly defined revenue or distribution metric, with statements and audit rights.
- Buyout premium: compensates for surrendered future payments, exclusivity or a longer term; list all uses included and excluded.
- Postmortem compensation: states what the estate receives and when payments continue after death.
What should happen when the contract ends?
Expiration should trigger a technical and legal checklist, not merely a calendar entry. Require the licensee to stop generating new material, remove public outputs where the agreement requires it, disable access for vendors, return or delete source files, and certify deletion of backups, embeddings and model weights. Decide whether already-published materials may remain until a natural campaign end or must be removed immediately.
Best Value
Set a short emergency takedown path for unauthorized or harmful content. Identify who can issue the notice, which channels must be contacted, and how quickly access must be suspended while the dispute is investigated. Preserve logs and copies needed to prove what happened, subject to the agreed deletion schedule.
What are the most common contract failures?
- Blanket “all media” language: it may conceal political, medical, sexual, news-style or endorsement uses you never intended. Replace it with a use schedule and obtain counsel’s view on enforceability.
- One consent for everything: capture, training, generation and publication are different events. Require separate approvals.
- Unclear material alteration: specify whether age changes, accent changes, body swaps, fictional dialogue or composite performances are allowed.
- No downstream controls: a vendor or advertiser may receive the model without being bound by your restrictions. Name vendors and flow down every obligation.
- No deletion standard: “delete the data” may omit backups, embeddings or weights. List each copy and require certification.
- No estate plan: a company may claim a continuing license after death unless the term, representative, compensation and approval process are explicit.
- No governing-law review: a clause valid in one state or union agreement may not work elsewhere. Check every relevant connection before signing.
- Assuming ownership equals permission: owning an avatar file or model does not necessarily authorize use of a person’s identity, and personal consent does not transfer third-party copyrights.
What is a practical signing checklist?
- Attach an asset inventory with filenames, owners, permitted transformations and retention periods.
- Attach a use matrix listing product, campaign, medium, audience, language, territory, client, term and approval level.
- Mark each permission as allowed, prohibited or requiring fresh written consent.
- Confirm representation, union coverage, minimum compensation and any statutory requirements before recording.
- Negotiate payment triggers, statements, audit rights, taxes, expenses and buyout exceptions.
- Specify model hosting, vendor access, sublicensing, assignment, security controls and breach notice.
- Write takedown, suspension, deletion, return, incapacity and postmortem procedures with deadlines.
- Choose governing law and forum only after local counsel reviews publicity, privacy, labor, advertising and data-protection rules.
- Keep signed consent, scripts, approval emails, output versions and usage logs in a secure, access-controlled file.
Independent entertainment or intellectual-property counsel should review the completed package before you sign. Counsel can test whether the intended uses are specific enough, whether the payment matches the scope, and whether remedies are practical in the jurisdictions involved.
Frequently Asked Questions
Can I revoke consent after my AI model has been trained?
Only if the agreement gives you a revocation, suspension or takedown right, or another law supplies one. Negotiate a defined process before training, including deadlines, deletion of source data and model handling when revocation occurs; otherwise a licensee may argue that training created an irrevocable contractual right.
Does an AI disclosure have to appear in every output?
The contract should identify the channels and circumstances requiring disclosure, such as advertising, news-style presentation or an audience likely to believe the performance is live. The exact format depends on the medium and applicable consumer-protection rules, so specify audio, visual, text or metadata disclosure where appropriate rather than relying on a generic promise.
Can my employer use an AI replica made from work recordings?
Your employment agreement, union status, copyright ownership and publicity or privacy law may point in different directions. Review who owns the recordings and whether the agreement actually grants synthetic-performance rights; permission to perform a job or appear in a recording is not automatically permission for perpetual model training or unrelated campaigns.
How can an estate monitor a replica after I die?
Require the contract to name the estate representative, provide periodic usage and payment statements, preserve audit rights and give the estate a rapid takedown contact. State whether new clients, products, territories or materially different performances require fresh estate approval, and set a definite postmortem end date.
