Yes—AI-assisted writing can be copyrighted and licensed when a person contributes enough original expression. In the United States, a prompt by itself does not make you the author of the resulting text. Protection can cover your original passages, creative selection and arrangement, and substantial human revisions, while purely machine-generated wording should be excluded or disclaimed in a registration. You can sell or license the finished work, but a provider’s promise that you “own” output is not a government grant of copyright or a guarantee that nobody else received similar text.
The safest approach is to preserve a dated provenance record, clear the rights in every input, review the output for legal and factual problems, describe the human contribution in any U.S. registration, and write a license that identifies exactly what is being granted.

Can AI-assisted writing be copyrighted in the United States?
Copyright follows human authorship. The U.S. Copyright Office recognizes protection for AI-assisted output when a human determines sufficient expressive elements—for example, by contributing original material or making creative arrangements, selections, or modifications. A prompt alone is not enough because it describes an intended result without controlling every expressive detail.
Register of Copyrights Shira Perlmutter summarized the principle this way: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The protected claim is the human-authored expression, not an automatic monopoly over every word a model produced.

What kinds of human work can qualify?
- Original paragraphs, scenes, analysis, or other text written by a person and incorporated into the final work.
- Creative selection and arrangement of generated passages, research, and other materials.
- Human rewrites and modifications that add original expression rather than merely correcting spelling or accepting the first output.
The boundary is factual and context-dependent. Keep evidence showing what you chose, changed, rejected, and organized so you can explain the human contribution later.
What does copyright protect in an AI-assisted article or book?
Copyright protects original expression. It does not protect facts, ideas, systems, or methods, and protection does not depend on publication. A human-authored explanation of facts may be protected in its wording and structure even though another writer remains free to report the same facts independently.
This distinction matters when you license a mixed work. Your agreement can cover the copyrightable human expression and the contractual rights you actually control, but it cannot turn uncopyrightable facts or machine-only wording into exclusive human authorship.
How should I document my human contribution?
A contemporaneous record is more persuasive than a reconstruction made after a dispute. Maintain one provenance file for each article, chapter, script, or other deliverable.
- Save dated working materials. Keep outlines, drafts, source files, revision history, prompts, model or service names, generated outputs, and notes explaining your creative decisions.
- Map the text’s origin. Mark passages that were generated, heavily transformed, selected, arranged, or rewritten by a person. Preserve earlier and later versions rather than keeping only the final copy.
- Record editorial decisions. Note why you changed order, voice, examples, structure, or wording, and identify which decisions were yours.
- Preserve input permissions. Record where reference text, datasets, images, or uploads came from and why you were entitled to provide them to the service.
A provenance file should be understandable to someone who did not participate in the project. It can be a dated folder, version-control repository, or document log, provided it preserves the same information.
How do I disclose AI use in a U.S. copyright registration?
When AI-generated material is more than de minimis, disclose it in the application and briefly describe the human contribution. Exclude or disclaim purely machine-generated material. Register the human-authored expression, creative arrangement or selection, and human revisions; registration does not convert uncopyrightable machine expression into exclusive human authorship.

A practical registration sequence
- Identify every portion in the deposit that contains more-than-de-minimis AI-generated material.
- Describe, in plain language, the human-authored portions and the creative edits, arrangement, or selection you contributed.
- Exclude or disclaim machine-only passages rather than presenting them as solely human-written.
- Keep the underlying provenance file in case the Office or a later dispute requires a more precise explanation.
The U.S. Copyright Office’s AI study page records more than 10,000 comments received during its 2023 inquiry, illustrating why this area continues to receive close attention. Registration is a formal claim about the human-authored material; it is not a certification that a provider’s output is unique or infringement-free.
Can I sell or license an AI-assisted article or book?
Yes, if you have the rights you promise and the contract accurately separates human-authored material from machine-generated material where that distinction matters. You can grant rights in your copyrightable expression and in any additional contractual rights you control, but you should not promise that every generated sentence is exclusively yours unless you have a defensible basis for that promise.
Rights commonly addressed in a license
| Right or control | What the contract should specify |
|---|---|
| Reproduction | Whether the licensee may make copies, in which formats and editions. |
| Distribution | Permitted channels, markets, and whether physical and digital distribution are included. |
| Display and performance | Use on websites, applications, broadcasts, events, or other public presentations. |
| Adaptation and translation | Whether the licensee may edit, abridge, translate, localize, or create derivative works. |
| Database or text-and-data uses | Any permission for indexing, dataset inclusion, text mining, or similar uses. |
| Sublicensing | Whether downstream permissions are allowed, and on what conditions. |
Define the exact work and version being licensed. Attach a file name, date, word count, or other identifier so a later revision cannot silently expand the grant.
What clauses should an AI-writing license include?
A useful agreement makes the scope measurable and allocates the risks that ordinary copyright language may leave unclear.
1. Identify the work and its provenance
Name the deliverable, version, language, media, and any excluded material. If AI assistance is material to the deal, state which components were generated, which were human-authored, and how the human contribution was made.
2. Define the grant precisely
List reproduction, distribution, display, performance, adaptation, translation, database, and text-and-data rights as applicable. State territory, term, formats, exclusivity, sublicensing, and whether rights are reserved for the writer. Do not grant rights in territories, languages, or media that the contract does not identify.

3. Set editing, attribution, and moral-rights terms
Say who may edit, abridge, update, or combine the work. Address attribution and any moral-rights waiver or reservation to the extent the governing law permits. If the licensee must disclose AI assistance to a platform, client, or audience, put that duty in this section or a dedicated disclosure clause.
4. Set money and reporting rules
Specify fees, royalties, payment dates, statements, audit rights, and tax treatment. A royalty clause should identify the revenue base and permitted deductions rather than relying on an undefined phrase such as “net receipts.”

Represent what you know about the originality and provenance of your human contributions. Promise that inputs supplied to the AI service were lawfully obtained. Avoid an absolute warranty that all output is exclusive, entirely human-authored, or incapable of resembling another user’s output.
6. Allocate clearance and enforcement duties
Address review and clearance responsibilities, takedown procedures, indemnity, limitations of liability, termination, and which obligations survive termination. Clarify who responds to an infringement notice and who bears the cost of withdrawing or replacing disputed text.
What do AI-provider terms say about ownership and liability?
Provider terms can allocate contractual rights between the provider and customer, but they do not decide whether a government will recognize copyright in a particular passage. Read the terms in force on the date you use the service and preserve a copy for the project file.
| Provider terms described in the available materials | Ownership language | Important responsibility or limitation |
|---|---|---|
| OpenAI Services Agreement, effective January 1, 2026 | Between OpenAI and the customer, and to the extent permitted by law, the customer retains input ownership and owns output. | The customer must have rights in inputs and must evaluate output. Output-IP indemnity for API and Enterprise customers has exceptions, including known or likely infringement, lack of rights in inputs, and output modified or combined with non-OpenAI products. |
| Google Gemini API terms | Google says it will not claim ownership of generated content. | Similar content may be generated for others, and the user remains responsible for legal compliance and use. |
These terms support a contractual allocation, not a promise of exclusivity. A licensee should still review the text, clear third-party material, and limit warranties to rights that can actually be granted.

How do U.S. and UK rules differ?
Do not assume that a U.S. registration result or a U.S.-style license transfers automatically to the UK, European Union, or another jurisdiction.
| Issue | United States | United Kingdom |
|---|---|---|
| Human-assisted works | Protection can cover human-authored material, creative arrangements or selections, and human modifications in AI-assisted output. | The government report recognizes sufficiently original human-authored works made with AI assistance. |
| Computer-generated category | The available U.S. guidance requires human authorship for the protected claim; machine-only material should be excluded or disclaimed in registration. | A statutory computer-generated-works category exists where no human author exists; the person making the necessary arrangements is treated as author. |
| Term for the computer-generated category | No machine-only term is established by the U.S. material described here. | The UK report states a 50-year term for computer-generated works. |
| Infringing borrowed material | Unlicensed use of protected expression remains a clearance risk regardless of the tool used. | Consultation material warns that an output containing a substantial part of a protected work may infringe reproduction or communication rights without a licence. |
The UK consultation material also says a human creator is the author of co-created outputs. Obtain local advice when the license, creator, or audience crosses borders.

Use the following sequence before you promise rights to a client, publisher, platform, or buyer.
- Choose the governing law and contracting party. Decide which entity is licensing the work and which law will interpret the agreement.
- Use authorized inputs. Supply only prompts, reference text, datasets, and uploads you are entitled to provide. Check confidentiality restrictions before sending client material to a service.
- Build the provenance file. Save prompts, model or service name, dates, outputs, edits, and notes about human decisions.
- Review the result. Perform factual, plagiarism, privacy, defamation, trademark, and confidentiality checks. Provider terms place responsibility for evaluating and using output on the customer.
- Make the human contribution substantial and clear. Rewrite and arrange the draft so the final expression reflects your creative decisions rather than an unedited generation.
- Handle disclosures. Disclose material AI-generated content in a U.S. registration when required and follow any publisher, platform, client, or professional rule.
- License only what you can grant. Define rights, territory, term, exclusivity, disclosure duties, warranties, indemnity, takedown, and termination in writing.
What should I do if the output resembles another work?
Pause licensing and publication while you investigate. Unlicensed substantial portions of protected works may infringe, and a provider’s ownership clause does not cure a problem in the output or in the inputs you supplied.

- Compare the disputed passage with the suspected source and preserve both versions.
- Check whether the similarity comes from uncopyrightable facts or from protected expression.
- Remove, rewrite, or replace material you cannot clear; document the decision.
- Use the contract’s clearance, notice, takedown, and indemnity procedures if the work has already been delivered.
Also stop and escalate any output containing confidential information, personal data, defamatory assertions, or third-party trademarks until an appropriate review is complete.
Must I disclose AI assistance to readers?
There is no universal rule in the authoritative material described here requiring every publication to disclose AI assistance to its audience. A duty can arise from a contract, platform policy, professional rule, or local law, so check the instrument that governs your publication.
Best Value
Even when audience disclosure is not mandated, a client or licensee may require it. Put the requirement, wording, timing, and responsibility for updates in the license instead of leaving it to an informal understanding.
Which factors should I compare when choosing a provider or contract?
Evaluate the following questions side by side and keep the answers with the project record:
- Does the document discuss contractual ownership, and separately, does it address copyrightability?
- Who warrants that inputs were lawfully obtained?
- What does the provider say about output similarity and exclusivity?
- Is commercial use permitted for your service tier and intended medium?
- What indemnity is offered, and what exceptions remove it?
- Are prompts and outputs confidential, and may they be used for training?
- Which law governs, and where must disputes be brought?
- Who must disclose AI assistance, and to whom?
- What happens after termination, a takedown request, or a rights challenge?
Ownership language is only one row in this comparison. A contract that says you own output can still leave you responsible for input permissions, legal compliance, similarity, and the limits of human copyright.
What does a defensible project file contain?
For each deliverable, retain the signed agreement, provider terms in effect when the work was created, input-permission notes, prompts, outputs, dated drafts, revision history, and a short statement identifying the human-authored expression. Add copies of clearance decisions and any AI-disclosure wording supplied to the client or platform. This file lets you answer a registration question, a client audit, or a takedown request without guessing how the final text was made.
Frequently Asked Questions
Can I license only the human-edited portions of a mixed AI draft?
Yes. Identify the human-authored passages, arrangement, and revisions as the licensed material, and expressly exclude machine-only text or other material you cannot grant. The agreement should also state how later edits or replacement passages are handled.
What if a client demands a warranty that every sentence is exclusively mine?
Do not give an absolute promise that the evidence cannot support. Offer a narrower representation covering your original contributions and lawful inputs, explain the treatment of machine-generated material, and negotiate appropriate exclusions, review duties, and remedies.
Recommended Free Tools
Should I keep a copy of the provider terms after the project ends?
Yes. Terms can change, while a dispute may concern the version that applied when the output was created. Store the effective date and a copy with the provenance file so the contractual allocation can be checked later.
Can a publisher impose an AI-disclosure requirement even when copyright law does not?
Yes. A publisher, platform, client, professional body, or local law may create a disclosure duty independent of copyrightability. Treat that requirement as a contract or policy obligation and specify who makes the disclosure and when.
