Compare AI governance instruments by what they require, whom they apply to, and how they expect an organization to manage risk—not by ranking them as interchangeable frameworks. The EU AI Act is binding law within its scope; NIST AI RMF is voluntary operational guidance; ISO/IEC 42001 is an organizational management-system standard that can be certified; and the OECD and UNESCO instruments provide broader policy and ethical principles. Many organizations will need a layered approach: determine legal duties first, then choose practical controls and values-based checks that help meet them.
What does it mean to compare AI governance frameworks and regulations?
A useful comparison asks what each instrument does, rather than which one is “best.” A law can impose obligations on actors within its jurisdiction. A voluntary framework can organize risk-management work. A management-system standard can specify how an organization establishes and improves its governance processes. A recommendation can articulate values and policy goals without functioning as an organization-level certification scheme.

The EU AI Act helps determine mandatory obligations for AI systems in scope. NIST AI RMF helps structure an organization’s risk-management process. ISO/IEC 42001 provides requirements for an AI management system. The OECD AI Principles and UNESCO’s Recommendation on the Ethics of AI broaden the assessment toward rights, inclusion, democratic values, and sustainability.
Comparing them on a single “strictness” or “coverage” scale can mislead. A voluntary framework is not a substitute for a law, and an ethics recommendation is not an audit certificate. A more useful comparison checks legal force, jurisdiction, intended users, risk model, lifecycle coverage, documentation, oversight, implementation needs, and how the instruments can work together.

Which instruments should I compare?
For a practical comparison, keep the five instruments below distinct. Their mechanisms and purposes differ even where they address overlapping concerns such as accountability, safety, transparency, or risk.
| Instrument | Formal force | Main users | How it operates | Best fit |
|---|---|---|---|---|
| EU AI Act, Regulation (EU) 2024/1689 | Binding regulation for actors and systems within scope | Providers, deployers, importers, distributors, and other actors defined by the Act | Risk-tier duties, prohibitions, documentation, oversight, and enforcement | Identifying mandatory obligations connected with the EU market |
| NIST AI RMF 1.0 | Voluntary framework | Organizations designing, deploying, procuring, or evaluating AI | Four functions: Govern, Map, Measure, and Manage | Structuring a flexible risk-management workflow |
| ISO/IEC 42001:2023 | International management-system standard; certification is possible | Organizations that develop, provide, or use AI products and services | Policies, responsibilities, risk processes, evaluation, and continual improvement | Formalizing and auditing an AI management system |
| OECD AI Principles | Intergovernmental recommendation | Governments and organizations using the principles as a policy baseline | Five values-based principles and policy recommendations | Cross-border policy coherence and a shared values baseline |
| UNESCO Recommendation on the Ethics of AI | Global soft-law recommendation | Member States and public-interest stakeholders | Human-rights-centered principles and policy-action areas | Considering rights, inclusion, legitimacy, and sustainability |
Why the legal layer comes first
A voluntary program can help an organization manage risk, but it does not determine whether a law applies or remove a legal duty. Start with the markets where a system is placed or used, the organization’s role, and any applicable national or sectoral law. The EU AI Act is identified as Regulation (EU) 2024/1689 and uses a risk-tiered approach for AI systems placed on the EU market. The exact scope, prohibited practices, high-risk duties, general-purpose AI obligations, dates, and penalties require checking the Act and current European Commission guidance; do not infer those details from a general framework comparison.
What is the difference between the EU AI Act and NIST AI RMF?
The central difference is force: the EU AI Act is binding regulation for those within its scope, while NIST describes AI RMF as voluntary. The Act establishes legal requirements; the NIST framework supplies a process organizations can use to incorporate trustworthiness considerations into AI design, development, use, and evaluation.
EU AI Act: a legal obligation layer
The Act is the instrument to examine when deciding whether a particular organization, system, or activity has mandatory EU-related obligations. Its risk-tiered structure is not equivalent to a voluntary risk-management process: an organization cannot assume that following a framework alone satisfies applicable law. The actors identified in the comparison include providers, deployers, importers, distributors, and other roles defined by the Act.
Because legal scope and implementation details are consequential, use the regulation itself and current European Commission guidance for a legal analysis. A high-level comparison can identify the Act as the binding-law layer, but it cannot responsibly substitute for role-specific and system-specific interpretation.
NIST AI RMF: an adaptable operating process
NIST released AI RMF 1.0 on January 26, 2023, and says it is intended for voluntary use. Its four functions—Govern, Map, Measure, and Manage—organize work across the AI lifecycle. They help teams structure governance, understand context and risk, assess risks, and decide how to respond and monitor, without prescribing one industry-specific set of controls.

NIST also provides a Playbook, Roadmap, Crosswalk, and Resource Center. These resources can help organizations operationalize or map the framework, but the framework remains voluntary unless some separate law, contract, or organizational commitment makes particular practices obligatory.
Is ISO/IEC 42001 certification mandatory?
ISO/IEC 42001:2023 does not, by itself, make certification a universal legal requirement. ISO describes it as an international AI management-system standard; certification is one way an organization can demonstrate conformity to that management-system standard, not proof of compliance with every applicable law or proof that every AI model is safe.
ISO lists Edition 1, published in December 2023, at 51 pages. The standard specifies requirements for establishing, implementing, maintaining, and continually improving an Artificial Intelligence Management System (AIMS) in organizations that develop, provide, or use AI products and services.
What certification can show
Certification can provide evidence that an organization’s management system has been assessed against the standard. The standard’s management-system approach includes policies, objectives, risk treatment, traceability, transparency, and continual improvement. That organizational evidence can be useful when a company needs documented governance and external assessment.
What certification cannot establish on its own
A certificate should not be treated as a blanket legal-compliance certificate, a guarantee that an individual system is safe, or evidence that every deployment is appropriate. Those conclusions depend on the system, its use, relevant laws, and the evidence available for the particular case. Any customer, regulator, contract, or applicable law may create a separate reason to seek certification; check those requirements rather than assuming the standard itself makes it mandatory.
How do OECD and UNESCO fit into an AI governance program?
The OECD and UNESCO instruments are useful for testing whether an organization’s governance reflects wider public-interest values, but neither is an organization-level certification scheme. They complement operational controls by supplying principles that can guide policy, impact assessment, and decisions about what responsible AI should protect.

OECD AI Principles
The OECD Principles were initially adopted in 2019 and updated in May 2024. Their five principles address inclusive growth, sustainable development and well-being; human rights and democratic values, including fairness and privacy; transparency and explainability; robustness, security and safety; and accountability. The OECD describes its Recommendation as the first intergovernmental standard on AI and lists 47 adherents.
Use the principles as a policy baseline and interoperability reference: they help an organization ask whether its approach is coherent with broad commitments across borders. They do not provide an organization with a certification route or replace specific legal duties.

UNESCO’s 193 Member States adopted the Recommendation on the Ethics of Artificial Intelligence in November 2021. It is grounded in human rights and human dignity and is described by UNESCO as the first global standard on AI ethics. Its ten principles cover proportionality and do no harm; safety and security; privacy and data protection; multi-stakeholder and adaptive governance; responsibility and accountability; transparency and explainability; human oversight; sustainability; awareness and literacy; and fairness and non-discrimination.
UNESCO also provides policy-action guidance in areas such as gender, data, and international cooperation. Those areas can help reveal gaps that a narrowly technical risk review might miss, particularly where effects on people and communities are central to a system’s use.
How should I choose a framework for my company?
Choose based on exposure and the work your organization needs to do, not on a universal ranking. First establish the legal floor; then select an operating method, decide whether management-system evidence matters, and use values-based principles to test the program’s broader impact.
- Map legal exposure. Identify relevant jurisdictions, applicable national or sectoral rules, and the organization’s role in the AI activity. For EU-market activity, assess whether the AI Act applies and consult the Act and current European Commission guidance for exact duties.
- Choose an operational workflow. Use NIST AI RMF when the organization needs a flexible process for governance, risk mapping, measurement, and management without a prescribed industry-specific control set. Determine who will own each function and how it will apply across design, development, procurement, deployment, and evaluation.
- Decide whether formal management-system evidence is needed. Consider ISO/IEC 42001 when documented governance, assigned accountability, internal evaluation, continual improvement, or potential third-party certification is important. Clarify whether the goal is internal discipline, customer assurance, or a separate contractual or regulatory need.
- Extend the test beyond technical risk. Use OECD and UNESCO principles to examine human rights, fairness, privacy, explainability, sustainability, inclusion, literacy, and democratic values. Identify which principles are relevant to the system’s context and how the organization will assess them.
- Layer rather than substitute. A common architecture is applicable law for mandatory duties, NIST or ISO for operational controls, and OECD or UNESCO for values, impact, and policy coherence. The instruments can reinforce one another without becoming interchangeable.
How can the instruments be combined without duplicating work?
Build one governance system and map each requirement or principle to it, rather than creating five disconnected programs. The legal obligations remain the baseline; operational processes create repeatable work; and values-based principles can add questions that legal or technical controls may not answer on their own.

Keep a single inventory and ownership structure
Maintain an inventory of AI systems and activities, and identify the people responsible for assessing and managing each one. Use the relevant legal analysis to determine which systems and organizational roles need closer attention. A NIST- or ISO-shaped process can then provide a consistent way to record context, risks, decisions, and follow-up across the organization.
Separate evidence by purpose
For each control or decision, record what it is intended to demonstrate: compliance with a legal duty, operation of a management-system process, implementation of a risk response, or consideration of an ethical principle. That distinction prevents a voluntary control or certificate from being presented as proof of a legal conclusion it does not establish.
Use crosswalks as navigation, not equivalence
A crosswalk can show where processes or evidence align across instruments, making it easier to reuse work. Alignment is not identity: similar terms such as transparency, accountability, or safety may have different meanings and consequences in different contexts. Preserve each instrument’s own scope and force when mapping controls.
Review when the context changes
Governance should respond to changes in the system, its use, and the applicable rules. Revisit the relevant legal analysis and risk decisions when the organization’s role, deployment context, or operating assumptions change. Current guidance and standards editions also matter; NIST says AI RMF is being revised, so users should check its current materials rather than assume that the 1.0 publication is the final version.
What should a comparison checklist include?
Use the following checklist to make the comparison concrete and auditable. It keeps questions about legal applicability separate from questions about how a governance program operates.
- Legal force: Is this a binding regulation, voluntary framework, management-system standard, or recommendation?
- Jurisdiction and scope: Which countries, markets, organizations, systems, or roles does it cover?
- Intended user: Is it written primarily for regulators and governments, or for organizations developing, providing, deploying, procuring, or evaluating AI?
- Risk model: Does it use risk tiers, a management process, values-based principles, or another mechanism?
- Lifecycle reach: Does it address design, development, use, evaluation, or continual improvement—and where are its boundaries?
- Evidence: What policies, records, assessments, traceability, or other documentation does it call for?
- Oversight and enforcement: Is compliance enforced by law, assessed through a management-system certification, or encouraged through policy guidance?
- Implementation fit: Who will own the work, what processes already exist, and what new documentation or evaluation capacity is needed?
- Interoperability: Can the same process or evidence support more than one instrument without obscuring different obligations?
- Currency: Is the edition or guidance current, and have relevant legal dates or official implementation materials changed?
What should a company remember when comparing AI governance instruments?
Start by distinguishing the instruments’ roles. Law sets mandatory obligations within its scope; voluntary frameworks and standards can help organizations implement governance; and policy recommendations can widen the program’s values and impact assessment. The strongest comparison is therefore a map of complementary layers, not a contest with one winner.
Best Value
For the specific instruments here, the practical sequence is to assess applicable law, choose NIST or ISO for operational structure according to organizational needs, and use OECD and UNESCO to test the program’s broader commitments. Keep legal interpretation tied to the relevant official materials, and do not treat voluntary adoption or certification as a substitute for that analysis.
Frequently Asked Questions
How can we show an auditor which AI governance control supports which requirement?
Keep a crosswalk that names the requirement or principle, the control or process addressing it, its owner, and the evidence produced. Mark whether the mapping is intended to support a legal obligation, a management-system requirement, or a voluntary principle so the evidence is not overstated.

How often should an AI governance program be reviewed?
The instruments summarized here do not establish one universal review interval for every organization. Set a documented cadence appropriate to the program and trigger an earlier review when a system’s use, organizational role, or governing requirements change.
Can two organizations have different responsibilities for the same AI system?
Yes, an AI activity may involve multiple organizations and roles. Under the EU AI Act, the relevant actor categories are defined by the Act, so parties should assess their own role rather than assume that another participant’s governance program covers them.
Does a framework comparison tell me whether a specific AI system is low risk?
No. A comparison explains how instruments are structured; it does not classify an individual system or determine which obligations apply to a particular deployment. That assessment requires facts about the system, its context, the organization’s role, and the relevant law.
