How to Choose Music for an AI-Generated Game: Licensed Tracks, Original Scores, and Royalty-Free Music

Choose the music source by matching the game’s creative brief to the rights you need at launch and later. A recognizable commercial recording can deliver instant identity, but usually requires permission for both the underlying composition and the particular sound recording. A commissioned score can follow gameplay and mood more closely, provided the contract covers ownership, reuse and delivery. Royalty-free catalogs and AI music can reduce negotiation, but neither label is a blanket permission: the actual license, service plan and third-party rights still control what you may ship.

This guide treats an AI-generated game like any other commercial game. The development method does not remove music-clearance obligations. Plan for in-game audio, trailers, social clips, demos, downloadable content, sequels and a possible soundtrack before you choose a track.

What music rights does a game actually need?

You normally deal with at least two separate works: the musical composition (music and lyrics) and the sound recording (the recorded performance). The U.S. Copyright Office explains that “a sound recording and the music, lyrics, words, or other content included in the recording are separate copyright-protected works.” Different people or companies can own those rights, and one license does not automatically grant the other.

For a game, rights can also split by activity. Synchronizing music with visuals or gameplay, reproducing it in builds, distributing copies, streaming or downloading a soundtrack, and using it in advertising may each require permission. SUISA’s Swiss guidance lists synchronization, reproduction, physical distribution, online download or streaming, and neighboring (master-recording) rights. That framework is useful for identifying tasks, but it is Swiss guidance rather than a universal rule; your contracts and local law determine the result in each territory.

Composition and master in plain language

  • Composition: the written music and lyrics. Publishers, songwriters and collecting societies may share ownership.
  • Master recording: a specific recorded performance. A label, artist or another owner may control it.
  • Synchronization: permission to pair the composition with game action, menus, cinematics or video.
  • Master use: permission to use an existing recording, in addition to composition permission.
  • Reproduction and distribution: permission to copy the audio into downloadable builds, updates, physical media or a soundtrack.
  • Promotion: trailers, advertisements, livestream clips, press kits and creator videos may fall outside an in-game license.

Universal Music Group’s licensing FAQ describes synchronization as a composition license and master use as a recording license, and notes that requested term and territory affect a quote. That FAQ is a vocabulary and process reference for film and television licensing, not a game-music price list.

Which music source should an indie game use?

There is no universally best route. Use the option whose creative benefit justifies its clearance work and whose permission covers every planned release channel.

Route What it does well Checks before shipping Good fit when
License an existing track Delivers a familiar song and finished performance; useful when a particular recording is central to the concept. Locate composition and master owners; obtain all necessary permissions; define game, platforms, territory, term, trailers, social clips, edits, downloadable content, soundtrack release and exclusivity. The song itself is a core creative feature and the budget and schedule can absorb negotiations.
Commission an original score Can be written for the game world, pacing, adaptive states and technical constraints. Contract for ownership or license, stems, loops, adaptive variants, revisions, credit, platforms, territories, promotion, sequel and downloadable-content reuse, soundtrack rights, acceptance and termination. You want a distinctive identity or interactive music that changes with play.
Royalty-free or production-library catalog Provides ready-made music under a defined catalog license, often avoiding direct negotiation with a songwriter and label. Read the license itself. Confirm game embedding, commercial release, platforms, territory, term, trailers, streams, edits, attribution and whether separate soundtrack distribution is allowed. You need reliable, affordable coverage and can work within catalog terms.
AI-generated music Supports rapid mood exploration and can supply generated assets where the provider expressly permits game and commercial use. Check the current plan, Terms of Service, Acceptable Use Policy, commercial permission, embedding, output and reuse rules, attribution, warranties, indemnities and third-party-rights limits. Keep a record of the generation context and terms. You need fast iteration or custom variations and can accept provider-specific legal conditions.

Compare routes on six practical dimensions: rights certainty, creative fit and adaptability, platform and territory coverage, promotion and sequel or downloadable-content reuse, implementation support, and total budget and clearance effort. A low purchase price is not a low-risk choice if a trailer or console release is excluded.

Can I use a copyrighted song in my game?

Yes, but only after you obtain the permissions that match your use. Buying a song, owning a streaming subscription or crediting the artist does not grant game synchronization or master-use rights.

Clear both sides of an existing recording

  1. Identify the exact recording. Record the artist, track title, album or release, label, catalogue identifiers and the version you intend to ship. A cover, live take or remix can have different owners.
  2. Map the composition stakeholders. Find publishers and songwriters, including co-writers. Several composition owners may need to approve the same use.
  3. Approach the recording owner. Request a master-use license from the label, artist or other master owner. Ask whether an alternate recording would simplify clearance.
  4. Describe the use precisely. State whether the track appears in gameplay, a menu, a cutscene, a trailer, a demo, a press kit, a livestream capture, downloadable content, a sequel or a soundtrack.
  5. Specify scope. Put platforms, territories, term, release date, edits, language versions, paid advertising, creator videos, archival builds and exclusivity in the request. UMG’s FAQ explains why term and territory are meaningful licensing variables.
  6. Obtain executed documents. Store signed licenses, invoices, contacts and any approval of edits or mixes. Do not ship on a verbal promise.

Rights packages differ by country and use. SUISA’s Music in video-games guidance is a Swiss example of how synchronization, online and neighboring rights can be separated; obtain local advice for your release territories.

When an existing song is still a sensible choice

Choose a commercial track when recognizability is part of the design brief, such as a licensed period setting or a game built around a specific artist. Build schedule time for ownership research and negotiation, and budget for renewals if the license is term-limited. If the game may remain on sale indefinitely, a perpetual or renewable structure matters more than a one-time launch clearance.

Is commissioning an original score safer?

A commissioned score can reduce the number of outside owners, but “original” does not decide ownership or permitted uses. Your composer agreement must say who owns the music and recordings, what license is granted, and how the score can be reused.

Terms to put in the composer agreement

  • Ownership model: assignment of specified rights, an exclusive license, or a non-exclusive license. State which party owns compositions, recordings, stems and project files.
  • Deliverables: full mixes, stems, loopable files, one-shot cues, alternate lengths, layered or adaptive versions, silence tails, loudness targets and the delivery format.
  • Interactive use: permission to loop, layer, crossfade, re-order, shorten, transpose or otherwise adapt music in the game engine.
  • Scope: platforms, territories, term, languages, stores, cloud versions and any physical edition.
  • Promotion and reuse: trailers, paid advertising, social clips, press kits, livestreams, downloadable content, patches, a sequel, a remake and a separate soundtrack.
  • Credit and approvals: the exact credit line, placement, approval deadlines and whether the composer may show the work in a portfolio.
  • Revisions and acceptance: number of revision rounds, milestones, acceptance criteria, payment triggers and what happens if a cue is rejected.
  • Third-party material: a warranty that the delivered work is original or properly cleared, plus a process for replacing an infringing sample or library element.
  • Termination and source files: what happens to unfinished music, paid-for rights and project files if either party ends the engagement.

WIPO’s Mastering The Game discusses game-development business and legal issues and cautions that it is educational information, not professional legal advice. Have counsel adapt the agreement to your jurisdiction and business structure.

Commissioning for adaptive music

Tell the composer how the game engine will trigger music: exploration, combat, low health, victory and pause states may each need stems or loops. Request clean loop points and alternate arrangements at the start, not after the final mix. A contract that grants only a fixed linear track may not authorize the technical edits your implementation requires.

Does “royalty-free” mean I can use music anywhere?

No. “Royalty-free” generally describes the payment model after a license is obtained; it does not mean copyright-free, platform-free or unrestricted. A catalog can permit embedding in a commercial game while forbidding a standalone soundtrack, paid advertising or use after a subscription ends.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Read the catalog license for these clauses

  • Commercial game distribution, including free-to-play, demos and early-access builds.
  • Permitted platforms: PC, console, mobile, web, cloud and named storefronts.
  • Territory and duration, including whether the license survives cancellation or catalog removal.
  • Use in trailers, advertisements, social posts, livestreams and creator videos.
  • Editing, looping, layering, remixing, voice-over and synchronization with gameplay.
  • Attribution, content-ID procedures, takedown handling and project registration.
  • Whether you may sell or stream a soundtrack, music pack or physical edition separately.
  • Indemnity, warranties, prohibited uses and what happens if a contributor later disputes rights.

Why platform-specific catalogs need extra caution

Roblox’s official licensed-music support page describes an APM Music arrangement for tracks used on Roblox games. It limits use to Roblox, bars separate downloading of the catalog tracks, allows certain derivative changes only within Roblox and states a limit of 250 licensed tracks at a time in a single game. Those terms do not grant permission for a standalone PC, console or mobile release.

Roblox separately explains on its licensed music in videos page that gameplay captures containing the music may be posted to social media subject to conditions, including synchronization only with Roblox gameplay and no unrelated videos. Check the current platform terms before launch; platform policies can change.

Can AI-generated music be used commercially in a game?

Sometimes, depending on the provider, plan and intended use. Treat AI output as a licensed service deliverable with conditions, not as automatically copyright-free or risk-free.

What one provider currently permits

Stability AI’s Stable Audio commercial and usage licensing guidance says generated music and sound effects may be embedded as background music or other audio assets in video games, including on its Free plan, subject to its Terms of Service and Acceptable Use Policy. It also says commercial use is allowed subject to those documents and places responsibility on users to avoid infringing others’ rights. This is a provider-specific statement, not a guarantee for every AI music service or every country.

AI clearance checklist

  1. Save the account, plan name and applicable Terms of Service and Acceptable Use Policy on the generation date.
  2. Record prompts, settings, model or tool version, output files, revisions and the person who generated each cue.
  3. Confirm that the plan permits commercial game embedding, updates, ports, trailers, social clips and soundtrack distribution if those uses are planned.
  4. Check attribution, output ownership or license language, termination effects, warranties, indemnities and any usage caps.
  5. Review outputs for recognizable melodies, lyrics, samples, artist imitation or other material that could create a third-party claim.
  6. Keep the source audio, stems and a rights log so you can replace a disputed cue without rebuilding the entire soundtrack.

WIPO’s 2024 How to Make a Living from Music describes an unresolved debate about permission to train systems on commercially released recordings and compositions. Music-industry organizations have called for permission, but that discussion is not a universal court ruling and does not establish the training practices of a particular provider. Ask the provider for current terms rather than assuming a broad industry position answers your project.

How should I compare music options before deciding?

Score each candidate against the same release plan. The best choice is the one that remains usable when the game expands beyond its first build.

Decision question Existing recording Commissioned score Catalog or AI output
Can it match a specific creative reference? High if the exact song is available. High after briefing and revisions. Varies by catalog, prompt control and editing rights.
Can it adapt to gameplay? Usually requires permission to edit, loop or stem. Can be designed for layers, states and loops. Check whether edits and derivative versions are allowed.
How many owners must be cleared? Potentially multiple composition owners plus the master owner. Usually the composer and any approved contributors. The provider plus any third-party contributors or rights holders identified in its terms.
Are trailers and social clips included? Only if expressly licensed. Only if the agreement says so. Only if the catalog or service license says so; platform rules may add limits.
Can the music appear in a sequel or DLC? Request explicit reuse and term coverage. Negotiate reuse at commissioning time. Confirm whether the license is project-specific, account-based or perpetual.
What is the main operational risk? Uncleared owner, narrow territory or an expiring term. Ambiguous ownership, missing stems or incomplete deliverables. Plan restrictions, provider changes, attribution rules or third-party claims.

Do not invent a cost comparison where a source does not provide one. Quotes depend on the track, territory, term, audience, media and negotiating parties; catalog and AI pricing also changes by plan. Compare the complete rights package and the staff time required to verify it.

What should be in a game-music rights record?

Create one record per cue before the audio enters a release candidate. This turns a legal question into a repeatable production check.

How do promotion, DLC and future releases change the clearance?

They expand the permission you need. An in-game license that covers a PC build may not cover a console port, a paid trailer, a creator’s review video or a separate soundtrack.

Promotion

Ask whether the music may synchronize with trailers, advertisements, social clips, press reels and livestream recordings. Define who may post the material: your studio, platform accounts, influencers and players can have different permissions. If a platform supplies music under a game-only arrangement, do not assume the same track can accompany an unrelated developer documentary or announcement video.

Downloadable content, sequel and remake

State whether the original license covers expansions, patches, a sequel, a remake, a remaster and ports. If the term ends, decide whether existing customers may continue playing old builds and whether you must replace the cue in new downloads. A composer agreement should address reuse of stems and motifs as well as the final mix.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Soundtrack and user-generated content

A soundtrack album, music video, physical disc or streaming release is a separate distribution use. User-generated videos may add another layer of platform rules and content-identification systems. Obtain permission for those channels or exclude them explicitly from the product promise.

What implementation details should the audio brief include?

Rights and engineering should be planned together. Give the composer or licensor a concise technical brief covering:

  • Engine and middleware, sample rate, channel layout, file format and loudness target.
  • Loop length, loop points, intro and outro behavior, stems and layer names.
  • State transitions, crossfades, intensity parameters and maximum simultaneous layers.
  • Memory and download budgets for low-end hardware, mobile builds and streaming installations.
  • Pause, suspend, save-load and language-switch behavior.
  • Fallback cues for missing assets, offline play and accessibility settings.
  • Whether players can mute, reduce music independently or hear music during streaming and capture.

Include permission to make these technical changes in the agreement. A rights grant that allows only unmodified playback can conflict with ordinary adaptive implementation.

What are common music-clearance failures and their fixes?

  • Failure: treating a streaming subscription as a game license. Fix: obtain composition and master permissions for the game use.
  • Failure: relying on the phrase “royalty-free.” Fix: read platform, territory, term, promotion, editing and soundtrack clauses in the actual license.
  • Failure: commissioning without a written scope. Fix: specify ownership or license, deliverables, adaptive edits, credit, reuse and acceptance before work begins.
  • Failure: assuming AI output has no rights issues. Fix: save provider terms and generation records, confirm the plan permits each use and review outputs for third-party material.
  • Failure: clearing gameplay but not trailers. Fix: list every promotional channel in the request and license.
  • Failure: forgetting ports and updates. Fix: name every platform and future release, or budget for replacement music.
  • Failure: losing proof of permission. Fix: keep executed documents, terms snapshots, receipts, owner contacts and cue-to-build mappings in a shared rights archive.
  • Failure: using a platform catalog outside that platform. Fix: treat platform-specific permissions as confined to the stated service unless the license expressly says otherwise.

What is the safest release workflow for a small studio?

Use a staged gate so an attractive demo cue does not become a launch blocker.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Creative brief: describe mood, references, adaptive states, audience, rating and all expected releases.
  2. Route selection: compare an existing track, commissioned score, catalog and AI options against the rights matrix.
  3. Pre-clearance: verify owners, provider plan and platform scope before integrating audio deeply.
  4. Contract and archive: sign the license or commission agreement and save the exact terms and receipts.
  5. Technical delivery: obtain stems, loops, alternate mixes and metadata needed by the engine.
  6. Promotion check: clear trailers, press assets, social clips, livestreams and creator use separately where necessary.
  7. Release audit: match every shipped cue to a document covering the actual platform, territory, term and use.
  8. Post-launch monitoring: track renewals, catalog changes, provider-term updates, takedown notices and future DLC or port decisions.

For a small team, this workflow is usually more valuable than chasing a nominally free track. It preserves the ability to replace one cue, prove permission to a platform or expand to a new territory without reconstructing the entire soundtrack.

Frequently Asked Questions

Do I need a separate license for a game trailer?

Usually you should assume so unless the music agreement expressly includes trailers and advertising. Confirm whether paid ads, social posts, press reels, livestreams and influencer videos are covered, because an in-game permission may be narrower.

Can I release an AI-generated game soundtrack on streaming services?

Only if the provider’s current plan and terms permit separate music distribution, not merely embedding audio in a game. Check ownership, attribution, distributor warranties and any restrictions on registering or monetizing generated output.

What happens if a licensed track’s term expires after launch?

Your agreement should state whether existing purchasers may keep playing the released build and whether new downloads, updates, ports or advertisements must remove the cue. Without that language, plan a replacement and preserve stems or transition versions.

Should an indie studio hire a music-rights lawyer?

Professional advice is most useful when a recognizable recording, several territories, exclusivity, a large promotional campaign or a complex composer deal is involved. A lawyer can verify ownership chains and adapt terms to the jurisdictions and platforms you actually plan to use.
