Choose a confidential AI inference platform by verifying its complete trust boundary—not by accepting the phrase “confidential AI” at face value. Start with a written threat model, then require fresh attestation before releasing sensitive prompts or keys, confirm that GPU and CPU components are covered, and match the deployment to your control and residency requirements. Finally, obtain explicit contractual permission to process the regulated data, including the right service, region, model, subprocessors and retention terms. Confidential computing can protect data while it is being processed, but it does not by itself make an AI service HIPAA compliant, guarantee accurate answers, or prove that a provider’s operations are secure.

This guide gives you a procurement method for hosted inference APIs, confidential virtual machines, licensed or self-hosted stacks, confidential containers, bare metal and enclave-based designs.

What does confidential AI inference protect?

Traditional encryption protects data in transit and at rest. Confidential computing extends protection to data in active use by placing computation inside hardware-enforced isolation, such as a confidential virtual machine, container boundary, enclave or protected bare-metal environment. In an inference request, that can include the prompt, retrieved documents, completion, model weights, encryption keys and intermediate tensors while they are held in CPU or GPU memory.

The protection is conditional. The hardware, firmware, hypervisor, guest image, inference runtime, drivers, model files, control plane, key-release service and logging path all determine what is actually shielded. A provider may protect the inference worker while leaving a gateway, telemetry service, cache or support channel outside the confidential boundary. Ask for a diagram of the entire request path rather than a statement that the service is “encrypted.”

Define who must not see plaintext: the cloud operator, host administrator, service operator, tenant administrator, model supplier, support engineer or another customer. Then list every asset that matters and the threats you will still accept. Confidential computing is one technical control in a broader privacy, security and compliance program.

Two official cautions capture the right attitude. The company terms for one hosted service state, Confidential computing reduces risk. It does not eliminate it. NVIDIA’s overview similarly says, The deployment modalities do not provide interchangeable security guarantees. Treat both as design constraints, not marketing slogans.

How do I define the data and threat model before comparing vendors?

Write the threat model before requesting proposals. It gives security, legal and engineering teams the same pass/fail criteria and prevents a platform from being selected on a single feature such as attestation.

Classify the information

  • Identify regulated categories, such as protected health information, payment-card data, personal data, financial records, export-controlled information or confidential business records.
  • Record the jurisdictions that apply to the people, records, model provider, cloud region and support personnel.
  • Separate prompts, completions, uploaded files, retrieval results, model weights, API keys, intermediate tensors, logs, caches, backups, billing records and abuse-review data. Each may follow a different path.

Name the observers you need to exclude

State whether plaintext must be hidden from a host administrator, cloud operator, managed-service employee, model provider, customer administrator, other tenant or a compromised application component. A confidential VM may reduce host visibility while leaving an application administrator able to read requests; an enclave may isolate a component while exposing its network-facing parent process.

Define acceptable residual risk

Decide what happens if a provider can see metadata such as account identifiers, token counts, timing, region, rate-limit events or billing information. Decide whether a support engineer may access diagnostics under a break-glass process, whether availability failures may trigger a non-confidential fallback, and whether model outputs can be used in an automated regulated decision. Put these choices in the acceptance criteria and contract.

What should a platform prove with attestation?

Attestation is useful only when a client or independent verifier checks fresh evidence against an approved policy before sensitive data or secrets are released. It is evidence for a trust decision, not the decision itself.

Use a nonce and bind evidence to the request

  1. Generate a cryptographically random nonce in the client or verifier.
  2. Request fresh attestation from the platform, binding the nonce to the evidence and workload identity.
  3. Validate the hardware-signed evidence, certificate chain, freshness and any expiration or replay protections.
  4. Check the expected firmware, base-image measurement, boot configuration, hypervisor or guest measurement, inference image digest, command, workload identity and signing-key identity.
  5. Compare the measurements with an allowlist or policy digest that your organization owns or has independently assessed.
  6. Release a data-encryption key or permit traffic only after every required check passes.

The current Confidential Inference API documentation describes a public attestation endpoint and directs verifiers to check fresh evidence and approved measurements. Ask whether the endpoint returns raw evidence, a provider-generated summary or both. A summary may be convenient, but it gives you less independent material to evaluate.

Decide what a failed check does

Write an operational rule for measurement changes. A strict policy fails closed, pauses traffic, prevents key release and sends the new image or firmware for review. A controlled migration can allow two approved digests during a scheduled rollout, but it should expire automatically. Never make “attestation unavailable” an implicit approval path.

Verify GPUs separately

For GPU inference, confirm that confidential-computing mode is enabled on every attached accelerator and that GPU attestation is checked separately from CPU or VM evidence. Determine whether the evidence covers all devices, whether the verifier sees raw GPU evidence, and how driver and firmware measurements are represented. A provider assertion that GPUs are protected is not equivalent to independently validating the evidence chain.

Know what attestation cannot establish

  • It does not prove that measured software has no vulnerabilities.
  • It does not prove that a model’s answer is accurate, unbiased or suitable for a regulated decision.
  • It does not prove current availability, capacity, latency or incident-free operation.
  • It does not establish that logs, caches, support systems or backups are inside the measured boundary.

Which deployment model fits my control and risk requirements?

Compare the boundary you can verify and operate, not just the label attached to the product. The following distinctions are based on the documented deployment modalities.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Deployment model What to assess Main trade-off
Hosted confidential inference API Client verification, model and runtime coverage, service terms, shared-cache behavior, regions, capacity, API lifecycle Lowest infrastructure burden; the provider controls more of the service stack.
Confidential VM rented from a provider Customer configuration rights, host and hypervisor boundary, GPU attestation, persistence, tenant sharing, image control More workload control; the customer takes on verification and operations.
Licensed or self-hosted stack Hardware ownership, on-premises or cloud location, operator separation, attested builds, support, update process, licensing and staffing Most control over location and runtime; greatest integration and operational responsibility.
Confidential containers Control-plane separation, pod policy, host trust, workload admission and measured components Kubernetes-native operations, but the container boundary and control-plane design must be understood.
Confidential bare metal Host ownership, administrative access, device lifecycle, measured software and key-release policy Strong tenant control over the stack with corresponding security and operational ownership.
Cloud enclave Enclave boundary, communication path, network and storage limits, attestation and key-policy integration Useful for isolated components; an enclave is not automatically a complete inference platform.

NVIDIA distinguishes confidential bare metal, confidential VMs and confidential containers by who controls the host, guest or container workload. That distinction affects both the attack surface and who must investigate a failed measurement. Select the smallest boundary that still contains the sensitive computation and its secrets.

What is different about an enclave?

A documented enclave service provides a concrete example of a narrow isolation component: it is isolated from its parent instance, communicates through a local socket and has no persistent storage, SSH or external networking. Such constraints can protect a key broker or preprocessing step, but they also mean that you must design model distribution, network access, observability and output delivery around the enclave. Do not treat an enclave as a turnkey model-serving service.

Is a hosted confidential inference API sufficient?

A hosted API can be the fastest route to production when you accept the provider’s model catalog, regions and operational boundary. It is suitable only if you can verify the relevant workload and obtain written permission to process your data.

Inspect the request path

Ask where TLS terminates, whether a gateway or router handles plaintext, which process loads the model, and whether monitoring, abuse review, cache, support and backup systems receive request content. Require a diagram that labels measured components separately from components covered only by contract.

Check cache and retention behavior

The hosted service FAQ says prompts, outputs and workload data are not stored, while billing metadata is governed by the service terms and privacy policy. It also says prefix caching on the shared endpoint is not isolated per account today; per-account or per-tenant cache isolation is available on dedicated deployments. Confirm the cache scope for your exact plan, whether caching can be disabled, how request logging and abuse review work, and what deletion evidence is available.

Understand endpoint and model lifecycle

The documented hosted endpoint is in the United States South Central region and Central America, with European capacity described as forthcoming. Verify the selectable region and data-processing commitments when you contract; capacity and regional availability can change. Confirm model names, version pinning, context limits, structured-output and tool-calling support, rate limits, reserved capacity and deprecation notice. The API documentation says rate-limited calls return HTTP 429 with a Retry-After header and describes model-ID succession behavior. Build client logic around those documented behaviors rather than assuming a model identifier is permanent.

What contractual and regulatory evidence should I require?

Encryption in use is not a legal authorization to process regulated information. The service terms effective August 27, 2026 state: Do not use the Services to process Protected Health Information under HIPAA, payment card data, or other sector-regulated data unless we have agreed in writing to permit it. Treat that sentence as a procurement gate: obtain the executed written permission for the exact service and data type before sending production records.

Request the complete evidence set

  • The agreement, service description and any business associate agreement for protected health information.
  • A Data Processing Addendum for GDPR or UK GDPR personal data, including the current subprocessor list.
  • SOC 2 or ISO reports and certificates, with the covered service, regions and examination period identified.
  • Retention, deletion, backup, breach-notification, support-access and audit-rights terms.
  • Incident responsibilities, service-level commitments and the process for suspending or revoking access.
  • The exact model, endpoint and deployment scope covered by each artifact.

Compliance reports are scoped evidence, not blanket approvals. A trust center may present artifacts by product, region or service tier; verify that your selected confidential inference path is included. The same caution applies to a business associate agreement: it must name the relevant service and permit the processing you intend, not merely exist somewhere in the provider’s portfolio.

Use standards correctly

NIST IR 8320E, published as an initial public draft on May 29, 2026, describes confidential computing as extending encryption to data in active use. It is technical guidance, not a certification and not a legal determination that a platform satisfies HIPAA, PCI DSS, GDPR or another sector rule. Use it to organize control questions, then have counsel and your compliance team map the implemented system to the applicable regulation.

How do I verify residency and end-to-end data handling?

Draw the data flow from the client to deletion. Mark the location and operator for every hop, including services that do not run the model.

  1. Record the client region, DNS or API gateway, TLS termination point and routing layer.
  2. Identify the inference worker, CPU and GPU memory, model-storage location and key-management service.
  3. Trace prompts, completions, retrieval documents, telemetry, logs, caches, backups, billing metadata and support tickets.
  4. List every subprocessor and administrative access location, including emergency support.
  5. Document retention periods, deletion triggers, backup expiry and the evidence you will receive after deletion.
  6. Reconcile the diagram with the contract, attestation measurements and selectable product region.

Inference location does not necessarily constrain administrative access or metadata processing. A hosted endpoint may process model traffic in one region while support or billing data is handled elsewhere. Licensed deployments are described as running wherever the customer operates them, which provides more location control but transfers responsibility for local administrators, hardware, backups and incident response.

How should I evaluate model fit, performance and availability?

Confidential-computing architecture does not predict latency, throughput, accuracy or quality. Run a workload-specific evaluation using representative data and the exact model, hardware, context size and API features you plan to deploy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Test the model contract

  • Pin the model version or document how a successor is selected when an identifier is forwarded.
  • Exercise the maximum context, structured outputs, tool calls, streaming behavior and error formats your application uses.
  • Test rate limits, HTTP 429 handling, Retry-After backoff and concurrency under normal and peak traffic.
  • Check whether prompts or outputs are retained for abuse review, debugging or quality improvement under your contract.

Measure the real workload

Use a fixed evaluation set that includes long prompts, retrieved documents, sensitive tokens and adversarial inputs. Measure end-to-end latency, time to first token, sustained throughput, error rate, output quality and cost at the concurrency you expect. Repeat the test after enabling confidential GPU mode because supported hardware, drivers and model kernels may differ. No universal overhead percentage is established; the result is configuration-specific.

Plan for degraded service

Define a human-review path for outputs that affect regulated decisions. Decide whether a request is queued, rejected or sent to a separately approved service when attestation, capacity or the region is unavailable. Provider terms disclaim guarantees that outputs are accurate or fit for a particular purpose, so your application must enforce validation, policy checks and escalation.

What costs belong in the comparison?

Use a workload-specific total-cost model instead of comparing a token price with an infrastructure price. Current commercial offerings in this category include token-metered inference, hourly confidential VM usage and annual resource licensing; prices, model availability and capacity are volatile and must be confirmed in current terms.

  • Usage: input and output tokens, requests, reserved capacity and overage rates.
  • Infrastructure: confidential GPU or CPU hours, storage, networking, key-management services and backup.
  • Security operations: attestation verifier development, policy review, image signing, key rotation, monitoring and incident response.
  • Engineering: API integration, retrieval pipeline changes, model evaluation, migration testing and regional failover.
  • Compliance: legal review, audits, evidence collection, contract negotiation and recurring assessments.
  • Support: response-time commitments, dedicated support, escalation coverage and maintenance coordination.
  • Staffing: platform, Kubernetes, GPU, cryptography and privacy expertise for self-hosted or licensed deployments.

Ask for a quote that identifies recurring and one-time charges, minimum commitments, egress, failed-request billing, reserved-capacity rules and the cost of maintaining two approved images during updates. Do not present an illustrative annual license calculation or a temporary price as a market statistic.

How should I run a procurement pilot?

A short pilot should prove trust, data handling and operations before it proves model quality. Keep production secrets out of the pilot until the controls pass.

  1. Write acceptance criteria. Specify excluded observers, protected assets, approved regions, model versions, latency targets, retention limits, fallback rules and the evidence required for sign-off.
  2. Build the verifier. Validate nonce-bound attestation, certificate chains, measurements, GPU evidence, policy digests and image-signing identities. Log every decision.
  3. Test key release. Store test data encrypted and release the decryption key only after a passing verification. Confirm that a changed image, firmware version, GPU mode or policy causes a fail-closed result.
  4. Trace data. Use synthetic records and canary values to inspect gateways, logs, caches, telemetry, backups and support workflows. Reconcile observations with the provider’s written terms.
  5. Run the workload evaluation. Benchmark representative prompts, retrieval, structured output, tool calls, concurrency, 429 handling and human-review routing.
  6. Review the contract. Match the BAA or DPA, subprocessors, retention, incident, audit and region language to the exact endpoint and deployment.
  7. Exercise change control. Simulate an image update, model successor, attestation endpoint outage, GPU replacement and region evacuation. Verify that traffic pauses or moves only according to policy.
  8. Approve or reject explicitly. Record residual risks, owners, expiry dates and the conditions that trigger re-review.

What are the common failure modes and how do I fix them?

Observed problem Likely cause Corrective action
Attestation passes but a gateway still sees prompts The gateway or TLS terminator is outside the measured workload. Move termination into the protected boundary, encrypt between components, or prohibit sensitive data at that gateway.
GPU is advertised as confidential but no GPU evidence is available Only the CPU or VM measurement is verified. Require device-level evidence and a policy check covering every accelerator and driver.
A new image silently receives traffic Allowlist updates are automatic or unreviewed. Pin image digests, require signed change approval and fail closed on unknown measurements.
Shared responses appear across tenants Prefix or response caching is not isolated on the shared endpoint. Disable caching or use a dedicated deployment with documented tenant isolation.
Regulated data is sent before the contract is complete Technical encryption was mistaken for legal permission. Block production credentials until the executed agreement names the service, data and region.
Latency or quality drops after confidential mode is enabled Different hardware, kernels, drivers or capacity apply to the protected path. Benchmark the exact confidential configuration and adjust model, batching, capacity or fallback policy.
Incident response cannot explain what was exposed Logs, support access and backups were omitted from the data-flow map. Inventory those systems, set retention and access controls, and require provider notification and evidence.

What should be on the final selection checklist?

  • The threat model names every observer, asset, jurisdiction and accepted residual risk.
  • The request path identifies plaintext locations, measured components and contract-only controls.
  • Fresh nonce-bound attestation is independently verified before data or keys are released.
  • CPU, GPU, firmware, drivers, image digest, command and policy are covered by the approval decision.
  • Unknown or changed measurements fail closed and trigger a documented review.
  • The exact service, model, region and data type are authorized in the executed agreement.
  • BAA, DPA, subprocessor, retention, deletion, support, breach and audit terms are complete.
  • Cache, logs, telemetry, backups, billing metadata and abuse-review handling are understood.
  • Model versioning, API limits, 429 behavior, capacity and deprecation policy are tested.
  • Representative quality, latency, throughput, cost and human-review workflows are benchmarked.
  • Fallback, key revocation, image updates, attestation outages and region failures have been exercised.
  • Residual risks have owners, review dates and an explicit go-live decision.

Frequently Asked Questions

Can a platform process protected health information just because it uses a confidential VM?

No. The provider must authorize that processing in the executed agreement, typically with a business associate agreement that names the relevant service and scope. You also need to verify regions, subprocessors, retention and administrative access for the exact deployment; hardware isolation alone does not create HIPAA permission.

What should the application do if the attestation service is temporarily unavailable?

Treat unavailable evidence as a failed trust decision, not as an approval. Queue only data that remains encrypted under your control, or route to a separately approved path; never release the workload key or send plaintext until fresh evidence is validated.

How can I detect plaintext leakage that a provider’s architecture diagram misses?

Place synthetic canary values in prompts and retrieved documents, then inspect application, gateway, monitoring, support and backup records for those values. Combine that exercise with access-log review, a data-loss-prevention rule and an incident drill so you test both technical visibility and human access.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can confidential inference support retrieval-augmented generation safely?

Yes, but the retrieval store, embedding service, query results and document cache must be included in the trust and residency analysis. If documents leave the protected boundary for search or reranking, the model enclave alone does not protect the complete request.

How should a regulated team handle a model or firmware update?

Use a change window with a second approved measurement, signed artifacts and a rollback image. Run representative quality and performance tests, compare the new attestation evidence with policy, and remove the old digest only after the migration and audit records are complete.
