Choose a cloud provider by proving that its processing, contracts, locations, security controls and exit procedures fit your GDPR obligations—not by selecting a provider that merely advertises “EU hosting.” Start by documenting what data you will process and why, then determine whether the provider is a processor, controller or joint controller for each operation. Verify every storage, backup, support, subprocessor and administrator-access location; require an Article 28-compliant data-processing agreement; assess international transfers with an adequacy decision or Standard Contractual Clauses (SCCs) where necessary; and demand evidence of risk-based technical and organisational measures. For high-risk processing, complete a data-protection impact assessment (DPIA). Contract for incident assistance, audits, deletion, portability and a tested exit. The result should be a documented, risk-based decision that your organisation can defend to customers, auditors and a supervisory authority.

What does GDPR require when you use a cloud provider?

GDPR obligations follow the processing activity, not the location of a server or the marketing label on a service. It applies to organisations established in the European Union that process personal data and to organisations outside the EU that offer services to, or monitor the behaviour of, people in the EU. Your organisation remains accountable for the personal data it entrusts to a cloud service.

The Irish Data Protection Commission puts the accountability point plainly: “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” Outsourcing infrastructure does not outsource your duties to provide a lawful basis, give privacy information, respect data-subject rights, limit retention or demonstrate appropriate security.

Start with a processing inventory

Before comparing services, record the data categories, purposes, data subjects, retention periods, approximate volumes, availability needs and systems that will connect to the service. Mark special-category data, criminal-offence data, children’s data, authentication secrets, precise location data and information that could cause substantial harm if exposed. Note whether processing is continuous, large-scale, systematic monitoring or otherwise likely to create a high risk to individuals.

GDPR also requires processing to be lawful, transparent, purpose-limited and necessary. A technically secure service cannot cure an unlawful purpose or excessive collection. Use the inventory as the baseline for your records of processing activities, security design and procurement requirements.

How do I decide whether a provider is a processor, controller or joint controller?

Classify the relationship separately for each processing operation. Do not accept a provider’s generic “GDPR-compliant” label or a single role description for an entire product portfolio.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Processor

A provider is generally a processor when it handles personal data only on your documented instructions and does not decide the purposes or essential means of processing. A processor engagement requires sufficient guarantees and a legally binding written contract meeting Article 28. Your instructions should cover the data, purposes, duration, categories of people and types of operation.

Independent controller

A provider may be an independent controller for activities where it determines its own purposes and means—for example, certain account administration, billing, fraud prevention or legal-retention operations. That status brings its own transparency, lawful-basis, retention and rights obligations. The contract should identify those activities rather than implying that every use is performed on your behalf.

Joint controllers

Joint controllership can arise when you and the provider jointly determine purposes and essential means. The parties must arrange their respective responsibilities, provide transparent information and make the arrangement available to people where required. Have counsel validate this classification when the provider uses customer data for shared analytics, product improvement or a jointly designed service.

Evidence to request

  • A processing-by-processing role matrix, including any controller or joint-controller activities.
  • The provider’s description of purposes, data fields, retention and secondary uses.
  • Named contacts responsible for privacy and security decisions.
  • An explanation of how role changes are notified and approved.

What should a cloud data-processing agreement include?

An Article 28 data-processing agreement (DPA) should be specific enough to allocate work and test compliance. A short reference to “industry-standard security” is not a substitute for defined duties, evidence and remedies.

Minimum contractual elements

  • Documented instructions: the subject matter, duration, nature and purpose of processing, data categories and categories of data subjects.
  • Confidentiality: binding duties for employees and contractors with access, plus access limited to people who need it.
  • Security responsibilities: a clear split between your configuration and identity duties and the provider’s infrastructure, platform and personnel controls.
  • Subprocessors: a current list, prior or general written authorisation, notice of proposed changes and a practical objection process. The provider remains responsible for its subprocessors.
  • Rights assistance: tools and timely cooperation for access, correction, erasure, restriction, objection and portability requests.
  • Incident assistance: prompt notification, investigation support, evidence preservation and help with regulator and individual communications.
  • DPIA and consultation support: information needed to assess risks and, where appropriate, consult a supervisory authority.
  • Audits and inspections: access to relevant records, independent reports and reasonable on-site or remote testing, with confidentiality safeguards.
  • Deletion or return: a defined format, timetable, backup treatment and written confirmation at the end of the service.
  • Purpose limits: no sale, advertising, model training or other secondary use unless separately lawful, transparent and authorised.

Make security obligations measurable

Attach a security schedule that names required controls, responsible parties, notification deadlines, recovery objectives and evidence frequency. It should be possible to determine whether a missed obligation is a configuration issue for your team, a provider defect or a shared responsibility gap.

Does EU data residency guarantee GDPR compliance?

No. Keeping primary data in the EU or European Economic Area (EEA) can simplify some transfer questions, but it does not establish a lawful purpose, suitable security, correct controller-processor roles or an Article 28 contract. EU residency also does not prevent access from another country by support staff, administrators, affiliates or subprocessors.

Build a complete data-location map

Ask for region-level locations—not just a country listed on a sales page—for:

  • Primary storage and active processing.
  • Replicated databases, snapshots and backups.
  • Disaster-recovery sites and restoration environments.
  • Logging, telemetry, crash reports and support-ticket systems.
  • Customer-support and security-operation centres.
  • Remote administrator access, including the countries from which it may occur.
  • Every subprocessor and its own onward transfers.

Require notice before a location or subprocessor changes. Record the answer in your transfer register and revisit it when the service architecture, support model or legal environment changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When do I need SCCs for a cloud service?

If personal data is transferred from the EEA to a third country without an applicable adequacy decision, you need an appropriate safeguard such as SCCs, unless a narrowly applicable GDPR derogation applies. The European Commission adopted its modernised SCCs on 4 June 2021.

Separate the two SCC functions

Question What the document addresses What it does not establish
Is the provider acting as your processor? Processor clauses can satisfy Article 28 requirements when incorporated into the service contract and tailored to the relationship. They do not, by themselves, legalise a transfer to a third country.
Is data transferred to a third country? Transfer SCCs provide safeguards for the relevant exporter, importer and transfer module. They do not remove the need to examine the actual transfer context or to implement supplementary measures where required.

Complete a transfer assessment

For each transfer, identify the exporter, importer, data, purpose, route, access possibilities and applicable law in the destination country. Assess whether public authorities could obtain access in a way that undermines the safeguards, and document technical or organisational supplementary measures such as strong encryption with customer-controlled keys, strict access controls, minimised data and robust logging. Reassess when the provider changes subprocessors, support locations, encryption design or the legal environment.

An adequacy decision can remove the need for SCCs for the covered transfer, but confirm that the decision applies to the specific destination and remains in force. A derogation is an exception for limited circumstances, not a general hosting strategy.

Which security controls should I demand from a cloud provider?

Security measures must be proportionate to the risks created by your data and processing. Ask for current design descriptions, policies, test results and assurance reports rather than relying on slogans or a certificate logo.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Identity and privileged access

  • Separate customer and provider administrative planes.
  • Multi-factor authentication, phishing-resistant options where feasible and least-privilege roles.
  • Privileged-access approval, time limits, session recording and periodic reviews.
  • Immediate revocation for leavers and compromised credentials.

Encryption and key control

  • Encryption in transit and at rest, with documented algorithms and key rotation.
  • A clear answer on who controls keys, who can access them and how emergency access works.
  • Options for customer-managed or externally held keys when the threat model requires them.

Isolation and network defence

  • Tenant-isolation design and controls against cross-customer access.
  • Network segmentation, firewalls, secure default settings and protected management interfaces.
  • Vulnerability management, patch timelines and independent penetration testing scope.

Detection, response and recovery

  • Centralised logs, monitoring, alerting, retention periods and customer access to relevant records.
  • A documented incident-response plan, escalation contacts and evidence-preservation process.
  • Backups protected from ransomware, restoration tests, recovery time and recovery point objectives.
  • Business-continuity plans, dependency mapping and results of recent exercises.

People and change management

  • Background screening where lawful and appropriate, confidentiality commitments and role-based training.
  • Formal change approval, secure development practices and notification of material architecture changes.
  • Documented policies for media handling, secure deletion and physical access.

The Data Protection Commission specifically highlights access control and identity verification, firewalls, secure defaults, documented policies, provider assurances, training and risk-based categorisation. Request evidence that maps each requirement to an owner and testing method.

Which certifications and assurance reports matter?

Certifications can organise due diligence, but none automatically proves that your processing complies with GDPR. Review the scope, service boundaries, locations, exclusions, control period and exceptions in each report.

Evidence Useful for Questions to ask
ISO/IEC 27001 Information-security management system and risk governance. Does the certificate cover the exact service, region and support operation you will use? What controls and exclusions are in the statement of applicability?
ISO/IEC 27017 Cloud-specific security practices and shared responsibilities. Which customer configuration duties remain with you, and how are they tested?
ISO/IEC 27018 Protection of personally identifiable information in public-cloud processing. How are deletion, subprocessor and secondary-use controls implemented in this service?
ISO/IEC 27701 Privacy-information management processes. Does the scope include the roles and processing operations relevant to your account?
SOC 2 Independent testing of selected trust-service criteria over a stated period. Read the auditor’s testing, exceptions and complementary customer controls; do not rely on the opinion alone.
EU Cloud Code mappings A structured way to map cloud controls to GDPR concepts. Which controls are actually implemented, and what evidence supports each one?

The EDPB cloud-control material describes its mapping as a starting point, not an exhaustive or binding legal reference. Treat mapped controls and certifications as evidence inputs for your own risk assessment, not as a legal conclusion that a provider is “GDPR compliant.”

Do I need a DPIA before moving data to the cloud?

A DPIA is mandatory when intended processing is likely to result in a high risk to individuals. The trigger is the nature, scope, context and purposes of your processing—not the fact that a cloud service is involved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When a DPIA is commonly indicated

  • Large-scale processing of special-category or criminal-offence data.
  • Systematic monitoring of people, including extensive online or physical tracking.
  • Combining datasets to make decisions that significantly affect individuals.
  • Use of new technologies or processing that creates unfamiliar risks.
  • Processing involving vulnerable people or large populations.

What to include about the provider

  1. Describe the processing operation, data flows, purposes and lawful basis.
  2. Assess necessity and proportionality, including minimisation and retention.
  3. Identify threats from unauthorised access, misuse, loss, outage and unlawful government access.
  4. Document provider controls, your configuration duties and residual risks.
  5. Specify mitigations, owners and review dates.
  6. Consult your data-protection officer where applicable and seek prior consultation if high residual risk remains.

Keep the provider’s architecture, transfer assessment, DPA and assurance evidence with the DPIA. Update it when the service, data, threat model or transfer route changes.

How should I assess incidents, resilience and regulatory oversight?

Contractual notification alone is not enough; you need a process that lets your organisation meet its own reporting deadlines and continue operating during an outage.

Incident provisions

  • Define “personal-data breach” and other security events, including suspected events.
  • Set a notification clock that starts when the provider becomes aware, with an initial notice even when facts are incomplete.
  • Require incident details, affected systems and data, containment steps, likely impact and updates until closure.
  • Preserve logs and forensic evidence and support communications to regulators and affected people.

Availability and recovery

  • Set service-level targets, maintenance notice and remedies that are meaningful for your risk.
  • Specify recovery time objectives (RTO) and recovery point objectives (RPO) for each critical workload.
  • Request evidence of restoration tests, dependency failures and lessons learned.
  • Define how you will obtain data during a prolonged outage or provider insolvency.

NIS2 and other obligations

Where the provider falls within the scope of the EU Network and Information Security Directive 2 (NIS2), ask how applicable implementing requirements, supply-chain controls and incident processes are addressed. NIS2 status does not replace GDPR analysis; it can provide additional resilience evidence relevant to your risk assessment.

How do I make cloud exit and portability enforceable?

Design the exit before signing. A provider that can export data only in a proprietary format, or deletes backups on an unknown schedule, can leave you unable to honour retention, access or erasure duties.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Put these terms in the contract

  • Export formats, schemas, metadata and encryption requirements.
  • Self-service export and provider-assisted migration, with named response times.
  • Access to logs, configuration, keys and documentation needed to operate the replacement environment.
  • Suspension and termination rights for material security, transfer or legal failures.
  • Deletion deadlines for live systems, replicas, caches and backups.
  • Deletion by subprocessors and a certificate or other verifiable evidence.
  • Retention of legally required records without keeping operational personal data unnecessarily.
  • Transparent exit fees and assistance rates.

Run a portability test

  1. Select a representative workload, including relational data, files, identities, logs and application metadata.
  2. Export it using the documented method and record time, cost and format limitations.
  3. Restore it in an independent test environment.
  4. Verify completeness, integrity, timestamps, permissions and searchability.
  5. Delete the test copy under the provider’s process and obtain evidence.
  6. Record remediation actions and repeat the test after major platform changes.

European Data Protection Supervisor guidance recommends integrating safe return of data and portability into the cloud contract and procurement specification. Treat exit as an operational control, not a theoretical right.

How can I compare two providers objectively?

Use the same evidence request and scoring scale for every finalist. Weight criteria according to your processing risk; a low-risk development environment should not be scored like a system containing health or financial data.

What procurement process produces a defensible decision?

Keep an evidence file that shows who decided what, on which facts and with which residual risks accepted.

  1. Define the use case: inventory data, purposes, subjects, retention, availability and risk.
  2. Set mandatory gates: acceptable locations, role classification, Article 28 terms, transfer mechanism, security baseline and exit capability.
  3. Issue a structured questionnaire: ask every candidate for the same architecture, subprocessor, assurance, incident and portability evidence.
  4. Validate claims: inspect report scope and dates, test administrative controls, review contract redlines and challenge vague answers.
  5. Complete legal assessments: finalise the DPA, transfer assessment and DPIA where required; involve your data-protection officer and security team.
  6. Score residual risk: document mitigations, owners, deadlines and the person authorised to accept what remains.
  7. Approve and monitor: set review dates, change-notice triggers, subprocessor checks, incident exercises and annual evidence refreshes.
  8. Rehearse exit: perform a portability and deletion test before the service becomes business-critical.

What are the most common selection mistakes?

Confusing a region selector with residency

A selectable EU region may still involve global support, telemetry or administrator access. Demand the complete location map and contractual change controls.

What’s actually slowing this PC down?

Pick the symptom - the matching free tool is one click away.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating a certificate as a compliance verdict

Certificates have scopes, exclusions and periods. Read the underlying report and map controls to your processing rather than accepting a logo as proof.

Signing a generic DPA without operational details

Generic terms often omit actual subprocessors, response times, deletion evidence, audit mechanics and customer configuration duties. Redline those gaps before production use.

Using SCCs without examining the transfer

SCCs are safeguards, not a substitute for a transfer assessment. Check destination-country law, access possibilities and supplementary measures for each route.

Ignoring secondary use

Provider analytics, service improvement or machine-learning uses may change the provider’s role and create a new purpose. Require explicit limits, transparency and approval for any reuse.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Leaving without testing

An untested export can fail because of missing metadata, proprietary formats, inaccessible keys or hidden backup copies. Test a representative workload while you still have negotiating leverage.

What should management approve before production?

Approval should be conditional on evidence, not on a vendor’s promise. The decision record should contain:

  • The processing inventory, role classification and lawful-basis analysis.
  • The signed DPA and security schedule, including subprocessor terms.
  • The location and transfer register, adequacy or SCC documentation and transfer assessment.
  • The DPIA and residual-risk acceptance where high-risk processing is involved.
  • Assurance reports, control mappings, penetration-test summaries and remediation plans.
  • Incident, continuity, RTO/RPO and regulator-cooperation arrangements.
  • The export, deletion and portability procedure, including test results.
  • A monitoring calendar and named owners for renewal, changes and exit.

GDPR administrative fines can reach EUR 20 million or 4% of global annual turnover, as stated in the European Union’s current GDPR guidance checked on 5 August 2026. The exposure is one reason to treat cloud selection as an accountability decision rather than a purely technical purchase, but the practical objective is broader: maintain lawful, secure and demonstrable control throughout the service lifecycle.

How do I keep the assessment current after onboarding?

Cloud environments change frequently, so approval is not permanent. Review the provider at least annually and whenever a material change occurs.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Reconcile the subprocessor list and processing locations with your records.
  • Review new transfer routes, support countries and changes in government-access risk.
  • Refresh assurance reports, penetration-test summaries and unresolved exceptions.
  • Test privileged access, key management, logging, backup restoration and deletion.
  • Exercise breach notification and escalation contacts.
  • Re-run the DPIA or transfer assessment when the purpose, data, technology or legal context changes.
  • Repeat the portability test after major platform or schema changes.

A provider remains suitable only while its actual processing, controls and contract continue to match your documented requirements.

Frequently Asked Questions

Which cloud provider is GDPR compliant in Europe?

There is no single provider or physical product that makes every use compliant. Compliance depends on your purposes, data, configuration, contract, transfer safeguards and ongoing oversight, so evaluate a specific service and processing operation rather than relying on a universal label.

Do I need SCCs if my data is stored in the EU?

Possibly. SCCs may still be needed if support personnel, administrators, subprocessors, backups or telemetry can access the data from a country without an adequacy decision. Confirm the complete access path, not only the location of the primary database.

How often should I check a cloud provider’s subprocessors?

Check the list before signing, whenever the provider announces a change and on a scheduled review at least annually. Compare each version with your transfer register and use the contractual objection process when a new subprocessor creates an unacceptable risk.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a small company skip a DPIA when using a major cloud platform?

Company size and the provider’s reputation do not determine the DPIA requirement. If your intended processing is likely to create high risk—such as large-scale sensitive-data processing or systematic monitoring—you must assess it and document the provider’s role and controls.

What evidence proves that cloud deletion really happened?

Use a contractually defined deletion process covering live systems, replicas, caches, backups and subprocessors. Request a deletion certificate or equivalent verifiable record, and validate the process with a test export and deletion exercise before termination.
