Use a documented, two-part review before shipping AI-generated code: establish where every line came from, then verify that its copyright status, third-party licenses, provider contract and your project policy allow the intended use. Save the tool, model, date, prompt, context and exact output; run the tool’s public-code matching controls and an independent scanner; inventory imports and copied material; read each upstream license and notice; and have a human reviewer assess substantial matches. A match is a reason to investigate, not proof of infringement, and a prompt alone does not give you copyright in the resulting code.
What exactly are you checking when code comes from an AI tool?
“Can I use this code?” actually combines several different questions. Treating them separately prevents a clean-looking scan from hiding a contractual or licensing problem.

Is the output protected by copyright?
Copyright protects expression, not an abstract idea or a purely functional requirement. The U.S. Copyright Office’s January 29, 2025 guidance says protection turns on the expressive elements a human author determines. A machine-determined result is not protected under that analysis, while human selection, arrangement or creative modification can be protected on a case-by-case basis. The Office received more than 10,000 public comments on AI by December 2023, and its conclusions are U.S.-focused; other jurisdictions can apply different tests. Could the output reproduce somebody else’s code?
Yes. A generator can produce a distinctive function, comment, test fixture or configuration that resembles code in its training material. GitHub says such matches are rare in its cited research—less than 1% of suggestions—but that is GitHub’s own reported figure, not an independent prevalence estimate. The risk is comparable to reusing code found online, so a reviewer must inspect any match rather than assuming the output is original. See GitHub’s Copilot guidance.

Do the tool’s contract and your project policy permit the use?
Provider terms may allocate output rights, restrict data use, or offer a conditional defense. Your repository may also require an approved license, attribution, disclosure or a human review. A contractual promise is not a copyright clearance: it applies only within its stated product, geography, settings and conditions.
What provenance should you capture before editing the output?
Create a record while the interaction is still available. Provider interfaces and terms change, and a later screenshot rarely proves what model or settings produced a line.

- Identify the service and account context. Record the product name, subscription or plan, organization account and whether an enterprise data or training-control setting was enabled.
- Record the model and version. Save the displayed model name, release or date. If the interface does not show a version, write “not displayed” rather than guessing.
- Timestamp the interaction. Use a consistent time zone and include the date. Keep the relevant terms or policy version that was presented at that time.
- Preserve the complete prompt and context. Include system or repository instructions you supplied, the surrounding code shown to the tool, file paths, language, framework and any examples in the prompt. Redact secrets, credentials and personal data, but note that redaction occurred.
- Save the exact response. Keep the generated code, comments, suggested tests and any source or reference panel exactly as returned. Hash the captured file if your evidence system supports it, then link the hash to the commit that used it.
- Log transformations. Note what a person selected, rewrote, combined, deleted or tested after generation. Keep the commit history that shows those changes and the reviewer’s identity.
This record does not prove that every line is copyright-free. It lets you explain the decision, reproduce a scan and show which parts were independently authored if a question arises later.
How do public-code matching and repository scanners fit together?
Use both layers when they are available. The generator’s matching or reference feature can flag a close response at the moment of suggestion; a repository scanner can find matches after code has been edited, copied between files or combined with dependencies.
Configure the generator first
Check whether the service can block or filter suggestions that match public code, show a reference or repository, and export an audit log. GitHub lets customers control whether suggestions matching public code are allowed and recommends code-scanning policies. Turn on the strictest setting compatible with your work, and record the setting in the provenance log. Filtering reduces exposure; it does not establish that an unflagged line is original.

Scan the committed tree
Run your normal software-composition and code-scanning tools against source files, generated files, tests, examples, comments and configuration. Scan again after rebases or vendor updates. Apache Software Foundation guidance notes that many AI tools provide no training-data information and that scanners can match only known open-source code; an absence of a hit is therefore not proof of clean provenance. GitHub’s own wording is important: “Matching code does not necessarily mean copyright infringement.” The user must determine whether to use the suggestion and what attribution or other license compliance is appropriate. A reviewer should consider the quantity and substantiality of the match, whether the material is functional or expressive, the source license and the way your product is distributed.
How do you inventory every third-party element?
Do not limit the review to imported packages. AI output often hides legal material in a small helper, a copied comment or a fixture that never appears in a dependency manifest.

For each item, locate the upstream license file and notice file in the exact version you used. If the repository has no clear license, treat that as an unresolved rights issue rather than assuming that public availability grants permission. Keep a software bill of materials or equivalent inventory tied to the release commit.
How do you test license compatibility with the way you distribute the software?
Start with your distribution model, then map each obligation to a concrete release action. The same code can be acceptable in an internal prototype and unacceptable in a product that ships a binary or contributes changes upstream.

Apache Software Foundation guidance says contributors remain responsible for disclosing copyrighted material that is not their original creation and identifying its license. It also says the AI tool’s terms must grant rights broad enough for the contribution under Apache-2.0, and third-party material must be used only with permission or a compatible open-source license. Preserve copyright notices and attribution exactly where the license requires them; do not replace an upstream notice with an “AI-generated” label.
What obligations should appear on your release checklist?
- Attribution and copyright notices are present in the locations required by the license.
- Any source-offer, corresponding-source or disclosure package is ready for the same release channels as the product.
- Patent, contribution and modification terms have been reviewed where the license includes them.
- License identifiers in manifests match the actual license text in the upstream version.
- Exceptions are approved by the person responsible for open-source compliance, not silently waived in a pull request.
Does AI-generated code receive copyright protection?
In the United States, not automatically. The Copyright Office’s January 29, 2025 report says prompts alone generally do not supply the human authorship needed for protection; the result depends on the human-determined expressive elements. Selecting among outputs, arranging code creatively or making substantial expressive modifications can support protection, but the question is fact-specific. The Office’s statement from Register Shira Perlmutter is explicit: extending protection to material whose expressive elements are determined by a machine would undermine copyright’s constitutional goals. This is an analysis of U.S. law, not a worldwide rule.
Keep the human-authorship record separate from the license review. A developer may own copyright in an original surrounding architecture while a generated helper remains unprotected, and both can coexist with a third-party license attached to copied lines. Do not claim that a large prompt, extensive testing or a company’s payment for the tool automatically creates authorship.
What do provider terms and indemnities actually cover?
Read the contract in force for the exact product and plan. Provider language can reduce risk, but it is conditional and does not transfer responsibility for choosing code.

Save a copy or stable reference to the applicable terms with each release record. If the terms change, note the effective date and determine whether existing releases or support commitments are affected. An indemnity is a contract for specified costs and conditions, not permission to ignore an upstream license.

What should you do before contributing AI-assisted code to an open-source project?
Follow the project’s contribution policy in addition to the upstream license. Maintainers may require disclosure of AI assistance, a signed contributor agreement, human review or a prohibition on generated patches.
- Classify the patch. Separate your original design and edits from generated sections and any material traced to another repository.
- Disclose non-original material. Identify copied or matched code, its copyright holder and its license in the pull request or project-required notice.
- Confirm contribution rights. Check that your AI provider’s terms and your employer’s policies let you grant the project the rights required by its license or contributor agreement.
- Attach evidence. Provide scan results, upstream links, license files and the provenance record privately or publicly as the project requests.
- Ask before merging an exception. If a match is substantial, distinctive or under an incompatible license, pause and obtain maintainer or specialist open-source counsel approval.
Apache’s guidance captures the core duty: contributors are responsible for disclosing copyrighted materials in submitted contributions that are not their original creation. A maintainer’s acceptance does not retroactively cure missing permission, so resolve the issue before the merge.
What should you do when a scan finds a substantial or distinctive match?
Stop the release of the affected component until someone can identify the source and obligations. A fast, repeatable response is safer than debating similarity in the abstract.

- Quarantine the code. Mark the file or lines as under review and prevent the match from entering a release branch.
- Capture the evidence. Save the scanner output, the generated response, the matching upstream commit, line counts and the reviewer’s comparison.
- Assess substantiality. Determine whether the match is a commonplace functional pattern or distinctive expression, and whether comments, tests or structure are included.
- Read the source license. Verify the exact version, copyright notices, attribution, source-disclosure and patent or contribution terms.
- Choose a remedy. Replace the code with an independently implemented version, comply with a compatible license, obtain permission or remove the feature. Do not merely rename variables or reorder lines.
- Escalate when uncertainty remains. Obtain specialized open-source-compliance or legal review for a material product, a disputed ownership claim or an incompatible license.
If the provider supplies no similarity information, record that limitation in the decision file. Apache notes that no current tool can reveal all training data; your conclusion should state exactly which databases and scans were used.
How should you compare AI coding tools for compliance controls?
Do not compare tools only on code quality. Evaluate whether the product helps you prove what happened and enforce your project’s rules.

Ask vendors to demonstrate the controls on a test repository, then keep the configuration export with your policy. Features and indemnities are volatile; recheck them when renewing a plan or changing models.
What is still unsettled about AI-generated code?
There is no universal worldwide rule that makes AI output either copyright-free or automatically licensed for reuse. Copyrightability, implied permissions and contractual duties can vary by jurisdiction, project policy, provider plan and the amount of human authorship. Even a favorable U.S. analysis does not answer whether an upstream author can enforce a license in another country.

Frequently Asked Questions
Do I have to disclose AI assistance in a project’s NOTICE file?
There is no single rule for every project. Add disclosure when the project policy, contributor agreement or an applicable license requires it; otherwise keep the provenance record internally and follow the project’s normal attribution format rather than inventing a new notice category.
How long should provenance and scan records be kept?
Keep them for at least the supported life of the release and any period in which you distribute updates, accept contributions or face license inquiries. Retain the records with the commit or release artifact so a future maintainer can reproduce the decision after a model or provider policy changes.
What if a scanner finds code in a repository with no license?
Public visibility is not a grant of reuse rights. Treat the material as all-rights-reserved, replace it with an independently written implementation, or obtain permission from the copyright holder before distribution.
Does adding comments or changing variable names make generated code original?
Cosmetic edits usually do not resolve a substantial match. A human-authorship analysis looks at the expressive choices and the overall protected material, so document meaningful creative changes and have a reviewer assess the complete comparison.
