Fact-check a documentary one claim at a time: write down the exact statement or image, find the strongest original source for it, check what that source actually establishes, and corroborate consequential claims independently. A court filing can confirm that an allegation was made; it does not, by itself, prove the allegation. The docket, filing type, procedural history, and final outcome matter. The steps below focus on U.S. federal court records; state, local, tribal, and non-U.S. court systems have different access procedures and terminology.

What does it mean to fact-check a documentary?

It means checking the film’s factual assertions against evidence, not deciding whether the film feels persuasive or whether its overall point seems plausible. A documentary can combine accurate facts with a misleading legal description, an incomplete quotation, a misdated image, or an inference presented as established fact. Check each part separately.

Start with a record of the film itself: its title and edition, release date, platform or broadcast, and the timecodes you review. If multiple edits, trailers, or episodes exist, identify which version you mean. A claim’s wording or context can change between versions.

For each checkable assertion, capture the exact words and timecode. Include narration, interview statements, captions, on-screen text, names, job titles, dates, locations, translations, causal explanations, legal characterizations, photographs, archival footage, screenshots, maps, and graphics. A single sentence can contain several claims with different evidence requirements. FRONTLINE’s standards say that long-form content should be checked line by line, including what appears on screen, and that producers should be prepared to cite their sources in a fact-checking document or annotated script (FRONTLINE editorial standards).

Separate facts from interpretation. “The court entered a judgment on Tuesday” is a verifiable procedural claim. “The judgment proves the company knowingly misled customers” is a broader interpretation that needs evidence for knowledge and intent, not merely a judgment about some other issue. Opinions need not be treated as facts, but any factual premise embedded in an opinion can still be checked.

How do I build a claim-by-claim fact-check?

Use an annotated script or a claim matrix so another editor can follow the evidence and reproduce your reasoning. Do not rely on memory, a general impression, or a folder of unlabeled links.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Record the claim exactly. Include the timecode, speaker or visual, and enough surrounding context to avoid changing the meaning. Preserve the exact spelling and wording before paraphrasing.
  2. Classify it. Mark it as a factual assertion, allegation, quotation, procedural/legal statement, interpretation, or opinion. A quote needs a reliable record of what was said; a claim about a court result needs the relevant order, verdict, or judgment; an allegation needs evidence beyond the document that repeats it.
  3. Break compound claims apart. For example, “The executive ordered the payment after the warning and concealed it from regulators” contains at least three propositions: an order, timing, and concealment. One source may support only one of them.
  4. Find the best primary source available. Prefer the original record or direct evidence over a summary of it. For a court claim, identify the case and locate the docket and relevant filed document. For a quote, look for the original recording or official transcript. For a date or government action, seek the issuing agency’s original notice or record.
  5. Write down both the support and the limit. State what the source establishes and what it does not. If a complaint says a defendant did something, the complaint establishes that the plaintiff alleged it; it does not automatically establish that the event occurred.
  6. Seek independent corroboration for disputed or consequential claims. Check whether the second source is truly independent or simply repeats the first source, a press release, or the same wire report. Attribute the assertion precisely if it cannot be confirmed.
  7. Assign a status and revise the wording. Use labels such as verified, qualified, unresolved, or remove. A qualified claim may be publishable with narrower wording and clear attribution; an unresolved one should not be narrated as settled fact.

A practical matrix can use these columns:

Field What to record
Claim ID and wording Exact statement, separated into individual propositions
Location in film Edition, episode, timecode, speaker, and visual context
Claim type Fact, allegation, quotation, legal status, interpretation, or opinion
Primary source Creator or custodian, title, URL or file name, court and docket details if relevant
Independent corroboration Source, its independence, and the specific point it supports
Source limits What the source proves, what it does not, and any missing context
Locator and provenance Page, paragraph, document number, transcript timestamp, access date, and how the item was obtained
Decision Status, proposed final wording, attribution, and editor’s reason

Keep a copy or screenshot of important public webpages and a clear record of the version you consulted when doing so is lawful and consistent with your organization’s policies. Links can change, and a link alone may not let a later editor identify the exact passage you relied on. Preserve source material securely; do not circulate sealed, confidential, or sensitive personal information merely because it was encountered during research.

How can I find the original court documents?

For a U.S. federal case, begin with the official case docket, then retrieve the particular filing that bears on the documentary’s claim. The U.S. Courts describes a federal case file as the docket sheet plus documents filed in the case. Most federal case documents are available electronically through PACER, while CM/ECF is the courts’ electronic filing system. Court websites, clerk’s offices, and public terminals may provide other access routes (U.S. Courts: accessing federal court documents).

  1. Identify the case accurately. Use party names and, where possible, the court, case number, and filing date. Similar party names or multiple related cases can lead to the wrong docket.
  2. Read the docket entries, not just a search snippet. Note the court, case type, filing dates, document numbers, and current procedural status. A document may be amended, superseded, withdrawn, or followed by a ruling that changes how it should be described.
  3. Open the filing that matches the claim. Record its full title and document number. Read relevant pages in context and check referenced exhibits or attachments where available.
  4. Trace the case forward. Look for responses, motions, orders, trial or plea records, verdicts, judgments, appeals, and later modifications. A claim based on an early filing may be incomplete if the case was later dismissed, settled, tried, or appealed.
  5. Compare the documentary’s wording with the court’s wording. Preserve distinctions such as “alleged,” “charged,” “admitted,” “found,” and “held.” Do not turn a party’s description into a court finding.

When reporting on a federal criminal case, the document type is essential. An indictment or complaint states charges or allegations. A supporting affidavit sets out evidence offered to establish probable cause; probable cause is not a final determination of guilt. A plea agreement and statement of facts identify the charges resolved and may record facts admitted by the defendant. A verdict or judgment reflects an adjudicated result, but the exact result and scope still matter. The U.S. Courts’ guidance on reporting criminal cases explains why these records are not interchangeable. Its media guidance puts the priority plainly: “Reporters must rely on the official case proceedings as their primary information source” (U.S. Courts, federal court media basics).

For state, county, tribal, or foreign proceedings, do not assume federal PACER procedures apply. Find the relevant court’s official docket or records guidance, check local access rules, and confirm that the record belongs to the right court and case. The research process remains the same even when the portal and document names differ.

Can I trust a court filing as proof?

Trust it for what it is: an official record of a filing or proceeding, not automatic proof that every factual assertion in it is true. A primary source is valuable because it is close to the event or decision, but its creator, purpose, completeness, and limits still need examination.

For every key document, ask:

  • Provenance: Who created, filed, recorded, or kept it? Is this an official copy, a party’s exhibit, a media-hosted copy, or an unattributed image of a document?
  • Date: When was it created or filed, and how does that compare with the events described? A later recollection may differ from a contemporaneous record.
  • Purpose and audience: Is it a sworn declaration, advocacy brief, internal memo, official order, press release, or personal account? Its role affects what it can establish.
  • Completeness: Is this the whole document and relevant record, or an excerpt, redacted copy, or selection made by one side? Check attachments and surrounding docket activity.
  • Knowledge and incentives: What did the author know firsthand? What outcome might the author have wanted, feared, or been authorized to establish?
  • Corroboration: Do independent records, witnesses, transcripts, data, or original media support the same point?

GSR’s editorial standards caution: “Possession of a document does not automatically establish its authenticity or prove every assertion contained within it” (GSR source guidance). UC Berkeley’s guidance likewise recommends checking creator, date, audience, purpose, bias, and corroboration rather than assuming that a firsthand source is accurate simply because it is primary (UC Berkeley Library: evaluating primary sources).

Federal Rule of Evidence 1005 offers legal context for copies of public records: subject to the rule’s conditions, a copy may prove the record’s content if it is certified or shown to match the original. That courtroom evidence rule is not a substitute for journalistic verification, but it underscores why the exact official record and the reliability of a copy matter (Federal Rule of Evidence 1005).

How do I distinguish an allegation from a proven fact?

Track the claim through the procedural posture of the case and use a verb that matches the record. “The complaint alleged,” “prosecutors charged,” “the defendant admitted in a plea,” and “the jury found” describe different things. Replacing them all with “the court proved” erases distinctions that are central to an accurate account.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use this sequence when a film makes a legal claim:

  • Filing: A complaint or indictment tells you what a party or prosecutor alleged. Attribute the claim to that party unless another record establishes it.
  • Evidence offered: An affidavit or motion presents material for a legal purpose. Identify whose evidence it is and what question the court was deciding.
  • Admission or plea: Check the signed agreement and any statement of facts. Describe only the charges and facts actually admitted; a plea does not necessarily admit every allegation in a broader narrative.
  • Ruling or verdict: Read the decision, instructions or relevant record, and judgment. State what issue was decided, against whom, and with what result.
  • After the result: Check for sentencing, appeal, reversal, dismissal, or later orders before describing the case as final.

A civil settlement is not automatically an admission of liability; its terms and public record determine what can responsibly be said. If the terms are confidential or not available, do not infer them. Similarly, dismissal may have different meanings depending on the order and procedural grounds. The safe approach is not to use a generic outcome label when the record provides a more precise one.

Investigate Midwest’s guidance specifically warns writers to distinguish allegations in pending cases from charges proven in court (Investigate Midwest fact-checking guidelines). If the case is still pending, say so and attribute contested factual claims. If no final ruling addresses the relevant assertion, do not imply that one does.

How many sources should support a controversial claim?

For a controversial or potentially damaging assertion, aim for two independent on-the-record sources, one of which may be a document. Independence matters: two articles repeating the same press release are not two separate confirmations. FRONTLINE describes two independent on-record sources as best practice (FRONTLINE standards), and the Associated Press describes verification as corroborating facts with several independent, reliable sources and documents (AP verification).

Independence does not mean every source must have firsthand knowledge of every part. A court document may establish what was filed or admitted; a separately interviewed witness or contemporaneous record may corroborate the underlying event. Explain the division of proof rather than treating sources as interchangeable.

If two independent sources are unavailable, there are responsible alternatives: narrow the statement to what the evidence supports, attribute it directly to the source, explain the limit, or omit it. “A filing alleged that…” is not a substitute for corroboration when a film presents the allegation as fact. Nor does a confident interview answer alone resolve a disputed factual question.

How should I verify documentary footage, photographs, and audio?

Authenticate the visual or recording as its own claim. An image can be genuine but misdated, a real recording can be edited in a way that changes context, and a screenshot can show a page without proving who created or controlled it.

For each item, record who supplied it and whether you have the original file or a copy. Check metadata when available, but do not treat metadata as conclusive: it can be missing, altered, or stripped during copying. Compare the claimed date and place with visible landmarks, signage, language, weather, clothing, and continuity. For a screenshot, identify the page address and capture date if known, then seek the underlying page, original document, or an independent record rather than relying on the image alone.

Use reverse-image search and geolocation where appropriate; compare the frame with independent reporting or official records; inspect suspicious edits frame by frame; and contact the original filmer or rights holder when relevant. The Associated Press includes these kinds of checks in its verification workflow (AP verification practices). Authentication should answer separate questions: Is this the claimed file? Does it depict the claimed event? Does the date and location match? Does the edit preserve the relevant context?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Audio needs comparable attention. Confirm the speaker and recording source where possible, check whether the clip is complete, and compare its words with a reliable transcript or the full recording. If a translation or subtitle carries meaning essential to the claim, verify the translation and keep a record of who made it. A source’s caption is not proof that the caption is accurate.

What if a court record is sealed, redacted, or unavailable?

Mark the limitation; do not fill gaps with inference. Some information is redacted for privacy, some filings or proceedings are sealed, juvenile and ongoing-investigation materials may be unavailable, discovery that was never filed may remain confidential, and settlement terms may not be public. Federal court access guidance describes these limits (U.S. Courts: accessing court documents).

First check whether the docket identifies a public version, a later unsealed filing, an order explaining the restriction, or another public record that addresses the same point. Ask the clerk about access procedures, not for an interpretation of the case. Do not imply that an unavailable document says what a source claims it says unless you can independently substantiate that description.

How should I preserve web sources and screenshots?

Keep source copies and capture details so another editor can see what was available at the time of review. For a webpage, record its title, publisher or creator, full URL, access date, and the exact passage or data used. Save a PDF or screenshot when permitted, but retain the URL and page context as well; an image capture alone does not establish that the page was authentic, complete, or authoritative.

For court filings, preserve the case name, court, docket number, document number, filing date, page or paragraph, and source of the copy. If you obtain a copy from a secondary host, trace it back to the official docket when possible and record the route. The Associated Press recommends attributing information to the original source rather than an unsourced web copy (AP news values and principles).

Keep versions organized and access-controlled, particularly where personal data or sensitive records are involved. Use filenames that identify the claim and source rather than vague labels such as “document2.” Include the date accessed and, where your newsroom’s procedures support it, a checksum or other integrity record. Follow applicable court restrictions, copyright rules, privacy obligations, and your organization’s retention policies.

What are common fact-checking mistakes?

  • Treating a filing as a finding: Check whether the document is an allegation, evidence submission, admission, ruling, or judgment, then choose wording that reflects it.
  • Checking only the quoted line: Read surrounding pages, exhibits, and later docket entries to identify qualifications or outcomes.
  • Counting copies as corroboration: Trace repeated claims to their origin and look for sources with genuinely separate knowledge or evidence.
  • Assuming a primary source is neutral: Evaluate who created it, when, for what purpose, and what they were positioned to know.
  • Using visuals as self-authenticating proof: Verify provenance, date, place, continuity, and context independently.
  • Overstating a case outcome: Confirm the final disposition and later proceedings; distinguish a settlement, dismissal, plea, verdict, and judgment.
  • Hiding uncertainty: If a record is missing, sealed, redacted, or inconclusive, state the limit and narrow or remove the claim.
  • Leaving no trail: Record locators and access details so another editor can reproduce the check rather than repeat it from scratch.

How do I decide whether a documentary claim is verified?

A claim is ready to describe as verified only when the evidence supports its precise wording, the source is sufficiently authenticated, relevant context and later developments have been checked, and independent corroboration is adequate for the claim’s seriousness. Verification is not a binary stamp on the whole film. One claim may be well established, another qualified, and another unresolved.

Before closing a claim, ask: What exactly does the source prove? What does it not prove? Is the source official or otherwise traceable? Have I checked the document’s procedural status and the case’s later outcome? Is corroboration independent? Does the film’s wording go beyond the evidence? Can a second editor find the same passage from my notes? If any answer is no, revise the wording, add a precise attribution, disclose the limit, or remove the assertion.

The practical standard is a transparent source trail, not a verdict on the documentary’s overall viewpoint. As FRONTLINE’s editorial standards put it, producers should be able to show and cite their sourcing in an annotated script or fact-checking document. That record makes both the conclusion and its limits auditable.

Frequently Asked Questions

Can I fact-check a documentary if its producers have not released a transcript?

Yes. Work from the edition you can access, log timecodes, and transcribe only the passages needed to identify exact claims. Note that your transcript is your working record rather than an official transcript, and distinguish uncertainty in what was said from uncertainty about whether the statement is true.

Should I contact the person accused in a documentary before publishing a fact-check?

For a consequential disputed claim, seeking a response can surface records, context, or corrections that public documents do not show. Record when and how you contacted them, give a reasonable opportunity to respond, and describe any response accurately without treating a denial alone as disproof.

What should I do if two reliable sources conflict about a court case?

Check whether they refer to the same case, date, document version, or procedural stage, then return to the official docket and order. If the conflict remains, identify the disagreement and avoid choosing the more convenient account without evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a documentary need to be neutral to be accurate?

A documentary may advance an argument or point of view; fact-checking asks whether its factual claims are supported and fairly characterized. Evaluate the evidence and wording claim by claim rather than treating viewpoint itself as proof of accuracy or inaccuracy.
