You cannot establish that an AI tool is “compliant” from a badge, sales answer, or vendor privacy page alone. A defensible decision combines your intended use, the people and data involved, applicable laws, the organization’s legal role, vendor evidence, hands-on testing, contract controls, and monitoring after launch. Start by defining the use and its boundaries, then classify legal and operational risk, verify privacy and security controls, assign human oversight, and record a go/no-go decision with evidence and an owner. Use the NIST AI Risk Management Framework as a voluntary governance structure, CNIL’s GDPR-oriented self-assessment for personal-data issues, the EU AI Act where it applies, and procurement guidance such as the UK government toolkit. Treat every certification or vendor claim as evidence to verify—not as a replacement for your own risk assessment.
What should you define before assessing an AI tool?
Write a short, specific use-case record before looking at vendors. Compliance depends on what the system does, who is affected, where it operates, and how much harm an error could cause; the same model can be acceptable for drafting internal notes and unacceptable for deciding a person’s eligibility for a benefit.

Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsRecord the intended purpose
Describe the business problem, expected output, decision or workflow it supports, and the result that counts as success. State prohibited uses explicitly, including uses that might be added later by another team. Identify whether the tool only suggests content, makes a recommendation, or automatically takes an action.
List users, affected people and jurisdictions
Name internal users, administrators, customers and other people whose data or opportunities may be affected. List every country or state in which the tool is used, offered, hosted or accessed, including locations of support staff and subprocessors. A tool used by a company outside the European Union can still fall within EU rules if it is placed on the EU market, put into service there, or used there.

Describe data, integrations and retention
Inventory prompt data, uploaded files, generated outputs, metadata, logs, identity data and connected systems. Mark sensitive categories such as health, financial, biometric, employment, children’s or confidential business information. Record the required retention period, backup period, deletion deadline and whether data is transferred to another service.
Set an error and impact threshold
Define what an incorrect, biased, unavailable or leaked output would cost. Set measurable acceptance limits where possible—for example, a maximum false-negative rate for a triage aid, a required review rate, or a prohibition on autonomous decisions. If you cannot state a tolerable impact, the use is not ready for procurement.
Which legal role does your organization have?
Map the organization’s role before assigning obligations. A business may be a deployer of a purchased system, a provider that develops or substantially modifies one, an importer or distributor, or a downstream integrator that combines several components. It can hold more than one role in the same project.
The European Commission says the EU AI Act can apply to public and private actors inside and outside the EU that place an AI system or a general-purpose AI (GPAI) model on the EU market, put it into service, or use it in the EU. Duties vary by the system’s risk category and by role. Document why you believe a role and jurisdiction do or do not apply; have counsel confirm the conclusion for regulated or high-impact uses.
Check for a provider or substantial-change trigger
If your organization trains a model, markets a system under its name, changes its intended purpose, or makes a substantial modification, provider-style duties may arise. A company that only configures an internal workflow may remain a deployer, but the boundary should be documented rather than assumed.
Map sector and contractual rules
List financial, health, employment, education, public-sector, export-control, records-management and accessibility requirements that apply to the workflow. A general privacy statement does not displace a sector rule, a regulator’s retention requirement, or a customer contract that restricts automated processing.
How do you classify prohibited, high-risk and transparency uses?
Screen the proposed use against binding law before testing convenience features. Under the EU AI Act, some practices are prohibited, high-risk systems carry extensive obligations, and other systems have transparency duties. The exact classification depends on the use and deployment context, not simply on whether a vendor calls its product “AI.”
Screen prohibited practices first
Stop and obtain legal advice if the tool could involve a prohibited manipulation, exploitation, social-scoring or other restricted practice. Do not proceed to a pilot merely because a supplier offers a configuration that appears technically possible.

Identify high-risk controls
For an EU high-risk use, plan for risk management, appropriate data quality, technical documentation and traceability, user transparency, human oversight, accuracy, cybersecurity and robustness. Identify which controls the provider supplies and which the deployer must operate, then test the hand-off.
Check GPAI dependencies
Ask whether the application relies on a general-purpose model and which model version is used. European Commission guidance identifies a compute threshold of 1023 floating-point operations, combined with specified generative capabilities, as a criterion used to identify models that qualify as GPAI in that guidance. It is not a universal legal definition for every model or jurisdiction. GPAI providers may need technical documentation, downstream information, a copyright policy and a public summary of training content; models with systemic risk face additional evaluation, risk-assessment, incident-reporting and cybersecurity duties.

Record where people must be told that they are interacting with AI, that content was generated or manipulated, or that an AI system assisted a decision. Specify the notice text, language, delivery channel and retention of the notice. A disclosure that appears only in a buried policy may not satisfy the workflow’s practical transparency need.
Is the tool GDPR-ready for personal data?
“GDPR compliant” is not a product attribute that a vendor can guarantee for every customer. Your organization must establish a lawful basis, define purposes, minimize data, set retention, handle individual rights and document the relationship with the supplier. CNIL’s self-assessment structure is useful because it covers the full lifecycle rather than only the model endpoint.
Purpose, lawful basis and minimization
Write the specific purposes for collecting prompts, files, outputs and telemetry. Confirm the lawful basis for each purpose and prohibit secondary training, advertising or profiling unless separately justified. Remove fields the model does not need, and use masking, pseudonymization or synthetic records for development where feasible.
Training use and provenance
Ask whether customer inputs and outputs are retained, reviewed by people, or used to train or fine-tune a shared model. Obtain the default setting and the contractual setting, because an administrative switch is not the same as a binding restriction. For supplied or fine-tuned data, document provenance, permissions, licensing constraints and procedures for correcting or removing problematic records.

Processing location and transfers
Request a current list of processing regions, subprocessors, support locations and backup locations. Map transfers outside the relevant jurisdiction and identify the transfer mechanism, supplementary safeguards and access controls. “Hosted in the region” may describe the primary service while support, telemetry or disaster recovery occurs elsewhere.
Rights and deletion
Test how you will answer access, correction, deletion, objection and restriction requests when a person’s information appears in prompts, logs, retrieved documents, fine-tuning data or outputs. Ask whether the supplier can locate records by a customer identifier, delete them from active and backup systems, and provide completion evidence. Document what cannot be removed from a trained model and the compensating procedure.

Bias and data-quality controls
Evaluate whether training and operational data represent affected groups and whether the vendor tests for disparate performance. Require subgroup results relevant to your use, not only an overall average. If the supplier cannot disclose a meaningful test population or metric, record that limitation and reduce the permitted use accordingly.
What evidence should you request from the vendor?
Request evidence that is specific to the product, model version, region and intended use. A generic marketing deck is not a control description. Give the vendor a dated questionnaire and require an accountable response for every material item.
Minimum evidence pack
- System architecture, data flows, hosting regions, subprocessors and dependency list.
- Intended-use, limitation and prohibited-use statements, including known failure modes.
- Model and software version history, release process, change notices and rollback procedure.
- Evaluation and validation results, test data description, subgroup performance and uncertainty information.
- Robustness, adversarial, abuse, privacy and security testing, with dates and unresolved findings.
- Logging fields, retention, customer access, monitoring dashboards and alert thresholds.
- Incident history, severity definitions, notification process and corrective-action records.
- Documentation for any GPAI component, including downstream information, copyright policy and public training-content summary where applicable.
- Independent assurance reports or certifications, their scope, period, exceptions and corrective actions.
- Business-continuity, disaster-recovery, availability and data-portability procedures.
Ask for testable answers
Replace questions such as “Is the service secure?” with requests for the control, owner, test frequency, result, scope and evidence location. Ask for a sample audit log, a redacted incident report, a deletion certificate, a subprocessor-change notice and a recent model card or system card. If the answer is “not applicable,” require the reasoning and the compensating control.
How can you compare evidence across AI tools?
Use one scoring sheet for every candidate, with a separate column for evidence, residual risk, owner and decision. Do not award full credit for an assertion without scope and a date.
| Assessment area | Questions to answer | Evidence to retain |
|---|---|---|
| Legal scope and role | Which jurisdictions, risk categories and provider/deployer roles apply? | Legal analysis, use-case record and role determination |
| Data location and retention | Where are prompts, outputs, logs and backups processed, and when are they deleted? | Data-flow diagram, retention schedule and deletion test |
| Training and rights | Are inputs used for training, and how are access, correction, objection and deletion handled? | Contract language, rights procedure and test results |
| Security architecture | How are identity, keys, isolation, secrets, integrations and supply-chain risks controlled? | Architecture description, assurance report and penetration findings |
| Accuracy and subgroup performance | Does performance meet the use-case threshold for relevant groups and conditions? | Validation protocol, metrics, test set description and limitations |
| Robustness and misuse | How does the system resist prompt injection, data leakage, abuse and adversarial inputs? | Red-team results, mitigations and retest dates |
| Transparency and explainability | What notices, explanations, confidence indicators and user instructions are available? | User interface captures, documentation and notice text |
| Human oversight | Who reviews outputs, overrides decisions and stops the system? | Named owners, procedures, training records and override logs |
| Traceability and change | Can you identify the model, prompt, data and policy version behind an output? | Immutable logs, version records and change notices |
| Incidents and audit | Can you investigate, obtain information and require timely notification? | Incident SLA, audit clause and sample report |
| Continuity and exit | Can the service be restored, exported, replaced or terminated without unacceptable harm? | Recovery objectives, export test and exit plan |
How do you test an AI tool before production?
Run a controlled pilot with representative but protected data. Testing should challenge the claims that matter to your risk decision, not merely demonstrate a successful example.
- Freeze the test scope. Record the model and application version, configuration, region, user roles, connected systems, allowed prompts, prohibited prompts and success thresholds.
- Build a representative test set. Include normal cases, edge cases, multilingual inputs where relevant, incomplete records, adversarial prompts, sensitive-data attempts and examples from every materially affected subgroup. Keep personal data minimized or synthetic unless production data is essential.
- Measure quality and harm. Track accuracy, false positives, false negatives, hallucinated claims, unsafe recommendations, refusal behavior, latency and availability. Review subgroup results and examine whether errors create unequal impact.
- Test privacy behavior. Submit deletion, access and correction scenarios; check logs and support workflows; verify that a prompt marked confidential is not exposed to another tenant or used for training contrary to the contract.
- Test security and abuse paths. Attempt prompt injection, retrieval of secrets, unauthorized tool calls, malicious file uploads, privilege escalation and data exfiltration. Coordinate testing with the supplier so that defensive monitoring is not mistaken for an attack.
- Test human intervention. Confirm that reviewers see the necessary context, can reject or edit an output, can suspend automation, and know how to escalate an uncertain or harmful result.
- Record exceptions and retest. Assign each failure an owner, deadline, compensating control and residual-risk rating. Repeat the test after fixes and before a material model or integration change.
Who must provide human oversight?
Name a person or group accountable for each consequential workflow, and give them real authority to pause, override or shut down the AI-assisted process. The European Commission’s high-risk FAQ says deployers must assign one or more people for human oversight and equip them to exercise it.
Define the reviewer’s operating procedure
- Specify which outputs require approval, which may be auto-applied and which are always prohibited.
- Give reviewers access to source records, model limitations, confidence or uncertainty indicators and an explanation appropriate to the decision.
- Set escalation rules for suspected bias, privacy breaches, unsafe content, repeated errors and unavailable evidence.
- Log the reviewer, decision, reason, override, time and resulting action.
- Train reviewers on automation bias, secure handling of prompts and the technical steps for suspension.
Do not describe a person as “in the loop” if that person lacks time, information or authority to change the outcome. A nominal approval click is not meaningful oversight.
How should you test security and resilience?
Assess the entire service chain, not just the model. CNIL emphasizes securing processing and preventing flaws and attacks; guidance for GPAI models with systemic risk adds model evaluation, incident reporting and cybersecurity safeguards.

Identity and access
Verify single sign-on, multifactor authentication, role-based permissions, service-account controls, tenant isolation and administrator logging. Confirm that exports, debug consoles and support tools follow the same access policy as the main interface.
Prompt, data and integration leakage
Test whether one user can retrieve another tenant’s content, whether prompts appear in analytics or error messages, and whether connected tools can be induced to send data to an unauthorized destination. Limit tool permissions, network egress and secrets available to the model.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What should the contract require?
Convert material answers into enforceable terms. Procurement guidance from the UK government covers supplier evaluation, implementation and ongoing management and recommends impact-assessment go/no-go points.
Core contractual provisions
- Permitted purposes, prohibited uses and instructions for handling personal and confidential data.
- Processor terms, confidentiality, subprocessor disclosure and advance notice of subprocessor changes.
- Processing locations, transfer mechanisms, deletion deadlines, backup treatment and assistance with individual rights.
- Security controls, independent-assurance access, vulnerability cooperation and remediation obligations.
- Incident notification deadlines, required information, cooperation duties and communications authority.
- Model, feature, policy and hosting change notices, with a right to reassess or reject material changes.
- Access to logs, documentation, evaluation results and information needed for regulatory or customer audits.
- Service levels, support coverage, continuity commitments, portability format and migration assistance.
- Suspension, termination, deletion certification and continued access to records needed for legal retention.
Ensure the agreement does not quietly permit the vendor to use your prompts, outputs or feedback for unrelated training. If a supplier will not accept an essential control, record the exception, assess alternatives and obtain an accountable risk acceptance rather than relying on an informal promise.

How do you monitor compliance after launch?
Approval is a point in time; compliance is a lifecycle control. Reassess when the model version, purpose, data, integration, jurisdiction, law or incident pattern changes.
Maintain a control-evidence register
For each requirement, record the control, evidence link or identifier, owner, test date, result, exception, expiry date and next review. Keep model versions, prompts or policy configurations and significant outputs long enough to investigate incidents while honoring the approved retention schedule.
Best Value
Set event-driven review triggers
- A new model, retrieval source, plugin, region, subprocessor or training setting.
- A change from drafting or recommendation to automated action or eligibility decision.
- A privacy complaint, security incident, unexplained performance shift or subgroup disparity.
- A new law, regulator interpretation, customer requirement or contractual restriction.
- Material drift in input data, user population, language, workload or operating conditions.
Report meaningful metrics
Give governance owners a regular view of error rates, override rates, abstentions, privacy requests, incidents, availability, unresolved findings and upcoming changes. Trend metrics by relevant subgroup and workflow, and investigate sudden improvements as well as deterioration because a logging or data-pipeline change can create a false signal.
Which frameworks should you use?
No single framework answers every legal question. Combine a voluntary governance framework with binding law, privacy guidance and procurement controls.
| Framework or guidance | Best use | Important qualification |
|---|---|---|
| NIST AI Risk Management Framework 1.0 | Organizing trustworthiness activities across design, development, use and evaluation. | Released 26 January 2023; NIST describes it as voluntary and notes that it is being revised. It does not replace law. |
| CNIL GDPR self-assessment structure | Checking purpose, training-data collection, development, production quality and transparency, security, individual rights, and responsibilities/documentation. | Use it alongside your legal-basis analysis and applicable national or sector rules. |
| EU AI Act | Determining prohibited, high-risk, transparency and GPAI obligations for covered activities. | Apply the relevant role, market, service and risk category; do not generalize an EU conclusion to every jurisdiction. |
| UK government AI Risk Management Toolkit and procurement guidance | Structuring risk treatment, supplier evaluation, contract implementation, impact-assessment gates and ongoing management. | It is practical governance and procurement guidance, not a universal certification of legal compliance. |
NIST describes the AI RMF as intended for voluntary use to improve the ability to incorporate trustworthiness considerations into the design, development, use and evaluation of AI products, services and systems. That makes it a useful backbone for assigning work and evidence, while the applicable law supplies mandatory duties.
How do you make the final go/no-go decision?
Use explicit gates rather than an unqualified “approved” label.
- Scope gate: purpose, users, data, jurisdictions, roles and impact thresholds are documented.
- Legal gate: prohibited uses are excluded, applicable risk categories are recorded and required assessments are complete.
- Evidence gate: the vendor has supplied current, scoped evidence for privacy, security, quality, transparency, oversight and continuity.
- Test gate: representative testing meets thresholds, failures have owners and compensating controls, and high-severity findings are closed.
- Contract gate: data use, subprocessors, incidents, changes, audits, portability and exit rights are enforceable.
- Operations gate: accountable reviewers, training, logging, monitoring, fallback and reassessment triggers are live.
Approve only the documented use, configuration, users and jurisdictions. A conditional approval should state its expiry, required fixes and the person who can suspend the system. If essential evidence is unavailable or residual impact exceeds the organization’s threshold, reject or redesign the use rather than treating uncertainty as compliance.
Frequently Asked Questions
Does an ISO or other certification prove that an AI tool is compliant?
No. A certificate demonstrates that an auditor assessed a defined management system or control scope during a stated period. Check the certificate’s boundaries, exclusions, expiry, findings and relevance to your data, model and deployment; you still need your own legal analysis and operational tests.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →What if a vendor refuses to disclose its training data or model weights?
You can still assess the service, but treat the missing information as a limitation rather than assuming the best case. Ask for outcome-focused evidence such as provenance controls, copyright procedures, subgroup evaluations, deletion behavior, version history and independent testing, then restrict the use or choose another supplier if the residual risk remains unacceptable.
Can employees paste confidential information into a public AI service?
Not without an approved purpose, data classification, contract and technical controls. Public interfaces may retain prompts, route them through undisclosed locations or use them for service improvement, so establish an approved enterprise configuration or prohibit confidential inputs until those facts are verified.
How should a company handle an AI model update that changes results?
Treat a material update as a change event: capture the new version, rerun relevant quality, subgroup, privacy and security tests, review notices and contracts, and obtain approval before re-enabling consequential automation. Keep the previous configuration or a documented rollback path when the workflow requires continuity.
