Assess a proposed AI policy by comparing it with a clear no-action baseline and feasible alternatives, then tracing its expected costs, benefits, risks, and distributional effects across businesses, people, and government. Define the problem and policy mechanism first; quantify significant impacts where credible evidence allows; make assumptions and uncertainty visible; and plan how to evaluate and revise the policy after implementation. The right result is not a universal price tag: it is a transparent, proposal-specific comparison that shows what is known, who is affected, and what remains uncertain.

What does an economic impact assessment of an AI policy answer?

It answers whether a proposed intervention is likely to achieve a defined public objective, compared with doing nothing new or choosing another feasible approach, and at what economic and social cost. It should help decision-makers understand not only an aggregate total but also who pays, who benefits, when impacts occur, and how strong the supporting evidence is.

“Economic impact” is broader than the regulator’s budget or the compliance bill for AI companies. It can include administrative work, financial and capital costs, enforcement and implementation costs, opportunity costs, benefits, and avoided harms. Effects on citizens, workers, consumers, downstream users, and public agencies may matter alongside effects on the organizations directly regulated.

The assessment is specific to a jurisdiction and a policy design. A rule applying to development may affect different actors and activities from one applying to deployment, procurement, or a particular AI use. Without those details, it is not possible to calculate a credible impact, identify every relevant legal requirement, or select a best option.

How should you define the policy problem and objective?

Start by stating the public problem the proposal is meant to address, the evidence that the problem exists, and the objective the intervention is meant to achieve. Then explain the mechanism: how would a particular requirement change decisions or behavior, and how could that change improve outcomes?

Specify who and what is in scope

Describe the jurisdiction, population, markets, and activities the proposal would cover. Clarify whether it concerns AI development, deployment, procurement, or a defined use. Identify the organizations expected to comply and the people or services potentially affected. These boundaries determine which impacts belong in the assessment; a scope that is too broad can make estimates misleading, while a scope that omits downstream users can miss material effects.

Make the causal pathway explicit

Write down the chain from requirement to outcome. For example: a policy requirement changes an organization’s process; the changed process affects a decision, product, or service; that change may then reduce a stated harm or create a new burden. State the assumptions at each link. If the policy only works when organizations can identify affected systems, obtain usable information, or change their practices, those conditions belong in the assessment rather than being treated as automatic.

Keep the objective distinct from the proposed instrument. “Adopt a reporting requirement” describes an instrument; the underlying objective might be to improve oversight or reduce a specified harm. Defining the objective independently lets the assessment compare instruments that could pursue the same result.

What should the baseline and alternatives include?

Compare the proposal with a no-action or business-as-usual baseline and with plausible alternatives. The baseline is not an assumption that nothing changes: it should describe relevant existing rules and expected market or technology developments over the assessment period.

Build a realistic no-action scenario

Explain what is likely to happen if the proposed intervention is not adopted. Account for the status quo, including current requirements, existing practices, and changes that are expected independently of the proposal. Use the same scope and time horizon for the baseline and each option. Otherwise, a difference attributed to the policy may instead reflect a change that would have happened anyway.

Compare options that could actually be chosen

Depending on the problem, alternatives may include different regulatory designs, non-regulatory approaches, or combinations such as regulation with education or voluntary standards. Do not compare only the preferred proposal with an unrealistic “do nothing” caricature. Explain the trade-offs: an option may be more effective against the stated problem but harder to administer, or less burdensome but less likely to change the outcome.

Use common comparison axes for each option:

  • Expected effectiveness against the defined problem and objective.
  • Total costs and benefits for businesses, citizens, and government.
  • How impacts are distributed among groups and across time and place.
  • Uncertainty and the strength of the evidence behind estimates.
  • Implementation, enforcement, monitoring, and ability to adapt.

Which costs, benefits, and risks should you count?

Map the people and organizations affected before estimating amounts. Include direct effects on regulated organizations, but also consider downstream users, workers, consumers, government, and other groups whose costs or outcomes may change. Assess benefits and avoided harms against the same baseline used to estimate costs.

Separate the types of cost

Include the cost categories relevant to the proposal, not just the easiest ones to measure. Depending on its design, these may include administrative, financial, capital, implementation, compliance, and enforcement costs. Include opportunity costs where resources used to meet a requirement would otherwise have been used for another purpose.

Where the evidence supports it, distinguish one-time implementation costs from recurring compliance costs. The distinction matters because a startup burden and an ongoing annual burden have different timing. Do not assume that every cost is one-time or recurring without evidence about the requirement and the activities it induces.

Identify benefits and possible unintended effects

Describe the intended benefits and harms the proposal is meant to avoid, using the same comparison period as for costs. Then consider unintended consequences: a measure can change behavior beyond its intended target, shift activity to other actors, or create burdens not captured by the rule’s immediate compliance requirements. The assessment should explain plausible pathways and assumptions, rather than presenting speculative outcomes as established facts.

Show who bears each effect

An aggregate net estimate can conceal unequal consequences. Report which groups bear costs and which receive benefits, and describe how those effects vary over time and place. A policy’s overall result does not show whether a particular group faces a concentrated burden or whether benefits reach the people the intervention is meant to help. Include distributional and equity considerations even when a credible monetary value cannot be assigned to them.

How can you quantify impacts without overstating precision?

Use evidence in proportion to the proposal’s expected significance. For significant impacts, quantify costs, benefits, and risks wherever the evidence makes a credible estimate possible. Quantification is useful only when its scope, assumptions, and uncertainty are clear; a precise-looking number is not a substitute for a defensible method.

Document the basis for each estimate

For every material estimate, state what activities or outcomes it covers, which affected parties are included, what period it represents, and what evidence supports it. Explain the assumptions used to move from an observed activity or cost to an expected impact of the proposal. Distinguish observed evidence from projections and make clear which results depend on uncertain assumptions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Keep the policy’s incremental effect separate from costs or benefits that already exist in the baseline. If organizations already perform an activity, the relevant question is what additional activity the proposal induces, not the full cost of the pre-existing activity. This is also why a time-based estimate should be tied to specified requirements and affected actors rather than generalized to every AI policy.

Test assumptions that could change the result

Use sensitivity or scenario analysis when key assumptions could materially affect the comparison. Show how the assessment changes under plausible alternatives to those assumptions, and identify which assumptions drive the result. If available evidence cannot support a numerical estimate, describe the impact qualitatively and explain why it matters instead of assigning it a false value.

Important effects that resist monetization should not be treated as zero. Fairness, distributional effects, and other material outcomes may need clear qualitative treatment alongside quantified estimates. State what is known, what is uncertain, and what evidence would help resolve the uncertainty.

How should you evaluate an AI intervention after it starts?

Build monitoring and evaluation into the policy from the outset. Define how implementation and outcomes will be tracked, what evidence will be used to test whether the intervention worked, for whom, and why, and how findings could inform changes.

Set indicators and a comparison approach

Choose indicators linked to the objective and causal pathway, rather than measuring activity alone. Specify what would count as evidence of changed outcomes and identify a suitable comparison group where one can be established. An evaluation that only records whether organizations completed required steps may not show whether the policy improved the outcome it was designed to affect.

Consider experimental designs when feasible and appropriate. If context or complexity makes that unsuitable, quasi-experimental or theory-based methods may provide a better fit. The design should match the question, implementation conditions, and available evidence; do not promise a level of causal certainty the evaluation cannot deliver.

Plan for iteration and different time horizons

AI interventions may be implemented iteratively, so an evaluation plan should be flexible enough to accommodate changes in rollout. Include early implementation as well as longer-term effects: an initial assessment can reveal whether a policy is being applied as intended, while later evaluation can test outcomes that take time to emerge. Set out how monitoring findings could trigger further evaluation or policy revision.

How should the assessment be presented for scrutiny?

Explain which option is preferred and why it performs better against the stated objective and alternatives. Give decision-makers and affected people enough information to examine the reasoning, rather than presenting a conclusion without its evidentiary basis.

Make the following visible in the assessment:

  • The problem, objective, scope, causal pathway, baseline, and alternatives.
  • The evidence, assumptions, methods, time horizon, and uncertainty behind material estimates.
  • Significant costs, benefits, risks, and distributional effects, including qualitative impacts.
  • Consultation findings and the reasoning behind the preferred option.
  • The implementation, enforcement, monitoring, and evaluation approach.

Institutional processes vary by jurisdiction. The European Commission provides one example: significant initiatives receive impact assessments, and an independent Regulatory Scrutiny Board checks report quality. That process is an example of scrutiny, not a universal legal checklist for every government.

What does the European Commission’s AI assessment illustrate?

The European Commission published an impact assessment for its proposed AI regulation on 21 April 2021. A supporting EU study examined administrative and substantive compliance costs and estimated them from time spent on activities induced by the proposed requirements.

The useful lesson is methodological: identify the activities a proposal would cause, estimate the time they require, and connect that work to the requirements and actors in scope. The study’s estimates are specific to that proposal and its assumptions. They are not a current, universal cost estimate for AI regulation, and should not be transferred to a different policy without checking its scope and underlying assumptions.

No numerical estimate is necessary to explain the method. For an unnamed proposal, jurisdiction, affected sectors, and design have not been established, so a defensible impact figure or preferred policy option cannot be supplied. The assessment must be built around those specifics.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What does a defensible assessment look like in practice?

Before presenting a conclusion, check that the analysis is internally consistent and usable by someone who did not write it. A practical review can follow the sequence below:

  1. Problem and objective: Can a reader identify the public problem, evidence for it, and intended outcome without confusing them with the policy instrument?
  2. Scope and mechanism: Are jurisdiction, affected activities, parties, and the expected causal pathway explicit?
  3. Baseline and options: Does the no-action scenario include existing rules and expected changes, and are the alternatives feasible and compared on the same basis?
  4. Impacts and distribution: Are relevant costs, benefits, risks, opportunity costs, and affected groups considered beyond the regulator’s budget?
  5. Evidence and uncertainty: Are significant effects quantified where credible, with assumptions and sensitivity made visible, while non-monetized effects are still described?
  6. Evaluation and accountability: Are indicators, a comparison approach, monitoring, and a route to later revision built into the proposal?

If a check fails, the remedy is usually to narrow the claim, improve the evidence, or state the uncertainty—not to fill the gap with an unsupported number. The result should let readers distinguish what the proposal is expected to do from what the available evidence can actually establish.

Frequently Asked Questions

Can I calculate an AI policy’s economic impact before the proposal is finalized?

You can assess a sufficiently defined draft and compare design alternatives before final adoption; the estimates should be updated if the scope or requirements change. If core design choices are still open, show how those alternatives affect the analysis rather than presenting a single figure as settled.

Does an economic impact assessment have to put a dollar value on every effect?

No. Quantification is useful when evidence supports a credible estimate, but important effects that resist monetization should be described and considered rather than assigned a value of zero. The assessment should distinguish a qualitative judgment from a measured amount.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Who should be consulted when evaluating an AI policy’s impact?

Consultation findings should be part of the material presented for scrutiny, and the affected parties identified by the policy’s scope are relevant perspectives to consider. The appropriate participants depend on the jurisdiction, design, and groups likely to experience costs or benefits.

How often should an AI policy’s impact assessment be updated?

The method described here calls for flexible evaluation that covers early rollout and longer-term effects, but it does not establish a universal review interval. Set review timing around the implementation plan, indicators, and the pace at which evidence about outcomes becomes available.
