Public agencies can determine whether a cloud provider will handle data properly only through a documented, risk-based evaluation. Start by categorizing the information and recording legal, privacy, records, mission, and continuity requirements. Translate those requirements into a control baseline and a shared-responsibility matrix for the specific IaaS, PaaS, or SaaS service. Then review current independent assessment evidence, authorization materials, technical controls, contract terms, and continuous-monitoring results. A certification or authorization is useful evidence, but it does not replace the agency’s own authorization decision or its duty to enforce data-location, access, disclosure, retention, incident, return, and deletion obligations.

What should an agency decide before comparing cloud providers?

Define the information, impact, mission consequences, and non-negotiable obligations first. Comparing vendors before this work produces misleading checklists because the same service may be acceptable for public information but unsuitable for regulated, sensitive, or mission-critical records.

Categorize every information type

Use the federal or jurisdictional categorization method that applies to the agency. NIST’s government cloud roadmap explains that categorization drives the security and privacy controls required for a system. Document the result for each data set, not merely for the agency as a whole, and identify whether a service will store, process, transmit, back up, or temporarily cache it.

Turn obligations into a control baseline

Build a requirements register that names the obligation, the responsible party, the evidence required, and the consequence of failure. Include:

  • Statutory, regulatory, privacy, records-management, and disclosure requirements.
  • Availability, continuity, problem reporting, and mission recovery objectives.
  • Physical and logical access, network segmentation, and administrative access paths.
  • Encryption, key custody, configuration control, patching, vulnerability scanning, and malware defenses.
  • Logging, monitoring, alerting, forensic preservation, and audit access.
  • Backup, restoration testing, disaster recovery, portability, retention, sanitization, and exit requirements.
  • Incident response, breach notification, cooperation with investigations, and public-records support.
  • Certification, authorization, independent assessment, and remediation reporting.

Separate mandatory requirements from preferences. A requirement that cannot be waived should become a pass/fail gate; a preference can be scored when providers are otherwise qualified.

How do you map shared responsibility for IaaS, PaaS, and SaaS?

Create a control-by-control matrix before contract negotiations. The service model changes the boundary: a provider may secure the physical platform while the agency remains responsible for identities, configurations, data, or applications. The provider’s marketing description is not a substitute for an allocation that names who performs each task and supplies evidence.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Control area Agency responsibilities to assign Provider or subcontractor responsibilities to verify Evidence to require
Identity and privileged access Approve administrators, configure federation, review accounts, and enforce agency policy. Protect platform administrators, support federation, and log provider-side access. Role matrix, access reviews, authentication configuration, and privileged-access logs.
Encryption and keys Choose data classifications, approve key ownership, and configure tenant encryption. Protect encryption services, hardware, key stores, and backup copies within its boundary. Architecture, key-management procedures, rotation records, and control-test results.
Logging and monitoring Enable required logs, set alerts, retain agency copies, and investigate events. Generate platform, hypervisor, service, and administrator logs and protect their integrity. Log catalog, sample events, retention settings, time synchronization, and monitoring reports.
Backup and recovery Set recovery objectives, identify records that must be retained, and test restoration of agency configurations and data. Operate resilient storage, replicate within approved boundaries, and test infrastructure recovery. Recovery architecture, test summaries, dependencies, and restoration responsibilities.
Deletion and exit Issue deletion instructions, preserve records subject to legal holds, and validate returned data. Delete production, replica, cache, and backup copies according to the agreed schedule. Deletion procedure, completion certificate, media-sanitization evidence, and exit test results.
Incident response Classify events, notify oversight bodies, preserve evidence, and coordinate public communications. Detect, contain, investigate, and promptly notify the agency of provider-side events. Response plan, notification workflow, contact roster, forensic-access terms, and exercise results.

Extend the matrix to every subcontractor. Put the allocation in the contract and service-level agreement, including who configures identity, logging, encryption, key management, backup, deletion, and incident communications. If a control is inherited from another provider, identify that provider and the evidence that demonstrates the inheritance remains valid.

What compliance evidence should a public agency request?

Request evidence that shows controls are implemented and operating effectively, rather than brochures or unqualified compliance claims. Ask for the current security and privacy plans, control-implementation statements, assessment procedures and results, findings, remediation records, and authorization-package materials applicable to the exact service and environment.

Build an evidence request package

  • System security and privacy plans describing boundaries, data flows, components, regions, and inherited controls.
  • Control implementation statements identifying the provider, agency, and subcontractor portions of each control.
  • Independent assessment procedures and results, including the assessor’s scope, testing period, sampling approach, exceptions, and severity ratings.
  • Current findings, corrective-action records, and the plan of action and milestones (POA&M), with owners and target dates.
  • Penetration-test or vulnerability-assessment summaries where relevant, plus evidence that material issues were remediated or formally accepted.
  • Authorization letters or decisions, the exact service offering covered, impact level, authorization boundary, region, and expiration or review date.
  • Continuous-monitoring reports, significant-change notices, incident metrics, and evidence that recurring tests are actually performed.
  • Subprocessor inventory, locations, services supplied, oversight arrangements, and the process for adding or replacing one.

NIST’s Risk Management Framework Assess step defines the purpose as determining whether controls are implemented correctly, operating as intended, and producing the desired outcome for the system and organization. Apply that standard to the evidence you receive: a policy document proves that a policy exists, while test results and operating records show whether it works.

Is FedRAMP enough for a public agency?

FedRAMP is valuable evidence for a federal cloud service, but it is not the agency’s complete risk decision. Confirm that the authorization covers the exact cloud service offering, impact level, authorization boundary, regions, inherited controls, and current monitoring package—not merely the provider’s corporate name.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Questions to ask about a federal authorization

  1. What is the precise authorized service, version, and boundary?
  2. Which impact level and information types does it cover?
  3. Which regions, facilities, and subprocessors are included or excluded?
  4. What controls are inherited, and what remains the agency’s configuration responsibility?
  5. When was the latest assessment, authorization decision, and continuous-monitoring report issued?
  6. What open findings, deviations, or POA&M items could affect the agency’s risk?
  7. How will the provider notify the agency of a significant architecture, region, subprocessor, or control change?

FedRAMP supplies a common assessment and authorization approach and can support joint authorizations. The agency still owns its authorization decision, must configure and operate its side of the boundary, and must apply its own mission, privacy, records, and contractual requirements. State and local agencies may use FedRAMP materials as evidence, but they should not assume federal authorization overrides state law, public-records duties, residency rules, or local policy.

What should the cloud contract say about data handling?

Make each data-handling obligation enforceable, measurable, and supported by a remedy. NIST SP 800-144 identifies contract topics that should be explicit; vague promises to use “reasonable security” do not tell an agency where data may reside, who may see it, or how an exit will work.

Contract topic Terms to specify Evidence or remedy to attach
Ownership and permitted use Agency ownership, limited processing purpose, no unauthorized secondary use, and rules for derived data and metadata. Data-flow description, use restrictions, audit rights, and injunctive or monetary remedies.
Location and sovereignty Approved countries, regions, facilities, support locations, and notice or approval for changes. Current location list, geographic controls, change notice, and suspension or termination rights for an unapproved move.
Access and disclosure Least privilege, support-access approval, government-request handling, legal-hold cooperation, and disclosure notification where lawful. Access logs, request workflow, disclosure reports, and named escalation contacts.
Subcontractors Complete inventory, flow-down obligations, agency approval or advance notice for material additions, and responsibility for subcontractor acts. Subprocessor register, due-diligence summaries, and termination or transition assistance if an objection cannot be resolved.
Security and privacy visibility Right to receive assessment reports, inspect relevant records, and obtain information needed for oversight without exposing other tenants. Evidence-delivery schedule, confidentiality safeguards, and an alternative test method when direct inspection is impractical.
Availability, backup, and recovery Service levels, maintenance notice, recovery objectives, backup locations, restoration testing, and disaster-recovery cooperation. Service credits or other remedies, test reports, dependency lists, and escalation timelines.
Incidents and investigations Definition of a reportable incident, notification deadline, required facts, preservation of evidence, forensic access, and cooperation with regulators and law enforcement. Incident playbook, contact roster, status updates, and cost-allocation terms.
Retention, return, and deletion Retention schedule, legal holds, export format, transition period, deletion of replicas and backups, and certification of completion. Export test, chain-of-custody record, deletion certificate, and remedy for incomplete deletion.
Audit, testing, and remedies Assessment rights, penetration-test coordination, material-breach remedies, cure periods, suspension rights, and termination assistance. Annual or event-driven evidence package, finding-tracking process, and enforceable cure or exit provisions.

Require the provider to assist with records requests and investigations without placing the agency in breach of confidentiality obligations to other customers. Define how the agency can obtain logs and evidence when a provider claims that tenant isolation prevents direct access.

How should an agency compare two or more providers?

Use the same evidence-based questions and weighting for every candidate, then document trade-offs rather than selecting the longest certification list. A provider with broader authorization may still impose more agency configuration work or offer less control over keys, regions, logs, or exit.

Comparison axis Questions that reveal the difference
Control coverage and impact-level fit Does the service meet every mandatory control for the information category, and which gaps require agency compensating controls?
Independent assessment quality and recency Who assessed the service, what was tested, when, what findings remain, and how quickly are findings closed?
Authorization scope and inherited controls Does the authorization cover the exact service, region, boundary, and version the agency will use?
Residency, sovereignty, and subprocessors Can the provider identify every processing location and subcontractor and provide advance notice of changes?
Encryption and customer key control Can the agency control, rotate, revoke, and audit keys, including for backups and provider-managed services?
Identity, logging, and monitoring visibility Are federation, administrative access, event logs, alerts, and evidence exports sufficiently configurable?
Incident cooperation and forensic access How fast will the provider notify, preserve evidence, share facts, and support an investigation?
Backup, recovery, portability, and exit Can the agency restore service and export usable data without proprietary lock-in or an untested process?
Contract remedies and termination assistance Do service levels, cure rights, audit clauses, and transition support make poor performance consequential?
Agency operating burden What people, tools, reviews, and configurations must the agency provide to operate its side of the boundary?

How should the agency accept the service and track findings?

Make acceptance conditional on resolving material findings or obtaining a documented, authorized risk decision. Do not treat contract signature or a provider’s authorization as proof that the agency’s implementation is ready.

  1. Review the boundary. Confirm the production architecture, data flows, regions, accounts, interfaces, subcontractors, and inherited controls match the evidence package.
  2. Test agency configurations. Verify identity federation, least privilege, logging, encryption, network restrictions, backup settings, alert routing, and retention choices.
  3. Evaluate findings. Classify each issue by mission, legal, privacy, and security impact; assign an owner, due date, compensating control, and acceptance authority.
  4. Run an exit or restoration exercise. Export representative data, restore it in the agreed format, and verify that deletion and legal-hold procedures work.
  5. Record the decision. Preserve the authorization rationale, residual risk, conditions of use, evidence dates, and triggers for reassessment.

How do agencies monitor a provider after award?

Continuous monitoring is part of authorization, not an optional post-award activity. The contract and monitoring plan should define frequency, scope, evidence format, notification timelines, severity thresholds, agency access to logs and reports, and remediation deadlines.

Set recurring and event-driven reviews

  • Review scheduled assessment and vulnerability evidence, open findings, POA&M progress, service-level performance, and incident metrics.
  • Require prompt notice of material architecture, region, data-flow, subprocessor, identity, encryption, or control changes.
  • Reassess after a significant incident, failed recovery test, major finding, ownership change, or change in the information category.
  • Track every finding to closure and verify the fix with new evidence rather than accepting a provider statement alone.
  • Keep agency-side configurations, approvals, logs, and risk acceptances current; provider evidence cannot validate a control the agency has disabled or misconfigured.

Use updated plans, assessments, reports, and milestones in each ongoing authorization decision. If evidence becomes stale or a material risk exceeds the approved tolerance, pause expansion, require remediation, move the workload, or terminate under the contract’s transition provisions.

Why do identity tokens, federation, and APIs need a separate review?

Cloud data is often reached through identity tokens, assertions, and APIs rather than a direct console login. A weakness in issuance, validation, signing-key protection, audience checks, replay resistance, revocation, or API authorization can therefore bypass otherwise strong storage and network controls.

NIST IR 8587, published in September 2026, recommends protections against forgery, theft, and misuse of identity tokens and assertions. Ask the provider to demonstrate:

  • How the provider detects anomalous token use and shares actionable evidence with the agency.

What common evaluation failures should agencies avoid?

Most failures are process errors rather than an absence of security technology.

Accepting a logo instead of a scope

A certification may cover a different service, region, version, or impact level. Require the exact boundary and current assessment date before treating it as evidence.

Ignoring agency-side controls

Federation, logging, encryption settings, network rules, backup policies, and retention choices often remain the agency’s responsibility. Test those settings in the acceptance environment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Leaving exit terms until termination

Without an export format, restoration test, backup-deletion schedule, and transition assistance, the agency may be unable to leave while preserving records and continuity.

Allowing silent subcontractor changes

A new support company or processing region can alter legal and operational risk. Require an inventory, advance notice or approval, flow-down controls, and a practical objection or exit remedy.

Closing findings on promises

Track owners, deadlines, compensating controls, and verification evidence. An open material finding should remain visible in the authorization decision until independently resolved or formally accepted by the authorized official.

Frequently Asked Questions

How often should a public agency refresh a cloud provider’s compliance evidence?

Set a regular review cycle in the monitoring plan and require event-driven updates after incidents, material architecture changes, new subprocessors, or major control findings. Each document should carry its assessment period and scope so reviewers can identify stale evidence instead of relying on a publication date alone.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can an agency require the provider to use agency-managed encryption keys?

It can make customer key control a requirement when the information category or policy calls for it, but the decision should account for availability, recovery, rotation, and emergency-access procedures. If the provider cannot meet the requirement, document the residual risk and compensating controls before approval rather than treating provider-managed keys as equivalent.

What should an agency do when a provider refuses direct audit access?

Use a structured alternative such as an independent assessment report, controlled evidence review, witnessed testing, or a third-party audit right. The contract should still provide enough access to verify agency-specific controls, investigate incidents, and test deletion or exit obligations.

How can a public agency preserve records when cloud data is deleted?

Define legal-hold and records-suspension procedures that override ordinary deletion schedules. Require export in a usable, documented format, chain-of-custody information where appropriate, and evidence that replicas, caches, and backups were handled consistently with the approved retention schedule.
