GST on a digital subscription in India depends on four facts: what service is actually supplied, where the supplier is located, where the recipient is located, and whether the recipient is GST-registered. Cloud software, software delivered over a network, online content and digital storage can fall within the statutory definition of online information and database access or retrieval (OIDAR) services when delivery is essentially automated and involves minimal human intervention. A foreign supplier and a GST-registered Indian business may trigger reverse-charge IGST, while an overseas OIDAR supplier generally carries the registration and payment responsibility for a non-taxable online recipient. There is no single GST rate that can safely be applied to every digital subscription; classification and the current rate notification must be checked for the specific service.

What determines whether a digital subscription attracts GST in India?

The label on a pricing page is not enough. GST treatment follows the legal nature of the supply, the parties and the place of supply. A subscription called “software,” “membership” or “online access” can produce different compliance outcomes depending on whether it is automated, whether a supplier is in India, and whether the customer is a registered business or an individual consumer.

Use this order of analysis:

  1. Identify the contracting supplier and its country and Indian registration status.
  2. Identify the actual recipient: an individual, a company, a partnership, a government body or another entity.
  3. Describe what the customer receives and how it is delivered, including the amount of human intervention.
  4. Establish the recipient’s location and GST-registration status.
  5. Apply the place-of-supply and tax-collection rule, then verify the current classification and rate.

What counts as an OIDAR service?

OIDAR status turns on the delivery method and automation, not on a product name. Under the Integrated Goods and Services Tax Act, 2017, the service must be delivered through the internet or an electronic network, be “essentially automated and involving minimal human intervention,” and be impossible to supply without information technology.

Examples that can fit the statutory description

  • Software supplied over a network, including access to hosted applications.
  • Cloud computing services and remote digital infrastructure.
  • Online digital content, such as electronically delivered media or files.
  • Digital data storage supplied remotely.

These are statutory examples, not an automatic classification for every product using the same words. A subscription that includes substantial consultancy, implementation, tutoring, moderation or bespoke professional work may need to be analysed as a different or mixed service. Separate the automated access from human-delivered components in the contract, invoices and accounting records.

Where is the place of supply for a cross-border digital service?

For an imported service, the general cross-border rule generally places the supply at the recipient’s location. The IGST Act also gives OIDAR supplies a recipient-location rule. The place of supply matters because it determines whether an Indian tax obligation is engaged and which accounting route applies.

How OIDAR recipient location is established

The law provides indicators for deciding whether an OIDAR recipient is in India. Depending on the facts, evidence can include the customer’s address, billing address, payment instrument, internet-protocol address, bank details and the country associated with a subscriber identity module. No single commercial label overrides the statutory indicators; retain the information used to make the determination.

For a business customer, the contracting entity, GSTIN, billing records and the location where the service is received should align. If staff in several countries use one account, document which entity purchased the service and how the supplier determined the recipient location.

Do I have to pay GST on a foreign software subscription as an Indian business?

A GST-registered Indian recipient can be liable to pay applicable IGST under reverse charge when the foreign software supply meets the import-of-services conditions: the supplier is outside India, the recipient is in India, and the place of supply is in India. CBIC’s sectoral FAQ specifically addresses foreign software used in an Indian firm and online database access supplied from abroad.

How reverse charge works

  1. Confirm the parties. Keep the foreign supplier’s legal name and address, your entity’s legal name and GSTIN, and the contract or order form.
  2. Confirm the service and place of supply. Record why the service is an imported service and why the recipient is located in India.
  3. Determine the applicable rate and value. The rate is service-specific; do not use a blanket “software subscription” rate without checking the current notification and classification.
  4. Account for IGST under reverse charge. Report the liability in the applicable GST return and pay it by the statutory due date.
  5. Review credit eligibility separately. Payment under reverse charge does not by itself establish that input tax credit can be claimed. That depends on the recipient’s use of the service and the current credit conditions.

CBIC’s FAQ says the currency used to pay the foreign supplier is immaterial when the import-of-service conditions are satisfied. Paying in Indian rupees rather than a foreign currency does not, by itself, remove a reverse-charge obligation.

Does the reverse-charge rule have a registration consequence?

CBIC guidance states that a person required to pay tax under reverse charge must register, without relying on the ordinary registration threshold. Because registration provisions and exceptions can change, a business should verify the current consolidated law and its exact facts before acting on this consequence.

Who pays GST when an overseas online service is sold to an unregistered consumer?

For an overseas OIDAR supplier serving a non-taxable online recipient in India, CBIC guidance places the registration and tax-payment responsibility on the overseas supplier. This is a different route from the registered-business reverse charge described above.

What counts as a non-taxable online recipient?

In practical terms, this is an online recipient who is not registered for GST and is not receiving the service as a taxable business supply. An individual buying an automated digital service for personal use commonly falls into this fact pattern, but the recipient’s status and use must be established from the transaction records.

The overseas supplier should maintain evidence supporting the Indian recipient’s location and follow the registration, invoicing and payment requirements applicable to the OIDAR regime. A consumer should not assume that the absence of a GSTIN means no GST exists; the collection obligation may sit with the foreign supplier instead.

How does GST place of supply work for domestic digital subscriptions?

When both supplier and recipient are in India, the general domestic place-of-supply rule distinguishes registered and unregistered recipients.

Domestic transaction General place-of-supply approach Practical record to retain
Recipient is GST-registered Location of the registered recipient Valid GSTIN and the registered address of the purchasing entity
Recipient is unregistered and an address is on record Recipient’s location shown in the supplier’s records Name, address and state captured during ordering or billing
Recipient is unregistered and no address is on record Supplier’s location Evidence that no recipient address was available

A 2024 clarification gives a specific invoicing instruction for online services, including OIDAR supplied to unregistered recipients: the supplier should record the recipient’s state name on the tax invoice, and that state is treated as the address on record for the stated place-of-supply rule. Suppliers should update checkout and invoice systems rather than relying on an informal customer statement.

How should a company classify a subscription before quoting a GST rate?

First identify the exact bundle being sold. A product may combine automated platform access, storage, advertising, support, implementation and professional services. The classification and rate can depend on the dominant or separately identifiable supplies and on the wording of the current rate notification.

Questions for the contract and invoice

  • Is access delivered automatically through an online account, or does a person perform the core service?
  • Are onboarding, configuration, training or consulting included in the recurring price?
  • Does the customer receive software access, downloadable content, storage capacity, data processing or a human service?
  • Are the components separately priced and separately usable?
  • Which legal entity issues the invoice and receives payment?

The available legal and administrative material does not establish one rate for every digital subscription. Before publishing a rate on an invoice, website or accounting policy, check the current GST rate notification and the classification for that actual service. If the classification is uncertain, obtain a written professional opinion rather than treating a neighboring category as interchangeable.

What is the difference between the main subscription scenarios?

The supplier’s location, recipient’s GST status and service characteristics determine who accounts for tax. The comparison below keeps those variables separate.

Scenario Likely tax-accounting route Key evidence or caution
Indian supplier to GST-registered Indian business Supplier charges GST under the applicable domestic supply rules. Use the recipient’s GSTIN and registered location; verify classification and rate.
Indian supplier to unregistered Indian recipient Supplier applies the domestic rule for an unregistered recipient. Capture the recipient address and state where required on the invoice.
Foreign supplier to GST-registered Indian business Recipient may owe IGST under reverse charge if import conditions are met. Currency of payment does not change the analysis; registration consequences may apply.
Foreign OIDAR supplier to non-taxable online recipient in India Overseas supplier is responsible for the OIDAR registration and tax-payment route described by CBIC. Supplier must establish recipient location and meet invoicing and reporting obligations.
Foreign supplier providing a predominantly human service Apply the general imported-service rules; do not assume OIDAR treatment. Analyse the service delivery and place-of-supply facts, not the platform’s marketing name.

What records should a subscriber keep?

Good records make the place-of-supply and reverse-charge analysis auditable. Keep the order confirmation, master service agreement, invoice, renewal notices, payment record, supplier’s legal details, GSTIN if shown, and the account or billing address used at purchase.

What common GST mistakes should be avoided?

Assuming every subscription has the same rate

Digital subscriptions cover materially different supplies. A universal percentage can misstate tax and create invoice, payment and credit problems. Verify the current rate for the identified service.

Treating every online service as OIDAR

An online interface does not prove that the core supply is automated with minimal human intervention. Examine what people actually do to deliver the service.

Ignoring the recipient’s status

A GST-registered company and an individual consumer can trigger different accounting routes even when they buy access to the same platform. Capture the recipient identity before deciding who pays.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Believing payment currency controls GST

For the import conditions described by CBIC, the payment currency is immaterial. The supplier’s location, recipient’s location and place of supply control the analysis.

Claiming input tax credit automatically

Reverse-charge payment and input tax credit are separate questions. Eligibility depends on statutory conditions and the recipient’s use of the service; it is not established merely because the invoice relates to software.

Using an old FAQ or rate table without checking its date

The Act, clarifications and rate notifications can change. Use the current consolidated statute, current CBIC guidance and the rate notification in force for the tax period being reported.

What should a finance team do when the facts are unclear?

Escalate the transaction instead of forcing it into a familiar category. Ask the supplier for the contracting entity, service description, delivery model, human-intervention details and the GST treatment it applies. Then document the Indian recipient, place-of-supply evidence, classification, rate source and accounting route in a short tax memo.

For recurring subscriptions, review the setup when the vendor changes its contracting entity, adds managed services, changes billing geography, or materially changes the product. A renewal that looks identical commercially can have a different GST result if any of those legal or operational facts change.

What is the practical answer for an Indian subscriber?

Do not decide GST from the word “subscription.” Identify the service and automation level, establish supplier and recipient locations, determine whether the customer is GST-registered, apply the domestic or import place-of-supply rule, and then verify the current classification and rate. A registered Indian business buying qualifying foreign software or online database access should specifically test reverse charge, while an overseas OIDAR supplier selling to a non-taxable online recipient should be assessed under the supplier-liability route.

Frequently Asked Questions

Can an employee’s personal subscription be treated as the company’s imported service?

Not automatically. The contracting customer, invoice, payment and business purpose should show that the Indian entity received the service; an employee’s personal account may require a different analysis and may not support business tax treatment.

What if the foreign vendor adds Indian GST to my invoice?

Check the vendor’s contracting entity and the legal basis for the charge. If the Indian recipient is also required to account under reverse charge, obtain professional advice before paying tax twice and reconcile the invoice with the applicable import rules.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do free trials create a GST obligation?

A genuinely free supply with no consideration may require a different analysis from a paid subscription, but conversion fees, bundled services, data exchanges or automatic paid renewals can change the facts. Keep the trial terms and the first paid invoice.

Is a downloadable app always treated as OIDAR?

No. Download or online delivery is only part of the statutory test. You must also consider whether the supply is essentially automated, involves minimal human intervention and cannot be made without information technology.
