In the United States, nobody owns an idea under copyright—not the person who prompted an AI system, the service provider, or the person who receives the output. Copyright may protect original human expression of that idea once it is fixed, including qualifying human contributions to an AI-assisted work. Purely AI-generated material does not become copyrightable just because someone requested it, paid for it, or has the file. Who owns any protectable human contribution is a separate question involving authorship, employment or commissioning arrangements, transfers, and the service’s terms.
This is a U.S.-first explanation of general copyright principles, not legal advice about a particular work or contract. Rules differ by country, and a platform’s promise about output ownership does not itself establish copyright.

What does copyright protect when an idea is made with generative AI?
Copyright protects qualifying original expression—not the underlying idea, theme, method, system, process, or concept. U.S. law draws that line in Section 102 of the Copyright Act. Writing down a story premise or asking an AI to illustrate a concept does not give the requester an exclusive right to that premise or concept.
A work must also be fixed in a tangible medium to qualify for copyright. A written passage, saved image, or recorded composition may contain protectable expression; the abstract idea behind it does not. The distinction matters because a person can have rights in their own original wording or artwork without controlling every later work that uses the same broad idea.

With AI-assisted work, the practical question is: which expressive elements did a human author actually determine? The U.S. Copyright Office’s January 2025 report says purely AI-generated material is not protected by copyright. It assesses human contributions case by case, including human-authored expression that remains perceptible in the result, a sufficiently creative arrangement, or sufficiently original modifications. Any protection applies to qualifying human expression, not automatically to all the AI material around it. Read the Copyright Office’s Part 2 report.
There is no universal edit count, prompt length, or percentage of human work that decides the question. The nature and originality of the contribution matter. A person’s creative choices may be substantial in one work and too limited in another, even if both involved many prompts or revisions.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Scan for outdated or missing drivers - takes under a minuteDriver Scan →Repair Windows errors before they cause bigger problemsFix Now →Does writing a prompt make someone the author of the output?
Not by itself. The Copyright Office concluded that, for the generally available AI technology it examined, even detailed instructions do not necessarily determine the expressive elements the system generates.
A prompt can describe a subject, mood, style, or desired result while leaving the system to produce the actual wording, composition, or other expressive choices. Describing the outcome is not the same as authoring the expression that appears in it. The inquiry is about the output’s expressive elements, not how much effort the user put into requesting them.
That does not mean a prompt can never be protected. A separately written prompt may itself qualify as a copyrightable text if it contains sufficiently original human expression. That would protect the prompt’s eligible wording as a text, not automatically the AI-generated result. The distinction is between authorship of the instructions and authorship of the expression the system returns.
Which human contributions could be protected?
Human expression can remain protectable in a mixed work, but the claim should be limited to the qualifying contribution. These examples illustrate the Copyright Office’s framework; whether a real work qualifies depends on its actual content and creation.

Human-written passages included in an AI-assisted story
If a person writes original passages and incorporates them into a story that also contains generated text, the person may claim copyright in their own qualifying passages. That does not automatically extend protection to generated sentences merely because they appear in the same file.
Creative selection and arrangement
A person who chooses and arranges generated elements may contribute original expression through the selection, coordination, or arrangement. The arrangement must meet the applicable originality threshold; merely collecting or presenting output is not necessarily enough. Any protection would cover the creative arrangement, not necessarily each generated element on its own.
Substantial human revisions
Original revisions that add human-authored expression may qualify. For example, rewriting passages, changing a composition in creative ways, or adding original visual elements could contribute protectable expression. Routine cleanup or simply accepting a system’s suggestions does not automatically make the underlying output human-authored.
These categories are not a formula. A work may combine them, and the boundary between human and generated material can be difficult to describe. Keep track of what you wrote, selected, changed, or arranged so you can identify the human contribution accurately if you later register the work or need to explain your claim.
Who owns the copyright in an AI-assisted work?
First identify what, if anything, is copyrightable; then identify who owns that protectable expression. U.S. law generally gives initial copyright to the author, subject to specific rules such as work made for hire and later transfers. The person who typed a prompt, paid an invoice, or received the finished file is not automatically the copyright owner of every part.
Freelancer and client
Separate four questions: who authored the human-written or otherwise human-created material; whether a valid work-made-for-hire arrangement applies; whether the agreement transfers copyright; and who merely possesses the delivered file. A client can own a copy without owning copyright, and a contract can allocate rights differently from the default rules.

Calling a commissioned project “work for hire” does not make it so by itself. Section 101 sets conditions for commissioned works to qualify, and the particular arrangement matters. Read the actual agreement for language covering copyright ownership, licenses, permitted uses, revisions, and AI-generated material rather than assuming that payment or delivery settled every right. See the Copyright Act provisions on ownership and transfers.
Employee and employer
For work made by an employee within the scope of employment, work-made-for-hire rules may affect initial ownership. Whether the work was within that scope depends on the circumstances; a job title or use of workplace equipment alone is not a complete answer. A separate agreement may also transfer rights, so check the employment documents and any project-specific terms.
People who only receive or buy a file
Owning a physical or digital copy is not the same as owning copyright. A buyer may receive permission to use a file under a license, while copyright remains elsewhere—or the file may contain material that is not copyrightable in the first place. Confirm the license or assignment rather than treating possession as proof of exclusive rights.
What do AI service terms say about output ownership?
Terms of service create a contractual layer between a provider and its user; they do not decide whether a work meets copyright law’s authorship requirements. For example, OpenAI’s individual-service terms effective January 1, 2026 say that, as between OpenAI and the user and insofar as law permits, the user owns output and receives OpenAI’s rights, if any. The terms also warn that outputs may be similar. Read OpenAI’s individual-service terms.
That example is not a statement about every service, business account, or country. Read the terms that apply to your account and date of use, including any product-specific or business agreement. A promise to assign a provider’s rights, if any, can clarify the provider-user relationship; it cannot create statutory copyright in material that lacks the required human authorship.
Keep four questions separate when evaluating a result: whether you are allowed to use it under the service’s terms; whether copyright protects any part; whether you have an exclusive right; and whether the result raises a third-party infringement concern. Permission to use output does not answer all four.

How does the answer differ in the United Kingdom and European Union?
Country matters. The U.S. answer should not be treated as a universal rule, and the UK’s specific provision for certain computer-generated works is distinct from ordinary human authorship analysis.
United Kingdom
A UK government report published March 18, 2026 describes an existing provision for certain computer-generated works where there is no human author. It provides a 50-year term and deems the author to be the person who made the necessary arrangements for the work’s creation. For a general-purpose system responding to a prompt, the report says that person will usually be the prompter.
The same report proposes removing that provision. A proposal is not a repeal: do not treat the suggested change as current law unless legislation has actually changed. The report’s description is specific to that UK provision and should not be applied to U.S. works or other countries. Read the UK government report.
European Union
The UK report says the EU has no equivalent specific right for computer-generated works. That does not make every AI output freely usable in every EU circumstance or settle questions about human-authored contributions, contracts, or third-party rights. The UK report’s account is not a substitute for checking the law that applies to a particular EU country and use.
How do I protect my idea?
You cannot use copyright to own an abstract idea, but you can preserve and protect eligible expression of it. The U.S. Copyright Office frames this as “How do I protect my idea?”: the answer depends on what you create and which legal protection, if any, fits that creation.
- Write or create original expression. A developed text, drawing, photograph, or other fixed work may contain copyrightable expression. The copyright claim would not cover the underlying concept, method, or system.
- Keep records of human contributions. Save drafts, original passages, source files, and revision history that show what you authored or changed. These records can help distinguish your work from generated material, though records alone do not make a contribution copyrightable.
- Read the relevant agreement. For a client, employer, collaborator, or AI provider, check whether rights are licensed, assigned, retained, or restricted. Make sure the terms address the actual account and project.
- Consider other legal tools only when they fit. Confidentiality agreements or other protections may be relevant to a business concept, but they are not copyright in an idea. A potentially patentable invention is a separate matter; copyright does not confer a patent.
On patents, the USPTO’s November 2025 revised guidance applies the ordinary U.S. inventorship standard to AI-assisted inventions and says only natural persons can be named as inventors. That does not mean an invention automatically qualifies for a patent. Read the USPTO’s revised inventorship guidance.

How do I register a mixed human-and-AI work in the United States?
The Copyright Office instructs applicants for a mixed work to disclose AI-generated content, identify their human contribution in the Standard Application, and exclude more than de minimis AI-generated content from the claim. Registration is an application and review process; it does not turn machine-generated expression into human authorship.
- Identify the human-authored material. Separate original text, artwork, arrangement, or revisions you claim from generated material that does not qualify as human authorship.
- Complete the Standard Application accurately. Use the “Author Created” field to describe the human contribution. Use “Material Excluded” to identify AI-generated content that is more than de minimis and is not part of the claim.
- Do not name the AI system as a coauthor. The Office says not to list an AI system or its provider as a coauthor merely because it was used.
- Correct an omission if needed. The Office describes ways to correct pending applications or registrations already issued when relevant AI material was not disclosed. Follow its current instructions for the type and status of the filing.
The Office’s AI registration guidance explains these disclosure fields and correction procedures. Because guidance and forms can change, consult the current Office instructions when filing.
What should you check before relying on an AI-generated result?
A defensible ownership decision starts by separating the output’s source, the human contribution, the applicable agreement, and the intended use. Use this checklist before claiming exclusivity, transferring rights, or registering a mixed work.
- Jurisdiction: Which country’s law governs the work and the intended use?
- Human expression: Which wording, artwork, arrangement, or revisions did a person create, and which elements came from the system?
- Ownership path: Is the human author an employee, contractor, collaborator, or the person receiving the file? Is there a work-made-for-hire arrangement or written transfer?
- Applicable terms: Which service, product, account type, and version of terms governed the generation?
- Scope of the claim: Are you claiming rights only in the human contribution, or mistakenly treating the entire output as exclusively yours?
- Registration disclosure: If filing in the U.S., have you identified and excluded more than de minimis generated material as the Office directs?
The Copyright Office’s January 2025 Part 2 report concerns copyrightability. It does not resolve every dispute involving model training or infringement; the Office lists a separate Part 3 report on training. A conclusion about authorship or registration should therefore not be treated as a blanket answer to every legal issue involving an AI system.
Frequently Asked Questions
Can I sell something made with generative AI?
Possibly, but first check the terms that apply to your service and account, and distinguish permission to sell or use an output from owning an exclusive copyright in it. A provider’s terms may allocate rights between provider and user without guaranteeing that the output is copyrightable.
Can I copyright the exact prompt I wrote?
A sufficiently original prompt may be protected as a text in its own right. That does not mean copyright in the prompt automatically extends to the system’s generated response.

Can another person get a similar AI-generated result?
Yes. OpenAI’s individual-service terms warn that outputs may be similar, and a service’s output-ownership language is not a promise of uniqueness. Whether any particular work infringes another person’s rights is a separate question.
Does copyright protect an AI-generated invention?
Copyright and patent law address different subject matter: copyright does not protect an idea or invention as such. The USPTO says only natural persons can be named as inventors under its November 2025 guidance, and ordinary patent requirements still apply.
