European cloud providers are usually easier to align with EU sovereignty goals, but they are not automatically more private or GDPR-compliant. A US hyperscaler can lawfully process EU personal data when the organisation has the right processor terms, transfer mechanism, technical safeguards and governance. The decisive distinction is broader than where a server sits: it includes ownership, governing law, administrator access, metadata and support paths, software control, and exposure to third-country orders.

US hyperscalers generally deliver more integrated services, global regions and mature AI, analytics and serverless tooling. European providers can reduce jurisdictional and vendor-dependency risk, although matching one hyperscaler’s breadth may require several providers. The right choice depends on the workload’s legal sensitivity, technical requirements, resilience needs and exit plan.

Are European cloud providers more private than AWS, Azure or Google Cloud?

They can offer a stronger sovereignty position, but “European” is not a privacy certification. A provider established and operated in the EU may make ownership, local jurisdiction and supervisory-authority discussions easier to document. You still need encryption, access controls, processor contracts, incident response, retention rules and evidence that the actual service follows the promised data-flow model.

Privacy has at least two dimensions:

  • Information security: preventing unauthorised access, alteration, loss and service disruption.
  • Legal and operational sovereignty: controlling who can order access, where staff and infrastructure are located, which law governs the provider, and whether the customer can continue operating without a foreign supplier.

A technically secure service can therefore remain exposed to foreign legal control. Conversely, an EU-based service can still be poorly configured or inadequately governed. Assess both dimensions separately.

What a European provider can simplify

EU establishment, EU operations and local support personnel can make it easier to demonstrate where decisions are made and which courts have authority. Some European offerings also provide sovereignty-oriented certifications or operating models, such as SecNumCloud or controls mapped to CISPE, the EU Cloud Code of Conduct, BSI C5 and ISO/IEC 27001. These are evidence points, not substitutes for your own risk assessment.

What it does not remove

You remain responsible for selecting the correct region, configuring identity and permissions, protecting keys, limiting administrator access, handling data-subject rights and checking subprocessors. A provider’s parent company, support arrangement or software dependency can introduce third-country exposure even when the primary data centre is in Europe.

What does “data residency” actually protect?

Residency controls the physical location of a particular category of data. It does not automatically control metadata, telemetry, backups, support tickets, remote administration, software development or legal access.

The European Commission’s sovereign-cloud framework evaluates several dimensions together:

  • where the provider is established and who owns or controls it;
  • where infrastructure and personnel are located;
  • where customer data and metadata reside;
  • who controls the software stack and encryption functions;
  • whether operations can continue autonomously; and
  • the provider’s protection from third-country interference.

Ask the provider to map each data class separately. “Data” may mean application records, while “metadata” includes account identifiers, logs, diagnostic events, network information and billing records. Confirm the locations of replicas, snapshots, disaster-recovery copies and support tooling rather than relying on the region name shown in a console.

Does an EU region on a US hyperscaler solve the jurisdiction question?

No. An EU region can materially reduce ordinary cross-border transfers and help meet a residency requirement, but it does not by itself change the provider’s legal entity, ownership or exposure to a third-country order. Review the contracting entity, governing law, support-access process and any commitments concerning compelled disclosure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Provider documentation can also contain service-specific exceptions. AWS documents EU region selection, customer-controlled keys and GDPR safeguards, while warning that some services may transfer data outside the selected region. Treat the service’s data-flow documentation—not a marketing label—as the authoritative starting point.

Can I keep GDPR data in Europe on a US hyperscaler?

Yes, in many situations. A US provider is not automatically unlawful in Europe, and an EU provider is not automatically compliant. The controller must select a lawful processing arrangement, document transfers and safeguards, and retain effective control over the processing.

Which transfer mechanisms may apply?

The EU-U.S. Data Privacy Framework entered into force on 10 July 2023. For participating organisations, it can serve as an Article 45 adequacy mechanism for transfers to the United States. It is not a general GDPR-compliance certificate: you still need a valid purpose, lawful basis, processor governance, security, records, rights handling and appropriate technical and organisational measures.

Where the framework does not apply, or where your assessment requires another safeguard, the European Commission’s Standard Contractual Clauses (SCCs) and other Chapter V mechanisms may be relevant. Confirm which legal entity is certified or signs the clauses, which processing activities they cover, and whether your transfer-impact assessment addresses government-access risk.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What must the controller still control?

The Irish Data Protection Commission states that “A data controller must remain in control of the personal data it collects when it subcontracts the processing to a cloud provider.” In practice, document:

  • the controller-processor agreement and subprocessor list;
  • purposes, categories of data and retention periods;
  • region, backup and metadata locations for every service;
  • encryption in transit and at rest, including who controls keys;
  • privileged-access approvals, logging and support-session controls;
  • incident notification, deletion and data-subject-rights procedures; and
  • the transfer mechanism and any supplementary measures.

Do not assume that a provider’s compliance page covers your application architecture. Your use of a managed database, logging service, AI API or support feature may create a different data flow from the underlying compute region.

Does EU residency protect me from the US CLOUD Act?

Residency alone is not a complete answer. The relevant question is whether a provider or its affiliates remain subject to a third country’s legal authority and could be required to disclose data, credentials or assistance. A provider can host content in Europe while its corporate structure, personnel or control systems create a separate jurisdictional exposure.

Evaluate this risk without treating it as proof that disclosure will occur. Ask for the legal entity that contracts with you, its ownership and governing law, the process for handling government demands, customer-notification commitments where lawful, and the technical design that prevents provider personnel from reading plaintext.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How technical controls change the exposure

Customer-controlled encryption keys, hardware-backed key management, split administration and strong separation of duties can reduce what a provider can disclose in usable form. They do not eliminate every risk: metadata, account information and operational assistance may still be accessible, and key custody can be undermined if the provider retains an administrative path.

For highly sensitive workloads, require evidence of who can invoke keys, how emergency access is approved, how sessions are recorded and whether the provider can operate the service without your key. Align those controls with your threat model rather than treating “encryption available” as sufficient.

How do European cloud catalogues compare with US hyperscalers?

The capability gap is real in some categories, although a smaller catalogue does not necessarily mean lower quality. A European Commission impact assessment published in 2026 reported approximately the following counts:

Provider example Approximate service count Source and date
OVHcloud Around 80 European Commission impact assessment, 2026
Scaleway Around 80 European Commission impact assessment, 2026
Amazon Around 200 European Commission impact assessment, 2026

The assessment identifies European gaps mainly in native AI and machine-learning platforms, serverless services and integrated analytics pipelines. US hyperscalers also tend to offer a larger marketplace, more mature managed databases, broader global-region coverage and deeper integration between identity, observability, data and developer tools.

Those advantages matter when a team wants one control plane, a common set of APIs or rapid access to specialised managed services. They can also increase switching costs through proprietary interfaces, service-specific data formats and tightly coupled pipelines.

Does fewer services mean lower quality?

Not necessarily. A focused catalogue may be sufficient for virtual machines, storage, networking, containers, backups and standard databases. The question is whether the missing managed services are central to your product. Reproducing the breadth of one hyperscaler may require combining several European providers, which can improve independence but adds integration and operational work.

Which compliance evidence should I request?

Request evidence at the service and region level, not just a corporate certificate. Gaia-X criteria, for example, require disclosure of third-country transfers and the Chapter V safeguard used. Depending on the workload and sector, useful evidence can include mappings or certifications associated with CISPE, the EU Cloud Code of Conduct, SecNumCloud, BSI C5 and ISO/IEC 27001.

  • Legal control: contracting entity, ownership, governing law, affiliates and government-request process.
  • Location: customer content, metadata, telemetry, backups, disaster-recovery copies and support access.
  • Security architecture: encryption defaults, customer-held keys, privileged-access management, logging and independent testing.
  • Regulatory scope: GDPR, NIS2, DORA, sector rules and public-procurement conditions relevant to your organisation.
  • Operational resilience: region redundancy, recovery objectives, incident communications, support coverage and skills availability.
  • Exit: export formats, migration assistance, data deletion, egress charges and dependencies on proprietary APIs.

NIS2’s implementing regulation specifies technical and methodological cybersecurity requirements for cloud-computing and related digital-infrastructure providers. Member States were required to transpose NIS2 by 17 October 2024, but the practical duties and supervision still depend on the applicable national implementation and your role in the supply chain.

How should I compare providers for a real workload?

Use the same questionnaire and workload test for every candidate. Separate non-negotiable legal controls from preferences such as a particular framework or developer tool.

  1. Classify the workload. Identify personal, health, financial, confidential, government or strategic data; processing purposes; retention; and the impact of loss or disclosure.
  2. Map every data flow. Include application traffic, logs, metrics, backups, support cases, identity systems, managed AI features and disaster recovery. Record country, legal entity and subprocessor for each flow.
  3. Define sovereignty requirements. Decide whether you need EU ownership, EU personnel, exclusive EU data and metadata, customer-held keys, local support or protection against third-country interference. Do not collapse these into a single “EU region” checkbox.
  4. Verify contractual safeguards. Check the DPA, SCCs or adequacy basis, subprocessor-change terms, government-request procedure, breach notification and deletion commitments.
  5. Test the security model. Confirm key custody, privileged access, audit logs, recovery procedures and whether support can access plaintext. Obtain independent assurance reports where permitted.
  6. Test portability before production. Export a representative dataset, infrastructure definitions and application configuration. Measure import effort, format loss, egress cost and downtime with a second provider or local environment.
  7. Price the complete operating model. Include inter-region traffic, backups, logging, support tiers, security tooling, migration, multi-provider integration and staff training—not only compute and storage.
  8. Record residual risk. Have legal, privacy, security, architecture and procurement owners sign off on the risks that remain after controls.

When is an EU-controlled provider the better choice?

Prefer an EU-controlled provider or a sovereign operating model when legal jurisdiction, public-sector sovereignty, strategic autonomy, sensitive personal data or third-country interference dominate the decision and the workload fits the available platform.

  • Public-sector or regulated procurement requires demonstrable EU control.
  • Customer contracts prohibit certain foreign jurisdictions or support access.
  • The application relies on standard infrastructure and managed services available from the candidate.
  • Reducing concentration and foreign-dependency risk is more valuable than a single integrated catalogue.
  • Your organisation can operate a multi-provider design where necessary.

Confirm the provider’s exact legal entity and service scope. “European provider” can describe a company with EU headquarters while a particular service, support function or subprocessor operates elsewhere.

When does a US hyperscaler make more sense?

Choose a US hyperscaler when global scale, advanced managed services, integrated AI and analytics, mature developer tooling, broad certification coverage or a specific platform capability outweigh the sovereignty trade-off—and when you can document the safeguards.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The product needs specialised AI or machine-learning services that are not available in the required European catalogue.
  • Latency or resilience requires regions across several continents.
  • One integrated identity, data, observability and deployment platform materially reduces operational risk.
  • Your team already has the skills and automation to manage the provider securely.
  • The legal, transfer, key-management and exit controls are acceptable to the risk owner.

Do not select a hyperscaler solely because it has the largest service list. A broad catalogue can create more proprietary dependencies and more data flows to govern.

Can hybrid or multi-cloud designs provide the best compromise?

Yes, but they exchange provider dependence for architecture and governance complexity. Keep sovereignty-sensitive systems—such as identity, highly sensitive records or regulated processing—on an EU-controlled platform, while using a hyperscaler for capability-intensive analytics or AI where the data can be minimised, anonymised or kept outside the restricted boundary.

Design explicit interfaces between environments. Decide where encryption keys live, which logs may cross boundaries, how identities are federated, how incidents are coordinated and how a workload is recovered if either provider is unavailable. A multi-cloud diagram without tested runbooks is not resilience.

More than 300 organisations were members of Gaia-X according to a 2025 European Parliament Research Service summary. Gaia-X is a federated trust and compliance framework, not a single cloud vendor; membership therefore does not mean that every service is sovereign or interchangeable.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How do the EU Data Act and sovereignty initiatives affect cloud buying?

The EU Data Act makes switching rights and obligations for data-processing services a procurement issue, not an afterthought. Contracts should state the assistance available during migration, export formats, timing, security responsibilities, deletion and charges. Test those promises with a pilot export before committing critical workloads.

The Commission’s proposed Cloud and AI Development Act frames over-reliance on non-EU cloud providers as a digital-autonomy and resilience risk and sets out four sovereignty assurance levels. Use that framework to ask which level your workload requires; do not assume that every application needs the highest level.

These initiatives do not make a European provider automatically preferable. They make legal control, portability and operational autonomy explicit criteria that should appear in the architecture decision record and contract.

What should the final decision record say?

State the workload, data classes, required sovereignty level, selected provider and service, regions, metadata and support locations, transfer mechanism, key-control model, certifications, resilience design, portability test and residual risks. Name the owner responsible for reviewing changes to regions, subprocessors, legal terms and service functionality.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Recheck the assessment at procurement and renewal. Provider catalogues, sovereignty programmes, certifications, transfer decisions and contractual terms can change, and a service that is compliant in one region may have different flows in another.

Frequently Asked Questions

Is an EU cloud always cheaper than a US hyperscaler?

Not necessarily. Compute and storage rates are only part of total cost; include support, traffic, backups, security controls, migration, staff skills and the integration cost of combining several providers. A narrower catalogue can lower unused-service complexity while a multi-provider design can raise operating costs.

Can I use a US hyperscaler’s AI service with EU personal data?

Only after checking that service’s processing terms, training and retention settings, region and support access. Minimise or pseudonymise data where possible, confirm the transfer mechanism and document whether prompts, outputs, logs or telemetry leave the approved boundary.

What is the difference between Gaia-X and a cloud provider?

Gaia-X is a federated trust and compliance framework rather than a hosting company. Its criteria help participants describe data location, third-country transfers and safeguards, but each individual service still needs its own contractual and technical assessment.

How often should a cloud sovereignty assessment be renewed?

Review it at procurement, major architecture changes, new regions or services, subprocessor changes, contract renewal and material regulatory developments. Continuous monitoring is important because service data flows and legal terms can change without a data-centre move.
