Yes, open-source general-purpose AI (GPAI) models are covered by the EU AI Act. A qualifying open-source release may receive a limited exemption from two documentation duties, but it does not remove the provider’s copyright-policy and training-content-summary duties. The exemption also does not apply to GPAI models classified as presenting systemic risk. This guide reflects the European Commission’s published guidance as of 25 October 2026; the guidance explains the Commission’s interpretation and is not a binding decision on any particular model.

What does the EU AI Act require from open-source GPAI providers?

The Act imposes obligations on providers of general-purpose AI models. The Commission’s guidance recognizes a narrow accommodation for some open-source releases: a qualifying provider does not have to prepare the specified technical documentation for authorities or supply the specified documentation to downstream AI-system providers. That is a documentation exemption, not a general exemption from the Act.

Open-source providers remain subject to two duties that apply to GPAI providers generally: they must put in place a policy to comply with EU copyright and related-rights law, and they must publish a sufficiently detailed summary of the content used to train the model. A provider cannot treat an open license as a substitute for those obligations.

The practical distinction is between a limited relief from particular model-documentation requirements and the duties that continue to apply to every GPAI provider. Whether a model qualifies depends on its release terms and what the provider makes public—not simply on whether the provider calls it “open source.”

When does the open-source documentation exemption apply?

According to the Commission, the exemption depends on both the licensing terms and the information made publicly available. A release should be assessed against each condition, rather than judged by its label or by the fact that some model files can be downloaded.

Check the license

The model must be released under a free and open-source license. Consider whether the terms permit access, use, modification, and distribution in the relevant circumstances. The actual license matters; a provider’s description of the release does not establish that it meets the Commission’s conditions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Check what is public

The required public materials include the model’s parameters, including its weights, as well as information about its architecture and usage. If one of these elements is missing or access is restricted, the open-source label alone does not establish eligibility for the documentation exemption.

Keep the remaining duties in view

Even if the license and public materials satisfy the conditions, the provider still needs the copyright-compliance policy and the public training-content summary. Those duties are not part of the limited documentation relief. The Commission’s FAQ and guidance describe them as applying to open-source GPAI providers as well as other GPAI providers.

Which open-source models are excluded from the exemption?

GPAI models with systemic risk do not receive the open-source documentation exemption. Their providers have additional obligations focused on identifying and addressing risks, evaluating the model, handling serious incidents, and securing the model and its physical infrastructure.

  • Assess and mitigate systemic risks: The provider must evaluate relevant risks and take steps to reduce them.
  • Evaluate the model: Providers must perform model evaluations under the applicable requirements.
  • Keep records and report serious incidents: These obligations apply to systemic-risk models.
  • Provide adequate cybersecurity: The duty covers the model and its physical infrastructure.

The Commission cautions that releasing a model openly can make later risk mitigation more difficult. For a model that may present systemic risk, the provider may therefore need to assess and mitigate risks before release. The open nature of the distribution does not waive these responsibilities.

How does the Commission identify GPAI and systemic-risk models?

The Commission’s 2025 guidance gives compute thresholds as criteria, but they are guidance criteria, not a complete substitute for examining a model’s capabilities and impact. The figures below should not be treated as automatic, universal safe harbors or as the only possible route to a designation.

Question Commission guidance criterion How to interpret it
Could the model be identified as GPAI? Training compute exceeding 1023 floating-point operations (FLOP), together with specified generative capabilities. The guidance describes compute alongside capabilities; compute alone should not be presented as the entire test.
Is systemic risk presumed? Training compute exceeding 1025 FLOP. This is a presumption in the guidance, not the only way a model can be designated.
Can a model be designated without crossing that compute figure? The Commission may designate a model based on equivalent capabilities or impact. A compute figure below the presumption does not, by itself, settle the question.

These are Commission-published legal criteria and guidance, not independent empirical statistics. The exact assessment depends on the facts and on the applicable law and guidance at the time. The Commission’s published guidance is useful for understanding its enforcement approach, but it is not legally binding; the Court of Justice of the European Union provides authoritative interpretation of EU law.

When did the GPAI rules start applying?

Under the Commission’s published information, provider obligations for GPAI models began to apply on 2 August 2025. Providers of GPAI models that were already placed on the market before that date have a transition period until 2 August 2027 to comply.

The transition is tied to when the model was placed on the market. It should not be read as a general delay for every model, every later release, or every separate obligation that may apply to an AI system using a model. Providers should verify the timing and scope against the Regulation and current Commission materials for their own circumstances.

Who counts as the provider after a model is modified?

The original developer is not necessarily the only provider throughout a model’s lifecycle. Under the Commission’s explanation, an entity that significantly modifies or fine-tunes an existing GPAI model may become the provider of a new model; minor changes do not automatically trigger that result.

The Commission guidance includes an indicative training-compute criterion for significant modification, but the figure is not specified here. Do not infer a threshold from the GPAI or systemic-risk figures above: they address different questions. The applicable guideline text and the facts of the modification need to be checked before deciding who has provider responsibilities.

This distinction matters for open releases. A party that takes an existing model and makes a significant change should not assume that the original provider’s compliance work covers the resulting model. Conversely, a change is not automatically significant merely because it is described as fine-tuning; the applicable criteria and facts determine the analysis.

Do companies that use an open model have obligations too?

Yes, a company integrating a model into an AI system can have obligations tied to that system, even if it is not the provider of the underlying GPAI model. The model-provider rules and the obligations applicable to an AI system or its deployer are related but distinct questions.

For that reason, an open-source model’s documentation exemption does not decide whether the company using it has duties under other parts of the Act. A downstream organization should separately assess its role, the system it is building or operating, and the rules that apply to that system. Open access to weights or architecture does not transfer every legal responsibility from the system provider or deployer to the model’s original developer.

What is a practical way to assess an open-source release?

Use the questions below as a screening process, not as a substitute for a fact-specific legal assessment. Keep evidence for each answer, especially where several organizations contribute to training, release, modification, or integration.

  1. Identify the model and provider. Establish which entity is placing the GPAI model on the market and whether another entity has significantly modified or fine-tuned it.
  2. Review the actual license. Check whether the model is offered under a free and open-source license and whether its terms permit access, use, modification, and distribution on the relevant terms.
  3. Inventory public materials. Confirm that parameters, including weights, architecture information, and usage information are publicly available.
  4. Assess systemic risk separately. Consider the Commission’s compute presumption and its ability to designate a model based on equivalent capabilities or impact. Do not treat open-source eligibility as an answer to the systemic-risk question.
  5. Plan for duties that remain. Establish a policy for compliance with EU copyright and related-rights law and prepare a sufficiently detailed public summary of training content.
  6. Check dates and separate system duties. Determine whether the model was placed on the market before 2 August 2025, and assess any obligations attached to an AI system that incorporates it.
  7. Recheck current legal materials. Use the Regulation and the latest Commission guidance for the specific facts. The Commission’s interpretation is informative but does not replace authoritative judicial interpretation.

This process helps separate four questions that are often conflated: whether the release meets the Commission’s open-source conditions, whether the provider has continuing GPAI duties, whether systemic-risk requirements apply, and whether another organization has obligations for an AI system built with the model.

Frequently Asked Questions

Is the General-Purpose AI Code of Practice mandatory under the AI Act?

No. The Code of Practice is voluntary; the AI Act, rather than the Code, is the source of the legal duties. The Commission and AI Board assessed adherence to its commitments as an adequate way for providers to demonstrate compliance, and it describes ways to meet obligations under Articles 53 and 55.

Can the Commission’s guidance settle a disagreement about what the Regulation means?

No. The guidance explains the Commission’s approach but is not legally binding. The Court of Justice of the European Union is the authoritative interpreter of EU law.

Is there a Commission template for the training-content summary?

Yes. The Commission provides a template that providers can use as a practical aid when preparing the public summary. Using a template does not remove the provider’s responsibility to make the summary sufficiently detailed.
