EU AI Act Governance: What Organisations Must Change and When

The EU AI Act turns AI governance into an operating responsibility, not a general statement of ethical intent. It uses a risk-based framework, so a prohibited practice, a high-risk system, a general-purpose AI model and a low-risk productivity tool do not face the same duties. The law entered into force on 1 August 2024, but its requirements start on different dates. Organisations therefore need an inventory of AI use, a clear view of their legal role, risk-based controls, named human oversight and a process for monitoring and incidents. The most urgent work is understanding which systems are already covered, which obligations begin next, and who owns each control.

Why do organisations need to rethink AI governance under the EU AI Act?

The Act changes governance in three important ways. First, it classifies AI by risk and use rather than treating “AI” as one regulatory category. Second, it assigns duties to specific operator roles, including providers, deployers, importers and distributors, instead of allowing a company to describe every activity simply as “using an AI tool.” Third, it makes ongoing operation part of compliance: high-risk deployers must follow instructions, monitor systems, respond to risks and serious incidents, and provide effective human oversight.

This means a policy that only says “use AI responsibly” is not enough. An organisation needs evidence of what systems it uses, what each system does, who supplied it, which role the organisation has, what risk category applies, which date the relevant rule starts, and who is accountable for controls after deployment.

Governance becomes a lifecycle process

The practical change is from one-time approval to a lifecycle. Before purchase or deployment, teams must identify the use case and obtain enough information from the provider to understand the system and its instructions. During use, they need trained staff, monitoring and escalation routes. When a risk or serious incident appears, someone must be able to stop, correct or report the system rather than treating the model as an autonomous decision-maker.

The same organisation can have several legal roles

A company may be a deployer when it uses a system supplied by another party, but it can also become a provider if it develops, substantially modifies or places an AI system on the market under its own name. A procurement team therefore cannot decide obligations from the product label alone. Contracts, system changes and the way a tool is presented to customers can affect the role assigned under the Act.

What does the EU AI Act mean for businesses using AI?

Businesses should map each AI use case against five questions: what role the organisation has, what the system does, where it is deployed, which risk category applies, and when the relevant provision becomes applicable. This produces a more reliable compliance plan than making a single list of “approved AI tools.”

Assessment axis Question to answer Why it matters
Role Is the organisation a provider, deployer, importer, distributor or provider of a general-purpose AI model? Duties differ by operator role; provider and deployer are not interchangeable terms.
Risk or use category Is the practice prohibited, subject to transparency rules, high-risk, or outside the specified obligations? The Act is risk-based and does not impose identical requirements on every system.
Application date Has the relevant article started to apply, or is there a transition? A system can require preparation before the legal duty is enforceable.
Deployment setting Is it used at work, in a public service, or to assist decisions about people? Some settings add information, assessment or fundamental-rights duties.
Standards and guidance Is a relevant harmonised standard or official guidance available? Standards can provide detailed specifications and support a presumption of conformity, but the standards programme is still developing.

Start with an AI inventory, not a policy rewrite

Include internally built models, software features supplied by vendors, browser or office assistants, customer-facing chatbots, recruitment and workforce tools, fraud or credit scoring, biometric functions, and systems embedded in products. Record the business owner, technical owner, provider, version, data used, affected people, geographic scope and whether the system makes or supports decisions.

Then document the arrangement with the supplier. Obtain instructions for use, known limitations, monitoring information, incident contacts, update practices and any conformity or technical documentation the provider is required to supply. If the supplier will not explain the system sufficiently for safe operation, that is a procurement and governance risk, not merely a technical inconvenience.

When do the EU AI Act rules apply?

Application is staggered. The dates below are the European Commission’s current timeline, but transitional provisions and amendments can change how a specific system is treated. Check the live Commission timeline and applicable national guidance before relying on a date.

Date What starts to apply Operational meaning
1 August 2024 The Act enters into force. The legal framework exists, although most obligations have later application dates.
2 February 2025 General provisions and definitions, AI-literacy duties and prohibited practices. Organisations should train relevant staff and stop practices that fall within the prohibitions.
2 August 2025 General-purpose AI obligations and governance arrangements. Providers of covered general-purpose models and affected organisations need role-specific processes.
2 August 2026 Most remaining provisions, including Article 50 transparency requirements, and enforcement for applicable provisions. Many organisations need operational controls, transparency notices and evidence ready by this date.
2 December 2026 New prohibitions concerning generation of non-consensual sexual deepfakes and child sexual abuse material. Relevant product and content pipelines require a separate prohibition check.
2 December 2027 Annex III high-risk-system rules. High-risk systems in the listed use areas need the applicable controls and assessments by this milestone.
2 August 2028 High-risk AI embedded in regulated products. Manufacturers and other operators need to coordinate AI obligations with the product’s existing sector regime.

The schedule is not a single “compliance day.” A company may already have literacy and prohibition duties while preparing for high-risk requirements that apply later. The Digital Omnibus has amended the schedule, so calendar entries copied from older explainers may be wrong.

What do organisations need to do about high-risk AI systems?

High-risk deployment requires an operating control system. The Commission describes duties to follow the provider’s instructions, monitor operation, address identified risks or serious incidents, and assign human oversight to people who are equipped and enabled to perform it.

1. Confirm the system and use case

Do not classify a tool by marketing name. Assess the actual function, the context of use and whether it falls within a high-risk category. A general-purpose assistant used for drafting internal notes is not automatically equivalent to a system that assists decisions about natural persons.

2. Assign an accountable deployer owner

Name a business owner with authority to pause use and a technical or operational owner who can inspect logs, manage configuration and coordinate with the provider. Their responsibilities should be written into operating procedures, not left to an informal project team.

3. Follow the instructions of use

Translate the provider’s instructions into local procedures: permitted purpose, prohibited inputs, user permissions, review thresholds, output handling and escalation. If the system is updated, reassess whether the instructions, performance or risk profile changed.

  • What You Get: Anker USB-C Hub (7-in-1), welcome guide, 18-month warranty, and our friendly customer service.

4. Make human oversight real

Human oversight is not satisfied by placing a person somewhere in the workflow. The assigned person or people must have the competence, authority, information and time to interpret outputs, challenge them and intervene. A reviewer who cannot access the underlying case or override the result is not an effective safeguard.

5. Monitor operation and investigate anomalies

Define what will be monitored, how often, and which signals trigger investigation. Depending on the use case, signals may include error patterns, unusual refusal or acceptance rates, drift in input data, complaints, discriminatory outcomes or a sudden change after a model update. Keep an auditable record of reviews and corrective actions.

6. Escalate risks and serious incidents

Provide a route from frontline users to compliance, security, legal and the provider. The procedure should state who can suspend the system, preserve relevant records, assess affected people and determine whether a notification is required. Test the route with a tabletop exercise before an incident occurs.

Additional duties in sensitive settings

Deployers providing public services may need a fundamental-rights impact assessment before first use. Workplace deployments and systems that assist decisions about natural persons can trigger additional information duties. These are context-dependent obligations, so the inventory must record where and how a system is used, not only its technical model name.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How should procurement and vendor management change?

Procurement should make regulatory role and evidence part of the selection decision. A contract should identify the provider and deployer responsibilities, permitted use, update notifications, access to instructions and documentation, incident cooperation, security contacts, subcontracting and exit arrangements. It should also state what happens if the provider changes the model or moves a feature into a higher-impact workflow.

Ask vendors for the information needed to operate the system safely, but do not assume a vendor’s claim that a product is “AI Act compliant” resolves the deployer’s duties. Compliance depends on the system, the use case and the operator’s conduct. A provider’s documentation cannot replace local human oversight, monitoring or staff training.

What does AI literacy require in practice?

AI literacy is an organisational capability, not a single online course. Staff should understand the systems they use, common failure modes, prohibited uses, privacy and confidentiality constraints, escalation routes and the limits of automated outputs. Training should be tailored: a frontline reviewer needs different instruction from a developer, procurement manager or executive approving a high-impact deployment.

  • Keep attendance and completion records.
  • Use realistic examples from the organisation’s own workflows.
  • Update training when a system, provider or use case changes.
  • Test whether users can recognise an unsafe or unreliable output.
  • Give users a clear route to report problems without bypassing management controls.

How will enforcement and governance work?

The framework is distributed. National competent authorities oversee and enforce rules for AI systems in their jurisdictions. The AI Office is responsible for general-purpose AI obligations and specified matters. The AI Board supports coordination across the EU, while the Scientific Panel and Advisory Forum provide expert input.

Enforcement began on 2 August 2026 for provisions that were applicable at that point; later provisions are enforced when they become applicable. Organisations should therefore preserve evidence as they implement controls rather than waiting for an investigation. Useful evidence includes the AI inventory, classification rationale, supplier information, training records, oversight assignments, monitoring results, incident records, impact assessments and approval decisions.

What is the status of AI Act standards?

Standards can translate legal requirements into detailed specifications and may support a presumption of conformity. They are not, however, a substitute for reading the Act or determining the correct risk category. The Commission reported delays in delivering harmonised standards for high-risk requirements. An October 2026 European Parliament Research Service briefing reported that one quality-management standard for organisations providing AI systems had been published in October 2026 while other standards remained under development.

This creates a practical distinction: a legal application date can arrive before the complete support-standard set is available. Track the standard relevant to the particular use case, confirm whether it has been harmonised and cited, and document the alternative controls used while work remains in progress.

What implementation plan works for a mid-sized organisation?

  1. Map use. Interview departments, review procurement and identify embedded AI features.
  2. Classify. Record the operator role, use category, deployment setting and applicable date for each system.
  3. Prioritise. Address prohibited practices, systems already subject to duties and high-impact uses before low-risk experiments.
  4. Assign owners. Give every system a business owner, technical contact and escalation route.
  5. Control procurement. Add documentation, update, incident and cooperation requirements to contracts and renewals.
  6. Operationalise oversight. Write instructions, reviewer authority, monitoring metrics and stop-use criteria.
  7. Train and test. Deliver role-specific literacy training and run an incident exercise.
  8. Review continuously. Reassess after model updates, changed data, new users, new countries or a change in the decision being supported.

This sequence is a governance design derived from the Act’s role, risk, oversight and monitoring requirements. It is not a universal legal checklist: sector rules, national procedures and the system’s exact classification can add obligations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What are the common governance mistakes?

  • One policy for every AI tool: a risk-based law requires differentiated controls.
  • Confusing provider and deployer: using a vendor product does not eliminate deployer responsibilities.
  • Waiting for every standard: standards may help demonstrate conformity, but legal duties can apply while standards are incomplete.
  • Nominal human review: oversight fails when reviewers lack authority, information or time.
  • No change management: a model update or new workflow can alter risk without changing the product name.
  • Ignoring the calendar: older summaries may omit the 2026, 2027 and 2028 milestones or reflect a schedule changed by the Digital Omnibus.

What should leadership decide now?

Leadership should decide who owns the AI inventory, which committee approves high-impact uses, how risk acceptance is documented and who can suspend a system. It should fund monitoring and training as operating costs, not treat them as a one-time legal project. The central question is not whether the organisation has an AI policy; it is whether the organisation can show, for each material use, who is accountable, what controls operate today and what changes when the next application date arrives.

Frequently Asked Questions

Are all chatbots treated as high-risk under the EU AI Act?

No. Risk depends on the system’s function and context, not the fact that it is conversational. A chatbot may face transparency duties or other requirements without being an Annex III high-risk system; the organisation must assess the actual use case and applicable date.

Can an organisation rely entirely on its vendor’s AI Act compliance statement?

No. A vendor’s role and documentation are important, but a deployer remains responsible for how the system is configured and used. Local instructions, human oversight, monitoring, staff literacy and incident escalation still need an accountable owner.

What should we do if the relevant harmonised standard is not published yet?

Continue preparing against the Act and the provider’s instructions, document the controls and monitor the standards status. A missing standard does not automatically postpone an applicable legal duty; it mainly means the conformity route and technical detail may be less settled.
