Neither DeepSeek nor ChatGPT is automatically the better choice for everyone. Your decision should start with the account type and the data you plan to submit. DeepSeek’s consumer policy says it collects prompts, uploaded files, account details, usage logs and approximate location, and that it processes and stores personal data in China. OpenAI says content from individual ChatGPT services may be used to improve models depending on your settings, while its API and managed-workspace content is not used for training by default. Those are meaningful policy differences, but they do not establish a universal security ranking or prove that one service is more capable or more widely available. This comparison explains the documented privacy terms, the controls you can use, and what remains unresolved about features and regional access.
Which service should you choose first: DeepSeek or ChatGPT?
Choose by matching the product tier to your privacy requirements, not by assuming that a model name tells you how your data is handled. A personal chat account has different terms from an API account, an employer-managed workspace, or an application built by another developer.

- Text prompts and other inputs sent to the service.
- Voice inputs, uploaded files and photos.
- Chat history associated with the account.
If a prompt contains a customer record, source code, a contract or an image, that material becomes part of the service’s processing context. Removing names from a document does not guarantee anonymity when the remaining text, metadata or account information can identify the subject.
Account, device and usage information
The policy lists account details and usage logs. It also says DeepSeek can infer an approximate location from an IP address. An IP-derived location is not the same as a precise GPS location, but it can still reveal a country, region or city-level approximation useful for service operations and compliance.

DeepSeek says it directly collects, processes and stores personal data in the People’s Republic of China. It also says personal data may be used to provide, improve and develop services, including training and improving its technology. Retention depends on the purpose and characteristics of the data; information needed to provide the service may be retained while you have an account. The policy does not reduce that to one universal deletion period.
These are statements about processing and policy commitments, not a finding that every request is reviewed by a person or that every item is retained for the same length of time. If you need a precise retention or transfer answer for a regulated project, obtain the applicable contractual terms rather than inferring them from a general consumer policy.
How does ChatGPT handle consumer content and privacy controls?
OpenAI’s Data Usage for Consumer Services FAQ says content from individual consumer services may be used to improve model performance depending on settings. OpenAI describes access by limited authorized personnel and trusted service providers for defined purposes, such as support, security, legal obligations and improving performance where permitted.
Model-improvement setting
The setting that permits or prevents use of new consumer conversations for model improvement is separate from deleting a conversation. Changing it affects future use according to the account’s current controls; it does not turn an existing chat into a guaranteed erasure event. Check the wording shown in your account because labels and defaults can change.

OpenAI’s Data controls in ChatGPT page says Temporary Chats do not appear in chat history and are not used to improve models. Temporary Chat is a session-level choice, not a promise that no operational, abuse-prevention or legally required record can ever exist. Treat it as a reduced-history and no-training control, not as an anonymous channel.
Deletion and export
OpenAI lists controls for exporting data, deleting individual chats and deleting an account. Exporting gives you a copy of available account data; it does not change retention. Deleting a chat removes it from the product’s normal history, while account deletion is a broader action with its own processing and legal-retention limits. If you are exercising a privacy right, record the request and any confirmation rather than relying on a screen disappearing.

What is the difference in storage geography, retention and human access?
The policies describe different locations and levels of detail. That difference is relevant to due diligence, but it is not a standalone risk score.

Storage in China or in multiple countries can trigger different transfer assessments, contractual clauses or government-access questions depending on your jurisdiction. The location itself does not establish that either provider violates a law, nor does it prove that one provider has stronger technical security. A procurement review should examine encryption, incident response, subprocessor lists, deletion evidence and applicable contracts in addition to geography.
How can you configure ChatGPT’s documented privacy controls?
The available controls are useful only when they match the account and the information being sent. The following workflow reflects the controls OpenAI documents; the exact screen text can change.
- Open the account settings and Data Controls. Identify the control governing whether conversations may be used to improve models. Set it according to your personal or organizational requirement before starting a sensitive project.
- Use Temporary Chat for a conversation that should not remain in normal history. Confirm that the Temporary Chat indicator is visible before entering the material. OpenAI says these chats do not appear in history and are not used to improve models.
- Delete chats that no longer need to be retained. Deleting is a separate action from changing the improvement setting. Apply it to each relevant conversation or use the account-deletion process when that is the intended request.
- Export data when you need an audit copy. Keep the export in an approved location, because it may contain prompts, files or account information that you no longer want in an unmanaged folder.
- Review memory and workspace controls where applicable. A managed workspace can impose organization-level retention, access and compliance rules that differ from a personal account. Follow the administrator’s policy rather than assuming personal settings carry over.
OpenAI’s US Privacy Policy and help documentation should be checked at the time of use because settings, retention explanations and product boundaries can change.
What privacy controls are documented for DeepSeek?
The supplied DeepSeek policy establishes collection, use, storage and retention statements, but it does not provide a comparable inventory of account switches such as Temporary Chat, a model-improvement toggle, or a specific deletion workflow. Do not assume that a control offered by another chatbot exists in DeepSeek.

How are API, managed-workspace and third-party uses different from consumer chat?
“DeepSeek” and “ChatGPT” can refer to several delivery models. Comparing a direct consumer website with an API call made through another application can produce a false conclusion because different contracts and defaults apply.
OpenAI API
OpenAI says API content is not used to train models by default. That default does not remove your responsibility for application logs, prompt storage, debugging tools, backups, analytics vendors or access by your own employees. A developer can retain a prompt in its database even when the model provider does not use it for training.

OpenAI managed workspaces
OpenAI says managed-workspace content is not used to train models by default. Workspace administrators can govern retention, access, memory and compliance settings. An employee’s ability to delete a chat, export data or use a particular model can therefore depend on organization policy rather than the personal ChatGPT controls described for consumer accounts.
DeepSeek open-platform or downstream applications
DeepSeek’s consumer policy is not a substitute for the privacy notice of an application that calls a DeepSeek model. The policy says downstream developers using the open platform are responsible for disclosing their own data processing. Read that developer’s notice, terms, logging practices and deletion process; the developer may store prompts, combine them with account data or send them to additional providers.
Why the distinction matters
Ask four questions for every deployment: Which legal entity receives the prompt? Where is it stored? Is it used for training or service improvement? Who controls deletion and access? If the answer changes between the website, a mobile app and an employer tool, treat them as separate services in your risk assessment.
