There is no universal rule that makes AI training on copyrighted material automatically lawful or unlawful. In the United States, a court would weigh fair-use factors for the particular works, purpose, copying and market effects. In the European Union, commercial text-and-data mining can generally be blocked when a rightsholder makes an appropriate, machine-readable reservation, while providers of general-purpose AI (GPAI) models have copyright-policy and training-content transparency duties from August 2, 2025. Human creative contribution also remains decisive: a prompt by itself does not give you copyright in an output, but perceptible human expression, arrangement or modification can.

This guide separates the U.S. and EU rules, explains what musicians can do to protect catalogs, and gives developers a practical documentation and risk-control workflow.

Can an AI model train on my songs, writing, images or code?

It depends on the jurisdiction, the source material, the way it was obtained, the model’s purpose and the effect on the market. A model developer may copy files into a training corpus, make intermediate copies during preprocessing, and use the resulting parameters to generate outputs. Each stage can raise different copyright and contract questions.

In the United States, no statute or court ruling creates a blanket permission for training on all publicly available works. The U.S. Copyright Office’s AI study treats training as an active policy issue, and litigation is continuing. A 2025 UK government report described more than 70 reportedly commenced U.S. AI copyright cases; that is a reported figure, not an independently verified court count or a prediction of outcomes.

Public availability is not the same as a license. A song posted for streaming, a source repository marked “public,” or an image available without a paywall may still be copyrighted and subject to terms of use. Developers should identify the rightsholder, the access terms and any reservation signal before ingesting material.

Is AI training automatically fair use in the United States?

No. Section 107 is a fact-specific defense. Courts consider four factors together, and no single factor decides every training dispute.

Fair-use factor Questions a court may examine in a training case
Purpose and character Is the use commercial, nonprofit, research-oriented, transformative, or competing with the original service? A commercial product can still make a transformation argument, but commerciality remains relevant.
Nature of the copyrighted work Is the source factual or highly creative, published or unpublished? Songs, novels, photographs and illustrations usually contain substantial creative expression, unlike a purely factual table.
Amount and substantiality How much was copied, and did the copying take the “heart” of a work? A complete file may be copied for computational reasons, yet that does not automatically answer the legal question.
Effect on the potential market Does training or the resulting service substitute for licensed access, reduce demand, interfere with an emerging licensing market, or create a new market without displacing the original?

The Copyright Office’s Fair Use FAQ emphasizes that the factors must be evaluated under all the circumstances. A developer should therefore preserve a written, work-specific analysis rather than labeling an entire dataset “fair use” once and moving on.

Is there a safe number of words, musical notes or files to copy?

No. The Copyright Office states: “There are no legal rules permitting the use of a specific number of words, a certain number of musical notes, or percentage of a work.” Small excerpts can be qualitatively important, while a larger amount may be justified in a particular transformative use; the amount and its significance are only one factor.

For music, do not rely on a rule such as “a few bars are always safe.” Melody, lyrics, distinctive hooks, sound recordings and arrangements can involve separate rights. For software, a short but highly original function or a copied license notice may matter more than thousands of routine lines. Track the source and the reason for each inclusion.

Can I copyright music, images, writing or code made with AI?

In the United States, protection attaches to human authorship, not to the mere fact that a system produced a file. The Copyright Office’s January 29, 2025 report explains that AI-assisted output may be protected when human expressive elements are perceptible or when a person makes creative arrangements or modifications. A prompt alone generally does not establish copyright because it may describe an idea without controlling the expressive details.

What kinds of contribution help establish authorship?

  • Writing original lyrics, melodies, source code, prose or visual elements that remain perceptible in the final work.
  • Selecting, sequencing and arranging generated components in a creative way.
  • Making detailed edits, rewrites, sound-design decisions, compositing choices or code refactoring that shape the final expression.
  • Combining generated material with independently authored material so the human-authored portions and the creative selection are identifiable.

Keep dated drafts, stems, project files, source-code commits, prompts, model and version information, edit histories and notes describing your decisions. When registering or licensing a work, identify AI-assisted portions accurately and claim only the human-authored expression. A record does not guarantee registration or litigation success, but it makes your contribution easier to prove.

What should I do if an AI output resembles my song, lyric, image or code?

Do not distribute the output immediately. A resemblance can result from coincidence, common genre conventions, memorization or unauthorized copying, and the legal analysis depends on the protected elements and the source.

  1. Preserve evidence. Save the exact prompt, output files, timestamps, model name and version, account settings, and any repeat generations. Keep the original work, drafts and registration or publication records.
  2. Compare protected expression. For music, compare melody, lyrics, arrangement and recording elements separately. For code, identify distinctive structure, comments, naming patterns and license text rather than relying on a similar idea or function.
  3. Investigate provenance. Check whether the output appears to reproduce a known work, whether the system offers a memorization or attribution report, and whether your material was in a documented training set.
  4. Pause publication and seek advice. The Copyright Office FAQ notes that unauthorized use may support an infringement action and recommends consulting an attorney when in doubt. A lawyer can assess substantial similarity, defenses, contracts and the appropriate notice or licensing strategy.

Do not assume that deleting a prompt, changing a file name or adding an AI disclosure cures a possible infringement. Those steps may help preserve records but do not decide liability.

How can an EU creator opt out of commercial text-and-data mining?

EU copyright rules allow rightsholders to reserve rights against commercial text-and-data mining (TDM) in an appropriate manner, including machine-readable methods. If a reservation is properly expressed, a developer generally needs authorization, such as a license, to use the reserved material.

Practical reservation checklist

  • Use a clear rights-reservation statement on the page or in the repository terms.
  • Publish the reservation in a machine-readable form that automated crawlers can detect, where the platform supports that method.
  • Apply the reservation consistently to mirrors, feeds, downloads and major catalogues; a notice on one copy may not reach every copy.
  • Keep dated records of the notice, the URL or repository location, and any subsequent changes.
  • Specify a licensing contact or route if you are willing to authorize particular uses.

An opt-out is not a guarantee that material already ingested has been removed from a trained model. Ask the provider what data was collected, whether it can be deleted, and whether retraining or a corrective process is available. The exact effect of a reservation can depend on how it was implemented and on national law, so obtain local advice for disputed cases.

What must EU GPAI providers disclose?

From August 2, 2025, providers of general-purpose AI models in the EU must meet copyright-related obligations listed by the European Commission. They must maintain a copyright-compliance policy that respects rights reservations and publish a sufficiently detailed summary of the model’s training content. They also have technical-documentation and downstream-information duties.

A useful public summary should let a rightsholder understand broad data categories, sources and collection practices without exposing security-sensitive details or every individual training record. “We used the internet” is unlikely to be a sufficiently detailed operational description. Providers should also maintain internal records linking datasets to licenses, reservations, processing dates and model versions so they can answer regulator, customer and rightsholder questions.

How should developers build a defensible training-data workflow?

Use the following sequence for each dataset and each model release. It is a governance process, not a guarantee that a court will find the training lawful.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Define the use. Record the model’s purpose, users, territory, commercial status, expected outputs and whether the system could substitute for the source market.
  2. Map provenance. For every source, record who supplied it, the original URL or repository, acquisition date, chain of title where known, and whether the material is licensed, public-domain or merely publicly accessible.
  3. Read the terms. Capture license scope, attribution and share-alike requirements, commercial restrictions, territorial limits, API rules, and prohibitions on automated collection.
  4. Capture reservations. Store crawler directives, page-level notices, repository metadata and other opt-out signals at collection time. Do not silently treat a missing signal as consent.
  5. Choose a response. Exclude the material, obtain a license, narrow the use, or document a jurisdiction-specific legal analysis. Escalate high-value creative catalogs to counsel.
  6. Control memorization. Deduplicate files, test for near-verbatim regeneration, apply filtering and output monitoring, and document remediation when a test exposes memorization.
  7. Version and audit. Link each dataset snapshot to the model version trained on it. Keep deletion and retraining procedures that can be executed when a license ends or a valid request is received.
  8. Prepare disclosures. Maintain a public-facing training summary and technical documentation consistent with applicable EU duties, customer contracts and confidentiality limits.

These controls also make it easier to answer a creator’s specific question: whether a work was collected, under what terms, and which model version used it.

How can musicians and songwriters protect a catalog?

Start with an inventory of compositions, lyrics, sound recordings, artwork and session files. Record ownership splits, publishers, labels, co-writers, registration numbers and license territories. Distinguish the musical composition from the sound recording because they can have different owners and permissions.

Next, publish clear terms on official sites and repositories, use machine-readable reservations where EU commercial TDM rules apply, and monitor unusual AI-generated releases that imitate distinctive material. Keep high-resolution masters and dated sessions in controlled storage, and preserve evidence of public release dates. If you license data, specify whether model training, fine-tuning, retrieval, output imitation and redistribution are each allowed; “AI use” is too vague for a catalog agreement.

When a service offers a removal or opt-out form, submit the request with URLs, ownership evidence and the exact work identifiers, then retain confirmation. Ask whether the provider will stop future collection, delete stored copies, prevent retrieval, or retrain a model; these are different remedies.

How do licensed, open and scraped datasets compare?

The label on a dataset is less important than its documented rights and controls. Evaluate each option against the same operational axes.

Dataset source Provenance and license Reservations and disclosure Output and operational risk
Licensed dataset Usually offers the clearest chain of title and defined territory, term, attribution and model-training rights; verify exclusions and sublicensing. Contract terms can specify opt-outs, reporting and audit rights, making a training summary easier to prepare. Lower uncertainty when the license is precise, but memorization, breach of scope and renewal or deletion duties still require testing.
Open dataset “Open” may mean public-domain material, a permissive license or a license with attribution and share-alike conditions. Confirm each item and the dataset curator’s authority. Check embedded rights reservations and whether the license permits commercial training and redistribution. Mixed provenance can create hidden exclusions; maintain item-level records and an exclusion pipeline.
Scraped web data Often has the weakest chain of title and may conflict with site terms, paywalls, robots directives or creator reservations. Capturing and honoring machine-readable reservations is essential in the EU; public disclosure may be difficult without reliable source records. Highest uncertainty about infringement, substitution, memorization and deletion or retraining requests.

Why is the legal landscape still unsettled?

The U.S. Copyright Office received more than 10,000 comments in its 2023 AI initiative, reflecting competing views from creators, technology companies and researchers. Courts are deciding disputes under existing doctrines while policymakers consider whether additional rules are needed. A favorable result in one case may turn on a particular dataset, purpose, model architecture or market record and should not be generalized to every system.

Scale increases the stakes. The Copyright Office’s 2025 Part 2 report cites a Universal Music Group estimate of 170 million AI-generated music tracks. This is an attributed industry estimate, not a government count; it is relevant to concerns about royalty dilution and substitution, not proof that any particular training use is infringing.

For both sides, the safest strategy is specificity: identify the work, jurisdiction, legal basis, permissions, reservation signals, model version and proposed remedy. When those facts are disputed or commercially important, obtain advice from a qualified copyright lawyer in the relevant country.

Frequently Asked Questions

Does putting a song online mean an AI company can use it for free?

No. Online access does not erase copyright, contract terms or a creator’s reservation of rights. A company still needs a defensible legal basis, such as a license or an applicable exception, for the way it copies and trains on the work.

Can I claim copyright in an AI-generated track if I only wrote the prompt?

A prompt alone normally does not establish authorship of the resulting expressive details. You may have protectable rights in your own lyrics, melody, edits, arrangement or other human-authored elements that are perceptible in the finished track.

Will an EU opt-out remove my song from a model that already trained on it?

Not necessarily. A reservation generally governs future commercial text-and-data mining; it does not automatically reverse prior ingestion or alter model parameters. Ask the provider about deletion, suppression and retraining procedures and document the response.

What records should a small developer keep before releasing a model?

Keep dataset source and access records, licenses, reservation signals, processing dates, exclusions, model-version links, memorization tests and remediation decisions. Retain enough detail to explain what was used, under which terms and how a valid deletion or audit request would be handled.
