Yes, conditionally. Unreal Engine’s EULA generally permits you to develop and distribute a game, including one made with generative-AI assistance. Publication still depends on clearing rights for every included asset, following the EULA’s distribution rules, meeting the destination storefront’s current disclosure requirements, and documenting enough human authorship to support any copyright claim. If you upload materially AI-generated assets or plugins to Fab, Epic’s Marketplace Distribution Agreement requires the CreatedWithAI tag. The same agreement also makes you responsible for ensuring that your submission does not infringe copyright, trademark, publicity, privacy, trade-secret, or other rights.
Is a game made with generative AI allowed under the Unreal Engine EULA?
In general, yes. Epic’s Unreal Engine EULA says that you own all rights, other than rights in the licensed technology, in the products you develop under the agreement. That ownership statement does not give you permission to use someone else’s material, waive platform rules, or guarantee copyright protection for content generated without sufficient human creativity.
As an Amazon Associate I earn from qualifying purchases.
A commercial release must therefore satisfy several separate conditions:
- The project must qualify as a permitted product under the EULA’s distribution provisions.
- You must have the rights needed to distribute every piece of content in the build.
- Your use of Unreal Engine and any Epic-provided content must stay within the applicable licenses.
- The release must comply with the law and the submission rules of the storefront or platform where you publish.
Epic marketplace content is a separate category. Assets obtained through Epic-operated marketplaces, including Fab, are licensed under their own content terms; they are not automatically covered by the engine EULA’s ownership language. Read the license attached to each asset before modifying it, bundling it, or distributing it in a game.

What does “owning the product” actually cover?
It covers the rights you have in the original game material you create, subject to the license for Unreal’s technology. It does not transfer ownership of a model downloaded from a third party, a voice copied from a performer, a trademark placed in a scene, or a data set used by an AI service. Your chain of title must be assembled asset by asset.
What rights must you clear before releasing an AI-assisted game?
Clearance is the practical bottleneck. Treat every generated or imported element as a rights question, not merely a file-format question.
AI-generated art, models, textures, and animation
Save the AI service’s commercial-use and redistribution terms that applied when each asset was created. Check whether the service limits use in games, requires attribution, reserves rights in outputs, or excludes outputs that resemble third-party works. Keep the prompts, source images, model or version information, and the final edited files so you can explain how the asset was produced.
Music and sound effects
Music licenses often distinguish between personal use, commercial games, trailers, streaming, and sublicensing. A license that permits a video on your own channel may not permit embedding the track in a game sold to customers. Confirm synchronization, distribution, performance, and territory rights, and obtain separate permission when a recognizable performer’s voice is involved.

Voices, faces, and likenesses
A generated voice or face can implicate publicity, privacy, contract, and consumer-protection laws even when no pixel or waveform was copied directly. Do not use a recognizable person’s likeness or vocal identity without documented permission covering game distribution, marketing, updates, and user-generated contexts. Epic’s IP guidance warns that an unauthorized recreation of a character, logo, or likeness can violate ecosystem rules even if the uploader made the recreation themselves.
Trademarks, fictional characters, and recognizable designs
Prompts such as “make a character like” a known franchise can produce material that is confusingly similar to protected characters, logos, costumes, or trade dress. Replace or redesign anything recognizable unless you have a license. This applies to background posters, UI icons, billboards, easter eggs, and marketing screenshots as well as the main character.
Code, plugins, and data
Inventory generated code and every external dependency. Open-source licenses can impose notice, source-distribution, or copyleft obligations; a plugin’s license may restrict redistribution in a packaged game. Also check whether training data, confidential documents, customer information, or proprietary Unreal project files were sent to an AI service. You need permission to use those inputs and must comply with any confidentiality commitments.
Does Epic allow Unreal Engine content to be used as AI training data?
No. The Unreal Engine EULA prohibits using Unreal Engine as training input for a generative-AI program. It also covers prompt-based input where the program trains on that input. In practical terms, do not feed Unreal project files, editor content, or other restricted engine material into a service that uses submitted prompts or files to train its model.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
This restriction is separate from whether an AI service allows commercial output. A service can grant you a commercial-use license while your particular input still violates the Unreal EULA or another confidentiality agreement. Configure opt-out or non-training settings where available, but do not assume a setting cures an otherwise prohibited use; verify the current terms for the service and your Unreal license.
When is the CreatedWithAI tag required on Fab?
Epic’s Marketplace Distribution Agreement requires the CreatedWithAI tag when a material portion of submitted content was created with a generative-AI program. The agreement gives characters, backgrounds, and other material elements as examples. The obligation concerns content you upload to Fab, such as an asset pack or plugin, rather than an automatic label applied to every game that happens to use Unreal.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
| Content or process | Fab treatment | What to document |
|---|---|---|
| Material character, environment, texture, sound, or other element generated by an AI program | Apply the CreatedWithAI tag when the generated portion is material to the submission. | Tool, model or version, prompts or inputs, edits, and the files included in the listing. |
| Minor AI assistance that does not materially create the submitted element | Assess the agreement’s materiality standard and describe the workflow accurately; do not omit a required tag. | What the AI changed and what a human created or supplied. |
| Ordinary non-generative processing, such as image upscaling | The agreement treats this differently from generative creation; an upscaler alone is not the same as generating a new asset. | Tool settings and the original source file, so the distinction is demonstrable. |
You also warrant that you have the intellectual-property rights needed to distribute the submission and that it does not infringe copyright, trademark, trade-secret, publicity, privacy, or other rights. A truthful tag does not cure infringement, and omitting a required tag can create a separate marketplace-compliance problem.
Can you copyright a game made with generative AI?
In the United States, copyright protection turns on human-authored expression and the degree of human control over the final result. The U.S. Copyright Office’s Part 2 report, issued January 29, 2025, says that AI-assisted outputs can be protected when a person determines sufficient expressive elements, including through creative selection, arrangement, or modifications. Purely AI-generated material, or material produced without sufficient human control, is not protected merely because you typed the prompt.

What kinds of human contribution help?
- Designing the game’s original characters, levels, dialogue, rules, and visual direction.
- Selecting and arranging generated components into a creative composition.
- Making substantial edits to meshes, textures, animation, audio, or writing.
- Combining generated pieces with human-authored material in an original sequence or interactive system.
The Office says prompts alone generally do not provide sufficient control, and the analysis is case by case. Keep layered source files, iteration history, edit records, and approvals that show your decisions. Those records do not guarantee registration, but they make it easier to identify which parts contain protectable human expression and to answer a challenge about authorship.
The Office reported receiving more than 10,000 comments on its AI notice of inquiry by December 2023. That figure measures public input, not the percentage of AI games that qualify for copyright, so it should not be treated as a success rate or a legal presumption.

How should you prepare an AI-assisted Unreal game for release?
Use a release file that connects each shipped asset to its creator, license, and approval. Follow this sequence before you submit a build.
- Read the current Unreal EULA. Identify whether your game is a Product under the distribution provisions and note any restrictions that apply to the engine, editor content, or services.
- Inventory the project. List every AI service, model, plugin, dataset, marketplace asset, sound, font, code library, voice, likeness, trademark, and external file used in development or marketing.
- Capture the governing terms. Save the commercial-use, attribution, redistribution, data-use, and termination terms for each AI service and asset license as they existed when you created or downloaded the material.
- Review inputs as well as outputs. Remove confidential documents, personal data, copyrighted references, and restricted Unreal content from prompts or uploads unless you have explicit permission and the workflow is permitted.
- Run a similarity and rights review. Inspect characters, logos, music, voices, scripts, and environments for recognizable third-party material. Replace questionable elements instead of relying on a disclaimer.
- Preserve human-authorship evidence. Keep source files, version history, prompt logs, edit passes, layout decisions, and written approvals that show your creative selection and modifications.
- Apply Fab disclosure when applicable. If you are listing an asset or plugin and a material portion was generated by AI, select the CreatedWithAI tag and make the listing description accurate.
- Check the destination storefront. Review the platform’s current AI disclosure form, prohibited-content rules, privacy requirements, ratings process, and update policy immediately before submission.
- Obtain a legal review for high-risk material. Consult qualified counsel about music, likenesses, training data, open-source code, employment-created content, and the laws of each important market.
Which AI workflow is safest for a commercial Unreal project?
No workflow eliminates legal risk, but comparing workflows with the same criteria exposes weak links before launch.
Best Value
| Evaluation axis | Questions to answer | Warning signs |
|---|---|---|
| Commercial-use and redistribution rights | Does the service permit commercial games, sublicensing to players, updates, trailers, and platform distribution? | Personal-use language, unclear output ownership, or a license that can be revoked without a transition period. |
| Provenance and documentation | Can you record the model, version, inputs, prompts, edits, and approvals? | Opaque generations, missing model information, or no way to export source history. |
| Third-party likeness or protected material | Could the output identify a real person, franchise, logo, song, or artist’s distinctive style? | Named-character prompts, voice cloning, or outputs that remain recognizable after light editing. |
| Human editorial control | Can your team demonstrate creative selection, arrangement, and modifications? | A one-click output shipped unchanged with no meaningful human contribution. |
| Runtime and platform constraints | Will generated assets meet memory, licensing, performance, accessibility, and platform-certification requirements? | Excessive texture sizes, unstable generated code, or assets that fail target-device testing. |
| Disclosure obligations | Do Fab and the chosen storefront require a tag, form, or other notice? | Assuming one platform’s disclosure rule applies everywhere. |
What can go wrong after launch?
Rights problems can surface through a takedown, a marketplace review, a platform complaint, or a customer report. Maintain a response plan: identify the affected asset, pause further distribution if necessary, preserve the relevant records, contact the licensor or claimant, and replace or remove the asset in a controlled update. Keep a manifest so you know which builds, trailers, downloadable content, and marketplace listings contain it.
Terms can change after generation. Retain a dated copy of the applicable AI-service, asset, Unreal, Fab, and storefront terms, then re-check them before major updates or a new regional release. A permissive term at creation does not automatically answer whether a later update, transfer, or new use is allowed.
What is the practical answer for an independent developer?
You can publish an AI-assisted Unreal game when you can show three things: the Unreal license permits your distribution, you have rights to every included element, and you have followed the disclosure rules of each place where you submit content. Use AI as part of a documented human-directed workflow, avoid feeding restricted Unreal material into training systems, tag materially AI-generated Fab submissions, and treat copyright as limited to the human expression you actually contributed.
Frequently Asked Questions
Does the CreatedWithAI tag apply to a finished game sold on a storefront?
The cited Fab agreement makes the tag requirement for content submitted to Fab, such as an asset pack or plugin. A finished game submitted elsewhere may be governed by a different disclosure form or no AI-specific form at all, so check that storefront’s rules rather than assuming the Fab label transfers.
Can I rely on an AI provider’s promise that its outputs are safe to use?
No. A provider’s warranty does not replace your review for recognizable people, trademarks, copyrighted references, privacy issues, or conflicting input licenses. Keep the provider’s terms and investigate each high-risk output before shipping.
What records should I keep if I may seek U.S. copyright registration?
Keep dated project files, edit layers, version-control history, prompt and input logs, and notes identifying the human decisions that shaped the final work. Separate unchanged machine output from your revisions so you can describe the human-authored portions accurately.
Is AI upscaling treated the same as generating a new texture?
Epic’s marketplace agreement distinguishes ordinary non-generative processing, such as upscaling, from generative creation. Preserve the original image and the processing settings, and reassess the tag if the tool adds or materially invents content rather than merely enlarging or cleaning the source.
