Sometimes—but commercial permission and copyright ownership are separate questions. A game studio may be allowed by an AI service’s contract to put an output in a paid game even when U.S. copyright law does not protect the machine-generated expression itself. Human-written, painted, arranged, or otherwise creative contributions may be protectable, while a prompt alone generally is not enough. Before shipping, check the law in the countries where you will distribute the game and the exact terms for the tool, plan, and feature used to create each asset.

The safest workflow is asset-by-asset: record what the system generated, identify your human contribution, verify commercial-use permission, screen inputs and outputs for third-party rights, and preserve the project files that show your creative decisions.

What does “commercial use” mean for an AI-generated game asset?

Commercial use is a permission granted by a contract, not a ruling that an asset is copyrighted or free of infringement risk. If a service’s terms permit commercial use, you may be able to include the output in a game sold for money, used in advertising, or distributed through a platform, subject to that agreement and any exceptions. The same output may still be non-copyrightable, non-unique, or risky if it copies someone else’s work.

Keep three questions separate:

  • May you use it? The service contract, your plan, and feature-specific rules answer this.
  • Can you stop others copying it? Copyright law answers whether the asset contains protectable human authorship.
  • Could someone else claim rights? Inputs, references, recognizable people, trademarks, characters, music, and similar material can create separate legal issues.

A “commercial-use” label therefore should be treated as one clearance step, not as a warranty of exclusivity, originality, or non-infringement.

What is the U.S. copyright position on AI-generated game assets?

As of the U.S. Copyright Office’s January 29, 2025 statement, an output is protectable only when a human author determines sufficient expressive elements. The Office says a prompt by itself does not supply those expressive elements. It also confirms that using AI as an assistive tool, or including AI-generated material in a larger human-created work, does not automatically block copyright.

That principle can produce different results for different parts of one game. A raw generated icon, texture, voice line, or 3D model may contain little or no protectable human expression. A designer’s original paint-over, a deliberately authored animation, or a creative selection and arrangement of many generated elements may contain protectable authorship. The completed game can also include copyrightable human code, writing, art, music, level design, and editing even if some components came from a model.

There is no published “edit this many pixels” or “write this many prompts” threshold that guarantees protection. The relevant question is what expressive choices a person actually made and how those choices appear in the finished work. Copyright protects original expression fixed in a tangible medium, including pictorial, graphic, sculptural, and audiovisual works; it does not protect ideas, systems, or methods of operation.

How common asset types can differ

Asset or contribution What to examine Likely rights question
Unedited generated texture or concept image Was the result selected with meaningful creative judgment, or merely accepted? The service may permit use, but the machine-generated expression may not receive U.S. copyright protection.
Human-painted revision Which visible strokes, shapes, colors, and details were created by the artist? Those human-authored additions may be protectable; the underlying generated material may not be.
Character sheet assembled from outputs Did a person make a creative selection, sequencing, and visual arrangement? The arrangement can qualify even if individual generated elements do not.
Human-written animation, shader, or tool script Who authored the code and timing decisions? Original human code and audiovisual expression may be protected independently of generated imagery.
Finished game containing AI material How much of the game’s code, art direction, writing, editing, and structure is human-authored? AI inclusion does not automatically disqualify the larger human-generated work.

Do a tool’s terms give me ownership or only permission?

Terms differ by service, plan, and feature, and they can change. Read the agreement that applied when the asset was generated, not just a marketing page you saw later. Look for ownership language qualified by “to the fullest extent possible under applicable law,” commercial-use limits, beta restrictions, input rules, publication settings, and responsibility for claims.

Adobe generative features

Adobe’s user guidance generally allows commercial use of outputs from its generative AI features. It also says a beta feature can be designated personal-use-only; its Firefly FAQ states that non-beta features may be used commercially and that beta features may be used commercially unless the product expressly says otherwise. Because the product label and agreement control, record the feature name and status at the time you create the asset. Material embedded from a non-generative source can remain subject to separate terms.

Product-specific terms effective April 23, 2026 place responsibility for inputs and outputs on the user. They warn that outputs may be unexpected, non-unique, or not protectable by intellectual-property rights, and disclaim warranties that an output will not violate third-party rights or law. These clauses are contractual risk allocations; they do not decide whether a particular image infringes.

Midjourney

Midjourney’s terms say users own assets “to the fullest extent possible under applicable law,” subject to the agreement and third-party rights. Companies, or employees of companies, with annual revenue above $1 million must subscribe to the Pro or Mega plan to own assets under those terms. The service also says users are responsible for content they provide or generate.

Its commercial-use help guidance adds an important ownership complication: an image upscaled from another user remains that original creator’s image. Do not assume that downloading, remixing, or upscaling a publicly visible result transfers rights to your studio.

A practical comparison checklist

  • Is commercial use allowed for this exact feature and plan?
  • Does a beta, preview, education, or free-tier exception apply?
  • Does the ownership promise depend on applicable law, revenue, subscription level, or account type?
  • Who is responsible for prompts, uploaded references, and generated outputs?
  • Does public posting let other users view, remix, or reuse the asset?
  • Is indemnity offered, and what exclusions or caps apply?
  • Does the contract acknowledge that outputs may be non-unique or unprotectable?

How should a studio clear an AI-generated asset before shipping?

Use the following process for every material asset, especially hero art, logos, character likenesses, music, voices, and promotional images.

  1. Inventory the asset. Give it an identifier and note its type, creator account, tool, model or feature, plan, generation date, and where it appears in the game.
  2. Describe the human contribution. Save the prompt, but also record selection among alternatives, compositing, paint-over work, modeling, retopology, rigging, editing, timing, writing, and other expressive decisions. Do not claim that a particular amount of editing guarantees copyright.
  3. Capture the applicable terms. Save a dated copy or export of the service terms, feature guidance, and plan status. Confirm whether the asset was generated during a beta or under a restriction that later changed.
  4. Audit inputs. Do not upload artwork, photographs, scans, voices, code, or confidential client material unless you have permission and the service allows that use. Check prompts for living artists’ names, copyrighted characters, logos, celebrity likenesses, and other references that could create separate claims.
  5. Inspect the output. Look for recognizable people, trademarks, copied characters, watermarks, signatures, distinctive costumes, text fragments, or accidental near-duplicates. A service’s commercial-use permission does not replace this review.
  6. Check publication and remix settings. Determine whether posting to a public gallery exposes the asset, permits other users to remix it, or affects confidentiality. Use private-generation settings where the contract offers them and your production needs secrecy.
  7. Build human-authored layers. Where practical, have artists create original paint, layout, modeling, animation, writing, or compositing that gives the final asset identifiable human expression. Keep the source layers rather than flattening everything into one export.
  8. Record territory and platform requirements. List the countries where the game will be sold and check local copyright rules, consumer disclosures, marketplace policies, and any contract obligations before launch.
  9. Escalate unusual assets. Ask qualified counsel to review celebrity likenesses, voices, real-world brands, licensed references, employee-created material, or an asset central to the game’s identity.

What records should I keep for copyright registration?

For U.S. registration, the Copyright Office position summarized in a 2026 UK government report is that an application for a work containing more than a de minimis amount of AI-generated material should disclose that material and describe the human author’s contribution. Treat disclosure as part of your registration planning rather than waiting until an application is filed.

Preserve prompts and outputs, but also retain dated source files, edit layers, version history, rejected alternatives, layout boards, model sheets, scripts, and notes explaining why particular elements were selected or changed. These records help identify the human-authored portion, support chain-of-title reviews, and let a future team reproduce the decision if a vendor changes its interface or terms. Maintaining them is practical risk management; the cited guidance does not establish that every listed record is legally mandatory.

What third-party rights can still affect a commercially usable output?

Copyright is only one layer. A generated image can raise publicity or privacy rights if it depicts a recognizable person, trademark issues if it reproduces a logo or trade dress, and contract issues if an uploaded reference belonged to someone else. Voices and likenesses can be particularly sensitive because a person may object even when the output is not a close copy of a copyrighted work.

Inputs matter as much as outputs. If an employee uploads concept art from a client, a freelancer, or a licensed asset library, verify that the license permits AI processing and commercial game use. Keep proof of those permissions with the asset record. Do not rely on a vendor’s statement that it will handle all claims when its terms place responsibility for inputs and outputs on you.

Does including AI material jeopardize copyright in the whole game?

No. The U.S. Copyright Office specifically says that AI assistance or inclusion of AI-generated material in a larger human-generated work does not bar copyrightability. A game can contain uncopyrightable generated fragments alongside protectable human code, writing, art direction, level structure, editing, and arrangement.

Registration and enforcement still require accurate identification of what was human-authored. Avoid presenting a raw machine output as entirely your own original authorship. In contracts with publishers, co-developers, or licensors, define which assets contain AI-generated material, who cleared the inputs, and who bears the risk if a claim arises.

How do U.S., UK, and EU considerations differ?

The detailed guidance above is U.S.-centered. Other jurisdictions may classify computer-generated or AI-assisted works differently, and the available data does not establish a complete country-by-country rule. If your game will be distributed internationally, identify the territories first and obtain jurisdiction-specific advice for ownership, moral rights, database rights, publicity rights, and disclosure obligations.

Do not infer worldwide permission from a U.S. copyright analysis or from a vendor contract written for a global service. Contractual commercial permission may travel with the account, but statutory rights and remedies are territorial.

What are the most common mistakes?

  • Confusing “commercial use allowed” with “copyright owned.” Permission to ship does not guarantee exclusive rights.
  • Assuming prompts are authorship. The U.S. Copyright Office says prompts alone do not provide the required expressive elements.
  • Ignoring plan and beta details. The same product can have different rules by feature, subscription, or release status.
  • Publishing first and checking privacy later. Public galleries and remix functions can expose work or affect control over it.
  • Uploading unlicensed references. A lawful game license does not automatically authorize AI processing of every source file.
  • Flattening the evidence. Without layers and version history, it becomes harder to show what a human created.
  • Making a global claim from U.S. law. Distribution territories can change the analysis.

What should a small team put in its production policy?

A short written policy can prevent inconsistent decisions. Require an asset register, named approver, dated terms capture, input-rights confirmation, output screening, and a statement of human contributions. Set a higher review threshold for logos, key art, character likenesses, voices, music, and assets used in advertising.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Specify who may use public-generation features, whether confidential material is prohibited, how long records are retained, and when legal review is mandatory. Add a contract clause requiring contractors to disclose AI use and deliver the source layers and permissions they relied on. This turns an informal tool choice into a traceable chain of title.

Frequently Asked Questions

Can I sell an AI-generated asset pack separately from my game?

Only if the service terms allow that type of redistribution and your plan covers it. Selling a pack does not create copyright in machine-generated expression, so describe your human-authored additions accurately and avoid promising exclusivity you cannot establish.

Do I have to tell players that a game contains AI-generated art?

There is no single worldwide disclosure rule established by the cited guidance. Check the laws, storefront policies, platform contracts, funding conditions, and consumer-protection rules in each distribution territory; keep an internal disclosure record even where public labeling is not required.

What happens if the AI service changes its terms after I ship?

The agreement in effect when an asset was generated may control that asset, but later updates can affect continued services, public hosting, or new uses. Keep dated copies of the terms and confirm that your planned post-launch edits, ports, and marketing uses remain permitted.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a freelancer’s AI-generated asset be transferred to my studio?

A freelancer can assign whatever rights they actually hold, but an assignment cannot create copyright in material that law does not protect or override the AI service’s restrictions. Require the freelancer to identify the tool and plan, provide source records, confirm input permissions, and warrant that any human-authored additions are assigned to the studio.

Should I register every individual generated texture?

Usually the more useful question is whether the game, asset collection, or human-authored arrangement contains protectable expression worth registering. Discuss grouping and deposit strategy with a copyright professional, and disclose more-than-de-minimis AI material and the human contribution when required by the application process.
