Before shipping a game feature that uses generative AI, answer four separate questions: whether the inputs and model use are permitted, what human expression in the output may be protected, whether a person has consented to any digital replica, and what must be disclosed to a registration authority, storefront, or player. A tool license does not settle those questions, and a single “AI used” notice does not answer them all. The right answer depends on the material, the feature, the contracts, and where the game is offered.
This is a pre-release decision guide, not a universal legal-clearance checklist. Treat the U.S. Copyright Office’s AI reports as agency analysis rather than court rulings, and distinguish enacted rules from policy requests: the European Parliament’s March 2026 resolution calls for further action but is not itself a binding game-label requirement.

What should a studio decide before release?
Make decisions in production order: identify what enters the system, document who shaped each shipped asset, check whether a person’s identity or performance is replicated, then assess what players and relevant institutions need to be told. Finally, map each answer to the jurisdictions, storefronts, and agreements that actually apply to the release.
These questions overlap in a production pipeline, but none substitutes for another. Permission to use training material does not establish copyright in generated output. A copyright claim does not prove that a performer agreed to a voice replica. A storefront survey is not player-facing disclosure, and neither is a U.S. copyright registration statement.

What material enters the AI system?
Start with an inventory of the inputs for each tool and feature. Include reference art, scripts, music, voice recordings, code, player submissions, and any fine-tuning dataset—not just the prompt a developer types. Record each item’s source, applicable permissions and restrictions, and the model or vendor terms that apply to that specific use.
Separate access from permission
Public availability is not automatic clearance for training, but it is also not proof that every training use infringes. The U.S. Copyright Office describes the fair-use analysis as fact-specific. Its analysis identifies relevant considerations such as which works were used and where they came from, the purpose of the use, controls on outputs, and effects on markets for the works. It cautions against prejudging a particular fair-use case and notes that licensing markets are unevenly developed.
That leaves the studio with a project-specific question, not a universal yes or no. Ask counsel to assess the actual material, source, purpose, and output controls. Keep evidence of provenance and the terms in force when the material was used; a general tool license does not by itself answer whether particular inputs could be used for training or fine-tuning.
Track changes in use
An input collected for internal prototyping may later be proposed for a shipped feature or a different model workflow. Record intended use alongside provenance so a change can trigger a fresh rights review. For player submissions, make the product’s collection and reuse terms part of that review rather than assuming that submitting content gives the studio unrestricted training rights.
Can I copyright AI-generated game art?
In the United States, AI-assisted work may contain copyrightable human expression, but a prompt alone does not establish human authorship of expression determined by the model. The U.S. Copyright Office’s January 2025 analysis recognizes protection when a human determines sufficient expressive elements; whether that standard is met depends on the asset and the human contribution.
Distinguish assistance from authorship
For each shipped asset—art, dialogue, audio, localization, or code—record what the model supplied and what a person contributed. A developer may have selected and arranged outputs, rewritten dialogue, modified an image, or made other expressive choices. Those contributions matter to the authorship analysis; merely describing a desired result in a prompt does not make the model’s resulting expression human-authored.

The practical question is not whether a project used AI somewhere, but which expression a person actually determined. Keep source files, meaningful revision history, selection and arrangement records, and notes identifying human-written or human-edited portions. These records help explain the claimed human contribution without promising that a particular asset qualifies.
What if the studio registers a work?
For a U.S. registration application, Copyright Office guidance instructs applicants to describe human contributions and exclude more-than-de-minimis AI-generated content from the claim. That is a disclosure and claim-scoping task, distinct from whether the studio had permission to use its inputs. Assess the work and the application rather than making a blanket claim about every AI-assisted asset in the game.
As Register of Copyrights and Copyright Office Director Shira Perlmutter put it in the Office’s January 29, 2025 announcement, “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection.” The surrounding distinction is essential: the protection rests on human creativity, not on the mere use of a generative tool.
Can we train an NPC on copyrighted dialogue?
There is no automatic fair-use answer that applies to every NPC-training setup. The Copyright Office’s discussion points to a fact-dependent assessment of the works, their source, the training purpose, output controls, and possible market effects; its report is agency analysis, not a court decision that clears a particular game.

Describe the proposed use precisely: what dialogue is included, how it was obtained, whether it is used for training or another purpose, what the NPC can generate, and what controls constrain output. Then have counsel assess that specific setup and the applicable contracts. Do not infer permission from the fact that dialogue can be found online, or infer infringement solely from the fact that copyrighted dialogue was involved.
Do voice actors have to consent to AI voices?
For work covered by SAG-AFTRA’s 2025 Interactive Media Agreement, the union’s FAQ describes a consent process tied to a reasonably specific account of intended use. It is not a universal rule for every actor or game: verify whether the performer and production are covered and consult the actual agreement.

Match consent to the proposed use
Document whose voice, face, motion, or other performance is involved; the role and project; and what the replica will do. Under the cited agreement, the FAQ says the intended-use description includes project and role information and whether dialogue will be generated in real time. Check whether the agreed scope covers the contemplated dialogue, distribution, and later use rather than treating a general permission as blanket approval.
Reassess when the feature changes
A consent description that fits one use may not fit a materially different one, such as a new role, project, or real-time generation feature. SAG-AFTRA says consent under the agreement can cease to authorize a use that no longer matches the reasonably specific description. Its FAQ also discusses strike-related suspension. Do not turn those agreement-specific points into a claim that every consent is freely revocable at any time; the applicable contract and circumstances matter.

Steam’s Content Survey distinguishes between pre-generated AI content and content generated while a game runs. It asks about AI-generated content that players consume, including live-generated output; developers using live generation are asked to describe safeguards against illegal content.
Classify assets by what reaches the player, not simply by whether someone in development used an AI tool. Internal assistance and player-consumed artwork, sound, narrative, or localization are different categories for this purpose. For live generation, describe the feature’s actual controls: how prompts and player input are handled, what refusals or moderation occur, and how a problematic output is escalated. These are implementation questions, not proof that any particular safeguard is legally sufficient.
Completing a Steam survey does not authorize infringing content. Keep the storefront response separate from the rights review, performer agreements, any U.S. registration disclosures, and player-facing notices. Check Steam’s current survey wording before submission, since storefront requirements can change.
Does the EU require an AI label in games?
No blanket rule requires every AI-assisted game asset to carry a player-facing label. Under Article 50 of the EU AI Act, duties differ for providers and deployers and depend on the feature and output: relevant obligations address direct AI interactions, machine-readable marking of covered synthetic output, and disclosure of qualifying deepfakes. Article 50 has applied since August 2, 2026.

Identify the role and the trigger
For each feature offered in the EU, determine whether the studio is a provider, a deployer, or both, and whether a player directly interacts with an AI system. Do not assume that a fictional character is automatically a deepfake. Assess whether the particular image, audio, or video meets the Act’s deepfake criteria before deciding whether a disclosure obligation applies.
Make an applicable disclosure usable
For qualifying deepfakes, the Commission says an applicable human-facing disclosure cannot be satisfied merely by embedding a machine-readable mark. The Act’s creative- and fictional-work provision affects the manner of an applicable disclosure; it does not erase the obligation. Where a fictional work includes a qualifying deepfake, the disclosure should be appropriate to the context and need not impede enjoyment of the work.
A limited transition runs through December 2, 2026 for the specified marking obligation for qualifying systems placed on the market or put into service before August 2, 2026. It is not a general extension for every Article 50 notice. The European Parliament’s March 2026 resolution asks for further action; it is a resolution, not itself a new binding requirement to label every AI asset. Check the current Act, Commission guidance, and the studio’s role before release.
What should players see, and when?
Write notices for the features that actually exist, and decide where they appear in the player journey. A live NPC conversation, a fixed generated image, and background development assistance are not interchangeable. The relevant trigger and audience can differ among an EU-facing notice, a Steam Content Survey answer, and a U.S. registration disclosure.
For a live feature, consider what the player needs to understand before interacting: that dialogue is AI-generated, what the feature can do, and how the game handles player input and problematic output. For a fixed asset, first establish whether a rule or storefront policy calls for a notice; do not add a vague game-wide “AI used” statement as a substitute for identifying the actual feature and obligation.
Use a release review that ties each notice to its trigger and destination. Confirm the build, store-page materials, survey answers, and any registration application all describe the same feature accurately. A change to generation behavior, asset provenance, or a performer’s permitted use should send the relevant item back through review.

How do the main workflow choices differ?
The following comparison shows which questions change with the production choice. It does not replace a project-specific legal assessment.
| Workflow choice | Primary question | Records or action to prioritize |
|---|---|---|
| Human-created asset | Who made the expression, and were any third-party inputs used? | Document creator, source material, and any applicable permissions. |
| AI-assisted shipped asset | What human expression is present, and what input rights apply? | Track provenance, meaningful human selection or revision, and the contribution to describe if registering in the U.S. |
| Original performance | Who performed it, and what agreements govern the recording and use? | Keep the relevant performer and project agreements with the asset record. |
| Licensed digital replica | Does consent cover the identity, role, project, and actual replica behavior? | Match a specific intended-use description to the feature and review changes against the agreement. |
| Fixed, pre-generated output | What content reaches players, and what policy or jurisdictional trigger applies? | Classify the asset for Steam and assess any applicable disclosure obligation. |
| Live NPC or other runtime generation | What can players generate or encounter, and which duties apply to the interaction? | Describe safeguards in the Steam survey and evaluate EU role, interaction, and output triggers. |
What should the pre-release review record?
A compact feature-by-feature record makes decisions auditable and gives production teams a clear trigger for reassessment. Assign an owner for each feature and link the record to the build or release in which it appears.

Pick the symptom - the matching free tool is one click away.
- Feature and output: Name the tool or system, identify the asset or interaction, and state whether output is fixed before release or generated at runtime.
- Inputs and provenance: List material used, its source, relevant permission or restriction, and the model terms that applied to the use.
- Human contribution: Record what people selected, arranged, rewrote, modified, or otherwise expressed in the shipped result.
- Identity and agreement: Identify any replicated performer and the agreement or consent description governing the project and intended use.
- Audience and jurisdiction: Note whether players directly interact with AI, where the game is offered, and whether a storefront survey, registration statement, or player notice is implicated.
- Change trigger: State which changes—such as a new model, new source material, live generation, a different performer role, or an EU release—require renewed review.
Unity’s 2026 report offers context on developer use, but not a legal standard: in a 2025 Cint survey of 300 game developers, 62% listed coding assistance and 35% listed concept art and game assets among AI-tool uses. The figures concern AI tools generally, not generative AI alone, and describe respondents rather than all developers. Unity says the survey ran from September 16 through October 3, 2025, across specified countries and regions.
How should a studio turn the review into a release decision?
Do not treat unresolved questions as one undifferentiated “AI risk.” Route each one to the right decision-maker and pause only the affected feature or claim when its basis is unclear.
- Freeze the feature description. State what model behavior, inputs, outputs, performers, and player interactions are actually planned for the release.
- Route input rights separately. Provide counsel with source and permission records for training, fine-tuning, or other uses; do not rely on a tool’s general license as the sole answer.
- Scope any authorship claim. Identify human expression asset by asset and follow Copyright Office registration guidance if making a U.S. claim.
- Confirm performer coverage. Check the applicable union agreement and ensure the consent description fits the real project and feature, including any runtime generation.
- Complete audience-specific disclosure work. Answer Steam’s current survey for player-consumed content, assess EU Article 50 triggers and roles, and prepare any applicable registration disclosure.
- Reopen review after a material change. A new input source, model, role, player-facing function, or release territory can change the analysis; update the corresponding record and notice.
Frequently Asked Questions
Can a studio use AI-generated assets in a game without registering them?
A studio may choose not to seek U.S. registration for an asset, but that choice does not resolve input permissions, contractual restrictions, or a performer’s rights. Registration questions and permission questions should be tracked separately.
Does using a licensed AI tool mean the game studio owns every output?
Not necessarily. The tool’s terms address the relationship with its provider; they do not automatically decide whether the output contains protectable human authorship or whether the material used as input was authorized.
Does Steam approval mean a game’s AI content is legally cleared?
No. A Content Survey response is a storefront process, not a copyright license, performer consent, or legal determination that an output is lawful. Studios still need separate rights and disclosure reviews.
Should AI use be disclosed in a game’s credits?
The sources described here do not establish a universal credits requirement for every AI-assisted asset. Decide based on the specific obligation, agreement, storefront policy, and player-facing context that apply to the feature.
