Sometimes—but there is no single nationwide answer. In the United States, federal law generally allows a participant to record a conversation with one party’s consent, while some state laws require consent from everyone involved in a private conversation. In the European Union, rules on accessing or storing microphone or camera information can apply alongside data-protection law and national rules. Small size, AI transcription, and a visible recording light do not by themselves make a wearable recording legal.
What determines whether a wearable recording is legal?
The answer depends less on whether the device is glasses, a pendant, a watch, or a phone than on the circumstances of the recording. The relevant questions include where each participant is, whether the conversation is private, whether the recording is in person or by phone, what notice was given, and which legal exceptions apply.

A wearable can capture sound through a microphone and may also store or process it as a transcript. Those technical features do not settle the legal question. The rules apply to the act and circumstances of recording or accessing information; using AI to transcribe a recording does not create a general exemption.
- Location: Identify the jurisdictions connected to the recording, including where the wearer and other participants are. A conversation can involve more than one jurisdiction.
- Privacy: Consider whether the setting and circumstances make the speech private or confidential. The laws cited below specifically turn on private communications or conversations.
- Consent threshold: Determine whether the applicable rule requires the recorder’s consent as a participant, consent from one party, or consent from all participants or other parties.
- Notice and exceptions: Check what kind of notice or consent is required and whether a statutory exception applies.
These are the questions to investigate before recording, not a shortcut that guarantees legality. The statutes discussed here illustrate important differences, but they do not cover every jurisdiction or every use.

What does U.S. federal law say about recording a conversation?
Federal law generally prohibits intentional interception, but 18 U.S.C. § 2511 provides an exception when the person recording is a party to the communication or when one party has given prior consent, provided the interception is not for a criminal or tortious purpose. That federal rule is not a blanket permission to record every conversation: state law may impose stricter requirements.
The statute describes the exception as applying “where such person is a party to the communication or where one of the parties to the communication has given prior consent to such interception.” The practical point is that participation or another party’s prior consent can matter under federal law, but the federal rule must be considered alongside the law governing the particular recording.

Do not assume that being present makes every recording lawful. The conversation may be private, the participants may be in a state with a stricter consent rule, or the recording may raise issues that are not resolved by the federal exception. The exception also does not extend to an interception undertaken for a criminal or tortious purpose.
How can state laws change the answer?
States can require more consent than the federal baseline. Washington and Illinois illustrate two ways state law can treat recording a private conversation; their rules should not be generalized to every state.

These examples show why “one-party consent” and “all-party consent” are useful shorthand but not a complete legal analysis. A state statute may define the covered conversation, distinguish between circumstances, or provide exceptions. Do not infer that a rule in one state applies across the country, or that the examples here are an exhaustive list of state laws.
Does it matter whether the conversation is private or in person?
Yes. Privacy and the type of communication are among the facts that can change the analysis. The cited Washington rule addresses private communications and private conversations; the Illinois provision described here concerns a private conversation. Whether a particular exchange meets those terms depends on its circumstances and the applicable statute.
Private or confidential settings
A wearable’s discretion does not answer whether a conversation is private. Consider what participants could reasonably understand about the setting and the conversation, and check how the relevant law defines the terms it uses. A quiet conversation in a setting where participants expect privacy may raise different questions from speech addressed openly to a group, but that contrast is not a universal legal test.
In-person conversations and phone calls
Do not assume that rules for calls automatically resolve the treatment of in-person conversations, or vice versa. The legal provisions can use different terms, and the applicable statute may treat communications differently. Confirm the rule for the actual format and location rather than transferring a conclusion from another kind of recording.

Notice is not a device feature
A recording indicator may help people notice that a device is active, but it is not necessarily the notice or consent required by law. A light can be obscured, misunderstood, or overlooked. Where consent is required, a clear announcement and affirmative agreement are more reliable ways to address the issue than relying on the device’s appearance alone; confirm the legal standard that applies.
What changes if the wearer is in the EU?
EU users should not treat U.S. one-party-consent rules as the governing framework. The ePrivacy rules may require consent before information from a microphone or camera is stored or accessed through terminal equipment, alongside the GDPR and national law. The exact requirements depend on the applicable law and use case.

That means a recording can raise questions beyond whether a person said yes to being recorded. Consider whether the device accesses or stores audio or image information, what data is retained, and how it is used or disclosed. The laws named here operate alongside one another; a conclusion about one legal question does not establish compliance with every other requirement.
For a recording that crosses borders, do not assume the wearer’s home jurisdiction is the only one that matters. Identify the locations and legal frameworks involved and obtain local advice if the recording has significant consequences.

How should you check before using an AI recording wearable?
Use a cautious, jurisdiction-specific sequence. It helps organize the questions, but it is practical guidance—not a universal safe harbor or a substitute for legal advice.
- List the jurisdictions involved. Identify where you and the people you might record are located. If participants are in different places, check the laws relevant to each location instead of choosing the most permissive rule.
- Describe the conversation and setting. Is it a phone call or in-person exchange? Is it private or confidential? Note the context rather than assuming every conversation has the same status.
- Find the consent threshold. Check whether the applicable law follows a one-party, all-party, or mixed rule for the circumstances. Read the relevant statute’s scope and exceptions rather than relying on a general summary.
- Give clear notice and seek affirmative consent when required. Explain that audio will be recorded and may be transcribed. Ask before activating the recording, and do not treat silence or an indicator light as consent unless the applicable law supports that conclusion.
- Limit what happens to the recording. Collect only what is needed, retain it only as long as necessary, and restrict disclosure. These measures reduce unnecessary exposure but do not make an otherwise unlawful recording lawful.
- Get local legal advice for higher-stakes settings. This is especially important for employment, healthcare, education, law-enforcement, and cross-border uses, where additional duties may apply.
What should users consider at work, school, or in care settings?
These settings deserve extra care because the recording can affect people who may not feel free to object, and because sector-specific or organizational duties may apply. The laws and examples above do not establish a complete rule for an employer, classroom, healthcare environment, or law-enforcement context.

- Law enforcement or investigations: The legal consequences can be especially significant. Get advice from a qualified local lawyer before recording or distributing material.
This is not a claim that every recording in these settings is prohibited. It is a warning that the general consent framework is not enough to establish what is permitted in a regulated or high-stakes situation.
Can device features make recording safer?
Some design choices can support responsible use, but no device feature determines legality. A visible indicator, a consent prompt, local processing, and deletion controls may help a user notice when recording is active, communicate with others, or reduce unnecessary retention. They cannot replace the consent required by law or override restrictions on a private conversation.
Before relying on a feature, check what it actually does. For example, find out whether the indicator stays visible throughout recording, whether audio is stored locally or sent elsewhere, and how deletion works. These are practical questions about the device; the legal test still depends on jurisdiction, privacy, notice, and applicable exceptions.
Do not select a wearable on the assumption that a particular model is “legal everywhere.” The legal status follows the recording and its circumstances, not a product label or a manufacturer’s general description.

- Assuming federal law settles everything. State rules may be stricter, as the Washington and Illinois examples show.
- Assuming participation always permits recording. That may not satisfy a stricter state requirement for a private conversation.
- Treating a light as consent. An indicator is a product feature, not proof that each participant received notice or agreed.
- Ignoring the setting or communication type. A statute may cover private communications or conversations differently, and a phone call is not automatically the same as an in-person exchange.
- Recording first and checking later. Consent may need to be obtained before interception; federal law’s quoted exception refers to prior consent where consent is relied upon.
- Assuming data minimization fixes the recording itself. Keeping less data or deleting it sooner can reduce privacy risks, but it does not cure a violation of a consent rule.
- Applying a U.S. rule in another country. EU ePrivacy, GDPR, and national law can create separate requirements.
Frequently Asked Questions
Can I record a conversation if I am one of the people speaking?
That fact can be relevant under the federal exception in 18 U.S.C. § 2511, but it is not a complete answer. Check whether a stricter state rule covers the conversation and whether the recording is private or otherwise subject to an exception.
Does a visible recording light count as consent?
A light can make recording more apparent, but it does not itself establish that participants consented. Treat notice, consent, and device indicators as separate questions.
Can I record a conversation and decide later whether to keep the file?
Deleting a file later does not necessarily resolve whether the initial interception was permitted. Decide whether recording is lawful before activating the device, then separately consider how long to keep any recording.
Are AI glasses treated differently from a phone recorder?
The device form alone does not create a general legal exemption. The decisive questions remain the locations, privacy of the conversation, consent rule, notice, and any applicable exception.
