Apple’s Child-Safety Approach and EU Policy: Similar Aims, Different Rules

Apple’s on-device child-safety feature and Brussels’s platform agenda share preventive aims, but they are not equivalent. Compare the feature, DSA guidance, proposed EU KIDS Act and separate temporary CSAM measure.

Apple’s Communication Safety and the European Union’s child-safety agenda share a direction: intervene earlier and make digital experiences safer for children. But they are not the same policy. Apple offers an existing, device-based feature for families; the EU’s approach includes Digital Services Act guidance for platforms, a proposed EU KIDS Act and a separate temporary law concerning online child sexual abuse.

What Apple and the EU have in common

Protection built into the experience

Apple Communication Safety can blur photos or videos that appear sensitive and give a child guidance and options for seeking help. The European Commission’s Digital Services Act (DSA) guidelines likewise emphasize service design rather than relying only on action after harm occurs: they recommend private-by-default accounts for minors and limiting features associated with excessive use. The Commission’s proposed EU KIDS Act also calls for stronger defaults. Apple’s description of Communication Safety, the Commission’s DSA guidelines and its KIDS Act proposal all reflect an emphasis on prevention.

Safety measures with privacy in view

Apple says Communication Safety analyzes images on a child’s device using on-device machine learning. Apple says it does not receive an indication that content was detected or access the analyzed photos and videos through the feature. The Commission’s DSA guidelines call for privacy-by-design and age assurance that is accurate, reliable, robust, non-intrusive and non-discriminatory. Those are parallel priorities, not evidence that Apple and the EU use the same technology or legal mechanism.

How the approaches differ

Approach Who or what it covers What it does Status
Apple Communication Safety A family-facing feature on supported Apple devices, services and some third-party sharing flows; it requires a child account and Family Sharing. Detects potentially sensitive images, can blur them, and offers prompts, resources and choices for getting help. Available now; device, service, software and regional age requirements vary. See Apple Support for current details.
DSA protection-of-minors guidelines Online platforms accessible to minors, except micro and small enterprises. Recommend risk-based measures addressing a range of risks, including grooming, harmful content, addictive design, cyberbullying and harmful commercial practices. Published July 14, 2025. Following the guidelines is voluntary and does not automatically establish DSA compliance; the Commission says it will use them as a reference for assessing compliance with Article 28(1). Commission guidance.
EU KIDS Act Platforms and children’s access to social media, as described in the Commission proposal. Proposes age-based access, stronger defaults, age checks and greater platform accountability. Proposed by the Commission on September 17, 2026; Parliament and Council must examine and negotiate the text before it can become legislation. Commission announcement.
Temporary EU measure on online child sexual abuse A separate legal framework concerning providers’ voluntary detection, reporting and removal of online child sexual abuse. Sets the scope for that temporary legal measure; it is not Apple Communication Safety or the KIDS Act. The Council says it was reinstated through April 3, 2028. The amended measure excludes covered number-independent interpersonal communications to which end-to-end encryption is, has been or will be applied; long-term legislation remains under negotiation. Council statement.

A family feature is not market-wide regulation

Communication Safety gives a child and family warnings, choices and support within certain interactions. EU guidance and legislation address the responsibilities and design of providers across the market. Their risk coverage is broader than the potentially sensitive photos and videos handled by Apple’s feature.

Image nudity detection is not CSAM scanning

Apple describes Communication Safety as on-device detection of potentially sensitive content. The temporary EU measure concerns a distinct legal framework for providers’ voluntary detection, reporting and removal of online child sexual abuse. They differ in purpose, mechanism and legal setting; treating them as the same kind of scanning would be inaccurate.

What Communication Safety does in practice

Apple lists Messages, AirDrop, Contact Posters, FaceTime calls and video messages, shared photo albums, and some third-party sharing flows among the contexts covered on specified devices. Its current requirements and defaults depend on the device, software, service and region, so consult Apple Support for the applicable setup rather than assuming every Apple device works the same way.

When the feature detects content, it can blur the image and present repeated interventions, age-appropriate resources and options such as contacting a trusted adult, leaving the conversation, blocking the contact or opening safety resources. In certain nudity detections in iMessage or FaceTime video, a child may choose to report the sender; in that specific reporting path, the content is sent to Apple for review. Apple explains the available help and reporting paths.

Why Apple’s App Store is also under scrutiny

On October 10, 2025, the European Commission requested information from Apple and Google about age verification, app age ratings and risks from harmful or illegal apps, including gambling and tools for making non-consensual sexualized images. This was an information request, not a finding that Apple had breached the DSA. The Commission’s request illustrates that its platform oversight is broader than the operation of a single device feature. Commission announcement.
