AI safety is overseen through several layers, not one universal test or certification. Providers evaluate their own models; independent evaluators and public authorities may also assess them in some contexts. What a provider must document or report—and what a user can expect to be told—depends on the system, its use, and the rules that apply. In the European Union, for example, specific duties apply to providers of general-purpose AI models with systemic risk, while separate transparency and oversight rules cover certain interactions and high-risk systems.

Who tests AI models?

There is no single organization that tests every AI model. The provider typically evaluates its model as part of development and risk management, but that is only one kind of evidence. Depending on the context, external evaluators or regulators may also examine a model.

Providers test the models they develop

Provider evaluation can include tests of model performance, adversarial testing designed to probe weaknesses, and testing with users. A provider’s report is evidence about the tests it chose to run, under the conditions it used; it is not automatically independent verification. When reading a provider’s safety claims, look for the model and use cases covered, the test methods, the limitations the provider acknowledges, and what happened after a problem was found.

For a particular legal example, Article 55 of the EU AI Act requires providers of general-purpose AI (GPAI) models with systemic risk to evaluate their models using state-of-the-art standardised protocols and tools, including documented adversarial testing. The duty is limited to providers and models within that category; it should not be read as a requirement imposed on every AI model.

Independent evaluators and authorities can add scrutiny

Independent evaluators may provide a different perspective from a provider’s internal team, but independence alone does not tell you how much evidence an evaluator saw. The useful questions are whether the evaluator had access to the relevant model, what it was permitted to test, and whether its report explains methods and limitations.

The European Commission’s AI Office can request access to models to conduct evaluations itself or through independent experts it appoints. That is an enforcement power, not proof that every model is routinely inspected. A regulator’s evaluation, an external evaluation commissioned by an organization, and a provider’s own testing are distinct forms of evidence and should be identified separately.

Testing methods answer different questions

NIST’s ARIA Evaluation Planning Manual, published on 18 September 2026, describes a plan combining Model Testing, Red Teaming, and User Testing. These methods are complementary rather than interchangeable:

  • Model testing examines specified capabilities or behaviors against selected tests. A result is meaningful only in relation to what was tested and under what conditions.
  • Red teaming uses adversarial approaches to look for weaknesses or risky behavior. A documented test should make clear what risks were probed and what was done in response.
  • User testing examines how people interact with a system. It can surface issues that a model-only test may not capture, such as how a user interprets or relies on an output.

The ARIA manual is an evaluation-planning resource, not a general legal rule requiring every AI product to undergo all three methods. A test plan should follow the risks and use context of the system rather than treating a named method as a universal pass mark.

What should an AI safety report tell you?

There is no single mandated universal format for every AI evaluation report in the cited rules and frameworks. To judge what a report establishes, check its scope, methods, independence, evidence, limitations, and reporting or remedy process.

Check the scope before comparing results

A report that examines one model version, setting, or type of use may not establish how the same model behaves in a different deployment. Look for which model and deployment were covered, who might use or be affected by it, which jurisdictions were considered, and what risk scenarios the evaluators included. If the report leaves these boundaries unclear, treat its conclusions as correspondingly limited.

Read the method and access details

Find out whether the evidence comes from benchmark testing, adversarial testing, red teaming, user testing, or a combination. Also check who performed the work and what access they had: a provider-run test, an external evaluator’s assessment, and an authority’s evaluation are not equivalent simply because all are called “testing.” A report that describes methods and access gives readers more basis to interpret its findings than a broad claim that a model was tested.

Look for failures, uncertainty, and follow-through

Useful reporting distinguishes observed results from conclusions and identifies conditions under which the tests were run. Look for failures found, uncertainty or limitations, and mitigations taken or proposed. A report that provides only a favourable conclusion without enough information to understand coverage does not establish that untested risks are absent.

For a comparison, use the same questions for each report rather than comparing headline claims:

  • Scope: Which model, deployment, people, locations, and scenarios are included?
  • Method: What kinds of tests were run, and under what conditions?
  • Independence: Who conducted the evaluation, and what access did they have?
  • Evidence: What failures, uncertainties, and mitigations are described?
  • Reporting and remedy: Who receives incident reports, what information is disclosed, and how can affected people raise or challenge a concern?

These are practical comparison questions derived from different evaluation and governance approaches. They are not a single report format required of every provider.

What gets reported—and what stays confidential?

Under Article 55 of the EU AI Act, providers of GPAI models with systemic risk must track, document, and report relevant information about serious incidents and possible corrective measures to the AI Office and, as appropriate, national competent authorities, without undue delay. This reporting duty does not mean that every test result or the complete safety file must be made public.

The same Article 55 duties include evaluation, assessment and mitigation of systemic risks, and protection of model and infrastructure cybersecurity. The legal text describes evaluation this way: “perform model evaluation in accordance with standardised protocols and tools reflecting the state of the art, including conducting and documenting adversarial testing of the model with a view to identifying and mitigating systemic risks.”

The distinction between reporting to authorities and public disclosure matters. The Act also protects confidential information obtained under it. A reader should not infer from a lack of a public test file that a provider has made no report, or infer from a public safety statement that all required information has been disclosed to an authority.

The European Commission describes baseline GPAI-provider duties that include technical documentation and information for downstream providers, with additional duties for systemic-risk models. Which obligations apply depends on whether the model and actor fall within the Act’s scope. A downstream provider receiving information is not the same as the general public receiving a complete evaluation report.

When do the EU obligations apply?

The relevant dates depend on which requirement is being discussed. The Commission says GPAI obligations began applying on 2 August 2025; Article 50 transparency obligations apply from 2 August 2026. These dates identify application of particular EU rules, not a global start date for AI safety regulation.

GPAI duties and systemic risk

Article 55’s evaluation, incident-reporting, systemic-risk, and cybersecurity duties concern providers of GPAI models with systemic risk. They are not a universal certification requirement for all AI systems, and the fact that a product uses AI does not by itself establish that Article 55 applies. The Commission’s guidance describes the GPAI obligations as applying from 2 August 2025.

Transparency duties for specified interactions and content

Article 50 addresses specified AI interactions and generated or manipulated content. The Commission’s guidance says those transparency obligations apply from 2 August 2026. The rules include certain provider duties to inform people that they are interacting directly with AI unless that fact is obvious, and machine-readable marking of certain generated or manipulated content. Separate deployer duties cover specified disclosures about deepfakes and certain biometric or emotion-recognition uses.

These are different requirements with different covered actors and situations. They should not be collapsed into a claim that every AI answer must carry the same label or that every person has the same disclosure duty.

How are users protected?

User protections operate at more than one layer: transparency can help people recognize AI involvement, while oversight and monitoring requirements address how certain higher-risk systems are used. Other principles and guidance emphasize privacy, accountability, and ways to challenge consequential outcomes. The details depend on the jurisdiction and the system’s role.

Transparency helps people understand an interaction

Under the EU rules described by the Commission, specified providers and deployers have transparency duties for covered interactions or content. The point is not that every AI-generated sentence must come with a universal warning; the applicable rule depends on the system and situation. The OECD’s AI Principles call for meaningful transparency about capabilities and limitations, awareness when people interact with AI, and information that can help affected people challenge outcomes. The OECD states: “AI Actors should commit to transparency and responsible disclosure regarding AI systems.” These principles guide policy but are not equivalent to a binding global law.

High-risk systems have additional oversight requirements

For high-risk systems within the EU AI Act’s scope, the Commission describes requirements that include conformity assessment, monitoring, human oversight, and incident response. In specified cases, a person may have a right to an explanation when an output is used in a decision with legal effects for them. This is not a general legal right for every chatbot user to receive a full explanation of every answer.

Human oversight is not just the presence of a person somewhere in the process. For a user or affected person, the practical question is whether someone can meaningfully review the system’s role and respond when an outcome causes a problem. The specific legal duties and available remedies still depend on the system and context.

Privacy and accountability matter alongside safety testing

The Office of the Privacy Commissioner of Canada recommends accountability, complaint mechanisms, assessments, independent audits, and effective challenge and human review for significant decisions involving generative AI. This is regulator guidance, and its legal effect depends on jurisdiction and context; it should not be presented as a rule that automatically applies worldwide. Together with the OECD principles, it highlights that safety oversight is not only about how a model performs in a test. It also concerns how an organization uses outputs, handles personal information, and responds when a person raises a concern.

What can you do before relying on an AI system?

Users cannot independently verify a model’s full safety from a short notice or a provider’s summary. They can, however, make more informed decisions by checking disclosures and privacy information, understanding the role AI plays in a consequential decision, and identifying a route to raise concerns.

  • Read the system’s disclosures. Check whether the provider explains that you are interacting with AI, what the system is intended to do, and any stated limitations relevant to your use.
  • Check privacy settings before sharing sensitive information. Review the product’s privacy settings and disclosures before entering information that could harm you if mishandled. General privacy principles do not establish the practices of a particular product, so check that product’s own terms and controls.
  • Find the human or organizational contact. If AI contributes to a significant decision, identify who is responsible for the decision and whether there is a process to ask for review or challenge an outcome.
  • Treat test claims as bounded evidence. If a provider cites an evaluation, look for the model, use case, method, evaluator, and limitations it actually covers rather than assuming a result applies to every use.
  • Keep a record when something goes wrong. Preserve the relevant output and context, then use the provider’s or organization’s stated complaint or review channel. The existence and scope of a formal remedy depend on the applicable law and the system involved.

Do frameworks or testing guarantee that an AI system is safe?

No. A framework can help an organization identify and manage risk, and a test can reveal issues within its scope, but neither establishes that a model is harmless or will never fail.

NIST’s AI Risk Management Framework (AI RMF) 1.0 is voluntary: it helps organizations manage AI risks rather than serving as a mandatory global certification. NIST notes that the framework is being revised, so its status should be checked for later changes. The ARIA manual is likewise an evaluation-planning resource, not proof that a product passed an official universal safety test.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Similarly, OECD principles and Canadian privacy guidance can inform responsible practice without creating identical legal duties in every country. To understand what protection exists in a particular case, distinguish a voluntary framework, a provider’s own process, an independent evaluation, and a binding legal obligation that applies to the specific actor and use.

Frequently Asked Questions

Can I ask a company for its full AI safety report?

You can ask what evaluation was performed and whether a summary or documentation is available, but the cited EU rules do not establish a general public right to every internal safety file. A company may have reporting duties to authorities while protecting confidential information.

What should I do if an AI-assisted decision seems wrong?

Contact the organization responsible for the decision and ask which review or complaint process applies; preserve the decision notice and the information you supplied. Whether a legal explanation or review right exists depends on the jurisdiction, system, and decision involved.

Is an independent AI audit the same as regulator approval?

No. An external evaluator’s report is not automatically a regulator’s finding or an official approval. Check who commissioned the work, what access the evaluator had, and whether an authority itself assessed the system.
