AI liability insurance: what it covers and what it excludes

AI liability insurance can cover losses caused by an AI system, but there is no single standard policy. Coverage may be sold as a dedicated policy or an affirmative endorsement, while cyber, technology errors and omissions (E&O), directors and officers (D&O), employment practices liability (EPL), and commercial general liability (CGL) policies may respond only to particular triggers. The decisive details are the insured’s role, the event that caused the loss, the policy’s definition of AI, and any exclusion that applies.

Some forms address hallucinated output, model drift, discriminatory screening, AI-washing, autonomous-agent mistakes, regulatory defense, and restoration. Others expressly remove losses “arising from,” “relating to,” or merely “involving” AI. Read the current policy and endorsements rather than relying on a product name or a broker’s summary.

What is AI liability insurance, and who is it for?

AI liability insurance is an emerging group of standalone policies and affirmative endorsements designed to address losses in which an artificial-intelligence system is alleged to have caused harm. It is not a universally standardized product. A company that develops a model, sells an AI-enabled service, deploys a third-party tool internally, or uses an agent to make decisions can face different exposures and therefore need different wording.

Ropes & Gray notes that businesses commonly assemble protection from cyber, technology E&O, D&O, EPL, and CGL. None of those lines was designed specifically for AI, and each insurer’s form can treat the same event differently. A developer’s technology E&O policy may be relevant to a customer’s financial-loss claim, while an employer using a screening tool may need affirmative EPL treatment for discrimination allegations. A company using an autonomous agent to issue refunds may need first-party restoration and execution-loss cover that a conventional liability policy does not provide.

Start by identifying four facts: your role (developer, vendor, deployer, or professional), whether the claimant is a customer, employee, regulator, or the company itself, the type of harm, and whether the event was a security incident. Those facts usually determine which policy section is even capable of responding.

What can a dedicated AI policy cover?

Publicly described AI forms show the range of protection available, but the modules and limits are not universal. Mayflower Specialty lists four modules under a claims-made-and-reported policy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

AI-D&O

This module addresses allegations that directors or officers failed to oversee AI, made misleading statements about AI capability, or engaged in “AI-washing” by overstating how much AI a product or business uses. The underlying allegation is management conduct, so the policy’s D&O definitions, entity coverage, insured-versus-insured wording, and defense provisions still matter.

AI-EPL

AI-EPL is aimed at employment claims involving screening or ranking tools that discriminate, or dismissals based on an AI-generated score. Buyers should check whether the wording reaches contractors and applicants as well as employees, and whether a sublimit applies to government proceedings or class actions.

AI-E&O

AI-E&O addresses professional or technology-service allegations involving hallucinated or inaccurate output, model errors, model drift, and mistakes by AI agents. It is most relevant when a customer alleges that an AI-enabled service caused financial loss. Definitions of “wrongful act,” “professional services,” and “computer system” can determine whether an internal deployment qualifies.

AI difference-in-conditions (DIC) excess

An AI DIC excess layer is intended for AI claims that fall outside existing D&O, EPL, or E&O wording. It may fill a gap after another policy denies a claim, but the attachment point, follow-form language, exclusions, and whether the layer provides a duty to defend must be confirmed.

Autonomous-operations protection

Auxilium describes an autonomous-operations policy that lists several additional exposures:

  • Execution loss: an agent sends a wrong payment or refund, makes an unauthorized commitment, runs up charges, or corrupts records.
  • Response and restoration: costs to investigate, contain, and restore affected systems or records.
  • Regulatory-proceeding defense: legal defense for an inquiry or proceeding connected with the AI operation.
  • Financial-loss liability: third-party claims alleging economic harm.
  • General-liability gap: protection where a CGL or umbrella policy excludes AI-related loss.

These descriptions are examples of insurable modules, not a promise that every policy includes them. Confirm each insuring agreement, limit, retention, and condition in the issued form.

When can ordinary insurance respond to an AI incident?

Traditional policies can still respond, but usually only when the event fits their existing trigger. The following map shows the usual logic and the principal gap identified by insurers and brokers.

Policy line Potential AI-related response Common limitation
Cyber A covered security incident, including some AI-powered phishing or deepfake-enabled attacks. Hallucinations, discrimination, intellectual-property infringement, defamation, financial loss from inaccurate output, and data disclosure through an output generally do not meet a cyber trigger.
Technology E&O Third-party financial-loss claims against a supplier of technology products or services. Generally not the stand-alone answer for a company that merely deploys someone else’s AI; the service and professional-services definitions control.
D&O Management claims about oversight, disclosure, or alleged misstatements. Entity coverage, conduct exclusions, and AI exclusions may remove the claim; operational errors may belong elsewhere.
EPL Employment discrimination or wrongful-termination allegations. Coverage may not extend to applicants, contractors, regulatory proceedings, or an AI tool if the form contains a broad exclusion.
CGL Some bodily injury, property damage, or personal and advertising injury when no AI exclusion applies. Usually excludes first-party loss and commonly does not cover hallucinations, financial loss, discrimination, bias, data breaches, or business interruption. New GenAI exclusions can remove bodily injury, property damage, and personal or advertising injury arising from generative AI.

Gallagher characterizes AI as a liability source rather than merely a cyber problem. For example, a deepfake email that compromises an account may satisfy a cyber policy’s security-incident trigger, while a sales chatbot inventing a product specification usually does not. The same technical system can therefore produce one covered event and one uninsured event under the same cyber policy.

Aon’s peril map illustrates why a portfolio review is necessary. Professional errors, output copyright or trademark allegations, patent and trade-secret disputes, employment discrimination, bodily injury, property damage, privacy, cyber, crime, D&O, and EPL may sit in different lines or require an endorsement. Do not assume that one “AI policy” automatically covers every peril on that list.

What AI exclusions can remove?

An exclusion can defeat both defense and indemnity even when the underlying allegation would otherwise fit a policy. Dentons describes a spectrum of wording: a narrow exclusion may require AI to be the direct cause, while a broad exclusion may apply whenever AI played any part in the event. Words such as “arising from,” “relating to,” and “involving” therefore deserve close attention.

Optional ISO/Verisk endorsements effective January 1, 2026 remove defense and indemnity for certain losses connected with generative AI. Their effect depends on the exact endorsement and the base form to which it is attached. A policy issued before that date may contain different language, and state filing or availability can vary.

Under a broad exclusion, a company could lose protection even if a human reviewed an AI output, a vendor supplied the model, or another system completed the final transaction. Ask whether the exclusion applies to use, development, training data, output, an AI vendor, or any causal contribution. Also check whether it overrides a coverage grant or only narrows a specific insuring agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Generative-AI exclusions in CGL forms can remove bodily injury, property damage, and personal or advertising injury arising from generative AI. CGL is also a first-party mismatch: it generally does not pay to correct a company’s own model, restore its records, or absorb business interruption. Those costs need an affirmative first-party grant, cyber coverage, or an AI-specific restoration section.

How should you match AI risks to insurance?

Use the insured role and the harm, not the marketing label, to choose coverage. This framework helps identify where a gap is likely to sit.

Situation Primary question Coverage to investigate
Model developer or AI-service vendor Could a customer suffer financial loss because the model or agent produced an error, drifted, or acted incorrectly? Technology E&O or AI-E&O, vendor-liability wording, IP treatment, and defense obligations.
Employer using AI to hire, rank, or dismiss Could an applicant or employee allege discriminatory selection or termination? EPL or AI-EPL, including applicants, contractors, class actions, and regulatory defense.
Public company or regulated business promoting AI Could investors or regulators allege inadequate oversight or misleading AI statements? D&O or AI-D&O, entity coverage, investigation costs, and disclosure controls.
Company deploying an autonomous agent Could the agent make a payment, commitment, charge, or record change that creates loss? Autonomous-operations cover, first-party restoration, financial-loss liability, and crime or funds-transfer coordination.
Any organization handling sensitive data Was there an unauthorized access or disclosure, or did data appear in an output? Cyber for a covered security incident; privacy and AI endorsements for output-related disclosure.

For intellectual-property disputes, ask separately about copyright, trademark, patent, and trade-secret allegations. A policy may cover one category, exclude another, and impose a sublimit or consent requirement on defense costs. Contractual indemnities from a model vendor can supplement insurance, but they do not replace checking whether your own policy gives you a defense when the vendor disputes responsibility.

How do you review an AI insurance policy before buying?

Ask the broker or insurer for the current policy form, every endorsement, and the applicable territory. Then work through these questions in order:

  1. Is the coverage affirmative, silent, or exclusionary? “Silent” coverage means the form does not mention AI; it can be useful, but it is less certain than an express grant and may be narrowed by another exclusion.
  2. What is the definition of AI? Check whether it includes machine learning, generative models, automated decision systems, agents, third-party tools, and future technology. Definitions that reach any system “using” AI can be much broader than those limited to a named application.
  3. What causation standard applies? Compare direct-cause language with wording that applies when AI contributes in any way. Review “arising from,” “relating to,” and “involving” phrases in both grants and exclusions.
  4. Who has the duty to defend? Confirm whether the insurer must defend, whether defense erodes the limit, who selects counsel, and whether the insurer’s consent is needed to settle.
  5. What are the sublimits, retentions, and aggregates? Separate limits may apply to IP, discrimination, regulatory proceedings, restoration, or autonomous-agent execution loss. A large aggregate does not make a small sublimit adequate.
  6. Which harms are expressly addressed? Obtain the treatment of IP, privacy, discrimination, bodily injury, property damage, financial loss, defamation, regulatory proceedings, and first-party restoration in writing.
  7. How are vendors and models treated? Determine whether a third-party model, cloud provider, or data supplier is covered, and whether the policy requires a written contract or vendor indemnity.
  8. What reporting and territory rules apply? Claims-made-and-reported policies require timely notice, even for circumstances that may become claims. Confirm retroactive dates, extended reporting options, territorial limits, and state availability.

Marketing language is not a substitute for the issued wording. Keep the quote, specimen form, endorsements, and broker’s coverage explanation together so a future claims handler can see what was actually purchased.

What governance controls do underwriters expect?

Underwriting readiness is also a practical way to reduce the chance of an avoidable claim. Guidance for AI applications commonly asks for:

  • A current inventory of models, tools, agents, vendors, data sources, and business owners.
  • Named accountable owners for each system and a record of its intended use, users, and risk classification.
  • Decision, prompt, input, output, and system logs that can be preserved for an investigation.
  • Human review for high-stakes decisions, with documented escalation and override procedures.
  • Post-deployment monitoring for bias, accuracy, security, and model drift, including thresholds that trigger suspension or retraining.
  • Vendor due diligence, contract terms, data-flow diagrams, and restrictions on using confidential or regulated information in prompts.
  • An AI-specific incident-response plan covering containment, customer notice, regulator contact, evidence preservation, and restoration.

The National Association of Insurance Commissioners states that when insurers use AI, they remain responsible for insurance-law compliance, fairness, accuracy, consumer protection, and human oversight. The same accountability principle is useful for any insured: assigning a person to review a tool does not eliminate the need to verify its work. Dentons describes a professional duty to understand the tools used and verify AI-generated work product before delivering it to clients.

How does a claim typically proceed?

First identify whether the event is a claim, a circumstance that may become a claim, or a first-party incident. Under a claims-made-and-reported form, waiting for a lawsuit can jeopardize coverage; notify the insurer according to the policy’s notice clause and preserve the relevant logs, prompts, model version, vendor communications, and human approvals.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Next separate the losses. A customer’s economic-loss demand, an employee discrimination charge, a regulator’s inquiry, a corrupted database, and a funds-transfer error may invoke different insuring agreements and retentions. Send notice under every potentially responsive policy while stating the facts neutrally; do not assume that a cyber notice alone preserves an E&O or EPL claim.

Finally, confirm defense control and settlement authority. Some policies provide a duty to defend; others reimburse defense costs, impose panel-counsel rules, or require consent before settlement. If another insurer or vendor may share responsibility, coordinate notices and contractual tenders without delaying the first notice required by your own policy.

How much does AI liability insurance cost?

There is no authoritative, general premium benchmark or claims-frequency figure that can responsibly be applied across jurisdictions. The market’s lack of a standardized form makes a single price comparison misleading. Pricing can vary with revenue, industry, number and type of models, data sensitivity, autonomy, human-review controls, prior incidents, limits, retentions, territory, and the breadth of any AI exclusion.

Compare quotations on equivalent limits and retentions, and record whether the price is recurring, whether a module is sublimited, and whether regulatory defense or restoration is included. A lower premium can simply reflect narrower triggers, a broader exclusion, or a higher retention.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Do you need a standalone AI policy?

A standalone policy or affirmative endorsement is worth investigating when AI is material to revenue, makes or recommends high-stakes decisions, acts autonomously, handles sensitive data, or creates a liability that your existing forms clearly exclude. A company with limited, low-impact experimentation may instead document its use, confirm that existing policies are silent rather than exclusionary, and add targeted endorsements.

For a final decision, compare your exposure inventory with the actual wording of cyber, E&O, D&O, EPL, CGL, crime, and umbrella policies. Buy the missing trigger, not the most impressive label. A broker licensed in the relevant jurisdiction can confirm availability and explain how the forms coordinate.

What mistakes leave AI users uninsured?

  • Assuming cyber equals AI liability: A security-incident trigger may not respond to an inaccurate answer, discrimination, or IP claim.
  • Relying on silent coverage without reading exclusions: A broad “involving AI” exclusion can erase an otherwise plausible claim.
  • Buying technology E&O as a deployer: Supplier-focused wording may not cover an organization using someone else’s tool internally.
  • Ignoring first-party costs: CGL and many liability forms do not pay to restore corrupted records or rebuild a model.
  • Failing to preserve evidence: Without model versions, logs, prompts, and approvals, proving what happened and who controlled the system becomes harder.
  • Missing claims-made deadlines: Late notice or an expired retroactive date can defeat an otherwise valid claim.
  • Comparing prices without limits: Different sublimits, retentions, defense treatment, and exclusions make headline premiums non-comparable.

Frequently Asked Questions

Will AI liability insurance pay a regulatory fine?

A policy may pay defense costs for a regulatory proceeding, but that does not automatically mean it indemnifies civil penalties, administrative fines, or restitution. Check the definition of covered loss and the public-policy treatment in the applicable jurisdiction.

Does a model vendor’s indemnity replace my own AI insurance?

No. A vendor contract may shift some costs, but it can contain exclusions, caps, procedural conditions, or insolvency risk. Your own policy determines whether you receive a defense promptly while responsibility is disputed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

What evidence should we preserve after an AI mistake?

Keep the model and prompt version, inputs and outputs, system and decision logs, human approvals, vendor notices, and a timeline of containment. Preserve them under your legal-hold process so they remain available to insurers, regulators, and counsel.

Can an AI exclusion apply even when a human made the final decision?

Yes, if the wording reaches losses in which AI contributed or was involved rather than requiring direct causation. The answer turns on the exact exclusion, the causal allegations, and any severability or concurrent-causation language.
