AI Insurance vs. Cyber Insurance: What Does Each Policy Cover?

Short answer: Cyber insurance is generally designed for losses and liability arising from a defined cyber event, such as unauthorized access, an electronic attack or a privacy breach. An AI system can be involved in such an event, but AI involvement alone does not create coverage. A faulty, discriminatory or allegedly infringing AI output may fall outside a cyber policy’s trigger and instead require review under technology errors and omissions (E&O), professional liability, directors and officers (D&O), general liability, property, product liability or a tailored endorsement. There is no universally standardized “AI insurance” policy, so the wording, exclusions, endorsements, jurisdiction and facts control.

The key distinction: what caused the loss?

The practical way to compare these policies is to identify the event that caused the loss and then ask what the contract requires before it responds. The word “AI” in an incident report is not itself a coverage trigger.

Situation Likely coverage question Why the distinction matters
An attacker uses generative AI to create phishing messages, exploit code or automated attacks. Does the event satisfy the cyber policy’s definition of a security incident, computer attack or privacy breach? AI may be the attacker’s tool, while the insured loss is still a conventional cyber event.
An AI application leaks personal data or allows unauthorized access. Are the access, breach, notification and response costs covered under the policy’s trigger and insuring agreements? The facts may fit cyber coverage, subject to exclusions, limits, retentions and conditions.
An AI model produces a hallucinated statement, discriminatory decision or infringing output without a security incident. Does another policy cover a professional error, injury, financial loss, advertising injury or intellectual-property allegation? A cyber policy may not respond when there is no covered security incident or privacy breach.
An insurer uses AI in underwriting or pricing. Is the insurer complying with insurance, fairness, governance and consumer-protection requirements? This is a regulatory issue about the insurer’s conduct, not coverage for the policyholder’s own AI liability.

What cyber insurance commonly covers

The Association of British Insurers describes a cyber event as actual or suspected unauthorized IT access, an electronic attack or a privacy breach. Its UK-market overview says cyber policies commonly combine first-party protection, third-party liability coverage and incident-management support. The exact package differs by form and territory; the ABI description is not a promise that every policy includes every item.

First-party costs

First-party cover addresses the insured’s own expenses or financial loss after a covered cyber event. Depending on the wording, this can include forensic investigation, breach counsel, notification, public-relations support, data restoration, system recovery, crisis management and business interruption. Sublimits, waiting periods, retentions and approved-vendor requirements can materially change what is payable.

Third-party liability

Third-party sections may respond when customers, employees, business partners or others allege that a cyber event caused them harm. Potentially relevant costs include defense, settlements, judgments and privacy-related liability, but the policy will define covered claims and may treat defense costs inside or outside the limit.

Common boundaries

Cyber forms commonly contain limitations or exclusions involving bodily injury, physical property damage, cyber warfare, fines and penalties, and territorial scope. These are market-wide themes identified in the ABI overview, not universal rules. Some policies buy back or modify an exclusion through endorsements; others do not.

When an AI-enabled attack may be covered

Gallagher Re’s March 2026 analysis and other market commentary distinguish the attacker’s method from the insured loss. If a criminal uses an AI tool to write convincing phishing emails and then obtains unauthorized access to the insured’s network, the claim may still be evaluated under the cyber policy’s security-incident definition. The insurer will apply all other conditions, such as required security controls, prompt notice, cooperation, waiting periods and applicable exclusions.

Example: AI-assisted phishing

  1. An employee receives an AI-polished impersonation email.
  2. The employee discloses credentials or approves a fraudulent payment.
  3. The attacker accesses systems or encrypts data.
  4. The company incurs investigation, restoration, interruption or notification costs.

The relevant question is whether the resulting unauthorized access, attack, privacy breach or funds-transfer event fits the policy’s insuring agreement. The fact that AI improved the email may be important to the incident narrative, but it does not replace the contractual trigger.

Example: AI-generated exploit code

If an attacker uses an AI coding assistant to develop malware that causes a covered network intrusion, the same trigger analysis applies. A policy could still deny or restrict the claim for reasons unrelated to AI, such as a war exclusion, failure to maintain a required control, an excluded type of payment fraud or late notice.

Why an AI output may fall outside cyber coverage

Ropes & Gray’s July 22, 2026 analysis says cyber policies typically focus on security incidents or personal-data breaches. Gallagher Re likewise notes that AI-powered attacks may trigger cyber coverage when contractual conditions are met, while other liabilities caused by AI outputs may be excluded or may fail to trigger coverage.

Hallucinated or inaccurate advice

Suppose an AI tool gives a customer incorrect medical, financial, engineering or legal guidance and the customer alleges economic loss. If no unauthorized access, electronic attack or privacy breach occurred, the claim may not satisfy a cyber trigger. Professional liability or technology E&O may be more relevant, depending on the service, insured entity and policy language.

Discriminatory or unfair decisions

An automated hiring, lending, insurance or eligibility decision may prompt allegations of discrimination or regulatory noncompliance. Those allegations do not automatically become cyber claims merely because software or machine learning was involved. D&O, employment practices, professional liability, general liability or a specialized endorsement may need to be examined.

Copyright or other intellectual-property allegations

A claimant may allege that generated text, images, code or other content infringes intellectual-property rights. A cyber policy’s privacy or security-event wording may not reach that dispute. Possible responses depend on the policy’s technology, media, advertising-injury, E&O and contractual-liability provisions, as well as the facts and applicable law.

Model failure without a breach

An AI system can be wrong because of poor data, defective design, inadequate testing, an unsafe integration or insufficient human review. Unless the resulting event also involves a covered cyber incident, cyber insurance may not be the primary policy. That gap is one reason buyers review cyber together with E&O and other liability lines.

What people mean by “AI insurance”

There is no single, universally defined AI insurance product in the sources reviewed. “AI insurance” can mean a policy endorsement, a bespoke liability contract, a performance guarantee, a difference-in-conditions arrangement or simply coordinated use of existing policies.

Potential lines that may respond

Coverage line AI-related exposure it may address Questions to ask
Technology E&O or professional liability Alleged errors, omissions, negligent advice, failed implementation or defective technology services. Does the definition of professional services include developing, configuring, operating or supervising the AI system?
Cyber liability Unauthorized access, electronic attack, privacy breach and related response or liability costs. What security-incident and privacy-breach triggers apply, and are AI tools or vendors treated specially?
D&O Claims that directors or officers mishandled governance, disclosure, oversight or risk management. Are investigations, securities claims and entity coverage addressed, and do conduct exclusions apply?
General commercial liability Certain third-party bodily injury, property damage or personal and advertising injury allegations. Do technology, electronic-data or intellectual-property exclusions remove the relevant claim?
Property Physical damage to insured property and, in some forms, associated business interruption. Does the policy cover physical consequences of an AI-controlled system failure?
Product liability Injury or damage allegedly caused by a product incorporating AI. Is software, an embedded model or an update treated as part of the insured product?
Endorsement or bespoke AI contract Specific agreed risks, performance obligations or gaps across standard policies. What exact event, loss, claimant and proof requirements are written into the endorsement?

BIS’s Financial Stability Institute identifies cyber liability, E&O, D&O, property and product liability as possible lines for AI-related claims. Marsh has discussed endorsements, difference-in-conditions liability contracts, performance guarantees and contractual-liability products as emerging market structures. These are possible approaches, not standard features available to every buyer.

How to review a policy for AI exposure

Marsh reports that clients ask, “does my policy have an AI exclusion?” That is a useful starting question, but a complete review must also determine whether the policy affirmatively covers the use, how a claim is triggered and how the policy coordinates with other insurance.

1. Map the actual AI deployment

  • Name each model, application, plug-in, vendor and cloud service.
  • Describe whether the system is built internally, fine-tuned, embedded in another product or accessed through a third-party service.
  • Record what data enters and leaves the system, including personal, confidential and regulated information.
  • Explain the system’s role: recommendation, decision, content generation, code generation, automation or control of a physical process.
  • Document human approval, testing, monitoring, logging, access control and fallback procedures.

Give the broker and insurer an accurate description. Understating an AI deployment can create disputes over application representations, warranties, controls or material change provisions.

2. Identify the contractual trigger

Highlight the policy language requiring a security incident, privacy breach, professional error, bodily injury, property damage, advertising injury or another specified event. Then test realistic scenarios against that wording rather than against the label “AI.”

3. Read exclusions and affirmative grants together

Look for an express AI exclusion, but also check exclusions for electronic data, software, intellectual property, contractual liability, professional services, discrimination, pollution, war and regulatory action. An exclusion may be narrowed by an exception or overridden by an affirmative endorsement. “Not excluded” is not the same as “covered.”

4. Check who and what is insured

Confirm whether the insured includes subsidiaries, contractors, developers, distributors and newly acquired entities. Review whether the policy treats a third-party model provider, cloud host or outsourced AI operator as a vendor, additional insured or independent contractor. The answer can affect indemnity, subrogation and contractual-transfer provisions.

5. Compare loss categories and limits

  • First-party remediation and interruption costs.
  • Defense expenses, and whether they erode the limit.
  • Damages, settlements and judgments.
  • Regulatory investigations, fines and penalties where legally insurable.
  • Privacy notification and monitoring.
  • Intellectual-property or media claims.
  • Business interruption, contingent interruption and system-failure sublimits.
  • Retentions, waiting periods, aggregate limits and per-claim limits.

6. Confirm territory, law and notice duties

AI services and claimants may span several countries. Check territorial limits, governing law, sanctions language, local-admitted requirements and rules for notifying circumstances that may become claims. A policy written for one jurisdiction may not respond identically to a claim brought elsewhere.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Coordinate the insurance program

Ask which policy responds first and how other-insurance clauses interact. A cyber policy, E&O policy and general liability policy may each contain overlapping or conflicting wording. Review claim-control, consent-to-settle, allocation and subrogation provisions before an incident occurs.

Questions to put to a broker or insurer

  • Does the policy cover an AI system operated by the insured, or only a conventional network incident?
  • Is use of a third-party model, application programming interface or embedded AI feature included?
  • Would an AI-caused privacy breach meet the policy’s security-incident definition?
  • How are hallucinations, inaccurate advice, discrimination, defamation and intellectual-property allegations treated?
  • Are defense costs inside the limit, and do special sublimits apply to technology or privacy claims?
  • What controls must be maintained, and what evidence is required after a claim?
  • Are contractual indemnities to customers or model vendors covered?
  • Which policy handles a claim involving both unauthorized access and an allegedly harmful output?
  • Are regulatory investigations, notification expenses and penalties covered, excluded or subject to local law?
  • Can the insurer provide an endorsement that states the covered AI use and its limits in clear terms?

Regulatory issue: the insurer’s AI is different

The use of AI by an insurance company in underwriting or pricing is separate from insurance for a policyholder’s AI risk. The National Association of Insurance Commissioners warns that AI-generated information can sound accurate while being wrong and says insurers remain responsible for insurance-law and consumer-protection compliance.

New York Department of Financial Services Circular Letter No. 7, issued July 11, 2024, sets expectations for insurers authorized in New York that use artificial intelligence systems and external consumer data in underwriting or pricing. It addresses fairness, actuarial support, governance, documentation and consumer notices. Those expectations govern the insurer’s process; they do not guarantee that a policyholder’s AI-related claim is covered.

Common mistakes and how to avoid them

Assuming every AI loss is a cyber loss

Start with the event and trigger, not the technology label. A model error without unauthorized access may belong under E&O or another liability policy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on a verbal assurance

Ask for the relevant policy form, endorsement and written interpretation. Coverage is determined by the contract, not by a marketing description or an informal statement that “AI is covered.”

Ignoring embedded AI

AI may arrive through ordinary business software, a customer-service platform, a security product or a cloud service. Inventory embedded features as well as internally developed models.

Buying a broad exclusion without testing the gap

An AI exclusion can remove liability that the buyer expected an E&O, cyber or general liability policy to address. Map the excluded scenarios and seek targeted coverage or operational controls before renewal.

Failing to preserve evidence

Retain model versions, prompts, inputs, outputs, approvals, logs, testing records, vendor notices and incident timelines. These records can be important to causation, notice, cooperation and defense, even when the policy does not impose a single universal AI documentation standard.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A practical coverage decision tree

  1. Was there unauthorized access, an electronic attack or a privacy breach? If yes, begin with the cyber policy’s trigger and conditions.
  2. Was the loss caused by a professional service, implementation error or technology failure? Review technology E&O or professional liability.
  3. Is the allegation about governance, disclosure or oversight by leaders? Review D&O and related investigation coverage.
  4. Did the AI-controlled product or process cause bodily injury or physical property damage? Review product, general liability and property wording.
  5. Is the dispute about generated content, discrimination, advice or contract performance? Examine intellectual-property, media, employment, professional and contractual-liability provisions.
  6. Do two or more categories apply? Notify potentially responsive insurers as required and obtain a coordinated coverage analysis; do not assume one policy will resolve the entire claim.

What cannot be determined without the policy

Public overviews from the ABI, Gallagher Re, Ropes & Gray, Marsh and BIS explain market patterns, but they do not decide a particular claim. A reliable answer requires the policy forms and endorsements, jurisdiction, insured’s AI deployment, loss facts, notice history and the insurer’s coverage position. Even policies with similar names can differ in triggers, exclusions, sublimits, defense treatment and definitions.

Bottom line for buyers

Cyber insurance is usually event-based coverage for defined cyber incidents and their first-party and third-party consequences. AI-assisted attacks can fit that framework when the contract’s conditions are met. Liability arising from an AI output, however, may not involve a covered cyber event and may need E&O, professional liability, D&O, general liability, property, product liability or a tailored solution. Review the actual AI deployment, ask whether coverage is affirmative or merely unexcluded, test every material scenario, and coordinate limits and exclusions across the insurance program with a licensed commercial broker.
